Volume 5, Issue 1
Aug/Sept 2013
In the past years motorcycles have become a popular mode of
transportation; therefore it is common to see an increase of motorcycle
crashes on our roads. The NMMRO has established a motorcycle rider down
message system. Currently if someone has information or has seen a
motorcycle crash they notify me or one of our board members and then I
notify all the contacts that have entrusted me with their phone numbers to
get the word out. This helps identify and provide support to the rider, the
passenger and the family as soon as possible; whether still at the scene, at
the hospital, or even at a later date. We also a have motorcycle ministry
group who will go to the hospital and support the rider and the family in
their time of need. If anyone would like to be added to the call list contact
me at atorrez2@msn.com or 730-0435. I was recently at the scene of a
crash where the motorcyclist involved in collusion with an RV who turned in
front of him unfortunately did not survive. The police allowed me to stay
with the understanding I would not interfere with the investigation. While
there, I had the opportunity to speak to the APD Chaplains who assist to
notify, counsel and provide guidance to the family of the accident victims.
Through my experience that night I realized that one of the most difficult
tasks they had is determining who the in case of emergency contact
person for the deceased was. The NMMRO has now developed an in case
of emergency card for our members and community in which you can fill in
your information and in case of emergency contacts to carry in your wallet
our vest. We also advise to add an in case of emergency person contact to
your cell phone list. This will help in case the crash victim is unable to speak
or deceased. The following is good advice from Attorney Dan Sorey, who
advises the NMMRO as to what to do in the event of an accident. Unless
your injuries require otherwise, don’t leave the scene of an accident until
you have called the police and they have documented the accident;
obtain the other driver(s) name, address and phone number, license plate
and registration numbers of the vehicle(s) involved in the accident. Ask the
other driver(s) to show you their license, give you their phone numbers, their
insurance company name and policy numbers. Obtain the names, phone
numbers and addresses of all eyewitnesses. Try to get a written statement
from any witnesses as to what happened. Remember that even serious
injuries are not always evident at the time of the collision. See your doctor
immediately and advise any of your passengers to do the same. Do not
discuss the accident with anyone except the investigating police officer,
and then, only the basic facts. If it’s a serious accident involving injury, you
will only want to make statements to your lawyer. Make your own written
notes on all significant circumstances concerning the accident. If you or
someone else has a camera at the scene, take pictures to preserve skid
marks, the position of the vehicles and other physical evidence that will
likely disappear after the accident.

THE NMMRO NEWSLETTER

The Washington Post recently reported that; The National
Security Agency has broken privacy rules or overstepped
its legal authority thousands of times each year since
Congress granted the agency broad new powers in 2008,
according to a recent internal audit and other top-secret
documents. Most of the infractions involve unauthorized
surveillance of Americans or foreign intelligence targets in
the United States, both of which are restricted by statute
and executive order. They range from significant violations
of law to typographical errors that resulted in unintended
interception of U.S. e-mails and telephone calls. They also
reported that the NSA and FBI are tapping directly into the
central serves of nine leading US internet companies
extracting audio, video, photographs, emails and
documents and connection logs that enable analysis to
track person’s movements and contacts over time. This
program is called Prism where they are monitoring Face
book, Skype, Apple, Yahoo, Google AOL, and Microsoft
that allow the government to obtain private information,
they can even look at private information before you even
send it as your thoughts are being formed. The audit
conducted reported a violation of surveillance of
Americans which breached our Fourth Amendment and
abuse our civil liberties.
Thank you to all who supported and assisted in our 2nd
Annual Safety Awareness event at the Balloon Fiesta Park
in June. Thank you to The Department of Transportation,
Lisa Van Druff, Victoria and ACCC Insurance companies
and Attorney Dan Sorey for the Funding to make this
event possible. We had approximately 1000 plus persons
in attendance. Also thank you to the Rollerz Only Car Club
for their assistance.
An entire motorcycle community should not be judged
due to a recent incident and the negative unjust actions of
a few. Several negative media reports have put a
motorcycle community under scrutiny and have caused
prejudice against bikers; there has been an increase
stereotyping, discrimination and profiling from law
enforcement and local businesses. I ask that you don’t
always believe or form personal opinions from everything
you read and hear from the media, it appears they don’t
always report the facts and embellish the truth to sell
papers. With so many outside forces with prejudice
against our motorcycle community it is important we
remain united with respect and support of each other and
our community. We ask that you welcome to our newly
elected NMMRO board members Lisa Van Druff, Tom
Newell. The NMMRO thanks you all for your support. Ride
Safe All. Annette
POW/MIA Ceremony
On 20 Sep Kirtland AFB will be holding a POW/MIA ceremony at the NM
Veterans Memorial Park on Gibson and Louisiana. We are in need of
motorcycle riders to escort the POW/MIA flag from Hardin Field to the
NM Memorial Park around 1000 that morning.
Riders are asked to be in place at 0930 if you are able to support. If you
have base access, you can meet at Hardin Field (corner of Wyoming and
Gibson). If you do not have base access you are still welcome to
support, you will just meet outside the Gibson gate (near the corner of
Gibson and Louisiana) and jump in the pack as it goes by. We will be
escorting a runner who will be carrying the POW/MIA flag from Hardin
Field to the NM Veterans Memorial Park. The ceremony will start at
1000, or after the flag arrives. We are all welcome to attend the
ceremony.

