TRIAL ADVOCACY AT LOYOLA LAW SCHOOL Many alumn i (ae) are onl y casua lly awa re of the substa ntia l changes w hich have been made in the curriculum at the Law School in recent years. In the last issue of the Loyola Lawyer the Cl inical Program was featured. In this issue we focus on the Tria l Advocacy Program. From time to lime we will present additional articles on the tra ini ng of Loyola Lawyers. Frederick }. Lower, Jr., ' 64 Dea n Trial advocacy plays a sign ificant role in the curriculum of the Loyola Law School. In furtherance of its commitment to the concept of teaching Trial Advocacy, several years ago two new courses were instituted: " Civil Trial Advocacy" and " Criminal Trial Advocacy." Both are three credit courses and are limited in enrollment to 25, thereby insuring a high degree of personal attention. Both courses have been extremely well received by students and faculty. By offering four sect ions of eac h course, some 200 students are able to benefit from this advocacy trai ning each year. It should be noted at the outset that many law schoo ls wh ich have an advocacy program do not sp lit C ivil and Crim in al but teach one generalized "Trial Advocacy" course. Loyola makes separate courses available on the th eory that by the time students take these courses, usually in their fina l year of law school, they have formed a specific interest in either " civi l" or " criminal " practice. Civi l Tri al Advocacy is designed to analyze all aspects of the Civ il Trial, including preparation for trial, settlement negotiations, the voir dire, jury selection tactics, opening statement, order of proof, direct and cross exam ination and closing argument. Students participate in simulated trial sessions, wh ich are videotaped for later critique. Evidence is a prerequ isite for the course. Students are assigned individual cases to "try. " O ne professor utilizes a critique form, two copies of wh ich are handed out to each student. The forms are filled out in duplicate by the entire class for each student w ho handles a case. O ne copy is given to the professor (the cri tiques aa th emse lves graded, in add ition to court perf. ) mance), and the other copy from each observi ng student is given to the student lawyer for that session. The students not on tria l must also submit a written strategy for each trial after reading all transcripts, etc.; consequently the critiques are usually qu ite extensive. Students Parti cipate in Trial Advocacy I Advocacy Courtroom with Videotape Equipment Which Provides Students the Opportunity to Instantly Their Courtroom Manner. .-..... 0 """ Another professor has the students prepare factual situations usable as potential assignments. In fact, a third professor gives a final exam which utilizes "mi ni tran scripts." Professors also use outside guest lecturers in specialized areas such as commercial litigation and malpractice. For example, in a session on va luation of property, Roger Sullivan, Esq., '52, was a guest along with Robert Beeney, an apprai ser, and Judge Alexander Early, Ill, so that students were able to examine and cross examine with a real judge ru li ng. In addition to "trial practice" ski lis the course also raises questions of ethical conduct by counsel. The above, along with advice, direction and conferences with the professors in conjunction with video tape playback are responsible for a very high degree of improvemen t for a student during the course of the semester. The Criminal Trial Advocacy course offers students an opportunity to participate in a "mock" criminal trial, including pre-trial mol)ns, voir dire, opening statements, direct and uoss examination of witness (including experts), closing arguments, jury instructions and sentencing, with emphasis upon strategic and tactical considerations. As with "Civil Trial Advocacy," trial sessions are video taped for critiques. A factor which makes this course particularly beneficia l to the stud ent, and a feature which is indeed unique to Loyola, is that this course is a prerequisite for the Di stri ct Attorney Clinical Practicum. In the clinical program students are assigned to various branches of the Los Angeles District Attorney's office. Under the supervision of a trial deputy, students prepare and present misdemeanor jury and non-jury cases as well as conduct preliminary hearings in felony cases. In recognition of the importance of trial advocacy to the overall training of a lawyer, Loyola Law School constructed a Trial Advocacy Courtroom. The Trial Courtroom, which is in addition to and a separate facility from the Moot Courtroom, has been provided wi th a remote controlled video-audio recordin g and playback system. Each course therefore can successfully use "simu lation" as a basic teaching tool. The above efforts in terms of curriculum, faculty and facilities are one very good reason for the high degree of competence exhibited by the Loyol a Lawyers now being graduated. St. Thomas More Society The St. Thomas More Law Society is organized to con sider and discuss ethical, moral, social , and political problems of interest to the legal profession, and to provide service to the law school. The Soc iety sponsors forums in which current topics are explared , and conducts a guidance program for first year students. At the annual Medallion breakfast th e Society awards the St. Thoma s More Law Soc iety Medal! ion to a member of th e profession who has made an outstanding contribution to society, the legal profession or the law school. Membership in the Society is by invitation to qualified advanced students. Diane Holman, President of the Law Honor Society, is pictured presenting the St. Thomas More M edallion to Judge Hufstedler for her d istin guished service in the legal and judicial profession. oyola University School of Law of Los Angeles Program of Continuing Legal Education The Facu lty and Adm inistrati on of the Law Schoo l are keen ly aware of both the rap idl y changing needs of the lega l profession and the demands being made on legal ed ucation. In 1974 a comm ittee of facul ty, alumni , practicing attorneys and students studied the need for a program of continuing legal education, the ro