The Hamburg Shipbrokers Association is circulating
their recently unveiled Hamburg Ship Evaluation
Standard (HSES). It was designed to determine the
value of a ship on the basis of its long-term earnings
potential with the assessment specifically tailored to
dysfunctional markets and irregular market conditions.
Their press release noted that the global financial crisis
has caused a virtual standstill in the main segments of
the S&P markets, causing ship valuators, S&P brokers
and value appraisers to virtually halt valuations of
vessels in various market segments. The small number
of transactions concluded in these segments and the
number of forced sales would not be representative in
accordance with traditional determinations of market
value. The HSES creates a Long Term Asset Value
(LTAV) describing the value of a ship beyond the shortterm market fluctuations. The HSES does not aim to
replace standard evaluation methods based on the rules
of shipping banks or governing legislation used during
normal activity. Instead, the LTVA approach can be
used as an additional value assessment method during a
normal shipping market conditions. During periods of
irregular market conditions it will provide a conservative unbiased and statistically proven approach to assist
in obtaining representative figures. The HSES is available in the office, email us if you would like a copy.

The following information was received at the meeting of
the National Association of Maritime Organizations in
Washington, D.C. last week.
The Economic Stimulus Bill approved by the Congress
and signed by the President this month included a number
of appropriations for maritime: Port Security Grants, State
Highway Programs, Discretionary Transportation Grants,
the Corp of Engineers including $1B for maintenance
dredging, the National Oceanic and Atmospheric
Administration (NOAA) and Build America Bonds for
Port Authorities.
Right Whale Ship Strike Reduction Rule is in effect.
All vessels greater than or equal to 65 ft. in overall length
and subject to the jurisdiction of the United States and all
vessels greater than or equal to 65 ft. in overall length
entering or departing a port or place subject to the jurisdiction of the United States must slow to speeds of 10 knots
or less in the designated Seasonal Management Areas:
Feeding Areas
Cape Code Bay - January 1 - May 15
Off Race Point - March 1 - April 30
Great South Channel - April 1 - July 31
Migratory Route & Calving Grounds - Mid-Atlantic
November 1 - April 30
Calving & Nursery Grounds - Southeast U.S.
November 15 - April 15

TWIC - Update
USCG is charged with enforcement of the TWIC. The Coast
Guard will utilize the MTSA Security Check and/or US Flag
Inspections (announced, unannounced or as warranted). The
Captain of the Port is to establish enforcement guidelines at
their port. Please be aware that TWIC enforcement at the ports
will again present serious issues for the seafarer. Seafarers cannot be issued a TWIC since they are not U.S. citizens which
means that they will require an escort when moving through
designated secure areas of the port. Establishment of escort
requirements have been transferred to the facilities and the
Coast Guard has issued guidance through a NVIC. All TWIC
holders are reminded to make note of your 6-8 digit pin number.
If you forgot your pin, you will have up to 10 incorrect
attempts. If you are unsuccessful, you will need to secure a new
card, which is at the TSA’s expense. Card holders should not
surrender their old card until you have your new one.
