(Authority: CCM-NWR No. C-498/2/1/JU/Vol-I dated 30.11.2012) 19 LRA COACHING 20 LOCAL RATE ADVICE - Coaching ( LRA) No. : 33 of 2012 F.M Circular No.21 of 2012 Sub: - Levy of Service Tax on Transportation of parcel traffic (leased or nonleased parcel traffic) by rail. 1.0 General : As per the Finance Bill 2012 and subsequent Gazette Notification No.43 of 2012 on the subject, “Service Tax on ‘Service provided in relation to transport of goods by rail’ will come into effect from 1st October 2012.” In compliance of the provisions contained in Finance Bill 2012 and subsequent notification issued by the Ministry of Finance as referred to above, the following instructions are issued. 2.0 Service Tax will be levied for transportation of all description of parcel traffic (Leased or non-leased parcel traffic) and merchandise items (for commercial use) booked as Luggage with effect from 1st October 2012. Luggage traffic i.e. personal baggage belonging to the travelling passengers, (excluding merchandise items for commercial use), shall be exempted from service tax. Commodities exempted from payment of service tax as per Ministry of Finance’s Notification No.25 of 2012 dated 20th June 2012 are (a) Relief materials meant for victims of natural or man-made disasters calamities, accidents or mishap; (b) Defense or military equipments: (c) Postal mail or mail bags; (d) Household effects: (e) Newspaper or magazines registered with the Registrar of Newspapers: (f) Railway equipments or materials; (g) Agricultural produce; (h) Foodstuff including flours, tea coffee, jiggery, sugar, milk products, salt and edible oil, excluding alcoholic beverages; 3.0 As on date, ‘Service Tax’ is levied at the following rates(i) Service Tax 12% (ii) Education Cess of 2% on Service Tax (iii) Higher Education Cess of 1% on Service Tax 4.0 Since an abatement of 70% has been permitted on freight for the taxable commodities vide notification No.26 of 2012 Service Tax dated 26.12.2012, Service Tax will be charged on 30% of the total freight inclusive of all charges, on parcels traffic. Service tax shall be rounded off to the nearest rupee as per Circular No.ST-53/2/2003 dated 27.03.2003 (i) Service Tax of 12% will be charged on 30% of Freight (equivalent to 3.6% on the total freight); (ii) Education Cess of 2% on Service Tax will be added (equivalent to 0.072% on total freight); and (iii) Higher Education Cess of 1% on Service Tax will also be added (equivalent to 0.036% on total freight) (iv) Total Service Tax implication will be (i)+(ii)+(iii) = 3.708% on the total freight. 5.0 Service tax will be levied on the total freight as reflected in the Parcel way Bill and /or Luggage Ticket and /or Money Receipt (in case of leased parcel traffic) 21 issued on or after 01.10.2012 and it will be collected at the time of booking and preparation of Parcel Way Bill /Luggage ticket/Money Receipt. 6.0 In case of undercharges or other charges, which are to be collected at the destination station, Service Tax at the stipulated percentage should be collected by the destination railway on such other components also. 7.0 To facilitate correct assessment, collection and payment of Service Tax, following instructions are issued: i) FA&CAO of Zonal Railways will get themselves registered online at the earliest and in any case within 30 days’ time to get Registration No. from the concerned Superintendent of Central Excise for proper accountal and remittance of Service Tax amount. ii) In case of Parcel Way Bills/Luggage Tickets which are being manually prepared (non-PMS locations), only the Registration No., Code of service and details of the Service Tax, Education Cess, Higher Education Cess and Total Service Tax will be indicated on the Parcel Way Bills also by the parcel staff. (iii) Till such time as changes are made in the PMS software, details mentioned in sub-para (ii) above will be manually written by the Parcel Clerks in the computerized Parcel Way Bills also which will be generated at PMS locations. (iv) Meanwhile, CRIS&CAO/PTS will make provision for separate accountal of Service Tax in the PMS software for inclusion of relevant details in computerized issued from PMS locations. The Computerised Parcel Way Bills will have separate indication for (a) Service Tax, (b) Education Cess, (c) Higher Education Cess and (d) Total Service Tax. Necessary changes should be made in the format of Parcel Way Bills for inclusion of following entries: Name & Address of customer Registration No. of Service Tax provider i.e. FA&CAO of zonal railway Amount of Service Tax Type of Service Code No. of Service Exemption Notification No. 25 of 2012 ST dt 20.06.2012 is being availed. (v) Till allotment