MINUTES OF THE BULLOCK PEN WATER DISTRICT MARCH, 2012 MEETING The March 15, 2012 meeting of the Bullock Pen Water District was called to order at the hour of 1:00 p.m. at the District Headquarters. Present at the meeting were Chairman Bobby Burgess, Superintendent William Catlett, Secretary Jimmie King, Commissioners Charles Givin, Andrea Walton and Logan Murphy. Also present were Karen VanHolten, Amy Johnson, Engineer Kerry Odle and Attorney Thomas R. Nienaber. The first order of business was a review of the February, 2012 Minutes. After discussion, upon motion of Chuck Givin and second by Andrea Walton, it was unanimously, “RESOLVED: that the February, 2012 Minutes be approved as presented.” The next order of business was a review of the warrants and profit and loss statement for February, 2012. After discussion, upon motion of Jimmie King and second by Chuck Givin, it was unanimously, “RESOLVED: that the February, 2012 profit and loss and warrants be approved as presented.” The next order of business was a presentation by Kerry Odle as follows: 1. The final engineering plans for the Phase XII should be completed next week. Mr. Odle noted that the backup generator at the tank site will be designed to provide backup generator service for the Grant County Sanitary Sewer District’s pump station which is directly across the road from the proposed tank site. Mr. Odle indicated that financing rates for the Phase XII Project are approved. Advertisements for bids should be completed next week. Kerry Odle indicated that he would bid the Tenemec Paint Systems as an alternate for the tank project. The District can make a decision on whether or not to use that advanced paint system on the tower and conduct a cost comparison when the bids are received. Mr. Odle reported that Tenemic Paint Systems cost $400.00 per gallon of paint. 2. Mr. Odle reported that he is preparing project profiles for the I-71 bore; McCoy Fork Road improvements; and the water pump station on US 42 in Boone County. These project profiles will be submitted to the county Judges for their review. Mr. Odle did report that it appears as though the Kentucky Legislature will have very little water project monies available for grants in the upcoming grant cycle. 3. Kentucky American Water Services has reported that the Owenton Water District has set aside money previously earmarked for its raw water intake project for use on other projects in Owen County. Mr. Odle is hopeful that some of those monies will be available for the District projects considered by the District in Owen County. The next order of business was a report by Counsel Thomas R. Nienaber as follows: MINUTES MARCH, 2012 MEETING (PAGE 2) 1. Mr. Nienaber reported he has prepared for submission to VanGorder Walker and Co., Inc. Opinion Letters for the December 31, 2011 year end audit. Mr. Nienaber inquired of the Commissioners and staff if they have heard of or have knowledge of any unasserted claims, assessments or litigation. No one has any such information. 2. Mr. Nienaber inquired as to whether or not VanGorder Walker and Co., Inc. has concluded its December 31, 2011 and year end audit. Mr. Nienaber would like to have the final audit for submittal to the Public Service Commission its Application for Certificate of Convenience and Public Necessity and Financing approval on the Phase XII submittal. Amy Johnson reported that the audit is not yet complete. 3. Mr. Nienaber inquired as to whether or not the information for the Phase XII Public Service filing has been completed. Kerry Odle indicated that it should be another 30 to 60 days before that information is in place for submittal to the Public Service Commission. The next order of business was a report by Superintendent Catlett as follows: 1. Superintendent Catlett reviewed with the Commissioners his monthly report. 2. Superintendent Catlett reported that there was no serious damage to the District or its facilities as a result of the recent tornado. Superintendent Catlett reported that the water plant electric service did not go down. One booster pump went down and a generator was secured to insure continuous water service. Superintendent Catlett reported that due to isolated residential damage, a number of meters were shut off at homes where the home was destroyed or substantial damage was incurred. A total of 75 to 80 customers discontinued their water service due to storm damages. Ten of those were immediately reconnected. Superintendent Catlett reported that undoubtedly some of the District’s customers will have elevated water readings due to water loss from broken water lines and the like. Kerry Odle reported that a Water District client of his encountered a similar situation. In that case, the Water District did not charge tornado victims for water loss which was a direct result of the tornados. In those cases, the District simply averaged the previous 