Foreword
I am delighted to note that commensurate to our vision statement
of giving an efficient, effective, transparent and quality service to the
citizens, the Licence Department has prepared this book which has
been aptly named “Trade Licence Demystified”. Our legacy of
obfuscated procedures, mystified modalities of fixation of rates and
thereby creating an atmosphere where the common citizens faced
harassment. Our continuous endeavour is to have a paradigmatic shift
in Corporation tax-payers interface by introducing simple procedures.
It is imperative that any tax structure should be simplified and
comprehendible by a man of ordinary prudence. Mitigation
of
bureaucratic procedures would encourage citizens to be more and more
tax compliant and it has been our motto to reduce the rate and widen
the net. Keeping in conformity with the said motto, we have this year
reduced the trade licence rates and over the past few years have
simplified the procedures and has tried to put in place an objective tax
structure.
I hope this book shall pave the way to lift the veil of secrecy and
obfuscation in the entire Trade Licence Department. We always assure
the citizens of providing best of our services and we stand by our

Message
We are pleased to know that the new formatted trade licence schedul e is
being issued. Over the years there has been an increased demand for newer,
advanced and an up -to-date schedule.
In keeping with these demands and the proactive -ness of the Corporation’s
departments, we are now ready with the new schedule. The task f or bringing out
this schedule has not been an easy one. The various departments and the
personnel concerned have put in a painstaking effort to make this possible. It is
one more example of KMC’s initiative bearing the desired result.
We do hope that this schedule would provide an impetus to the trading
communit y within Kolkata. Our unstinted and never -ending support to the
citizens of the cit y drives us to reach for higher goals in all our endeavours.

Preface
Over the years, it has always been the endeavour of the Kolkata Municipal Corporation to provide
value-added services to the citizens of this city. We have been constantly upgrading the facilities we offer in
such a way that the common man can also comprehend the same. It is in this context that we are introducing
a number of practical and customer-friendly measures in one of the most important departments within the
Corporation - that of the Licence Department.
For the first time within the annals of the Licence Department, the process of computation of licence
for any particular trade has been simplified to a large extent. The reason for this being that even a common
man of ordinary prudence can comprehend himself the process of computation of demands for issuance of
any new C.E.S as well as for its renewal without any external assistance. It has been felt by us that any
person should be able to easily comprehend the assessed demands for new C.E.S/renewal that the whole
licensing system which includes issuance of new licences, renewals, etc. as introduced in the budget schedule
of 2004-05 should meet the aspirations and expectations of the business community as well as the small
traders of Kolkata.
There has also been a demand for the pruning of unnecessary schedules and it is keeping this in
mind that we have slashed the schedules of over 700 traders to 167. Traders having similar characteristics
have been clubbed together to simplify the whole process. Schedules have been streamlined and the past
tendency of charging different rates for a same or identical nature of trade at different offices of KMC is
avoided. New trades, which have sprung up, have also been included in the schedules for the first time.
Inherent anomalies as evident in the method of assessing charges U/S 419, 421, 435 and P.F.A on
the basis of rent have been removed with the introduction of charges being assessed on the basis of area
which is a new concept in this year's schedule. The rates for this year have been rationalized after we have
received the views of different sections of traders. We sincerely hope that all traders will enlist their trades
voluntarily to avoid prosecution U/S 580 & 620 of the KMC Act of 1980.
We do believe that these steps will go a long way in simplifying the processes involved and the
grievances of the traders will be met to a large extent. We look forward to a constant feedback from all of
you to ensure that the systems are in place for us to serve you better.

CERTIFICATE OF ENLISTMENT (TRADE LICENCE)
Introduction
Every person engaged or intending to be engaged in any profession, trade or calling in Kolkata
Municipal Corporation area shall obtain a Certificate of Enlistment (Trade Licence) and get the same
renewed annually. Primarily the C.E. attracts section 199 of the K.M.C Act 1980. However, in addition to
that Certificate of Enlistment (Trade Licence) also attracts the following allied sections of the
K.M.C.Act1980 as applicable in the schedule.

If a trader fails to renew his C.E. (Trade Licence), he may be prosecuted in the court of
M.M (Municipal Magistrate).
PROCEDURE FOR OBTAINING C.E (Trade Licence)
Trader intending to obtain a C.E. has to apply in the application form, which may be obtained
from any counter of Licence Department on payment of Rs.5/-.