of Registration No., Zonal railways will be required to mention ‘Applied For’ against the space provided for Registration No. Parcel Way Bills software will also print ‘Applied For’ in the Computerized Parcel Way Bill till such time as CRIS&CAO/PTS is intimated about their Registration Nos. by FA&CAOs of Zonal Railways (vi) It may be ensured that not only railway customers but also all lease holders should pay Service Tax along with freight / lumpsum leased freight/haulage charge. Further, where advance payment facility has been permitted they would be required to pay Service Tax along with the freight / lumpsum leased freight/haulage charge. (vii) It may be ensured that proper arrangements are made for up-keep of records from the initial stage itself for subsequent auditing by Service Tax Authorities. As each location would be audited periodically, system of correct maintenance of records is a pre-requisite for its proper implementation. (viii) Instructions may be communicated to all the concerned staff at all levels regarding the relevant provisions of this tax and they should be made 22 conversant with the various provisions for effective and efficient implementation of the same. (ix) On any written request from customers, CCM office will issue a monthly consolidated certificate to be signed by an Officer authorized by CCM and duly countersigned by Dy.CAO/T or officer nominated thereto , for each customer giving details of Service Tax collected from them during the previous month, date-wise and PW Bill-wise with breakup of (a) Service Tax, (b) Education Cess, (c) Higher Education Cess and (d) Total Service Tax. This can be used by the customers for getting credit of Service Tax from the concerned Superintendent of Central Excise as due to them. (x) Each station/parcel office collecting the service tax shall submit a statement showing customer wise details of service tax collected from them during the previous month date-wise and PW Bill –wise with breakup of service tax, education cess and higher education cess along with the station balance sheet. (xi) Service tax as applicable shall be collected along with Wagon Registration Fee (WRF), if and where applicable, and, separately, at the stage of booking the consignment through Parcel Way Bill/Luggage Ticket and/or Money Receipt for the respective amount. In case of any refund of either the WRF or Freight charges the corresponding service tax shall also be refunded. (xii) Since service tax due in case of undercharges detected at the destination station will be recovered by the destination station, the station will maintain separate record of service tax so collected. It shall also prepare a monthly statement showing customer wise details of invoice, undercharges and service tax/cess collected thereon to be submitted along with the station balance sheet to Traffic Accounts office. 8.0 It is suggested that various documents like Service Tax, relevant notification etc. may be obtained and all concerned may be made well conversant with the same. The Computerised RRs will have separate indication for (a) Service Tax, (b) Education Cess, (c) Higher Education Cess and (d) Total Service Tax. In case of any refund of either the WRF or freight charges, the corresponding Service Tax shall also be refunded. ix) As per Rule 6 of the Service Tax (Determination of Value) Rules 2006, “the amount realized as demurrage or by any other name whatever called for the provision of service beyond the period originally contracted or in any other 32 manner relatable to the provision of service” is included as part of the taxable service. x) Accordingly, the levy of any demurrage and wharfage charges in case of transportation of goods by Rail shall attract Service Tax at the rate of 3.708%. Zonal Railways, FOIS/CRIS are instructed to levy the Service Tax @ 3.708% on the gross amount of the demurrage and wharfage charges and collect the same from the customers for the purpose of remitting to Government of India. It may be ensured that not only railway goods customers but also all Rail Operators such as Container Train Operators, SFTOs etc., should pay Service Tax along with haulage charges. Further, where advance payment facility on or after 01.10.2012 has been permitted they would be required to pay Service Tax along with haulage charge. Similary, element of Service Tax is leviable where ‘Weight Only’ system is in vogue. xi) It may be ensured that proper arrangement be made for up-keep of record from the initial stage itself for subsequent auditing by Service Tax Authorities. This can be used by the customers for getting credit of Service Tax from the concerned Superintendent of Central Excise as due to them. xiv) Each station/siding collecting the Service Tax shall submit a statement showing customer wise details of Service Tax collected from them during the previous month date-wise and rake-wise with breakup of Service Tax, education cess, and higher education cess along with the station balance sheet. 