MADD Always looking Volunteers
I recently had the opportunity to experience life that was finally driven by my heart and intuition. I want to share with
you all the exhilaration in that experience! There is nothing more gratifying than living your own life and not allowing
the negativity of the world to dictate your decisions! I encourage all of you to look into your own hearts and discover
the true meaning of your own life! "Your time is limited, so don't waste it living someone else's life. Don't be trapped by
dogma- which is living with the results of other people's thinking. Don't let the noise of others' opinions drown out your
own inner voice. And most important, have the courage to follow your heart and intuition." Steve Jobs
Volunteering comes from the heart! It can be a beneficial, rewarding component of a valuable life led the way you
choose. We live in a world where, it appears, that only negativity exists. I want to encourage you to look deeper and
see the reward and value within our community and let the positive things that are happening be your drive to create
a light where only the dark appears to exist. Too often we get trapped in the oppression of negative thoughts and
actions of others. Never accept a life that is created from others thoughts. Always follow the dreams and desires you
create for yourself!
We want the community to know who we are and what we truly stand for. We are women, men, children,
grandparents, young, old, and everyone in between. We believe in practicing responsibility in regard to legal adult
drinking. We work to educate and prevent underage drinking. And we work tirelessly to support the victims who have
been affected by this 100% preventable crime. A bad choice can lead to a changed life for everyone involved. This
year we have already lost 132 lives to drunk driving in NM. This is a number that could have been "0" if people had
made the choice to designate a driver. Please remember to share this message with those you come into contact
with. It is vital to our success and the communities understanding. I can only imagine a world where the positive will
outweigh the negative. This will happen through the efforts of volunteers like you! In a community where Drinking and
Driving seems to take over the headlines, we will make every effort to change those headlines and showcase our
community in a positive light! Thank you to all of you for having the courage to change the world!

MRF Alcohol Awareness Committee
Mothers Against Drunk Driving
New Mexico
A number of years ago the MRF formed the Alcohol Awareness committee as an advisory
3411 Candelaria Blvd. NE
committee to the Board of Directors. The reason for this committee and the ongoing work is
Suite B
due to the increasing awareness of government agencies of the issue of impaired riding.
Impaired riding has been an issue for many years but in the past decade it gained
Albuquerque, NM 87107
prominence to the point it is a major part of any discussion where motorcycle safety is the
505-255-2955 ext.3556-direct
topic. The MRF board tasked the committee to develop a program part of which will
877.ASK.MADD
present the MRF position on impaired riding. The following position paper was presented to
kristen.koger@madd.org
the Board at the September 2009 BOD meeting and with minor adjustments agreed upon
Visit us at www.madd.org
and approved.
Impaired riding is increasingly becoming a serious problem causing escalating attention in
both the motorcycling community, and the various bureaucracies with oversight of
motorcycling fatality statistics. As awareness of this issue increases, individuals and
organizations alike must make decisions as to how they will address the concerns of riding
impaired. Impaired riding occurs in a variety of conditions, the most common and probably
of most concern is alcohol. Drinking and riding is the most obvious and the most frequently
pointed to as a cause of concern. However, impaired riding is also a condition that occurs
under the influence of prescription drugs, illegal drugs, and over the counter drugs. As
leaders in the motorcycling community we must educate and inform riders of the hazards
and encourage personal responsibility. Impaired riding is sited as the cause of Forty-one
percent of the 2,182 motorcycle riders who died in single-vehicle crashes in 2007, they had
BAC levels of .08 or greater, (NHTSA). Motorcyclists must face the fact that this number is the
one area where the fatalities are in our direct control. If we want to bring about a reduction
in the number of impaired riding fatalities each of us must watch out for ourselves and
those we ride with. The Motorcycle Riders Foundation, MRF, has taken the position that
individual responsibility is the ultimate way to reduce fatalities. We encourage organizations
and riding groups to do what they can to take proactive efforts promoting unimpaired
riding. Through outreach campaigns of the risks associated with riding impaired; using
education and awareness of the various ways one can become impaired; and promoting
and increasing efforts to watch out for fellow riders, we can make a difference and
perhaps save a life and at the same time reduce the fatality numbers.

