2013 SUMMER RESIDENCE OCCUPANCY AGREEMENT

For University of Toronto Staff/Students
In consideration of the mutual covenants contained herein,
THE GOVERNING COUNCIL OF THE UNIVERSITY OF TORONTO the ("University") and
________________________________________(the "Resident") agree as follows:
1.
The University grants to the Resident a license to use and occupy a room (the "Room") in
the residence located at 75 St. George Street, Toronto, and known as Morrison Hall (the
"Residence") for a period (the "Occupancy Period") commencing on _______________ and
ending on ________________ unless terminated earlier pursuant to the provisions of this
agreement. The last day of the Occupancy Period or the Effective Date of Termination
under clause 15 is herein called the "Vacating Date".
2.
The Room shall be assigned to the Resident by the University College Summer Housing
Office (SHO).
3.
The Resident will pay a fee of either:
a) $2130.00 for a single room (the "Occupancy Fee”) for the sessional rate, or;
b) $700.00 for a single room (the "Occupancy Fee”) for the monthly rate, or;
c) $195.00 for a single room (the "Occupancy Fee”) for the weekly rate.
4.
The Occupancy Fee includes a food credit called “Dining Dollars” that can be used to
purchase food at Cafe Reznikoff at 75 St. George Street. The amount of this credit will be:
a) $350.00 for Residents who pay the sessional rate.
b) $80.00 for Residents who pay the monthly rate.
c) $20.00 for Residents who pay the weekly rate.
At registration, the Resident will be given a Dining Dollar card with a bar code to use to
redeem this food credit at Cafe Reznikoff. It is the Resident’s responsibility to use this food
credit before they vacate the residence. Residents will not be reimbursed for any food credit
that has not been used before they vacate the residence. The University is not responsible
for lost or stolen Dining Dollar cards. There will be a $10 service charge should the Resident
lose their Dining Dollar card and wish to have the balance of their food credit transferred to a
new card.
5.
The Resident wishing to vacate the room prior to the agreed departure date will give the
SHO a minimum of two weeks written notice. Residents who have paid the Sessional
Rate will have their rent recalculated at the monthly/weekly rate for the entire length of their
stay. Residents who have paid the Monthly Rate will have their rent recalculated at the
weekly rate for their entire stay.
6.
Any occupancy fee payments returned to the University by the Residents' banking institution
for non-sufficient funds will be subject to a penalty of $15.00.
7.
Residents will pay a late fee of $10.00 per day for rent not paid on time The Resident will
have his/her Occupancy Agreement terminated if he/she accumulates more than four days in
late penalties. The Resident will also have his/her Occupancy Agreement terminated if
he/she is repeatedly late paying rent.
8.
The Resident will present a current and valid University of Toronto student card on arrival.
The Resident will report any damage to the Room or the Residence to the SHO immediately.
The Resident will pay for the repair of any damage to the Room, Residence, or furnishings
thereof caused by him/her or his/her guest(s), normal wear and tear excepted. In the event
that the Resident fails to leave the room in a clean and undamaged condition on the
Vacating Date, the Resident will reimburse the University for the full cost of cleaning and/or
restoration of damaged items. If the Resident does not return his/her keys by the Vacating
Date, the Resident will be charged the cost of changing the Room's lock. If the Resident
does not pay outstanding rent or charges on the Vacating Date, the amount of this rent or
charges will be applied to the Resident's University of Toronto ROSI account.
9.
The Resident shall use the Room only as a private dwelling for her/himself and shall be
entitled to use the common facilities of the Residence together with the other residents so
long as she/he continues to occupy the Room and complies with the terms of the Agreement
and the Schedules hereto.
10.
The University will:

a)
provide the Resident with the furnishings listed on Schedule 7 until the Vacating
Date; and
b)
maintain the Residence in a reasonable state of repair and fit for habitation.
The Resident will:
a)
maintain the Room in a clean and wholesome condition and will not allow any refuse,
garbage or other objectionable material to accumulate in or about the Room or the
Residence;
b)
comply with the discipline policy, code of behaviour and rules and regulations
(collectively, the "Rules and Regulations" Schedule) and Guest Policy (the "Guest
Policy" Schedule), and Lock-Out Policy (the "Lock-Out Policy" Schedule), and
Smoking Policy (the "Smoking Policy" schedule), and Information Technology Policy
(the "Information Technology Policy" schedule), and Meeting Policy (the “Meeting
Policy” schedule) of the Residence as established and enforce compliance of the
same at all times by his guests and/or visitors; and
c)
respect and abide by the decisions of the SHO made pursuant to this agreement and,
respect and abide by the Rules and Regulations, the Guest Policy, the Lock-Out
Policy, the Smoking Policy, the Information Technology Policy, and the Meeting
Policy as published from time to time. The Resident acknowledges receipt of copies
of the current Rules and Regulations, Guest Policy, Lock-Out Policy, Smoking Policy,
Information Technology Policy, and Meeting Policy, as attached schedules to this
agreement, and further agrees that the posting of the Rules and Regulations, Guest
Policy, Lock-Out Policy, Smoking Policy, Information Technology Policy, and Meeting
Policy that are current for the time, in a prominent place in the Residence or the
delivery by hand or ordinary prepaid mail to the Resident at the Room shall be
deemed sufficient notice of same to the Resident.