5. Service Tax will be levied on the total freight as reflected in RR. 6. Please ensure that various documents like Service Tax, notification etc. are obtained and all concerned made well conversant with the same. (Authority: Railway Board’s letter No. TCR/1078/2008/11 dated 27.09.2012) (Authority: CCM-NWR No. C-423/1 Vol-III dated 28.09.2012) 40 LOCAL RATE ADVICE - GOODS (LRA) No: 95 of 2012 Sub: - Provision of private sidings on DFC network Ref: - Board’s letter of even number dated 14.03.2011 and 23.03.2011 In supersession of the above reffered letters of Railway Board, it has now been decided by Board (MT, ME, FC, CRB) that: 1. As a general principle, the connectivity of sidings either with IR or with DFC should be determined taking into account the siding location, depending on whether it is located on the side of DFC or IR. If the proposed siding is located on the side DFC, the take-off should be from DFC line and, similarly, if it is on the side of Indian Railways, it should take off from Indian Railways line. 2. If a new siding is proposed to take-off from DFC line, the application for siding connectivity should be addressed to DFCCIL for examination and approval of the sidings plans in consultation with the Zonal Railways. In case of the existing sidings, which are to be disconnected from Indian Railways and will rejoin the DFC line, the approval of both the Zonal Railways and DFCCIL should be necessary. 3. For siding proposals for which RTC has been issued and DPR has been prepared and the sidings is to ultimately get connected to DFC alignment, no surface crossing with DFC network will be allowed for connecting them to IR network. However, these sidings may be served by the IR network in the interim period till such time DFC is commissioned. All these cases should be dealt by DFCCIL in consultation with the Zonal Railways on case to case basis taking into account the operational and technical aspects of each connectivity. 4. For the cases where the length of the connecting siding line becomes very long and unviable for siding owners because of the inter block distance on DFC network, DFCCIL needs to evolve a policy for providing connectivity in such cases by exploring the possibilities of (i) construction of an IBH (through a variation in the design build contract), if required (ii) facilitating the connectivity by permitting construction of siding on the land acquired for service road and (iii) by taking other policy measures to make the siding construction viable. 5. Where DFC is on a detour, for sidings taking-off from DFC, the user will apply to DFCCIL. DFCCIL will coordinate with the Zonal Raiways. DFCCIL may prepare a policy in this regard for approval of the Board. (Authority: Railway Board’s letter No. 2010/Infra/6/10 dated 03.10.2012) (Authority: CCM-NWR No. C-491/1 Vol-IV dated 19.10.2012) 41 42 LOCAL RATE ADVICE - GOODS (LRA) No: 96 of 2012 Sub: - Permission for construction of private sidings on Railway Land Ref: - Railway Board’s letter No. 2012/TC(FM)/18/17 dated 22.10.2012 Attention is invited to Board’s Joint Circular issued vide letter No. 99/TC(FM)/26/1/Sdg. for Iron Ore dated 14th August 2012 wherein instructions for providing Rail land for Rail connectivity in case of Sidings on private land were issued. Some of the zonal railways have sought clarification/interpretation of “Small stretch of Rail land”. The matter has been examined in Board’s office and in this connection, following guidelines are issued – (i) In case of construction of siding on private land, provision of Rail connectivity may be made in railway land as per requirements. Licensing of land should be done accordingly in terms of extant policy. (ii) The land needed for connectivity should be limited to the extent inescapable, based on local conditions and terrain. General Managers shall decide upon the area to be licenced based on the HOD Committee’s recommendations in terms of Board’s letter No. 2005/LML/18/8 dated 10.02.2005. (iii) Phyisical work for providing connectivity should be done towards the end of the construction of siding. (iv) The instructions in this letter shall be applicable for all Private Sidings. This has the approval of L&A Directorate and Civil Engineering Directorate of Ministry of Railways. (Authority: Railway Board’s letter No. 2012/TC(FM)/18/17 dated 22.10.2012) (Authority: CCM-NWR No. C-491/1 