What is the thesis of the paper? What evidence is used to support the thesis? 2. What three issues does Hamilton address here? 3. What does the Judiciary need to be in office Indefinitely? 4. Do you think Hamilton was right? Note: A copy of the document is on schoology with annotations. Thesis: the Judicial branch is important: The way justices appointed, the length of terms, the structure of the court system and relationship between courts. (reason life long term is necessary – judicial branch would be effective and impartial) Evidence: Hamilton states that states already given judges lifetime jobs (for good behavior) Judicial branch have very little power so it is ok for them to have a life time appointment. They don’t have power to enforce anything and they don’t have control over the money. Bound to constitution (a constraint) the will of the people Three Issues Hamilton addresses 1. Don’t worry about tyranny due to Federalism and checks and balances 2. Justices have no power to pursue something for their own good 3. Constitution can be amended to correct bad decisions Why justices have lifetime appointment: In order to maintain independence from public opinion and political influence Was Hamilton right? In theory, but appointments can be politically motivated Correct in thesis But not in evidence/issues because justices have gain more power overtime