We had a benefit ride and games for the Community Pantry
on Aug. 10th which included a benefit ride ending with dinner,
games and a lot of raffle prizes. The event raised $1000.00 for
the local Community Pantry.
We are holding steady with about 33 members, but also have
numerous folks joining us for events and hopefully they will be
joining officially.
There was a hearing scheduled Aug. 9th at 2 pm for Larrieston
Charlie the DWI driver that killed Johnathan Yazzie on Dec. 1st,
2012. This case has really taken some wrong turns. The hearing
the 9th was due to the prosecutor signing a plea deal for 14
years with good time Mr. Charlie could be out in 7 years. The
DA Karl Gillison was out on sick leave when the plea deal was
signed and when he returned he would not accept the plea
deal due to this should be considered a serious violent crime
and also the Johnathan’s family had not been involved in the
plea. The svc means Mr. Charlie would have to serve 85% of
the sentence. So now the DA has to convince the Judge that
the plea is not acceptable. Johnathan’s family was notified
the morning of the 9th at approx. 10am that the time had
changed to 11am. Johnathan’s wife Michelle, Ra and myself
were there and once again there was a continuance till
Friday Aug. 16th at 2pm.
We also just got our patches done and will have them at the
next NMMRO meeting.
Also have some t-shirts left and will put another order in if
anyone would like to purchase one.

National Coalition of Motorcyclists (NCOM)
FEDERAL BILLS WOULD PROTECT MANUFACTURERS OF ETHANOL FUELS
Even as motorcyclists and others are calling for further research and testing of fuels containing ethanol, and the fact that E-15
(gasoline containing 15% ethanol) is not approved for use in any of the millions of motorcycles on and off-road, two bills have been
introduced in Congress to protect the fuel industry from lawsuits resulting from its use.
Illinois Congressman John Shimkus, otherwise a longtime friend of motorcycle riders, has authored H.R.1214, the Domestic Fuels
Protection Act of 2014; “To provide liability protection for claims based on the design, manufacture, sale, offer for sale, introduction
into commerce, or use of certain fuels and fuel additives.”
Likewise, Texas Congressman Gene Green has offered H.R.2267, the American Fuel Protection Act of 2013, which “Deems a claim for
liability against a qualified entity as a claim against the United States for damages resulting from, or aggravated by, the use of
transportation fuel containing ethanol in concentrations greater than 10% to operate an internal combustion engine. Abrogates U.S.
sovereign immunity and makes the United States exclusively liable for such claims. Limits awards to actual damages sustained by a
claimant. Defines "qualified entity" to mean an entity engaged in the manufacture, use, sale, or distribution of: (1) transportation fuel or
renewable fuel, or (2) products which use transportation fuel. Grants U.S. district courts exclusive jurisdiction of any civil actions on such
claims.”
Both bills have been referred to committee, and either proposal would indemnify fuel manufacturers and suppliers from legal actions
for damages caused by their product, leaving U.S. taxpayers to foot the bill for clean-ups from leakage and limiting their liability to
actual damages by a claimant, such as the out-of-pocket cost to rebuild an engine damaged by E-15 gas.

