To this end an assessment of the potential of all sites with a setback distance in excess of 2000 metres should be evaluated in order to demonstrate a need to infringe a 2000 metre set back distance from dwellings. A similar evaluation of all sites at 1500 metres, and 1000 metres setback form all potential wind power sites should be carried out to demonstrate the need for any setback distance of less than 2000 metres required for Ireland to meet its targets under 2009128/EC. (2) The Minister should have regard to the variation of wind power densities available at different sites in determining any minimum setback distance from turbines from dwellings. Wind developments should be directed to sites with the higher wind power densities in order to ensure that efficiency is maximised and that capacity factors are maximised. (3) The Minister should have regard to the fact that the Directive 2009/28/EC does not require that Ireland export wind energy to EU member States. No obligation arises on Ireland to infringe residential amenity to facilitate wind energy export (4) That the Minister having regard to preservation of residential amenity, property value, prevention of noise pollution and disturbance should impose a setback distance from dwelling of not less than 2000 metres for any wind turbine from any dwelling that does not use the electricity produced at the site of production. (5) That the assumption that the envelope of a dwelling will reduce sound by 10DB is unjustified and inappropriate. It should be the responsibility of Wind Generators to reduce the impact of their machines rather than imposing a burden on Homeowners. The proposed guidelines seek to achieve a maximum sound impact of 30DB by imposing a burden on people to reduce the impact of wind turbine noise themselves. The Building regulations imposed a requirement for 1120th of floor area to be provided by window or door openings to provide natural ventilation. Assuming a 10DB reduction derived from external wall construction is inappropriate. Setback distances should instead be increased to achieve a further 10DB reduction (6) Any Maximum sound level caused by any combination of background noise and wind turbines should be applied to the boundary of a property owner's property rather than at the outside of the external wall of their property. (7) That the maximum sound levels permitted by background noise and wind power generated noise should not exceed 35DB at the boundary of residential property (8) Home owners should be eligible for a grant of €5,000 per year, funded by levies on wind turbines where any turbine is closer than 1000 metres to be to a dwelling to defray any expense with sound level monitoring and engaging professional expertise as may be necessary to preserve their level of amenity, where dispute arise in relation to wind turbine generated noise. (9) That the Minister have regard to the rights of Citizens under Articles 40 & 43 of the constitution in relation to the infringement on personal rights and property rights as the draft regulations attempt to allow developers infringe on personal and property rights. The Minister should demonstrate that a minimum setback distance is necessary in order for the State to meet its obligations under 2009/28/EC. (10) The Minister should recognize that the proposal in the draft guidelines to shut down turbines demonstrates the inadequacy of separation distances of turbines from residential property. Locating turbines that generate our electricity supply in a place where they would need to be shut down to prevent nuisance demonstrates a fundamental flaw in locating turbines less than 2000metres from dwellings. The range of parameters such as elevation of a turbine over a dwelling, chord with of a turbine blade, Tip speed ratio, and rotation speed permit situations where in flicker beyond 10 diameters on one site may exceed flicker at less than 10 diameters at a second site. The definition of flicker is inadequate to protect amenity and prevent nuisance. (11) The Guidelines make no reference to preventing nuisance and disturbance to equines or farm animals!