Since 2003-2004, K.M.C. has introduced a new scheme for obtaining Licence within a day under
Green Channel.
At the time of issuing licence under Green Channel:




No inspection is made.
Inspection is made after issuance of the C.E(Trade Licence).
At the time of inspection, if it is found any wrong or false information supplied in the
application or in any of the supporting documents enclosed, the C.E. (Trade Licence) will
summarily be cancelled and penal measures will be taken.
The applicant is required to submit a declaration in plain paper as per annexed proforma
along with the APPLICATION FORM.
N.B. Under this scheme of Green Channel, the applicant is required to pay the fees/charges in cash/ by
Bank Draft/Pay Order only (Payment by Cheque is not allowed).
Trades under Green Category are those, which are outside the purview of Red Category of
trades (33 nos. trades which are appended below).

For the above mentioned Trades under Red Channel, the C.E(Trade Licence) would be issued
after subsequent inspection.
REQUIREMENTS FOR ISSUANCE & RENWAL OF C.E (TRADE LICENCE)
GENERAL REQUIREMENTS (IRRESPECTIVE OF ANY TRADE):
A.
Properly & neatly prescribed Application Form with Signature, Date, Seal, and Name/s of
Proprietor /Partner (S) /Director (S)/Karta/Manager;
B.
Photocopy of current rent receipt / challan from rent control (for tenants) or current K.M.C
Property Tax Receipt /Bill (for owner of the trading premises);
C.
In case of Rent –free trading spaces, Current consent letter in original, mentioning the area
along with Current Rent Receipt / Receipts from Rent Control or Current K.M.C Property
Tax Receipt/ Bill of the Consenter .
D.
For trading spaces in any (1) Govt.Markets, (2) K M C Markets, & (3) Govt campus like
campus of K.M.C, C. P. T., C.I .T. etc. C/E can be issued only in the name of actual tenant;
no consent or sub-tenancy will be entertained in such cases; for trading space in Co-Op
Housing Society the consent letter from Secretary of the Co-Op Society/Appropriate
Authority is required.
E.
For trading spaces in Govt. Housing Estates, current clearance from Housing Estate
Manager;
F.
For issuing new Professional Licences, documents confirming the profession.
G.
The trades which attract, Amusement Fees, Water Charges(I.C.I/Metered), Sewerage &
Drainage Charges and Solid Waste Removal Charges separately, in addition, should be
issued C.E(Trade Licence) under an information(in prescribed proforma) to the Concerned
Department.
H.
Since 2003-2004 The K.M.C. introduced a new procedure for renewal of C.E.(Trade
Licence) through Banks. In this system, demands for renewal for a year, are generated
through Computer centrally for all the traders who have come under the purview of C.E
(Trade Licence) up to 31st March of the previous year pertaining to the year for which
demand for renewal are generated. Then the demands are sent to the traders directly Under
Certificate of Posting. On the backside of the Demand, the names of the Banks and their
designated branches are printed. The traders are required to deposit the amount mentioned
in the demands to any of the branches they like. The demand, after payment, becomes the
Certificate of Enlistment (Trade Licence) for the year. Under this system, the traders are not
required to approach to any K.M.C office for the purpose of the renewal of their Trade
Licence only except in case of Correction/Change of information (please see CMA’s circular
no.1 of 2004-2005 dated 13/07/2004.
SPECIFIC REQUIREMENTS FOR SOME SPECIFIC TRADES:
1. For any trade related to (a) Liquor (Wine), (b) Ganja, (c) Bhang, (d) Opium, (e) Edible spirit, (f)
Gun, (g) Gunpowder, (h) Ammunition, (i) Fire works, (j) mobile outlet (food/ non-food), (k)
manufacturing of Toy Gun etc.
Clearance from Police (Permission)/ Application to Police for such permission/ necessary
permission as regards excise, wherever applicable;
2. For S.T.D/ I.S.D/P.C.O Booth
(i)
For new C.E.(Trade Licence), approval from P & T Department, along with money receipt;
(ii)
C.E. (Trade Licence) should be issued only in favour of P & T approved name;
3. For Money Lenders/Changers
Current clearance from Reserve Bank of India;
4. For Limited or Private Limited Company (New Cases/Registered Office)
(i)
Memorandum & Articles of Association;
(ii)
(iii)
(iv)
Certificate of Incorporation / Certificate of commencement in case of Public Limited
Company;
Form 18 & Form 32;
Money Receipt of (ii) & (iii) above;
5. For Branch/Branches of a Company (Ltd)

copy of current C.E. (Trade Licence) of the registered office if within KMC area;

copy of Board resolution mentioning opening of such branch, date of commencement &

