TENDER DOCUMENTATION
FOR THE PURCHASE OF MOBILE CONCRETE BATCHING PLANT WITH
MIXING

7. Name of the contract: equipment procurement contract
The machineries that shall be purchased are: 1 piece Mobile concrete batching plant with
mixing
Source of financing for these machineries is formed of :
● 50% of the value of the machineries without VAT, from structural funds within the POS
CCE Axe 1 program, Operation: Support for strengthening the productive sector by tangible
and intangible investments – operation for large enterprises.

8. Deadline for tender submission: 8th of March, time 10:00.
9. Clarifications: The Tenderer is entitled to seek clarifications and the Purchaser undertakes
to answer within a period not exceeding 3 working days from the moment when the
request was received. The Purchaser is obliged to transmit the answers – accompanied by
the relative questions – to all the economic operators that have obtained the tender
documentation, taking measures not to disclose the identity of those that have requested
the clarifications. The deadline for receiving the clarifications: at least 3 days before the
submission date of the tenders.
10. The validity of the contract and completion term is from the 18th of March to the 31st of
July 2011.

11. The tenderer must maintain its tender for at least 1 month (30 days).
12. The tenders shall be opened on the 8th of March, time 11:00, at the headquarters of the
contracting authority.
During the opening session it is not allowed to reject any tender, except those that have been
submitted after the submission date and time, or at an address other that the one established in
the notice of participation.
A report shall be drawn up at the end of the opening session, that shall be signed by the
members of the evaluation committee, co-opted experts (where appropriate) and the
representatives of the tenderers, in which it will be mentioned the modality in which the
session has taken place, the formal aspects observed upon the opening of the tenders and also
the financial proposal for each tender.
The evaluation committee is obliged to send a copy of the opening report to all the tenderers
participating in the award procedure, whether or not they were present at the opening session.
Any decision regarding the qualification / selection of the tenderers or, as appropriate,
regarding the evaluation of the tenders, is taken by the evaluation committee during
subsequent meetings of the opening of tenders.
Conditions for the participants at the opening session: The representatives of the
tenderers, on the basis of a written mandate and an identity document, with photo, of the
authorized person.
13. Ways to contest the purchaser’s decision to award the procurement contract and to
solve the appeal: any further complaints may be submitted at the Purchaser’s headquarters,
within 4 days from the notification of the evaluation results, time 4 p.m. The Purchaser shall
evaluate the appeal and shall give an answer within 3 days, justifying the decision.
14. The payment for the machineries: the payment of max. 25% before delivery is accepted,
the payment of the difference shall be made in maximum 45 days after delivery of the goods.

d) modality of presentation
The tender shall be submitted at the headquarters of S.C EUROPRODUCTS SRL, in sealed
and stamped envelope, on which it shall be mentioned:
“Tender for machineries in order to perform the project: “Purchase of competitive
industrial machineries and equipments for the modernization of SC EUROPRODUCTS
SRL”.
The tender shall not be open until the 8th of March, time 11:00.
The original and the copy shall be put in an envelope that is sealed with adhesive tape and
having the tenderer’s signature. In addition, an open envelope, stapled to the envelope
containing the tender shall be presented, which shall include:

The sealed envelope shall contain 2 envelopes (1 original + 1 copy). Each envelope (original
and copy) shall contain 2 sealed and stamped envelopes with:

Envelope no. 1: technical proposal;

Envelope no. 2: financial proposal.
The inner envelopes (original and copy) must be marked with the tenderer’s name and
address, in order to enable the return of the tender without being open, in case the respective
tender is declared delayed.

Modality of submitting the technical proposal: By submitting the technical proposal, the
tenderer has the obligation to prove the conformity of the products that are going to be
delivered, in conformity with the requirements from the books of specifications. To this end,
the technical proposal shall meet all the eliminatory conditions (in accordance to the order
imposed by the Book of Specifications) and explicitly for the other points.
The technical offer becomes integral part of the supply contract.
Modality of presentation of the financial proposal:
The financial offer shall be presented in a summary which will be the basis for the financial
offer.
The financial offer becomes integral part of the supply contract.
The tenders shall be expressed in euro, without VAT.
For the internal suppliers, the payment shall be made in lei, at the BNR exchange rate valid
for that day.
ALTERNATIVE OFFERS SHALL NOT BE ACCEPTED
If the outer envelope is not marked according to the above mentioned, the purchaser assumes
no responsibility for the missing offer.
Not filling in one of the missing documents, within the term requested by the purchaser, has
as consequence the rejection of the tender as UNACCEPTABLE.
FAILURE TO SUBMIT THE TECHNICAL AND/OR FINANCIAL PROPOSAL,
RESULTS IN DISQUALIFICATION OF THE TENDERER – unacceptable offer.
e) amendment or withdrawal of tender: The tenderer is entitled to withdraw the offer, by
means of a written request to the purchaser, until the opening date and time of the offers.
The tenderer may modify the content of the tender, until the date and time for tender
submitting, asking to this respect to the purchaser, a tender return request regarding the
modification. The purchaser shall not be liable in connection with the possibility of the
tenderer to submit the new modified tender, until the closing date and time, stipulated in the
tender documentation.
f) Late tenders: the tender is considered in delay if it is submitted after the closing date and
time stated in section. b).

g) Rejection of tender: The tender may be rejected during the opening session, according to
the provisions of art. 33, paragraph 3 from GD no. 925/2006, with further amendments and
integrations.
h) The tenders shall be directly submitted by the authorized dealers only.
It is attached a copy of the certificate of incorporation with the main object of activity or the
declaration of the manufacturer in case of authorized representatives.
16. The tenderers shall comply with all the eliminatory conditions. If at least one of the
eliminatory criterion is not met, the tender shall be rejected.
17. Award criteria: the most advantageous tender from an economic point of view.
The evaluation of tenders consists in granting for each tender, a score as a result of applying
while calculating the algorithm described below. The classification, on which the winning
tender is determined, will be elaborated in descending order according to the score.

software parameters and the programmable controller (PLC – Programmable Logic
Controller).

Warranty: min 2 years from the operation date. The warranty includes the free repair or
replacement of the defective parts if the fault is not due to the beneficiary
Free technical assistance during the warranty
Spare parts: It shall be ensured the supply time with spare parts in the warranty and postwarranty period of minimum 10 years.
The concrete batching plant shall be installed on the existing platform, on the current
location, without requiring constructive modifications of it.
