APPROVED EXCLUSIVE RIGHTS OF SALE LISTING AGREEMENT By Realtors Association of Jamaica Affiliate Member National Association of Realtor I/We_________________________________________________________________________________________________________ Of __________________________________________________________________________________________________________ the person(s) legally authorized to sell or otherwise deal with the property hereinafter mentioned ( hereinafter called the “Principal”) hereby give you (hereinafter called the “Broker”) the exclusive and sole right as the only Agent or person to sell the property including chattels (hereinafter collectively called the “Property”) upon the terms and conditions hereinafter mentioned in the Schedule hereto. DURATION OF THIS AGREEMENT: A period of _________ days commencing __________________ and expiring ____________________ COMMISSION: (1) A commission of per centum of the sales price of the listed property and/or chattels plus GCT shall be paid by the Principal or his duly authorized Agent to the Broker, should the Broker or his duly authorized Agent introduce a person who completes the purchase of the property. (2) The commission shall also be paid to the Broker when an agreement of sale is executed at any time during the duration of this agreement between the principal and a purchaser not introduced by the Broker, meaning the commission is also payable notwithstanding whether the principal/vendor sells the property on their own during the period for which this contract applies. (3) Where an agreement is executed at anytime up to a period of three months after the termination of this agreement or any extension thereof by a purchaser introduced by the Broker, the commission shall be payable to the Broker. 4. 5. BROKER OBLIGATION AND AUTHORITY: The Principal shall make the property available to the Broker for showing at reasonable hours. The principal shall immediately refer to the Listing Broker all inquiries received independently of the Broker relative to the said property, as this is an exclusive right of sale listing, bearing in mind paragraph 4 (2) above. The Broker is hereby authorized by the Principal to deal with other real estate Brokers and/or sales persons as co-brokers in matters relating to the said property during the period of this agreement. The Principal shall not contract with other Broker and/or salespersons in matters relating to the said property without first consulting with and obtaining the consent of the Broker herein. The Principal hereby certifies that he is entitled by law to sell or otherwise deal with this property and the Principal irrevocably undertakes indemnity and hold the Broker harmless for any loss, damages and/or expenses that may result, whether directly or indirectly as a result of this certification stipulated herein. The Principal agrees to instruct his Attorney-at-Law to pay the commission plus GCT on completion and to insert a clause in the agreement for sale indicating the payment of the commission to the Broker. The Principal hereby acknowledges and confirms that the Broker’s right to the commission specified at Clause 6 (5) above shall continue and be enforceable and shall survive the expiration of this agreement. Broker agrees to make diligent and continued efforts to sell the property until a sales contract Is signed and deposit paid. The Principal authorizes Broker to: (1) (2) (3) (4) (5) Advertise the property at Broker’s expense as Broker deems appropriate. The Principal also agrees with the Broker to photograph the property and place a “FOR SALE” sign on the property. Place the property on the RAJ Multiple Listing to facilitate co-broking with other Broker. Present all offers to the Principal whether in writing or verbal in a timely manner. Assist with negotiations and prepare vendor’s net out sheet for vendor’s perusal. 8. CANCELLATION BY PRINCIPAL: In the event of failure to honour the undertaking as specified in this contract, the Principal and the Broker reserve the right to cancel this contract by giving Thirty days written notice to either party.