Declaration in plain paper (in original) in prescribed proforma; copy of Blue Book and Insurance Policy
of the car/s; Certificate of Fitness of the Car/s from P.V.D/competent Authority;

8. For Trades related to inflammable and/or Explosive Articles
Fire Licence or necessary Permission from Directorate of West Bengal Fire Service/Explosive
Licence;

Electrical Workman’s Permit/Documents confirming the Trade;
10. For Chemist & Druggist
(i)
First Licence to be issued on production of deposit receipt (in T.R Form No.7)
(ii)
For renewal permission from Drug Control is necessary;
11. For Share Brokers/Sub Broker/Dealer
Membership Certificate from S.E.B.I. In case of Sub-Broker a consent letter from a broker having
Membership Certificate from S.E.B.I.
12. For Importers & Exporters
Import & Export Certificate (IEC) from Ministry of Commerce, Govt. of India;
13. For Clearing & Forwarding Agencies
Agency Certificate from respective appropriate authority (Appropriate Authority means,
Customs/Excise/Engaging Organisation or any other authority which may be deemed fit for this purpose);
14. For Pathological Laboratory/ Clinic/ Nursing Home/ Hospital (Private OR Charitable)
Registration under Clinical Establishment Act, Govt. of West Bengal;
15. For Singer & Dancer
(i)
Copy of Ration Card/Passport/Voter Identity Card/ Pan Card;
(ii)
Permission from appointing authority for singing and dancing;
(iii)
Two copies of latest Passport size photograph;
16. For Cable T.V. Operators
Current permission from P & T Department.
17. For Ration Shop (A.R. Shop)
Permission from FCI /Food Department mentioning A.R No.;
18. For Trades liable to pay Water Supply Fees separately
(i)
for ICI consumers, Receipt of current years Water Supply Fees along with receipt of current
years Drainage & Sewerage Fees;

for others, declaration of area of trading space along with last receipt regarding water supply
fees and Drainage & Sewerage Fees (if applicable);
19. In Case Assessee No of trading premises not found
A Declaration in plain paper in prescribed format to be submitted by the applicant;
20. For Workshop of Sweetmeat Shop
Exact address, location and area in sq ft of workshop for Sweetmeat shop to be clearly mentioned in
the application form.
21. For Mobile Outlet (Food / Non-food)
Police permission and certificate of fitness from R.T.A. for current year is necessary.
Should have separate Office / Factory.
P R O C E D U R E F O R I S S U I N G C.E.( T R A D E L I C E N C E ) U N D E R G R E E N C H A N N E L
The NATURE OF TRADES UNDER RED CHANNEL should be displayed in front of the Inspection
Counter and the statement "ANY OTHER NATURE OF TRADE NOT INVOLVING ANY OF THE ABOVE LIST WILL BE
TREATED AS UNDER GREEN CHANNEL"
should be inscribed below the list.
Steps for issuing Licences under Green Channel are as under:
A.
The intending Licencee will procure Application Form from the specified counter.
B.
The Application Form, duly filled in, along with all necessary documents should be deposited in
the Inspection Counter only.
C.
The In-charge of the Inspection Counter (ALO/Inspector/HA) will then check and verify the
documents submitted along with the Application Form immediately.
D.
If those are found to be in order, the Counter In-charge will send the Form(s) immediately to the
Head of the Department (L.O./Concerned D.L.O./A.L.O.) seeking permission for assessment.
E.
Head of the Department will then, if he/she finds that the application(s) are in order in all respect,
accord permission for assessment.
F.
On having necessary clearance from the HoD, the In-charge of the Inspection Counter will then
assess the fees & charges as applicable immediately and prepare a Passing/Demand Slip under
his signature. He will then send the Application Form(s) along with all enclosures to the Cash
Counter immediately. The Passing/Demand Slip will be handed over to the intending Licencee
immediately for depositing the requisite amount mentioned therein for the purpose of issuing
Trade Licence / Certificate of Enlistment on the same day.
G.
The In-charge of the Cash Counter will then receive the amount according to the
Passing/Demand Slip and take an account of this with the Green Channel Application(s) already
received by him/her. There should be a programme that after physical inspection if it is found that
the information furnished are correct, those can immediately be recorded in the Computer for
generation of future demands. But, on the other hand, if the information are found to be false, the
data would not be made available for future demand generation in lieu "Licence Cancelled"
would get effected.
H.
After the closing of the Cash Counter, the concerned In-charge will send all the Application
Forms along with all of their enclosures with a Register and the Summary Sheet of that particular
day marking the Green Channel cases to the concerned HoD for initiating verification at the site
by the concerned outdoor inspecting personnel at an subsequent stage. The Register will contain
the following columns:

I.
The concerned Assignee Officer will positively submit a report to the HoD as regards to Physical
Verification in respect of the Licences issued under Green Channel within Two Months from
the date of issuing of the Licence(s).
J.
If the report conforms to the information furnished by the Licencee at the time of application, HoD
will pass a Remark as "In Order". The data then immediately will be sent to the System Manager
for preserving them to generate future demands.
K.
If the information furnished do not tally with the (physical) Information Report, the HoD will issue
a Letter of Intimation to the concerned Licencee to show cause within 15 days as to why the
Licence already issued would not be treated as cancelled. If the Licencee appears and can
justify information already furnished, the HoD, after being satisfied, will allow the Licencee to
continue with the Licence and will inform System Manager accordingly to do the needful. If the
Licencee does not appear within the stipulated time or can not justify earlier information, the HoD
will call for the Licence and will cancel the Certificate of Enlistment along with the forfeiture of
the amount already paid. System Manager will also be accordingly informed for updating the
database.
L.
If the intending Licencee, after obtaining Passing/Demand Slip from the Inspection Counter does
not turn up for payment of the same, In-charge of the Cash Counter will retain the Application
along with all its enclosures for next seven working days. After the expiry of the stipulated time,
all such cases will be deposited to the HoD in a separate file.

It has been decided that from the financial year 2004-2005, the schedule of rates/fees/charges
as are provided in Volume-I of the Budget Estimates for 2004-2005 shall be applicable in cancellation of
all previous schedules issued from time to time in this regard.
It is hereby ordered that traders who have not obtained their Certificates of Enlistment (Trade
Licences) for the last ONE or TWO years shall be liable to pay TWO TIMES of the rates/fees/charges as
will be calculated for the current year according to the new schedule along with the current year’s
rates/fees/charges.
The traders who have not obtained Certificates of Enlistment (Trade Licences) for the last
THREE YEARS or MORE shall be liable to pay THREE TIMES of the rates/fees/charges as will be
calculated for the current year according to the new schedule along with the current year’s
rates/fees/charges.
There will be no late fine for any such defaulting trader.

Circular regarding the procedure to be followed for effecting any correction / change /
closing of business / cancellation of demands and for obtaining Certified copy of Trade
Licence
Chief Municipal Auditor’s Circular No. 1 of 2004-2005 dated 13-07-2004
For smooth running of the operations related to Renewal of Certificate of Enlistments (Trade
Licence) and for better maintenance of the Licencee Database, procedures related to the matters
mentioned below for the Licencee whose Demand has been raised from Special Cell for renewal
through Banks will be as follows:
1.
CORRECTION: Any erroneous information, printed in the Demand Notice, will be corrected
exclusively at the Special Cell of Head Quarter so that digitized data are rectified on-line. No other
personnel at any of the Location Office will be doing this. For correcting erroneous information printed in
the Demand Notice, the Licencee will be required to bring the current year’s Demand Notice and the
previous year’s Certificate of Enlistment (Trade Licence), both in original. Corrections involving change in
Demanded Fees Payable must be done before payment of the same.
2. CHANGE: Change of any information of a Trade/Business with respect to its identification or
nature will be according to the following manner:
The Licencee will apply in a plain paper enclosing photocopies of all supporting documents and
the photocopy of the last Certificate of Enlistment (Trade Licence) at the Location Office where the Ward
of his last Licence belonged.
In case of any Change other than Address, the application receiving office will scrutinise the
application and execute spot inspection, if required. Finally, the case will be recommended to Licence
Officer (HQ) in a prescribed form enclosed, completely filled in, whether the Change can be done or not.
In case of Change of Address, three different situations may arise.
Situation-1 (New Address belongs to the Old Ward): In such situation, concerned WardInspector will confirm non-existence of the said business in the old Address and existence of the same in
the new Address. Finally the case will be recommended to Licence Officer (HQ) in the prescribed form
enclosed, completely filled in, whether the Change of Address can be incorporated.
Situation-2 (New Address belongs to another Ward within the jurisdiction of the
application receiving office): Ward-Inspector of the old Ward will pass on the application to the WardInspector of the new Ward, along with all enclosures submitted by the applicant, after confirming nonexistence of the said business in the old Address and filling in the first part of the prescribed form
completely. Ward-Inspector of the new Ward will, after making necessary inspection at the new Address,
send the application to Licence Officer (HQ) in the prescribed form, filling in the second part completely
(the first being already filled in) and appropriate remarks whether the Change of Address can be
incorporated.
Situation-3 (New Address belongs to a Ward outside the jurisdiction of the application
receiving office): Ward-Inspector of the old Ward shall send the application to Licence Officer (HQ),
along with all enclosures submitted by the applicant, after confirming non-existence of the said business
in the old Address and filling in the first part of the prescribed form completely. Licence Officer (HQ) will
then send it to the appropriate office in whose jurisdiction the new Address belongs. This office will then
execute all necessary scrutiny and spot inspection and finally send the file back to Licence Officer (HQ)
after filling in the second part of the prescribed form along with appropriate remarks and clear
recommendations.
The Licencee will have to contact Licence Officer (HQ) to know the fate of his application. If it is
recommended to make the “Change” applied for be incorporated, Licence Officer (HQ) will arrange to
collect all necessary fees* following the Schedule in effect and update the database. Otherwise, Licence
Officer (HQ) will let the Licencee know with reason that the Change applied for cannot be incorporated.
*If it is found that the assessed fees payable, after incorporating the “Change” applied for, are
more than what it was previously, the Licencee will be bound to pay the excess amount. On the contrary,
if the assessed fees, after incorporation of the “Change”, are less, no adjustment/refund will be made
as the Licencee has already enjoyed the status before the “Change” during some part of the year.

