SECOND BAR MATERIALS PURCHASE AGREEMENT
PAYMENT INFORMATION:
DISCLAIMERS AND LIMITATION OF LIABILITY:
The total financial obligation of the product is due and payable prior to receipt of any
materials. This product is only available to those already enrolled in and paid in full
for a BARBRI bar review course for the same review session. The one-time purchase
fee provides full online access, where applicable, and printed second bar materials
for your selected state. Online access to the material remains active for the winter
course until March 2016 and for the summer course until August 2016.
You acknowledge that BARBRI owns all rights, title and interest in and to all materials,
all of which are protected by copyright laws and shall not be shared, sold, copied,
recorded or reproduced by you by any means for any purpose.
BARBRI MAKES NO WARRANTY OR REPRESENTATION AS TO THE SUITABILITY
OR QUALITY OF ITS SERVICES OR MATERIALS AND EXPRESSLY DISCLAIMS ALL
LIABILITY FOR ANYTHING DONE OR OMITTED IN RELIANCE UPON ITS SERVICES
OR MATERIALS. YOU SHALL HAVE SOLE RESPONSIBILITY FORFULFILLING ANY
REQUIREMENTS OR ACCOMPLISHING ANY OBJECTIVES FOR WHICH YOU
PURCHASED ANY OF BARBRI’S SERVICES OR MATERIALS. BARBRI EXPRESSLY
DISCLAIMS, AND YOU HEREBY EXPRESSLY WAIVE, ALL IMPLIED WARRANTIES
OR REPRESENTATIONS, INCLUDING WITHOUT LIMITATION, ANY WARRANTY
OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. TO THE MAXIMUM
EXTENT PERMITTED BY APPLICABLE LAW AND REGARDLESS OF WHETHER ANY
REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL PURPOSE, IN NO EVENT
WILL BARBRI BE LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT
OR SIMILAR DAMAGES EVEN IF BARBRI HAS BEEN ADVISED OF THE POSSIBILITY
OF SUCH DAMAGES. IN NO CASE SHALL BARBRI’S LIABILITY EXCEED THE
AMOUNT OF $250

GUARANTEE INFORMATION:
By purchasing a second bar add-on, you acknowledge this material is an add-on
to your primary course. As such, you are entitled to a free guarantee enrollment in
the “add-on” state, ONLY if you sit for, and are unsuccessful on, the exam in your
“add-on” state.
COPYRIGHT:
You may not assign this contract or any of your rights hereunder.
DEFAULT:
If you default on any part or all of your obligations arising from this contract, you are
liable for all losses suffered by BARBRI in connection with such default, including,
but not limited to, attorney’s fees and court costs. BARBRI also reserves the right
to terminate your enrollment for any reason, and to report any violations to your
state bar association and/or other professional associations in which you may be
a member.
CANCELLATION AND REFUNDS:
You may cancel your enrollment before midnight of the third business day following
the date of this contract by delivering a written request for cancellation to the BARBRI
office administering your course and receive a full refund of all payments made,
provided you have not been shipped course materials and have not had access to
any online course content. You may not cancel your enrollment once you have been
shipped course materials or had access to any online course content. BARBRI will
issue a refund of all payments made less shipping and handling. All refunds will be
issued within 75 days of BARBRI’s receipt of your written notice of cancellation.
This contract constitutes the agreement between BARBRI and you and supersedes
any previous communications, representations or agreements regarding a second
state bar review between you and BARBRI (including, without limitation, any BARBRI
student representative), whether oral or written. These terms have no bearing or
impact on the agreement between BARBRI and you for your primary bar review
state. Representations, whether oral or written, made by any person, including a
BARBRI student representative, that purport to modify any term of this contract,
shall be of no effect. If any term or provision herein is determined to be illegal
or unenforceable, the validity or enforceability of the remainder of the terms or
provisions herein will remain in full force and effect. Your failure to exercise any of
your rights under this contract will constitute or be deemed a waiver or forfeiture of
those rights.