12 month water bills and charged the customers the average water bill. Superintendent Catlett inquired of the Commissioners how the District should handle issues such as trip fees, water shut off fees, reconnection fees and charges for lost water due to tornado storm damage. After considerable discussion, upon motion of Chuck Givin and second by Andrea Walton, it was unanimously, “RESOLVED as follows: Upon proper verification by Superintendent Catlett that a customer’s water service was adversely affected as a direct result from tornado damage, charges to the effected customer will be made by the District as follows: MINUTES MARCH, 2012 MEETING (PAGE 3) A. B. C. D. E. F. G. No trip fees will be charged to the customer; No meter shut off fees will be charged to the customer; No reconnection fees will be charged to the customer; No charge will be made for lost water; Customers with water reflecting lost water will be averaged over the preceding 12 months and the customer will be billed the average monthly water bill; Where customers are rebuilding their homes, the District will retain that customer’s deposit and no new deposit will be required upon reconnection; A determination whether or not the customer’s water service was adversely affected by tornado damage will be made by Superintendent Catlett. Any customer who believes they were aggrieved by Superintendent Catlett’s decision can appeal that decision to the full District Board.” 3. Superintendent Catlett reported that the total cost of the District relating to the tornado damage was $280.00 representing the rental cost for the backup generator plus overtime pay for District employees. 4. During the aftermath of the tornado, Superintendent Catlett reported that some issues were encounterd by District personnel in connecting the backup generator. It appears that most of the booster pumps do not have transfer switches for use in connecting a generator for backup electric service. Superintendent Catlett reported that it would be better for the District to have transfer switches installed. The total cost of installation for a transfer switch would be approximately $2,500.00. 5. Superintendent Catlett reported that Ms. Joan Seltman, 14330 Walton Verona Road, Verona, Kentucky has made a claim with the District that her driveway has settled causing significant cracks. Ms. Seltman has stated that this driveway settlement is the direct result of the District’s work which was conducted approximately 12 years ago. Superintendent Catlett shared with the Commissioners photographs of the alleged damage. Kerry Odle reported that he visited the scene and it is his opinion that the settlement is not the result of any activity on the part of the District. Superintendent Catlett reported that Ms. Seltman is requesting the District to replace a portion of her driveway approximately 6 feet by 20 feet. Superintendent Catlett reported that Ms. Seltmen made this same complaint several years ago and was denied. After discussion, it was decided that the District has no responsibility and will not comply with Ms. Seltman’s request. 6. Superintendent Catlett reported that Ms. Wainscott, Ridge Road, Crittenden, Kentucky has lodged a complaint with the District stating that District personnel damaged her sanitary sewer line in 2003. Ms. Wainscott is requesting that the District replace her sanitary MINUTES MARCH, 2012 MEETING (PAGE 4) sewer line. Superintendent Catlett and Kerry Odle both inspected the scene and have determined that the District has no responsibility for Ms. Wainscott’s sanitary sewer issues. 7. Superintendent Catlett reported that the residents on Dickerson Road have requested to continue their line extension project. Superintendent Catlett reviewed with the Commissioners the September, 2011 Meeting Minutes wherein the District agreed with the residents on Dickerson Road that the District would cover the cost of one hydrant and the primary transmission line materials (approximate $7,423.00) and the customers would be responsible for all other materials and all labor costs, including engineering, easement acquisition and the like. Superintendent stated that he would report on the progress of this project at the next meeting. 8. Superintendent Catlett reported that Casey Kinman started work for the District last week. Superintendent Catlett is very pleased with his performance to date. The next order of business was a report by Amy Johnson and Karen VanHolten as follows: 1. Ms. VanHolten reported to Commissioner Logan Murphy that the Commissioner training session will be available in the next few months. She requested that Commissioner Murphy coordinate that training session with the District office. 2. Amy Johnson reported that the next meeting was scheduled for April 19, 2012. There being no further business to conduct before the meeting, upon motion and second, same was adjourned.
