PARTICIPANT LIABILITY RELEASE
I,_________________________ [Name], hereby acknowledge that I will be participating in DC Shoes, Inc.
and Mammoth Mountain Ski Area LLC’s Hit and Run Contest presented by DC Shoes, Inc. (“DC”) and Mammoth
Mountain Ski Area LLC (“MMSA”) held in and around Mammoth Mountain, California on February 28 and February
29, 2016 (the “Event”).
In consideration of the right to participate in the Event, which I acknowledge is good, valuable and sufficient
consideration, I hereby agree as follows:
1. I understand and acknowledge that snowboarding, skiing and related activities are hazardous and the risk of injury
from the activities involved in the Event is significant, including the potential for permanent paralysis and death, and
while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury or death does
exist. I have made a voluntary choice to participate in the Event in spite of the risks involved.
2. I acknowledge that DC Shoes, Inc., its parent, affiliates and their respective officers, directors, shareholders,
representatives, agents, and employees and each of them (collectively, “DC”) and any other sponsors or cosponsors, promoters and host(s) (“Other Releasees”) of the Event, have not and do not assume any liability for any
injury, damage or loss of any nature whatsoever which may occur as a result of my participation in or attendance at
the Event.
3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM
THE NEGLIGENCE OF OTHER PARTICIPANTS, ATTENDEES, OTHER RELEASEES or others, and assume full
responsibility for my participation, and I willingly agree to comply with any stated and customary terms and conditions
for participation. If, however, I observe any unusual significant hazard during my presence at the Event or involved
with my participation, I will remove myself from participation and bring such to the attention of the nearest official
immediately.
4. I hereby forever release and promise not to sue DC or the Other Releasees for any direct or indirect claims,
demands, causes of action, losses, expenses, costs or liability of any nature whatsoever which I or my heirs or
assigns may hereafter have for any loss, damage, injury or death against any of them arising out of or in connection
with the Event.
5. I irrevocably grant to DC the right to photograph and video me and the right to use my name, likeness, portrait,
recorded voice, addresses, photographs, film and video in advertising, marketing, product packaging or other uses,
without compensation and without restriction as to duration, geography, media or frequency. In the event of any
dispute arising in connection with my participation in the Event, any such disputes shall be governed by California law
and must be brought in the state or federal courts located in Orange County, California and I hereby submit to such
jurisdiction.
6. If any provision in this Release is held to be invalid by a court of competent jurisdiction, the balance shall,
notwithstanding, continue in full force and effect.

MEDIA CONSENT AND RELEASE
I,_________________________ [Name], hereby grant to DC Shoes, Inc. (“DC”), its parent,
affiliates and their respective licensees, successors, affiliates and assigns, and any sponsors,
promoters or hosts (herein collectively called the “Licensed Parties”) of DC Shoes, Inc. and
Mammoth Mountain Ski Area LLC’s Hit and Run Contest presented by DC Shoes, Inc. and
Mammoth Mountain Ski Area LLC held in and around Mammoth Mountain, California on
February 28 and February 29, 2016 (the “Event”) the absolute right and permission to
photograph, tape, video and/or film me and to use, (including for all marketing purposes such as
in-store signs (POP), marketing brochures, website images and advertisements of any kind)
publish, broadcast, webcast and copyright my voice recording, name, picture, and likeness, or
any material based upon or derived therefrom, or to refrain from so doing, in any manner or
media whatsoever for purposes of advertising or trade in promoting and publicizing the Event
and/or for all purposes of advertising, marketing or trade in promoting any of the DC brands and
for historic use, without restrictions as to geographic distribution, frequency or duration of use.
I agree that any voice recording, picture or likeness of me, or anything derived therefrom
created by the Licensed Parties is owned by the Licensed Parties and hereby waive all
ownership rights, title and interest and all rights to compensation from them. If I should receive
any print, negative, or other copy, I shall not authorize its use by anyone else.
I shall have no right of approval, no claim to any or additional compensation, and no claim
(including, without limitation, claims based upon invasion of privacy, defamation, or right of
publicity) arising out of any use, alteration, distortion, or illusionary effect, or use in any
composite form.
I agree that this release does not in any way conflict with any existing commitment on my part.

EMERGENCY AUTHORIZATION: I, the undersigned parent or legal guardian of the above minor, hereby authorize DC Shoes,
Inc., its parent and affiliates (“DC”) and/or the above-identified Emergency Contact/Chaperone to act as my agents in the capacity
of activity supervisors and vehicle drivers, and to consent to medical, surgical or dental examination and /or treatment.
DISCLAIMER, ASSUMPTION OF RISK AND WAIVER: I, the undersigned parent or legal guardian of the above minor, for
myself and on behalf of the above minor, our heirs, assigns and next of kin (“I”), acknowledge that participation in DC Shoes, Inc.
and Mammoth Mountain Ski Area LLC’s Hit and Run Contest presented by DC Shoes, Inc. (“DC”) and Mammoth Mountain Ski
Area LLC (“MMSA”) held in and around Mammoth Mountain, California on February 28 and February 29, 2016 (the “Event”)
involves participation in inherently dangerous activities (often in adverse conditions), physical contact and risk of severe, permanent
physical injury including brain damage, nerve and spinal cord injury, paralysis and death. For myself, and on behalf of the above
minor, our heirs, assigns and next of kin, we willingly and voluntarily accept and assume all such risk.
In consideration of accepting and permitting the voluntary participation of the above-named participant in the Event, I hereby
forever release, discharge and agree to hold harmless DC, its parent, affiliates and their respective officers, directors, employees,
volunteers, officials, sponsors, agents, partners, contractors and other representatives from any and all damages, claims, demands,
costs, expenses and compensation arising out of or in any way related to any injury, physical or otherwise, or other damage that
may result to said participant in connection with the Event.
ACKNOWLEDGEMENT AND CONSENT: I acknowledge that DC may compile and use the name, likeness, recorded voice,
addresses, photographs, film and videos of the named individual in advertising, marketing, product, packaging or other use, without
compensation and without restriction as to duration, geography, media or frequency. I consent to such uses and hereby waive all
rights to compensation.
I HAVE READ THE ABOVE EMERGENCY AUTHORIZATION, DISCLAIMER, ASSUMPTION OF RISK AND
WAIVER, AND ACKNOWLEDGEMENT AND CONSENT AGREEMENTS, FULLY UNDERSTAND THE TERMS OF
EACH, UNDERSTAND THAT I AND THE ABOVE PARTICIPANT HAVE GIVEN UP SUBSTANTIAL RIGHTS BY
MY SIGNING THIS FORM AND AGREEING TO THESE TERMS, AND I SIGN THIS FORM AND AGREE TO THESE
TERMS FREELY AND VOLUNTARILY AND WITHOUT INDUCEMENT FOR MYSELF AND ON BEHALF OF THE
ABOVE PARTICIPANT.