Vol-IV dated 01.11.2012) 43 LOCAL RATE ADVICE - GOODS (LRA) No: 97 of 2012 Sub: - Accounting Procedure for levy of Service Tax on goods, passenger, parcel and other auxiliary services. Ref: - Railway Board’s letter No. (1) TCR/1078/2011/2 dated 27.6.12 and 28.9.12 on Goods Services; (2) TC-II/2910/2012/Service Tax dated 26.6.12, 26.9.12, 28.9.12 on Passenger Services; (3) TC-II/2046/2012/3/Service Tax dated 28.9.12 on Parcel Services and (4) 2004/TG-IV/39/24/Service Tax pt iii dated 26.6.12, 27.7.12 and 26.9.12 and 2012/LML/25/15 dated 28.9.12 on Auxiliary Services; Please refer to the letter above wherein instructions for levy of Service Tax on Goods, Passenger, Parcel and other Auxiliary services provided by Indian Railways have been issued. The service tax, education cess and higher/secondary education cess charges shall be levied in the manner notified therein. Provisions pertaining to Service Tax are available in Finance Act 1994 and Service Tax Rules 1994 as amended subsequently from time to time. Relevant notifications issued in this regard are accessible from the website of Ministry of Finance. It is requested that these notifications may be provided to the concerned railway officials for their information and necessary action. Zonal Railways are also advised to go through the compendium “Taxation of services- An education guide”, released on 20th June, 2012 by Ministry of Finance www.servicetax.gov.in 2. As mentioned in letters ibid, FA&CAOs shall make an application to the concerned Service Tax Authority in the prescribed form (ST-1) for registration within 30 days positively and obtain a Registration Number for recovery and remittance of Service Tax amount. Till allotment of the Registration number, remarks "Applied for" will be printed/ indicated in the railway receipts etc. 3. Following instructions are issued in supersession of the accounting instructions issued vide letter of even no. dated 29.06.12, for accountal and remittance of Service Tax and cess amount so collected: 3.1 Goods Services: (i) The amount of service tax and cess (Primary Education cess and Secondary and Higher Education cess) shall be included in Invoice itself and collected and accounted for / adjusted in government accounts accordingly. (ii) The adjustment ibid will be made by the originating Railway in case of Paid traffic and by the destination Railway in case of To-pay traffic. (iii) Terminal Management System (TMS) is being modified so as to include details of customers viz their name and address of customer, Service Tax registration number of FA&CAOs, amount of service tax and cess (Education and Higher/Secondary Education cess) payable on total freight charges in the invoice etc separately. Till allotment of Registration number, remarks "Applied for" will be printed in RR. (iv) In cases where RRs are prepared manually (Non-TMS locations), the details ibid will be indicated manually by the Goods Clerk. 44 (v) (vi) (vii) (viii) (ix) (x) (xi) (xii) 3.2 Separate codes shall be notified by Statistical directorate for service tax, cess and higher/secondary education cess for coding of invoices by Statistical branch / Traffic Accounts Office for processing thereof in EDP Centres. The MPA / Paid statement generated from the processed invoices shall capture the service tax and cess separately EDP Centre shall also generate a statement of station wise service tax & cess so accounted for in the invoices for submission to Traffic Accounts office for arranging transfer of the amount of service tax & cess to the civil head 0044-Service Tax by contra debit to Goods Earnings in the relevant month’s account. In case of overcharge / refund of freight charges, if any, refund of Service Tax shall be made by Railway. Service Tax and cess due in case of under charges detected at destination station shall be recovered by the destination station along with undercharges. The station will maintain separate record of Service Tax / cess so collected. The stations shall also prepare a monthly statement showing party wise details of invoice, undercharges and Service Tax / cess collected thereon to be submitted alongwith the station balance sheet to Traffic Accounts Office. The Traffic Accounts Office will then arrange to transfer the net Service Tax/cess to the Civil Head 0044- Service Tax by contra debit to goods earnings. FA&CAO/ SC Railway shall introduce the above Civil Head in the Accounts Current Programme to facilitate the above adjustment. In case of charges payable through carriage bills, the Service Tax, cess and freight should be indicated separately and the Service Tax and cess shall be transferred to civil head 0044- Service Tax by contra debit to goods