BIKERS ROUSTED AFTER SHOOTING SUE POLICE
Members of a motorcycle club claim their constitutional rights were violated when Arizona officers rousted them at gunpoint at a
campsite where a man shot his wife and two others before killing himself at a 2011 bike rally near Flagstaff.
The Sons of Hell have filed a federal lawsuit last week against the Arizona Department of Public Safety and the Coconino County
Sheriff's Office seeking monetary compensation. Its members claim officers were trying to collect information for a criminal street gang
database, even though they knew club members weren't involved in the shooting.
MOTORCYCLISTS LAUNCH $100M SUIT AGAINST QUEBEC INSURANCE BOARD
The Motorcyclist Movement of Quebec, which represents more than 8,000 motorcyclists in the province, says sky-high hikes in insurance
premiums are unfair and discriminate against motorcycle owners, and held a protest in downtown Montreal to launch a $100 million
class-action lawsuit against Quebec's automobile insurance board (SAAQ).
The organization's president and founder, Michael Mosca, says license plate registration fees have increased by 400% since 2008.
“They’re being discriminated upon. It’s a very abusive law,” he says.
However, the SAAQ says the premiums are needed in order to compensate victims involved in motorcycle accidents. The board
adjusted insurance premiums after a review revealed a $109 million deficit in 2006. While Mosca admits that motorcycles are higherrisk vehicles, he claims that “When there are accidents between cars and motorcycles, 94 or 95% of the time it’s the car’s fault, so the
motorcyclist is being punished when he’s not at fault.”
Instead of increasing fees, Mosca suggests the SAAQ should do more to educate people about road safety, adding that it's time
people change their minds about motorcycles. “Motorcycles consume less fuel, they cause less pollution, less damage to the roads,
which is beneficial to the whole planet," he said.
MOTORCYCLE HELMETS BANNED IN PHILLIPINE CITY DUE TO BOMBINGS
For an easier identification of criminals, local authorities in Cotabato City have banned the wearing of motorcycle helmets after
several deadly car bomb blasts. City police said the measure will help them identify known criminals in the area, and are also hoping
that the city council will support their move, radio dzBB has reported.
Several countries had cautioned their nationals to take precautions in traveling to Mindanao, in the Philippines, due to the bombings.
Cotabato City is a mixed Muslim-Catholic city on the main southern island of Mindanao where Muslim insurgents have waged a
decades old rebellion that has claimed 150,000 lives.

PANAMANIAN RIDERS TO BE REQUIRED TO WEAR NUMBERED VESTS AND HELMETS
Amid nationwide protests from motorcycle riders, a controversial new set of laws may soon force motorcyclists in Panama to emblazon
their license plate number on reflective vests and helmets.
Following objections from motorcycle clubs, the Transport Authority (ATTT) decided to postpone the enforcement of the decree
regulating the new safety standards for motorcycles, Resolution 904, which was originally set to begin July 24th. Motorcyclist groups in
this Central American country say that the measure will not help reduce the use of motorcycles in acts of crime, such as drive-by
shootings, and they also insist that the measure is unconstitutional.
Ricardo Mosquera, the President of the Motorcycle Association of Panama, described the move as arbitrary, and as an imposition. "At
no time were we consulted on this new standard, it also strikes me as having been negotiated with whoever is going to sell the vests.
Moreover, a criminal could simply make a vest bearing any number, commit their crime, and the innocent would then be blamed,"
Mosquera told Panama-Guide.com.
ATTT head Roberto Moreno said that motorcyclists only disagree with the use of numbered helmets and vests but are not opposed to
driving with their lights on, and they also have no qualms about restrictions on driving on sidewalks and shoulders of the roads and in the
middle of streets and avenues around the country.
BMW DEVELOPS INFLATABLE SAFETY CLOTHING
BMW Motorrad and Dainese have announced that they are to cooperate in a joint development of innovative motorcycle safety
clothing, partnering to develop motorcycle rider equipment with fully integrated inflatable protectors.
The first product to emerge from the cooperation will be the DoubleR RaceAir one-piece leather suit designed exclusively for use on
racetracks, and the next stage will be to develop the Dainese D-Air Street System as a retrofit solution for BMW Motorrad. The system is
scheduled to be launched in 2015, following successful completion of all the crash tests. BMW Motorrad customers will then be able to
retrofit the innovative safety system to their motorcycles.
Based in Germany, BMW Motorrad is the only motorcycle manufacturer to have developed the complete range of rider equipment
ever since the 1970s - from motorcycle helmets to rider suits, boots and gloves. The ABS pioneer says it has always regarded
motorcycling and safety as being inseparably linked and anchored in the "Safety 360°" principle, which breaks down the overall
concept of safe motorcycling into three facets: safety technology in the vehicle, safety deriving from rider equipment and safety
through rider training.
FEDS PETITION FOR MANDATORY ANTI-LOCK BRAKES ON ALL STREET BIKES
The Insurance Institute for Highway Safety (IIHS) and the Highway Loss Data Institute (HLDI) have petitioned the National Highway Traffic
Safety Administration (NHTSA) to upgrade the Federal Motor Vehicle Safety Standard (FMVSS) No. 122 Motorcycle brake systems (49
CFR 571.122).
“This standard should be strengthened to require ABS on all new motorcycles manufactured for on-highway use in the United States,”
wrote the IIHS and HLDI in joint letter on May 30, 2013 to NHTSA Administrator David L. Strickland.
Research by IIHS and HLDI indicate that ABS reduces the motorcycle fatal crash rate by an estimated 31% and the collision insurance
claim rate by an estimated 20%.

