FULTON COUNTY COMMISSIONERS

Building.
Meeting Called To Order:
Mark J. Rodriguez called this Meeting to Order at 6:00 p.m., E.S.T. Present for this
meeting were Commissioners Mark J. Rodriguez; Sherry Fulton; Roger D. Rose;
Attorney Greg Heller; and Auditor Judy Reed.
Highway Department:
Superintendent Dave Tofson provided his December report to the Board. He reported
that, according to Shawn Porter at Structure Point, Bridge #2 was available for disposal
as of July, 2008. Porter will be composing a letter saying as much for the Board, the
DNR and the administrator.
He said that the highway department has 651 hours of comp time accrued and 111
overtime hours.
Tofson discussed the policy of mailbox replacement if a highway department vehicle hits
it versus if the force of the snow knocks it down. The policy will remain that if the
vehicle hits it, the County will replace it.
He said that the project on Old 31 South, north of Burns Tire Services, is completed. A
10’ metal culvert was slip lined into the concrete culvert.
Sheriff Department:
Sheriff Walker Conley provided an annual report from the animal warden. He said that
the building will need to be wired for electricity. The Board instructed him to obtain
quotes for the work.
He also provided a two-year comparison of Sheriff Department statistics showing a
16.4% increase in incidents from 2007 to 2008.
Commissioner Meeting Minutes:
The minutes of the January 5, 2009, Commissioner meeting were reviewed. Roger Rose
moved to approve the minutes of the January 5, 2009, meeting as corrected. Sherry
Fulton seconded this motion. Motion carried 3-0.

The transfer requests were reviewed and approved.
Claims and Payroll:
The Commissioners reviewed Payroll and all Claims and signed them for payment.
Nyona/South Mud Lake Waiver of Fees:
The Nyona/South Mud Lake Conservancy District asked that its fees for sign placement
at the Sewage Treatment Plant be waived. Roger Rose moved to waive the fees for the
Nyona/South Mud Lake Conservancy District associated with placement of the sign at
the Sewage Treatment Plant. Sherry Fulton seconded the motion. Motion carried 3-0.
Health Officer Appointment:
Dr. Craig Bugno was reappointed as Fulton County’s Health Officer.
EMS Task Force Committee:
Roger said that Hospital Board will be asked to make an appointment to the Committee.
It was suggested that it be brought to a Hospital Board meeting. The next meeting will be
January 27, 2009, at 1:00 p.m. The Board discussed the other appointments to the
committee and where the representative from the outlying areas should come from.
Kathy Siders suggested having some resolution before nest budget time. Roger said that
he would try to have the board of appointees established by next meeting.
Emergency Closing Procedure:
This has been addressed in the policy handbook, but the protocol still needs to be
established. Mark would call the Auditor and the Clerk and then other department heads
and supervisors. A call list will be drafted. The Board plans to have the decision made
by 6:30 a.m. with the radio station notified for publication.
Vacation of Road in Disko:
Mark Rodriguez called the public hearing to order. Michael Bennett asked that the Board
vacate a portion of a roadway in Disko so that he can erect a building on his property and

remain within the setback limits. He wants to vacate half of the roadway, leaving 21 feet
and not upsetting any restrictions of the utilities. Roger and Greg Heller didn’t believe
that one could vacate half of the road. He said that Jeremy Rush, who had a previous
petition to vacate, is angry that he purchased the property and is causing problems or him.
He said all he wants is to build his garage. Greg Heller will research statutes to
determine whether half of the roadway can be vacated and to check the notice statute.
Roger Rose moved to table the matter to get some questions answered. Sherry Fulton
seconded the motion. Motion carried 3-0. This will be readdressed at the February 17,
2009, meeting, at 7:00 p.m. The public hearing was closed.

New Business:
The Board reviewed two monthly reports of the Weights and Measures.
Roger brought up the Kernan-Shepherd Report that was in the Governor’s State of the
State speech. The Board discussed this issue and how proposed changes in county
government might affect Fulton County at length.
Judy said that W-2 forms were sent out and that a meeting should be scheduled for early
in February for department heads and elected officials.
Old Business:
Sherry Fulton reported that the IT Committee said that the group would send something
in writing as to the dollar amount. They are to contact Steve Reese if there is a problem
and he will contact the group if it is something serious that will take time.
Roger reported that the Redevelopment Commission has been discussing the Lift Station
Project for Fourth Street, which anticipates creating a TIF district. There may be some
conflict in some of the members of the committee. Two members may need to resign
with reappointments to come.
Mark said the Personnel Committee met last week and came up with a couple of items of
question in the policy manual. There was discussion regarding compensation time. He
said there were other questions and changes regarding the policy. He noted that the
sheriff department will be asked to look at its vacation policy so that it might coincide
with the County vacation policy. Judy noted that any changed would need to be made
through the consultant who created the policy.
The Board discussed the pros and cons of having a time-keeping device for employees.
There was significant discussion on this topic.
Kathy Siders said that on December 26, 2008, her father and two other veterans were
transported to Fort Wayne, though appreciated, the road were terrible and they ended up
on the side of the road after an accident. A good samaritan pulled them out of the ditch,

allowing them to get home. She felt the VA van should never have been out on the roads
in that kind of weather. She wondered who should indicate whether or not the van should
be on the road. Greg Heller suggested that would be a question for the insurance carrier.
The Board noted that on certain days he should consider consulting with the sheriff
department for road conditions and cancel the trip, if necessary.
Mark said that he continues to meet with the Highway Department. They will go back to
work on the frost law once a strategic plan is established.
This concluded the business of this meeting of the Fulton County Board of
Commissioners. Roger Rose moved to recess this meeting at 9:30 p.m. Sherry Fulton
seconded this motion. Motion carried 3-0.
