MANAGING EMPLOYEE PERFORMANCE AND DISCIPLINE
A ONE DAY WORKSHOP
8 November 2011
The Professional Development Project of the Faculty of Law, in partnership with the
Institute of Labour Law and Development, UCT is pleased to present this one day
workshop on the labour law pertaining to Managing Employee Performance and
Discipline.
Managing poor performers and misconduct issues is a reality faced by every
employer. It is important that managers understand when to address such issues
and the various procedures that should be followed.
Failure to comprehend these issues can lead to time-consuming and potentially
costly encounters in bargaining councils or the CCMA.
This one day workshop is aimed at anyone who is involved with the management of
employees. It will give participants a sound understanding of the principles
applicable to dealing with poor performance and misconduct in the workplace at both
a theoretical and practical level.

the influence of the Code of Good Practice: Dismissal
the impact of workplace policies
managing misconduct vs poor performance
golden rules: fairness and consistency
preparation for a performance/disciplinary hearing
the role of the initiator

This workshop will be presented by Craig Bosch (Associate at Maserumule
Consulting) and Paul Cooley (Workplace Strategies).
Paul Cooley from Workplace Strategies has a BA LLB from the University of Tasmania
and post-graduate qualifications in labour relations law from the University of
Melbourne. He has 15 years experience in advising on labour law matters in
Australia, the United Kingdom and South Africa.
Paul currently assists
organisations with managing their people, including addressing employee
performance or disciplinary issues. He is frequently asked to act as an independent
chairperson for disciplinary hearings and as an accredited facilitator, regularly trains
in the area of employee poor performance and discipline.
Craig Bosch has a BA LLB from the University of Stellenbosch and an LLM from the
University of Cape Town. He has been a senior lecturer in labour law at the
University of the Western Cape since 2002. Prior to that, he lectured at the
University of Cape Town. He has published articles and presented conference papers
on various labour law issues and is a co-author of Business Transfers and
Employment Rights in South Africa and of Labour Relations Law. Craig is a part-time
senior commissioner at the CCMA and serves as a member of the dispute resolution
panels of the Clothing Industry Bargaining Council: Western Cape Chamber and the
South African Local Government Bargaining Council.