whole club to go then great.
I would also like to address that in our community we as clubs
need to understand that there are issues within the community
that is out of our control. When something brings a lot of attention
to the motorcycle community we all need to work together and
not create any additional rumors. Social Media is not the forum to
discuss any business or to post any comments that others will take
offence to. With the proper education and guidance the
motorcycle community can work out any issues or concerns with
each club or individual involved in a private meeting. Social
Media if not all Media in fact, will not report the truth and will only
create additional issues. Lets all take a step back and look at
what Protocol we all have been taught and use that as a
guideline. Remember to get respect you have to give respect.
We have a strong community and if we all work together we can
only get stronger. We have enough people fighting against us,
lets not fight within our own.

13NR28 - MRF News Release - Feds to Motorcyclists: Pump E-15 into your bike and
go to jail.

Feds to Motorcyclists: Pump E-15 into your bike and go to jail.
The Motorcycle Riders Foundation (MRF) reports that according to the Environmental Protection Agency (EPA) using ethanol blends
of 15% ethanol in any vehicle that is not a passenger vehicle will be in direct violation of Federal law. The EPA has issued a list of
possible plans to mitigate mis-fueling issues with the recently approved E-15 ethanol blends. Prior to E-15, the highest blend allowed
for mass consumption was E-10. The MRF has been informing the EPA that the higher blend will be forced upon motorcyclists because
of the remaining fuel in the hose from the previous customer. The EPA then said that a 4 four-gallon minimum purchase would be
required by everyone. That was rolled back and an EPA document specifically mentions the work of the motorcycle rights
organizations in the overturn of the mandatory minimum.
From the EPA: "However, groups representing motorcycle owners and lawn mower manufacturers objected to this configuration
because their products have gas tanks that are normally two gallons or smaller. In response to these concerns, Renewable Fuel
Standard (RFS) developed and proposed a new configuration for EPA approval that retail stations may use as an alternative to the
currently approved configurations."
The solutions provided by the EPA is to label the pumps with attention getting labels that you are about to pump E-15 into your
vehicle. Or purchase new blender pumps that only carry about .3 gallons or have a new pump with a dedicated E-15 hose. The first
solution won't work and the second two solutions are too expensive.
In another recent EPA document on the Renewable Fuel Standard (RFS) the EPA states: "The EPA will propose to use flexibilities in the
RFS statute to reduce both the advanced bio fuel and total renewable volumes in the forthcoming 2014 RFS volume requirement
proposal."
The EPA also maintains that while ethanol will be the dominating renewable fuel, the marketplace for them is shrinking fast.
In a recent Wall Street Journal piece the author, US Representative Patrick Meehan, pointed out that the EPA's position on the RFS
was weak; "refusing to take action this year is a far too tepid response to this crisis. Next year may be too late." said Representative.
Meehan.
In order to stop the onslaught of higher ethanol blends the Motorcycle Riders Foundation asks that you support this important piece
of legislation. HR 875 is a bill that would stop the sale of E-15 and includes a study on the actual effects on the power train of your
vehicles.
Call the Capitol switchboard at (202) 224-3121 and ask to speak to your member of Congress and ask that they support this important
legislation.find/

cases are very different accidents and that there was a need
for lawyers that knew motorcycles because they rode too.
