12. Article II, Section 3
Checks and Balances
The power of Congress to make laws is checked by the President’s power to
either approve or veto any proposed law.
In addition any bill must pass both houses of Congress so each chamber
checks the other.
Finally the president must veto a bill with reason that is in writing and
returned to Congress. This checks his power to some extent by ensuring
vetoes aren’t on a whim or for purely personal reasons.
No treaty the President/Executive negotiates is official and legal until 2/3s
of the Senate votes to ratify.
No cabinet officer, ambassador or judge can take their position until the
Senate confirms the nomination.
Both of these serve as a check on the President’s power and ensure that
treaties and appointees reflect not just the will of the President but a
broader will.
Separation of powers
Checks and balances
The president’s oath of office requires him/her to ‘preserve, protect and
defend’ the Constitution.
The president may call a special session of Congress to resolve a dispute or
deal with crisis. This ensures that Congress cannot refuse to act in a
particular situation that needs a response for political or personal reasons.
Special Session
13. Article II, Section 4
“Impeachment for High Crimes”
Separation of powers
Checks and balances
Rule of law
Congress can check the power of the executive by impeaching and
removing them from office.
Ensures that even the executive can be held responsible for actions that are
deemed outside the bounds of the Constitution.
