STANDARD “AS IS” WARRANTY DISCLAIMER
WARRANTY:
This Boat, Trailer, Engine and Drive, (Boat Package) is being sold as is, where is, with no warranty,
expressed written or implied. The seller shall not be responsible for the correct description,
authenticity, genuineness, or defects herein, and makes no warranty in connection therewith. No
allowance or set aside will be made on account of any incorrectness, imperfection, defect or
damage. Any descriptions or representations are for identification purposes only and are not to be
construed as a warranty of any type. It is the responsibility of the buyer to have thoroughly
inspected the vehicle and to have satisfied himself or herself as to the condition and value and to
purchase based upon that judgment solely. Seller assumes no responsibility for any repairs
regardless of any oral statements about the Boat Package. Seller makes no guarantee or warranty,
expressed, written or implied of the vehicles ability to pass any third party inspection, prior to the
sale, during the sale and after the sale, and in the event it does not pass such inspection, no refunds
will be given to seller. Since it is impossible to inspect the interior parts of a boat, such as floor,
stringers, transom, or any other wood, fiberglass, aluminium part, and in the event an inspection
reveals damage to these components, then the seller is not responsible for refunds, credits, or any
payment to have these items repaired or replaced.
30 DAY WARRANTY:
Some boats qualify for a 30 day powertrain warranty. This warranty is offered by Five Star Boat
Center, and boat must be returned to us for service. We will not pay another dealer to provide
warranty service. Warranty coverage is limited to Powertrain FAILURE. Which includes the
engine and drive only. Coverage by us is provided only after we inspect the problem and
determine that it falls under a warranty issue and not abuse or neglect. All boat components
including electrical and fuel systems are not covered.
VEHICLE INSPECTION:
Five Star Boat Center and it's representatives have made every effort to accurately and fairly
describe the Boat Package to you and disclose any known information regarding the Boat Package.
When purchasing a USED boat, that is exactly what it is, USED and repairs to it should be expected
to it by you the customer. Remember this is a USED boat and anything at any time can go wrong
with it, if you would like to purchase a NEW boat with a warranty, we sell those to. We cannot be
held accountable for every little light, switch, pump, battery, radio, gauge or door hinge etc. that
may be bad or missing on a vessel. Other than a compression test, we do not check ANYTHING ELSE
on a used boat. It is up to you the buyer to inspect it yourself, or have it inspected by a third party
prior to purchase. We will have all 12 volt items working at the time of demonstration/pick up.
However once you take possession of the boat, again, it’s USED and anything at any time can go
wrong with it. Please read carefully about each individual boat. Also, please note that any trailers
that come with the boats are also sold AS IS. If a trailer needs tires, hubs, lights, bearing, axles or
anything else you will need to do the necessary repairs to make the trailer road worthy. On a good
note most trailers and vessels are in good overall and fair condition. Five Star Boat Center will not
be held responsible to provide any additional items other than represented as with the boat unless
detailed in writing by an authorized representative. Five Star Boat Center welcomes and
recommends an independent inspection of the boat, trailer and powertrain prior to purchase. All
costs and arrangements for such inspections are the responsibility of the buyer. All inspections are
to be performed on premises. Five Star will review any issues or concerns that develop as a result of
an inspection prior to the sale and Five Star will make repairs, adjustments or concessions at their
sole discretion.
Fuel in used boats
We do not check fuel in used boats. The fuel could be new or old. It is recommended that you use up any
fuel in the tank and fill with fresh fuel as soon as possible. During your demonstration ride, if the engine
misfires and or runs poorly, this must be reported to us prior to delivery. We will make every attempt to
make the engine run as well as possible without replacing any parts. Carburetors: Can run very well or
perform very poorly, again, you are purchasing a used boat and a carburetor can fail at any time.
Specific purpose
We do not gaurentee seaworthiness, or that the intended product, in this case a boat, can be used
for it’s intended purpose. Seaworthiness is to be determined soley by the buyer prior to purchase.
Brokerage boats
Seller, Five Star Boat Center, is only acting as a transfer agent between the buyer and seller of the
boat. We have no inspection process on a brokerage boat, and we recommend getting a third party
inspection prior to purchasing the boat. Any claim is to be taken up soley with the seller of the boat,
and not Five Star Boat Center.
