Dear Customer,
Exemption Review - end of transitional arrangements Environmental
Permitting (England and Wales) Regulations 2010
We are writing to you to let you know that you will be affected by the changes
to the waste exemption system that will come into force on the 1st of October
2011 and you will need to take some action.
Our records show that you are currently registered to undertake a paragraph
12 exemption waste activity for storage and composting of bio-degradable
waste under the Environmental Permitting (England and Wales) Regulations
2007.
You will no longer be able to carry on your waste operation after the 30th
September 2011 unless you have either registered for a new free of charge
waste exemption or made an application for an environmental permit.
If you do not wish to register the new exemption or apply for a permit you
must cease your waste operation.
If you wish to register for a free-of-charge exemption
A new exemption (T23) is available for aerobic composting and associated
prior treatment. There are also some new exemptions for anaerobic digestion
T24 and T25. More information and guidance on the new exemptions system

You can also register your exemption on-line by following the instructions from
the above link.
If you need a permit to continue operating
If you can’t meet the limits and conditions of any of these new exemptions and
you wish to continue operating, you will need to apply for a permit before the
1st of October 2011. The process of applying for a permit and information on
the different types of permit that are available to you is given in the “Making
the Steps to Permitting” guidance document enclosed with this letter.
It would be helpful if you could include your exemption registration number
when making your permit application.
You may continue to use your current Paragraph 12 exemption if:
1) You make a valid permit application before the 1st October 2011; and
2) You comply with the exemption

Where to find help
We strongly recommend that you talk to your local environment officer before
applying for a permit. If you do not know who to talk to then please call our
National Customer Contact Centre on 03708 506506 explaining the situation.
They will then transfer you to your local environment officer.

What happens next?
After the transition date we will remove all Paragraph 12 registrations from the
public register where we have not received a valid permit application. If you
continue to operate without being registered you will be committing an
offence. Where a valid permit application has been made the registration will
remain on the public register until the permit is issued or if refused until any
appeal is heard. Once the final decision on the permit application is made the
registration will be removed.
Our environment officers will be undertaking compliance visits to check that
operators have the correct permissions in place.
