Creative Work Disclosure
UNIVERSITY OF ULSTER – CONFIDENTIAL
This form should be completed and submitted to Department of Research and Innovation (R&I) if you believe you
have developed a Creative Work which is capable of commercialisation. The purpose of this form is to enable
R&I to evaluate whether legal protection to the Creative Work will be sought and/or commercialization pursued.
Please submit the completed form with all creators’ signatures to Sinead Hunter in R&I (s.hunter@ulster.ac.uk).

A Creative Work may attract legal protection under UK copyright, design or trade mark law. Copyright arises
automatically and can be used to protect any original works such as original literary works (tables or
compilations, computer software programs and databases), dramatic works (dance or mime), musical works
(music exclusive of any words or actions ) and artistic work (graphic works, photographs, sculptures, collages
irrespective of artistic quality, works of architecture and works of artistic craftsmanship), sound recordings, films,
broadcasts and typographical arrangement of published editions. In addition, design products can be protected
by design rights for the appearance of the product and trade mark rights allow you to protect creative works such
as names, logos, advertising jingles, slogans, shape of goods or packaging.

disclosure will not be divulged to others (with the exception of those individuals involved in the evaluation process) without a
proper Confidentiality Agreement in place.)

Declaration and Assignment of Intellectual Property
1. I/We confirm that the information contained in this Creative Work Disclosure Form is true,
accurate and complete and not misleading in any material regard.

consideration of the University’s agreement to take reasonable steps to exploit the Creative Work
and all Intellectual Property Rights therein and distribute any resulting profits in accordance with the
University’s Intellectual Property Policy and Procedures, I/We hereby assign to the University
absolutely the full legal and beneficial title in and to such Creative Work and associated Intellectual
Property Rights throughout the world save to the extent that such rights are required to vest directly
in or be assigned to any external body which is connected with or otherwise involved in the funding
of the Works.
3. I/We agree to notify Research and Innovation of any change in address, so that I/we can be
informed of any developments relating to the Creative Works.
4. For these purposes the phrase “Intellectual Property Rights” means in respect of the Invention
patents, rights to inventions, trademarks and service marks, trade names and domain names, rights
in get-up, rights to goodwill and to sue for passing off and unfair competition, rights in designs,
copyright including rights in computer software, database rights, rights in confidential information
(including know-how and trade secrets) and any other intellectual property rights, in each case
whether registered or unregistered and including all applications (and rights to apply) for, and
renewals or extensions of, such rights and all similar or equivalent rights or forms of protection which
subsist or will subsist, now or in the future, in any part of the world.
5. I/We shall at the University’s cost, perform all such further acts and things, and execute and
deliver all such further documents, required by law or which the University requests to vest in it the
full benefit of the right, title and interest which I/We have assigned to the University pursuant hereto
including assisting the University in obtaining, defending and enforcing registered designs, and
assisting with any other proceedings which may be brought by or against the University against or
by any third party relating to the rights hereby assigned.
6. I/We hereby appoint the University to be my/our attorney to execute and do any such instrument
or thing, and generally to use my/our name, for the purpose of giving the University the benefit of the
rights detailed above. I/We acknowledge in favour of a third party that a certificate in writing signed
by anyone authorised by the University to do so to the effect that any instrument or act falls within
the authority conferred above shall be conclusive evidence that such is the case.
7. I/We confirm that no failure or delay by the University to exercise any right or remedy provided to
it under the above assignment or by law shall constitute a waiver of that or any other right or
remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No
single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that
or any other right or remedy.
8. I/We warrant that the Creative Work was generated by original work and was not copied wholly or
substantially from any other work or material or any other source.
9. The assignment detailed above shall be governed by and construed in accordance with Northern
Ireland law and shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
