Instructions to Tenderer :
1. The original tender booklet purchased from the office of the
S.E.(ANRC),Dist- A'nagar as notified for the work shall only be accepted as
a valid tender.
The tender form duly filled in and signed should be submitted to the office of
The Superintending Engineer,Old Power House, New Admn.Bldg.Station
Road,Ahmednagar 414 001.
2. The tenders will be opened on 29.08.08 at 16.00 hrs. (if possible) in the
presence of the tenderes or their authorized representatives, who may desire
to be present at that time.
3. The tender cover should be superscribed with “Releasing of Service
Connections by providing and fixing of required material for new
Residential & Commercial connections with meter installation in Sub
Divisions under Ahmednagar.
4. The total Estimated value of the contract will be as per the form 'A' enclosed
herewith. Amount as per Form 'A' should be deposited by the tenderer as
Earnest Money deposit.
5. The EMD should be paid in cash / by Demand Draft / in terms of Bank
Guarantee only. The D.D. should be drawn in the name of " Supritending
Engr. Circle Office, MSEDCL, Ahmednagar " on any Nationalized Bank
having branch at Ahmednagar. Or payable at Ahmednagar. Cheque will not
be accepted. Tender not accompanying EMD will not be accepted. Money
Receipt No. /DD No. and date should be clearly mentioned in Form 'A'
6. Rate should be quoted for in Rs./per conn. In figures & in words only in the '
Schedule ' attached. The rate and amounts should be mentioned clearly in
figures & words without scratches, corrections and overwriting.
7. The tenderer must return the form of tender with specific schedule, duly
filled in & duly signed. The tender not bearing Signature of contractor and
not accompanying all the documents will be rejected.
8. Rate quoted are deemed to include all charges, taxes, duties, royalties and
any other incidental charges payable by the contractor at instant of work.

General Terms and Conditions :
1. The EMD will be forfeited in case of successful tenderer who refused to
sign, complete the tender document, agreement bond and further to execute
the Tender within stipulated time period.
2. The successful tenderer has to pay ' Security Deposit ' ( SD ) @ of 5 % of
total work value against Security deposit in cash/ in the form DD drawn in
favour of Superitending Engineer, Circle Office, MSEDCL,Ahmednagar / in
the form of Bank’s Fixed deposit receipt for 18 months / in the form of
Bank guarantee along with Rs 200/- bond for making an agreement within 7
days from the receipt of this order immediately after the finalization of
tender. The S. D. will be refunded after satisfactory completion of total
works against work order.
3. All general terms & conditions laid down by the Company in the booklet
‘Tender & Contract ' for the work will be applicable to the contractor over
and above other conditions laid down here.
4. All the Tender bid shall be opened for acceptance by the Company for the
period of 120 days from the date of opening of the tender and tenderer shall
be bound to execute the contract on such acceptance.
5. If it is found that the quality of the work as well as performance is
unsatisfactory, the contract is liable for termination without giving any
notice and at the risk of contractor & the SD/EMD paid will be forfeited.
6. The undersigned reserves the right to accept or reject any part or all tenders
without assigning any reasons. Further the undersigned reserves the right to
divide the tender order and work to more than one contractor.
7. The tenderer shall be deemed to have studied the specifications and drawings
and all documents attached to the tender.
8. SSI Units : Offers of the SSI units shall not be considered for the
concessions applicable unless the unit is registered with Directorate of
Industries of the GOVT. for manufacturing the items tendered / offered and
have valid registration certificate up to date of the estimated completion of
the supplies.
9. MSEDC Ltd by concerned sectional officer will arrange shutdown for the
works as and when warranted on your written request in advance. However
it will be your responsibility to confirm regarding shut down, discharging
and earthing of lines before commencing the works.

10.This work is covered in this tender, which is to be completed as per time
bound limit.
11.The completion period of the contract is 90 days from the date of issue of
order er.
12.If you failed to execute the work within the stipulated time, a penalty of 1%
per week of delayed work will be charged to the maximum of 10% of the
order value will be recovered from your bill.
13.The SDO will issue the details giving Name of consumer, location, name of
village, name of DTC, estimate number, particulars of work and quantity to
be executed, etc. and value of individual work order. List of the consumers
given by S.D.O. should be submitted with bill.
14.The Company will provide only meters; you have to arrange rest of the
material at your own cost.
15.Material /fabrication to be used by the Tenderer should be of I.S. Standard
specification and & as per MSDCLtd approved & will be inspected by our
S.D.O. before execution.
16.You have to make your arrangement of storing, stacking , transportation,
Freight , packing ,& forwarding charges will be borne by you .
17.Permission for transportation / shifting materials in motor vehicle should be
taken from the RTO by you. The Company will not accept responsibility of
accident, damages to any property/material during transportation/shifting.
18.In the event of failure of execution of this order, the same will be got done
from other agency even at higher rates, the difference in amount +15% will
be recovered from your bills, pending in this office or any other office or
division.
19.You will have submit the weekly progress report of the works to this office
with a copy to concerned SDO.
20.Quality of work should be satisfactory as per Company’s method of
construction and should be carried out as per instruction of SDO or his
representative.
21.If the quality of work and performance is found unsatisfactory, the contract
is liable for termination without any notice and at your entire risk, in which
the SD paid by you shall be forfeited.
22.The contractor shall not entrust the work on sub contract, transfer or assign
the contract or any part there of to other party. In case it is not followed it
will be treated as breach of contract and will be terminated at contractor's
risk and cost.

