Freehold development land For sale at Montgomery Road Huyton, Merseyside By informal tender (subject to Building Licence) 1,481m² (0.37 acre) Closing date – 3.00 p.m. – Date**** 2013 1 Site Plan 2 1.0 Introduction The Council is looking for a developer to enter into a building licence agreement to build housing on the cleared site of a former Resource Centre situated at Montgomery Road in the Huyton area of Knowsley. 2.0 Description 2.1 The parcel of land shown on the site plan is generally flat and level. The site is located at the corner of Montgomery Road and Horrocks Close, Huyton. 3.0 Location 3.1 The development site is located in a predominantly residential area. 3.2 Bus services are available along Blue Bell Lane whilst Huyton railway station is less than 1 mile away. Huyton Town Centre is approximately ½ a mile away and junction 2 on the M57 also approximately 1 mile away. 3.3 Schools are well provided for with primary schools and built some 300m away off Broad lane. 4.0 Site Area 4.1 The larger area of land contains an area of 1,481 (0.37 acres). 5.0 Planning issues 5.1 Currently the land is designated in the adopted Replacement Unitary Development Plan (2006) as primarily residential area and consequently there is a reasonable assumption that residential development would be acceptable. The Council is now in the process of putting together emerging planning policies for the Local Plan that will replace the UDP. 5.2 The site is in a low flood risk area. 5.3 Car parking requirement for each dwelling are to be in accordance with this table:Size of dwelling 1 bedroom dwelling 2 bedroom dwelling 3 bedroom dwelling 4+ bedroom dwelling 5.4 No. of persons 2 3 4 5 Car parking spaces 1 parking space 2 parking spaces 2 parking spaces 3 parking spaces All driveway spaces must be at least 5.5 metres in length. 3 5.5 The minimum width of a single parking space at the front of a property should be 3.3 metres to achieve Lifetime Homes status (2.4m is acceptable if a separate pedestrian path at least 0.9m wide is provided to the property). A 3m width is acceptable from a highways perspective if Lifetime Homes status is not required. 5.6 The minimum width of a parking space at the side of a property should be 2.75 metres wide (Note: 3m is preferred to allow for full side extensions in the future). 5.7 The minimum width of a double parking space at the front of a property should be 6 metres. 5.8 Any departure from the above standards should be discussed with the Council’s Highway Engineers on 0151 443 5962. 5.9 The layout should avoid over dominance of car parking along the street scene. This could be achieved with appropriate landscaping and/or parking to the side of dwellings or integral garages. 6.0 Highways issues 6.1 Access into the site for development can be from Montgomery Road or Horrocks Close. 7.0 Services 7.1 It is understood that 4” gas mains run under Montgomery Road and Horrocks Close that border the sites. Prospective purchasers should confirm this with National Grid plc. 7.2 There are understood to be 225mm sewers under Montgomery Road and 4” water mains are believed to be below Montgomery Road and Horrocks Close. 7.4 With both sewers and water mains a prospective purchaser should clarify the existence of services with United Utilities plc. 7.5 Mains electricity cables are evident in Montgomery Road and Horrocks Close. Potential purchasers are advised to contact SP Manweb plc to verify his information. 8.0 Public open space requirements 8.1 The site is in an area of an overall surplus open space and therefore as part of any planning consent there will be a required contribution payable on the basis of £490.49 per additional person to account for needs resulting from the development. 4 8.2 The contribution can be calculated by reference to Tables 4.1 and 6.1 of the Greenspace Standards and New Development Supplementary Planning Document (including inflation rises); Size of dwelling Number of persons Contribution per individual dwelling £980.98 1 bedroom dwelling 2 2 bedroom dwelling 3 £1471.47 3 bedroom dwelling 4 £1961.96 4+ bedroom dwelling 5 £2452.45 9.0 Basis of offer 9.1 The offer that you make is for the Council’s freehold interest in the site that would be transferred following satisfactory completion of the development under the Building Licence agreement (‘the Building Licence’). 10.0 Terms of Building Licence/Transfer 10.1 The successful tenderer shall be notified in writing of acceptance of the tender, subject only formal Council approval (‘Notice of Acceptance’). 10.2 Within two months of the issue of the Notice of Acceptance and subject only to the receipt of outline planning permission by the successful tenderer the Building Licence will be granted by the Council to the successful tenderer in respect of the site. 10.3 The Building Licence will be for a period of 24 months , or if earlier until practical completion of all buildings, surfaces, landscaping, access roads and all other associated works necessary to comply with the planning permission granted for the development and the agreed specification, to the satisfaction of the Council (‘the development Works’). 10.4 The purchase price offered by the successful tenderer shall be payable on the grant of the Building Licence. 10.5 The successful tenderer shall take the site in its existing condition and shall undertake any remediation and redevelopment in accordance with plans, elevations and sections previously approved by the Council as vendor and for statutory purposes. The development of apartments / flats will not be permitted as part of the development. All dwellings are to be constructed to meet at least Level 3 of the Code for 5 Sustainable Homes, or comply with updated Building regulations and the Secured by Design standards. 10.6 The successful tenderer shall be responsible for any boundary walls and fences enclosing the site. Such walls and fences are to be built as specified in the approved planning permission and subsequently repaired and maintained to the Council’s satisfaction. 10.7 No assignment of the Building Licence shall be permitted. 10.8 During the period of the Building Licence the successful tenderer shall insure the Development Works for their full reinstatement value and covenant to reinstate fully or rebuild the case of any damage. 10.9 The successful tenderer shall indemnify the Council against all costs, claims, actions, losses, damages and liabilities which may arise from the development of the site. 10.10 The site shall be used for residential purposes only. 10.11 During the period of the Building Licence the Council shall have the right to enter the site in order to inspect the state and progress of the Development Works. 10.12 All other terms are to be as contained in the Building Licence and Transfer to be prepared by the Council’s Head of Legal Services. 10.13 Subject to the satisfaction of the terms and conditions of the Building Licence the Council will convey its freehold interest in the development site. 10.14 No structural alterations or additions to the development site shall be made without the prior written consent of the Council, as vendor, such consent not to be unreasonably withheld. 10.15 All open land forming part of the development site shall be maintained in a neat and tidy condition, free of rubbish, by the developer to the Council’s satisfaction. 11.0 Contracts 11.1 The Building Licence must be entered into within two months after the posting of the Notice of Acceptance, subject only to receipt of formal Council approval and planning permission. 11.2 In the event that the timescales are not met, the Council shall at its own discretion be at liberty to accept any other offer. 12.0 Completion 6 12.1 Completion of the Building Licence agreement shall take place within 14 days of the receipt of planning permission.