le Loyola Law School could play in sati sfying that need and the demands such a program would make on the resources of the school. The committee was c haired by Professor Gerald F. Ue lmen. Based on the comm ittee's findings and recommendations a decision was made to undertake a pilot program of continuing legal education commencing in the Fall 1975. The financial support needed to begin the program was made available through the generosity of the donors to the annual Advocates fund drive. \n the Fall, 1975 two courses were offered: - 1 e Prosecution and Defense of Drug Cases" and " Cali fornia Land Use Control. " Seventyfive attorneys fro m Los Angeles and Orange County attended the courses w hich were conducted at the World Trade Center. For the Spring semester, 1976, over 200 attorneys have enrolled in : • International Business Transactions • The New Californ ia Genera l Corpora tion Law; A Transac ti onal Analysis • Psychiatry for the Cri minal Lawyer • How to Open, Maintain and Operate a Sma ll Law Office. Loyola Law Student Partners' Association Sponsors Casino Night Casino Night sponsored by the Loyola Law Student Partners' Association was held on the LMU campus in estchester on Saturday, january 17, 1976. The Loyola Law Student Partners' Association contributes two scholarships awarded to one married day student and o ne married evening student. David Tripp Wins National Lawyers' Art Competition David E. Tripp, Class of 1973, won first prize in the 1975 West Publishing Company's national lawyers' art competition with his multimedia work, " The Law: Key to Freedom." Mr. Tripp won $5,000 of the total $15,000 that was awarded in prizes. His winning work appeared on the cover of the july 1975 issue of the American Bar Association journal. Mr. Tripp stated that "the emphasis on the Su preme Court and its justices flows from my feeling that the interpretation of law is more important than the legislative process behind it." His work depicts Judge Roy Bean because he brought law and order to a then lawless land, civil ri ghts marchers carrying the flag to represent the significant changes that they instigated, and Sacco and Vanzetti and the Scottsboro boys because of their notoriety and to demonstrate society's vow not to allow that kind of loss of rights aga in. The West Publish ing Company, located in St. Paul, Minnesota, sponsored the competition in observance of the American Bicentennial, as well as the West Publishing Company's Centennial. Rai sed in Da llas, Texas, David Tripp was . ) couraged in hi s drawing by his parents. ~ graduated from North Texas State University and attended the Art Center College in Los Angeles. He then trave lled through Eu rope by earning his way as a portrait artist. After returning to Oxnard to work, he commu ted to Loyola Law School at night and received his j.D. in 1973 . He then worked in private practice before joining the Los Ange les County District Attorney's Office. H e lives in Los Angeles with hi s wife, Barbara, and three smal l sons. Thomas Girardi practices with the firm of WEST AND GIRARDI OF LOS ANGELES. @ acuity and Administration Briefs FATHER RAYMON D DECKER, Assistant Dean for Admissions, was invited by Ahmad Khalifa, a prominent Egyptian juri st, to attend a symposium in Aswan, Egypt, during January 1976. Dr. Khalifa, w ho is Chairm an of the Board of the National Center for Social Research, in Egypt met Father Decker w hi le he wa s visiting Loyola Law School th is past Fall. Father Raymond Decker Twenty legal scho lars throughout the w orld were invited to the symposium to add ress Egypr~n legal scho lars and to make legal reco.mmendations to th e Egyptian government wh 1ch is in the process of changing its legal code. Father Decker was the only invitee from the United States. He spoke on the c hanging role of American Penal Laws and his address show ed the relati onship between religion and penal law in the United States. He said, "What has taken place in Anglo-Ameri can penal law over the past 170 years has been somethin g more than analytical descripti ons - it is something deeply embedded in th e socio-religious hi story of both Great Brita in and the United States that w e can call the entelechy of secularization . Thi s process is in effect changing th e very role of the penal law in An glo-American society. W hereas once the penal law was looked upon as the enforcer of the prevailing religious ethic, it is now becoming the necessa ry protector of social adhesiveness by serving as the arbiter between conflict ing philosophies and value structu res. Through this reciprocity, involving at its root the process of secularization, the penal law has ~een assuming less and less the role of the \ '. nforcer, and more the role of the arbiter." Father Decker said after his visit that Egypt is con cerned with their penal code and w ants to L researc h the examples of other cou ntries. Their major concern is how the penal law could prevent crime. Father Decker is completing hi s second year as Assistant Dean for Admi ssion s at Loyola Law School and hold s a Ph .D. in Religion and Law. He is a diocesan pri est who came to Los Ange les from San Francisco. RO BERT BE NSON is the author of a regu lar column in the journal of the American Bar Associati on entitled "Wine Briefs." The column began in january 1976 and is devoted to providing knowledge concern ing the legal context of w ine prod ucts and regulations of w ine prod uction. STEVEN H IRSCHTICK conducted a lecture for the American College of Rad iology in Las Vegas in january and w ill conduct a similar lecture in New Orleans in O ctober. H is topic w i II concern the profession al corporations and pension p lans. Mr. Hi rschtick is Vice Chairman of the Lega l Aid Comm ittee and is a member of th e Committee on Corporate Stockholder Relation ships of the Section of Taxation for the American Bar Associati on. GID EON KAN NER has received a grant from the Institute for Humane Studi es to work on an article on constitution al limitations on land use regulation. Professor Kanner also participated in the fi rst Urban Land Institute Conference sponsored by the Un iversi ty of San Diego School of Law in February.
