MSP compliance is undergoing major changes; e.g. revised MSP policies, implementation of
SMART Act and the new issue, Medicare Advantage (MA) Plans. Primary payers are
increasingly receiving “lien notices” from MA Plans. What are MA plans? Do they have lien
rights?

Mr. Eastes, Ms. Evans and Mr.Koonce will explain the administration of their organizations’
successful self-insured programs. They will cover their department’s relationship with the
organization’s medical doctors, communications with employees’ medical doctors, as well as
their department’s relationship with attorneys, line supervisors and safety department.
Each will also discuss the advantages to a company of self-insurance.

As the W.C. industry shifts away from broad networks and deep discounts, new metrics are
critical for evaluating provider practice patterns. Leveraging of medical and treatment data, the
effectiveness of the relationship with network partners and the communications between key
stakeholders, such as the physician, employee and adjuster, need to be appraised. Another
difficult question is, “When should the employer pay more than the fee schedule?’

Mr. LeFevre will speak of Occupational Disability Guidelines, which place reasonable controls
on utilization, while safeguarding access to quality care. The Guidelines do not cut price below
market. Companies who use them will attract good doctors, who practice evidence-based
medicine.

“Erosion by RICO of Exclusive Remedy of Workers’ Compensation”

Self-Insurers Association
Court decisions in recent years, allowing RICO to overcome the exclusive remedy of workers’
compensation, have been encouraging to claimants. Employers, however, recently achieved a
victory in the Sixth Circuit Court.