a)
The Resident shall receive one set of keys for the Room upon arrival. The keys shall
be returned by the Resident to the University on or before the Vacating Date. The
Resident will not duplicate, or permit duplication, or be in possession of a duplicate of
the keys. If the keys are lost, the Resident will report the loss to the SHO
immediately. The Resident will then pay to have their room lock changed and the
keys replaced. If the Resident does not return their keys by the Vacating Date, the
cost of changing the Room's lock and replacing the keys will be applied to the
Resident's University of Toronto ROSI account.
b)
The University shall have the right to retain and use a master key, giving its
representatives access to the Room for the purposes permitted hereunder or by law.
The Resident shall not be in possession of a master key or any other key pertaining
to the Residence without the permission of the SHO.
c)
The Resident will not, under any circumstances, change the lock or add a lock or
locks to the door of the Room.
d)
After the Vacating Date, the University shall have the right to enter the Room and
change the lock without notice or liability to the Resident and without providing the
Resident with a key for the new lock. The University has no responsibility for any
possessions of the Resident or of any other person left in the Room or the Residence
after the Vacating Date. The University has the absolute right to dispose of such
possessions ten (10) days after the Vacating Date without any liability to the Resident
thereof.
The Resident will not:
a)
paint, decorate or redecorate the Room or Room Door without the consent of the
SHO;
b)
deface any wall, ceiling or surface of the Residence, including the windows, or
damage the Residence or its furnishings or permit his guests or visitors to do so;
c)
keep any open element or heating/cooling equipment in the Room or overload the
electrical circuits of the Room;
d)
make any alterations to the structure of the Room or affix anything to the walls or
ceiling thereof without the consent of the SHO;
e)
apply or affix anything to the exterior of the Residence;
f)
behave in a manner that will unreasonably disturb, annoy or interfere with the use or
enjoyment of the Residence by the other residents, or permit anything to be done or
kept in the Residence which will obstruct or interfere with the enjoyment or rights of
the other residents;
g)
commit or permit an illegal act to be committed in the Residence.
14.
a)
The University may at its option terminate this license upon the happening of any of
the following events:
(i)
non-payment by the Resident of any amount due to the University
hereunder;
(ii)
breach by the Resident of any other provision of this agreement, the
Rules and Regulations, the Guest Policy, the Lock-Out Policy, the
Smoking Policy, or the Information Technology Policy, as published
from time to time.
b)
In the event that the University exercises its option to terminate this license (i.e.
evict), the University or its designated official shall give written notice of such
termination to the Resident, which notice shall specify the effective date of the
termination (the "Effective Date of Termination"). The notice may be hand delivered
to the Room or slipped under the door of the Room, addressed to the Resident.
c)
Notwithstanding the early termination of this license, the Resident shall, at the option
of the University, be liable for payment of the full amount of the Occupancy Fee,
whether or not the Room is re-occupied or the Residence is filled.
15.
The Resident will vacate the Room and remove all possessions there from before noon on
the Vacating Date, and will have no vested right to occupy the Room in any subsequent
session.
16.
The Resident will not keep any firearms, fireworks, weapons, explosives, animals, fish, air
conditioners, reptiles, insects or birds in the Room or in the Residence.
17.
The Resident will ensure that all furniture received in Schedule 6 (Furnishings Inventory) will
be in the Room before the Room is vacated.
18.
The Resident will not assign this Agreement or sub-license the Room or any part thereof to
any other person or otherwise part with the possession or occupation of the Room.
19.
The SHO Manager or his/her designate shall be permitted to enter the Room during daylight
hours upon giving reasonable notice to the Resident and at regular intervals not more
frequent than monthly if previously announced to the residents, or at any time and without
notice in the event of an emergency or perceived emergency, in order to examine the state
of the Room, including the state of sanitation, safety and repair thereof, and to make such
repairs, changes or improvements to the Room and its furnishings as the University may
deem necessary or desirable.
20.
The University reserves the right, to be exercised by the SHO Manager, or his/her designate,
acting reasonably, to substitute another room in the Residence for the Room at any time
during the Occupancy Period, in which event the substituted room shall be deemed to be the
Room for all purposes hereunder and the Resident shall forthwith move to that other Room.
21.
It is agreed that there shall be no reduction of the Occupancy Fee or any other
compensation for or on account of any loss, damage, inconvenience or discomfort arising
from the interruption or curtailment, however caused, of any accommodation, facility or
service agreed to be furnished by the University.
22.
The University and its employees shall not be liable for any damage to the personal property
of the Resident or for any bodily injury to the Resident or to his/her guests, agents and
visitors, howsoever caused. The Resident will indemnify the University and its employees
against all liability in respect of any loss or damage occasioned by any act or omission of the
Resident, or of his/her guests, agents and visitors. Residents are solely responsible for
carrying whatever type of insurance coverage they deem appropriate for their person or
property. The University does not undertake to carry such insurance coverage.
23.
This Agreement and the Schedules attached hereto constitute the entire agreement between
the parties and there are no representations, warranties, collateral agreements or conditions
affecting the Room or this agreement except as expressed herein and except for the Rules
and Regulations, Guest Policy, Lock-Out Policy, Smoking Policy, and Information
Technology Policy, as amended from time to time.
24.
The Resident acknowledges that, during any prior stay at any residence at the University of
Toronto, his/her Occupancy Agreement was not terminated for violation of its provisions.
The Resident also acknowledges that he/she is not in arrears for non-payment of
occupancy fees at any residence at the University of Toronto.
25.
The Resident is aware that bed bugs have become a growing nuisance in Toronto. The
Resident will exercise due diligence to prevent bringing bed bugs with them into the
residence. The Resident will report any sightings or evidence of bed bugs in their room.
The Resident will cooperate fully with any treatment that is undertaken to treat and control
bed bug infestations, including, but not limited to, the possibility of having to change rooms
and properly clean all personal belongings.
26.
During seasonal periods of lower occupancy, the University of Toronto makes its residences,
which are primarily available to students and occasionally to staff, also available to members
of the travelling or vacationing public for short term stays. The terms of such temporary
occupancies are solely as set out in the Occupancy Agreement, which sets out the terms of
your contract, and which you should read carefully. Your occupancy may be terminated at
any time in accordance with the Occupancy Agreement and no ongoing rights are created by
the Occupancy Agreement.