25.The contractor should have his own workmen, tools and tackle, appliances
etc. that may be required for the proper execution of the work. The workers
should be well convergent with the work. In case of any accident to the
workers or outsiders during completion of work, the total responsibility lies
with the contractor and no compensation will be paid in any case.
26. All the risks under the regulations of Employment and welfare Act-1969, on
account of staff/labour employed by you will be on your account.
27. Contractor has to complete all formalities of Labour Contract Act 1970 and
its contractor.
28. You will have to submit works contract clearance certificate from the proper
authority before clearance of final Bill for this order.
29. Sales tax/VAT on material /fabrication supplied by you, local taxes, general
taxes, Excise duty, royalty, and any other incidental charges will be your
account. Income Tax & WCT will be deducted as per prevailing rules unless
the necessary exemption certificate from the Income Tax Dept. is produced
in time 4% VAT will be admitted in the bill and said should be given in the
bill. If which is included in rate & quoted by yourself.
30.The contractor shall submit his bill in triplicate for the completed 50 % work
to the Concerned Sub Divisional Officer for onwards transmission to this
office for payment, duly scrutinized & recorded in MB with certificate of
100 % check exercised by the section officer & SDO along with copy of
work order and material account through concerned S.D.O.
31.The measurement of work showing item wise quantities for work carried out
up to date, will be recorded by the authorised in charge of the work / area in
presence of your representative and you shall have to accept the same &
binding up on you.
32.Running and final bills submitted by Contractor will be paid by this office
within reasonable time limit & subject to the availability of funds.
33.On the basis of measurements the 95% of order value for which progressive
bill produced will be arranged till final bill will effect payment. Balance of
5% payment will be effected after satisfactory commissioning of total work
order.
34.Item which is made available by the Company other than Energy Meter, in
that case cost will be decided by undersigned & will be deducted from bill
accordingly.
35.You will not be entitled to claim for any alteration of work unless confirmed
in writing by the undersigned. The payment resulting thereof will be decided
mutually.

36.The works against this order will have to be guaranteed for the period of one
year from date of installation & commissioning.
37.You should obtain the signature of the concerned line staff or unit in charge
& signature of consumer or his representative after completion of work.
38. In case of any damage or loss to the Company's property, material etc., the
contractor will be responsible for the same and the cost of the same will be
recovered from the contractor. The loss due to misconnections to the meter
will also be recovered from your bill/S.D.
39. Attested copies /Documents to be enclosed in Envelope ‘I’
a. Valid contractor, supervisor license issued by Govt. Authority.
b. Valid income tax clearance.
c. Valid sales tax registration / VAT Registration..
d. Valid work contract certificate, labour license.
e. Experience certificate up to Rs 5 lakhs. In work of electrical/ similar
work.
f. Payment proof of EMD i.e. bid validity.
g. P.F. Registration if eligible.
h. Solvency certificate from Nationalized Bank for an amt. 25% of
Tender Amt.
i. Service Tax Registration certificate.
ii) Price bid will be submitted in envelop II and it will be opened after
fulfillment of documents in envelop I and any documents comes in
completed the right decistion will be take by undersigned.
40. If the tendered has any doubt about the meaning of any portion of the
specifications, he should submit the particulars thereof to the ' Executive
Engineer (Office) (in writing & the doubt may be got clarified before
submission of Tender).
41. The right to terminate or extend the period of this contract is reserved by the
undersigned.
42. Any dispute, arising out of or in connection with the contract, shall be
subject to the jurisdiction of the Ahmednagar Court only.

43. In case of any conflict in interpretation of any of the conditions of the
contract, conflict in the instruction, difference of opinion or any dispute, the
decision of the undersigned will be final and shall be binding on you.
44. No any material should be demanded towards the consumer. If any
evidence is observed, your contract will be terminated & S.D./EMD will be
forfeited.