CLOSING OF BUSINESS: In case any Licencee wants to close the business in the current
financial year and does not want any Demand Notice to be raised in the next financial year, application
for such must be received at the concerned Location Office latest by 15th of April of the next financial
year along with a photocopy of Certificate of Enlistment (Trade Licence) of the current year. Any
application for closing of business, received after 15th of April of the next financial year, will have to clear
the demand for that financial year. Applications for closing of business in original along with the
enclosures must reach the Special Cell latest by 20th of April of the next financial year.

CANCELLATION OF DEMANDS: In case any demand raised in a financial year is found
out to be BAD for some reason or other, recommendation to cancel that demand must reach the Special
Cell well before generating the demand for next financial year. Such recommendation must have
Demand No. & Reason for Cancellation along with signature of concerned A.L.O./ D.L.O.

CERTIFIED COPY OF TRADE LICENCE: Certified copy of a Certificate of Enlistment
(Trade Licence) of a particular year should be given from the concerned Location Office from where it
was originally issued. ONLY the certified copies against the Demands, renewed through Banks, will be
available from the Special Cell.
The procedures described above are to be followed from immediate effect. All the Location
Offices are requested to cooperate with the Special Cell in the matters described above and in other
matters, not mentioned here but the officials feel fit, so that the Licencee Database is maintained
properly.

The Table “1”, “2”, “3”, as mentioned in the Schedule of fees and charges, in respect of
the charges u/s 419, 435, 421, and P.F.A. are given in page no.

To give an idea as to (i) who are Professionals, (ii) who are the sellers (Food/Non-food),
(iii) which are Factory/Workshop, the lists of such trades are annexed at the end of the
schedule. The lists are indicative not exhaustive.

Notes:
1. Godown: Charges for Godown/Warehouse would be as per Sl.No.1 & 2, (as the case may
be), of the Schedule.
2. Commercial School/College mentioned in Sl.No.38 of the Schedule means School/College
for vocational/professional/industrial training.
3. Private School/College as mentioned in Sl.No.127 means School/College for academic
purpose.
4. I.T.Industry and Factory / Unit registered under S.S.I. will be allowed 50% rebate on the
total amount chargeable. For this purpose current S.S.I. Registration No. (permanent /
provisional ), is required to be produced. I.T. Industries are required to produce the Certificate
issued by Govt. of West Bengal for this purpose.
5. The charge u/s 435 would be doubled, subject to a maximum of Rs.2500/- only in such cases
where an Air Conditioner is fitted to the place of trade, even if partially. In such case the charge
u/s 419 (if applicable) would be equivalent to the normal rate (i.e. Single Rate) depending upon
the area as shown in Table 1.(i.e. A.C should not be considered as a parameter for the purpose
of ascertaining charges u/s 419).
6. In case of Saloon (with A.C.) [Sl.No.133] the charge u/s 435 is fixed at Rs.1000/irrespective of the area.
7. In case of Nursing Home/Private Hospital (Sl.No.120 and 121) the S.W.M. Fee u/s 333
(indicated by B in the schedule of charges) depending upon the no. of beds, would be
added to Rs.2560/- and Rs.5060/- respectively.