Schedule 1
RULES AND REGULATIONS
Each Resident is required under the Rules and Regulations to preserve good order and to protect
the overall interests of the Residence and the safety, rights and property of individuals and the
property of the University.
Without narrowing the generality of the foregoing, the following acts are prohibited and may result in
one or all of the following measures: financial restitution, the suspension of privileges, and/or
termination of the Occupancy Agreement and removal from the Residence in accordance with the
Summer Residence Occupancy Agreement:
1.
The violation of any law, rule, order or regulation of any Federal, Provincial, or Municipal
Government, or the violation of any rule, regulation or policy of the University of Toronto or
the University College residences;
2.
Throwing or letting fall any object from the building;
3.
Tampering with fire equipment;
4.
Shouting from the building;
5.
Excessive noise;
6.
Defacing any wall, ceiling or surface of the building;
7.
Any form of vandalism, damage to the residence, or to the property of a fellow resident;
8.
Any form of harassment, or behaviour judged to be abusive or violent toward any member of
the Residences or Residence Staff;
9.
Possession of weapons or firearms of any class or kind;
10.
Possession of prohibited substances;
11.
Use of air conditioning units;
12.
Cooking in individual residence rooms.

Schedule 2
GUEST POLICY

It is understood that a Resident will NOT have any guests in the building between midnight and 8a.m. Should
guests wish to remain in the building overnight, they must rent their own room. Guests’ actions are the total
responsibility of the Resident and violation of the Residence Rules and Regulations by the Resident’s guests
constitutes an offence within the residence. It is understood that guests are not to be left unaccompanied by the
Resident in the Residence.
Schedule 3
LOCK-OUT POLICY
It is understood that it is the Resident's responsibility to have their keys with them at all times, in order to avoid
being locked out of their room or locked out of the residence building. If the Resident locks themselves out of
their room or the residence building, and requires the assistance of staff to get back inside again, then it will up
to the discretion of the Summer Housing Manager, or his/her delegate, to decide whether to charge the
Resident for this service.

SMOKING POLICY
Smoking is not permitted anywhere in the buildings, including residents' rooms. Outside of the residences,
smoking is also not permitted within five metres of the residence buildings.
Schedule 5
INFORMATION TECHNOLOGY POLICY
In order to gain access to the Residence Ethernet system, the Resident agrees to be bound to the University’s
policy on the Appropriate Use of Information and Communication Technology
(www.provost.utoronto.ca/policy/use.htm) and to University College’s policy (presented upon online Network
registration), and have a computer that meets the current security standards as set by University College
Computing Services. All computers connecting to the Network from the Residence must, as a minimum, be
kept up-to-date with all security patches, have an up-to-date anti-virus package, and refrain from the use of
peer-to-peer applications, the running of servers of any kind, and excessive or inappropriate use of the Network
and/or internet connection. The University cannot guarantee the Resident’s system will be able to access the
Network. It is the Resident’s responsibility to acquire the appropriate hardware and software for this. The
University is not responsible for damages and/or losses to the Resident’s equipment and data. The University
reserves the right to revoke and/or suspend/limit access to the Network for any reason, including, but not
limited to, violations of any of the above.
Schedule 6
MEETING POLICY
The Residences strive for a sense of community. Regular monthly meetings of summer Residents are held to
discuss issues of common concern. Residents have access to a trained Residence Don, who acts as a resource
for Residents and enforces community standards. Residents are expected to attend the monthly Residence
meetings and to meet with their Don within three days of moving in.