earnings on collection of billed amount of Accounts Office Balance Sheet. Passenger Traffic (i) The Service Tax and cess on the stipulated rates shall be collected from AC-classes and 1st Class passengers along with the oter due fare (ii) The amount ibid shall be depicted separately on the ticket issued to the passengers. (iii) Service Tax collected by TTEs during journey would be reflected separately in their returns and mentioned while remitting their earnings at stations to facilitate separate account in Balance sheet and transfer thereof to the account head ‘Service Tax’. (iv) Refund of the Service Tax collected shall be made by railways on cancellation of tickets. (v) PRS shall capture Zone-wise, location-wise, terminal-wise details of Service Tax in accounting reports and furnish the same to Traffic Accounts Office. (vi) Similar accounting report shall be provided by Commercial Department for PCT, SPTM and UTS etc. also. (vii) The amount of Service Tax shall be worked out from accounting reports generated as detailed above. (viii) The amount so worked out shall be credited to the Civil account head 044- Service Tax by contra debit to passenger earnings. 45 3.3 Parcel Traffic (i) (ii) (iii) (iv) 3.4 Service Tax and cess shall be levied on Parcel traffic also as per instructions contained in the letter referred above. Each station collecting the Service Tax on parcel shall submit a statement showing customer wise details of Service Tax collected from them during the previous month, date wise with breakup of Service Tax and cess to CCM office and also to the Traffic Accounts Office alongwith the station balance sheet to facilitate accountal/ adjustment of the Service Tax in the concerned civil head of account (0044Service Tax) and issue of the Service Tax to the parties concerned. Before arrangeing adjustment of the amount in civil head, the amount of Service Tax / cess shall be contra debited to earnings by Traffic Accounts Office In case of overcharge, refund of Service Tax, if any, will be made by Railways. Service Tax due in case of under charges detected at destination station shall be recovered by the destination station along with undercharge. The station will maintain separate record of Service Tax / cess so collected. It shall also prepare a monthly statement showing party wise details of invoice, undercharges and Service Tax / cess collected thereon to be submitted to CCM office as also to the Traffic Accounts Office along with the station balance sheet. Auxiliary services (i) (ii) (iii) (iv) Zonal Railways shall compile and issue a consolidated list of all auxiliary services on which Service Tax is leviable. Each station/cash office collecting the Service Tax on such transactions shall submit a statement showing customer / contractorwise details of Service Tax collected from them during the previous month, date wise with breakup of Service Tax and cess to Traffic Accounts Office to facilitate accountal / adjustement of the Service Tax in the concerned civil head of account (0044- Service Tax), Before arranging adjustment of the amount in civil head, the amount of Service Tax / cess shall be contra debited to earnings, as the case may be, by Traffic Accounts Office. In case of waiver / refund of charges collected for auxiliary services, refund of Service Tax/ cess, if any, will be made by Railways. Regarding services rendered in the past, following course of action may be taken: a. If agreements are alive and supporting clauses are available, Zonal Railways may pass on the tax liability to the customer wherever possible. b. In case where agreements are alive but no supporting clause exists, Zonal Railways shall examine incorporating the same duly negotiating with the contracting party and pass on the liability to the customer. c. In cases where there is no such possibility, the liability may be assessed and the nodal Directorate in the Board may be informed for further instructions. 46 4. 5. 6. 7. 8. Proper record shall be maintained by the railway for the up keep of Service Tax related transactions from the initial stage itself for subsequent auditing by Service Tax authorities. As per Service Tax Rules 1994, all such records shall be preserved at least for a period of five years immediately after the financial year to which the records pertain. FA&CAO or an officer authorized by him shall submit return/returns in such form and in such manner and at such frequency as may be prescribed, to the conserned Service Tax authority. These instructions will come into effect from 01.10.2012. Detailed JPO may be issued by FA&CAOs in consultation with CCMs and PCEs to all concerned in this regard for their guidance and