Definitions
Agent means a real estate agent who holds or is deemed to hold a current license as
an agent under the Real Estate Agents Act 2008.
Branch manager means a person who holds, or is deemed to hold, a current license
as a branch manager under the Real Estate Agents Act 2008.
Client means the person on whose behalf an agent carries out real estate agency
work and is commonly known in the industry as a vendor or seller.
Common Law is also known as case law – judgements made by courts, rather than
laws written by parliament. Judgements relating to the duties of an ‘agent’ may be
applicable to this unit standard.

Industry requirements mean all actions must comply with relevant professional body
standards, legislation, codes of professional conduct and client care, and approved

Approved guides mean the two approved guides developed by the Real Estate
Agents Authority covering an agency agreement and a sale and purchase

Assessment
This unit standard must be assessed on the basis of evidence of demonstrated
performance in the workplace or in simulated work situations designed to draw upon
similar performance to that required in the workplace.
Outcomes and evidence requirements
Outcome 1
Develop descriptions for use in marketing businesses for sale.
Range
evidence is required of two different descriptions.
Evidence requirements
1.1
The history of businesses and current ownership structures are described,
including any franchise arrangements and conditions regarding transfer of
franchises, in accordance with industry requirements.
1.2
The nature, purpose, strengths, customer base, market conditions, and
competitive positions of the businesses are included in descriptions in
accordance with industry requirements.
1.3
Location of businesses and size, features, conditions, and characteristics of
buildings and facilities are included in descriptions in accordance with industry
requirements.
1.4
Financial performance, condition, and profitability are included in descriptions in
terms of potential performance ability of the businesses.
1.5
Values of assets, equity in assets, liabilities, and goodwill are verified by vendor
and included in descriptions in accordance with industry requirements.
Range
1.6
assets include – freeholds, stock plant, equipment, fixtures and
fittings.
Financial statements are explained in terms of viability of the businesses and
projections.
Range
may include but is not limited to – auditor's report, company
directory, directors review, statement of financial performance,
profit and loss, statement of movements in equity, statement of
financial position, cashflow.

Details of staff, wages, contracts, redundancy agreements, and other
contractual and financial liabilities are included in descriptions in accordance
with industry requirements.
1.8
Client reasons for selling, where appropriate, are included in descriptions in
accordance with industry requirements.
1.9
Lease arrangements, property owners, titles, easements, and zoning
requirements are included in descriptions in accordance with industry
requirements.
1.10
Existing rental and lease agreements, prepayments and clients’ obligations are
included in descriptions in accordance with industry requirements.
may include but is not limited to – signs, plant and equipment,
prepayments such as yellow pages advertising and vouchers, and
product and stock.
Range
1.11
Outstanding building compliance requirements and other requirements are
included in descriptions in accordance with industry requirements.
1.12
Property descriptions are accurate and comprehensive for the specific property.

Property descriptions are checked and agreed to by a branch manager, agent.

Providers and Industry Training Organisations, which have been granted consent and
which are assessing against unit standards must engage with the moderation system that
applies to those standards.
Requirements for consent to assess and an outline of the moderation system that applies
to this standard are outlined in the Consent and Moderation Requirements (CMR). The
CMR also includes useful information about special requirements for organisations wishing
to develop education and training programmes, such as minimum qualifications for tutors
and assessors, and special resource requirements.
