Massachusetts Acquiring Easements & Takings for Utility Relocations

QUESTION:
Currently, in Massachusetts, the utilities are responsible to acquire any and all easements, takings, etc.
necessary for their relocations for MassDOT projects.

How many states acquire the ROW (easements, etc) for the private utility relocations?
o Does it depend on the type of project (funding, scope, etc)?

Arkansas does not acquire easements for utilities. They are responsible for acquiring the necessary
easements needed to relocate their facilities.

In Illinois the utilities are responsible for obtaining their own easements. There is a push to combine the
land acquisition process with utilities from a utility.

In Minnesota the utilities are responsible for obtaining their own easements for relocations for Mn/DOT
projects.

Nevada DOT has acquired replacement easements for utilities to insure project timelines. If a utility can
remain in the highway right-of-way and there is not a conflict, we can also use an agreement that NDOT
calls “Consent To Common Use”.
This agreement identifies the company’s land right and replacement/relocation rights should it be
needed for a future highway project. The company’s deed or other documentation that establishes the
land right and a map or plan sheet that depicts the easement area is attached to the agreement as an
exhibit. These exhibits clarify the present and future rights.

NDDOT does not acquire right of way for utilities relocations

South Carolina requires the utility company to acquire there easements for relocation. By State Statue
we cannot acquire the easement for them.

Ohio will purchase an easement for a private utility but only after the utility demonstrates they are
currently in their own easement and can provide the appropriate documentation that they tried to acquire
the new easement but the affected property owner would not cooperate....project, funding, scope, etc.
has no bearing on this type of initiative.....it always has to do with delivering the project in a timely
fashion...the ability for our Department to perform this function is granted in our Ohio Revised Code...

In Pennsylvania, we acquire ROW easements for private utilities only when we overtaken their ROW.

Texas Response:
At this time Texas will only reimburse the utility for the
replacement of an existing easement. It has been proposed
the DOT purchase the replacement easement on behalf of the utility
during the DOT acquisition. This would eliminate the landowner being
approached multiple times by the DOT and then utility companies.
This may be considered during our legislative session.

pursuant to an easement or other compensable right.