compliance. This issues in consultation with Commercial, Land Management and Finance Directorate of Ministry of Railways. The matter has been examined and it has been decided that HR coil & other steel consignments which have been pre-weighed on certified mill-scales prior to getting loaded in railway wagons and bear marking of Central Excise and / or Customs Departments need not be subject to mandatory 100% weighment at EIMWBs. However, 5% of wagons loaded with such consignment may be weighed by way of sample checks. These instructions will be effective from 10.11.2012. This issues in consultation with Traffic Transportation Directorate and with the concurrence of Finance Directorate of the Ministry of Railways. Ref: - 1. Railway Board letter no. 2009/TT-III/73/9 dt 10.12.2010 2. Railway Board letter no. 2009/TT-III/73/10 dt 14.06.2012 issued under Container Train Circular No. 05/2012 Some Railways have sought clarification regarding guidelines for permitting access to Container Train Operators (CTOs) in private sidings who do not move outward traffic but handle only inward traffic. The issue has been examined and following clarification is given. “The rail co-efficient of inward traffic to the private siding shall be considered before permitting access to the private siding for handling inward traffic. Unloading Railway will Co-ordinate with loading Railway to protect Railcoefficient.” This is issued with the approval of Commercial Directorate. Not less than concessional freight for distance 1600 Kms. Not less than concessional freight for distance 2200 Kms. Not less than concessional freight for distance 3000 Kms. The concession will be granted on production of a certificate issued by the office of Salt Commissioner or his authorized official(s) about the nature and category of salt along with Forwarding Note by the consignor under priority ‘D’ or ‘C’, as the case may be, of the Preferential Traffic Order of the Indian Railways. Alternatively, concession will also be granted if the Forwarding Note detailing the nature and category of salt has endorsement / countersignature by the Salt Commissioner or his authorized official(s). The concessions will apply to both Non-Refined iodised and Non-Refined Salt meant for iodisation. The above mentioned concessions will, however, not be applicable to the various varieties of refined salt, branded refined salt, free-flowing salt, table salt, vacuum-salt etc. Sufficient precautions should be taken to avoid any mis-declaration by the parties. These instructions will come into force with immediate effect. 55 This issues with the concurrence of the Finance Directorate in the Ministry of Railways. (Authority: Railway Board’s letter No. TCR/1078/2012/06 dated 27.11.2012) (Authority: CCM-NWR No. C-176/8 dated 29.11.2012) LOCAL RATE ADVICE - GOODS (LRA) No: 105 of 2012 (Rates Circular No. 37 of 2012) Sub: - Exemption from 100% weighment in case of containerized EXIM traffic. Ref: - Railway Board’s letter No. 2008/TT-III/73/8 dated 01.07.2008 Board (MT) has accorded in-principle approval for dispensing with mandatory (100%) weighment in case of containerized EXIM traffic. The modalities of implementation of the afore-said dispensation, which are in the process of getting finalized in consultation with Customs, FOIS etc. shall be communicated separately. This issues in consultation with Traffic Transportation and Finance Directorates of the Ministry of Railways. (Authority: Railway Board’s letter No. TC-I/2006/109/6 dated 11.12.2012) (Authority: CCM-NWR No. C-611/0 dated 11.12.2012) LOCAL RATE ADVICE - GOODS (LRA) No: 106 of 2012 (Rates Circular No. 38 of 2012) Sub: - Haulage Charge recoverable for movement of containers in privately owned wagons Ref: - Railway Board’s letter No. 2008/TT-III/73/8 dated 01.07.2008 Reference is drawn to Para 4 of Board’s letter No. 2008/TT-III/73/8 dt. 01.07.2008 regarding levy of Haulage Charge for movement of containers under the Hub & Spoke system. 57 The matter has been reviewed. In partial modification to Para 4 of Board’s letter under reference, it has been decided to prescribe the following guidelines for levy of Haulage Charge under the Hub & Spoke system. General i. At the time of first booking, the Container Train Operator (CTO) shall declare the list of containers that are to be transported to destinations through designated Hub(s). Stuffing/de-stuffing of such containers at any time during transit will not be permissible. ii. RRs shall be generated for each leg of the movement separately. However, the linkage of RRs so generated for movements under the Hub & Spoke system shall be maintained for all in-transit containers all adjusted RRs will have reference to the previous RRs and this information shall be displayed on the container-wise Annexure sheets that form part of the RRs even presently. iii. In the case of traffic booked under the Hub & Spoke system, diversion and / or rebooking shall not be permissible. iv. Hubs can also be the final destination of any container. v. Loaded containers that idle at a designated Hub during transit for a period of five days (which shall be a parametric value) or more would be treated as having been delivered short of destination. In case such containers are ultimately dispatched to their original destinations, through distance or telescopic benefit would not be applicable. vi. The minimum/standard compositon prescribed for different types of stock would continue to be reckoned for the purposes of generating each RR and also for levy of Haulage Charge for a rake. vii. Notified commodities moving in a container rake under Hub & Spoke system will be charged as per ‘Container Class Rate’. The benefit of levying Haulage Charge as per rates prescribed vide Rates Circular No. 32 of 2010 (and as amended from time to time) for 30 or less container in the rake will not be applicable. viii. Other charges such as Punitive Charge, Development Surcharge and Terminal Access Charges applicable on a RR shall not be adjusted in subsequent RRs. These Charges will be calculated for point to point movements on a single RR basis. Methodology for charging for single stack operation under Hub & Spoke system A. In case of container transiting via just one transit Hub: a. The RR issued at the point of origin (say, S1) would be for its movement to the designated Hub (say, H1). However, the stated destination of the 58 container (say, S2) would be indicated on the RR (and / or the Annexure sheet referred to in para (ii) above). b. At H1, the CTO would be required to surrender the RR that was issued at S1. c. At the time of dispatch from H1 ‘freight already collected at S1’ would be deducted from the ‘freight chargeable for transportation of the container from S1 to S2 on through distance basis’ and ‘balance freight’ so arrived at would be collected. d. The (balance freight) RR issued at H1 would reflect linkage to the original RR that was issued at S1. B. In case of container booked through two transit Hubs: a. The RR issued at the point of origin (say, S1) would be for its movement to the designated Hub (say, H1). However, the stated destination of the container (say, S2) would be indicated on the RR (and / or the Annexure sheet referred to in para (ii) above). b. At H1, the CTO would be required to surrender the RR that was issued at S1. c. At the time of dispatch from H1 a second RR would be issued; ‘freight chargeable for transportation of the container’ would be the ‘freight on through distance basis from S1 to H2’ minus the ‘freight already charged and collected at S1. d. The RR issued at H1 would reflect linkage to the original RR that was issued at S1. e. At H2, the CTO would again be required to surrender the RR that was issued at H1. f. At the time of dispatch from H2, a third RR would be issued; the ‘chargeable freight for the transportation of the container from H2 to S2’ would be the ‘freight on through distance basis from S 1 to S2’ minus the ‘freight on through distance basis from S1 to H2’. g. The RR issued at H2 would reflect linkage to both the original RR that was issued at S1 as well as the other, intermediate RR that was issued at H1. Methodology for charging for double stack operation under Hub & Spoke system C. In case of containers carried on the lower/bottom deck, charging principles outlined in paras A and B, as the case may be, for single stack operations under Hub & Spoke system would apply. D. In case of containers carried on the upper deck, freight for the distance over which the containers are transported on upper deck would be levied 59 @50% of the freight chargeable in line with the principles outlined above in paras A and B, as the case may be, for single stack operations under Hub & Spoke system; for example, in case of the containers loaded on upper deck at H1 and transported as such to H2, 50% of the freight as computed under the provisions contained in para B(C) above would apply. The methodology prescribed in paras A and B above, in respect of issue of RRs at S1 and H1 /H2 as well as their surrender at the intermediate hubs would also apply equally in the case of the double stack operations under the Hub & Spoke system. These instructions will be effective from 1st January 2013. This issues in consultation with Traffic Transportation Directorate and with the concurrence of Finance Directorate of the Ministry of Railways.
