The Licensing Service, based at 1 Hillman Street E8 1DY is responsible for Massage / Special Treatment Licences. Licensing staff will be pleased to answer your queries; you can ring them on 020 8356 2431 between 9.00 am - 5.00 pm, Monday to Friday. WHAT REQUIRES A LICENCE? 2. A Licence is required to operate massage / special treatment premises under Part II of the London Local Authorities Act 1991 and the Local London Authorities Act 2000. 3. The lists below sets out some treatments which are considered to fall into the definition of “special treatments", as set out in the London Local Authorities Act 1991. If you are providing any of the listed treatments your premises may require licensing. PLEASE NOTE THIS LIST IS NOT EXHAUSTED AS NEW TREATMENTS ARE CONTINUALLY COMING INTO FORCE Please contact this service if you are proposing to carry out any treatments that may not be listed below. Before any licence application can be made, you have to ensure that your premises has planning permission. You are required to produce details - either a copy of the relevant planning permission or a letter from the Council's Development Control Service confirming planning permission is not required - with your licence application. 5. You will also need to provide the details as set out under paragraph 10 below. Without all the information, the application remains incomplete and will be returned to you. 6. As well as submitting a licence application for the use of the premises, you must arrange to submit at least one application for a practitioner who will be providing treatments. All persons who provide treatment at licensed properties have to be suitably qualified and approved by the Council. Application packs for practitioners can be obtained from the Licensing Service. 7. If you propose to employ trainees, please note that you will need to set up a training log to record the Trainee's start date and anticipated length of the training. The log must also be regularly updated to include details of the treatments for which training has been given and progress made. You must also complete the trainee Information form provided as Appendix 1 in this application pack. One form is needed for each trainee; each form must be provided to the Licensing Service within seven days of the trainee commencing work at your premises. Note: Trainees must always be under the supervision of a qualified practitioner. NOTE: It is an offence to carry out any SPECIAL TREATMENT if you do not have a licence. If you commit an offence you may be liable to a fine up to £2500. See the "Unlicensed Trading" paragraph at the end of these notes for further details. NEW APPLICATIONS 8. Applications must be made by the person who is the owner or legal occupier of the premises. 9. The application form must be fully completed and returned to us here at the Licensing Service 10. You must provide the following information with the application form: The appropriate fee - the current fee structure is set on the sheet appended to these notes. (Cheques / postal orders should be made payable to the LONDON BOROUGH OF HACKNEY.) Copies of all relevant membership and qualification certificates for all operatives The original current Electrical Certificate for the premises (Note: Electrical Certificates will only be accepted if issued by a member of the Institute of Electrical Engineers, the National Inspection Council for Electrical Installation Contracting or the Electrical Contractors Association) MSTPREMISES/GUIDANCE/new/renewal/variation/exemptions/revised28122011 3 2 copies of floor plans or plans showing the layout of the premises Submitted plans should be to scale (i.e. 1:50 or 1:100) and should include the following information: all areas that the public or staff have access to in connection with the use of the premises under the requested licence floors above and below the proposed licensed areas and details of their use escape routes in full, internal and external, i.e. to the nearest public thoroughfare the layout or proposed layout of the premises Further advice on the content of plans may be obtained from the Council's Building Control Service on Telephone Number 020 8356 8109. a copy of your public liability insurance certificate & schedule a copy of your trade waste agreement if relevant, a copy of your clinical waste agreement (where relevant) a copy of the planning permission/letter from the Development Control Service regarding planning permission for the premises A copy of the Fire Alarm certificate for the premises A copy of the Emergency Lighting certificate for the premises A copy of the Hand Fire appliances certificate for the premises A copy of the Gas Safety certificate for the premises (if using gas) Site Notice 11. The Council will provide a notice for you to complete and display on the premises concerned. It must be displayed for at least 28 days from the date the completed application is lodged with the Licensing Service. The notice must be posted up at eye level and be easily visible to persons in the street. Newspaper Advertisement 12. The Council will provide a specimen advertisement for you to place in a local newspaper, i.e. the Hackney Gazette (138 Cambridge Heath Road, London E1, Telephone: 020 7702 7777) or Hackney Today (2 Hillman Street, London E8, Telephone: 020 8356 3445), at your own expense. This advertisement should be placed in the newspaper within 7 days of the application being lodged with the Licensing Service. RENEWAL APPLICATIONS 13. You must provide the completed application form and the following: * the appropriate fee - the fee structure is set out below. (Cheques / postal orders should be made payable to the LONDON BOROUGH OF HACKNEY.) * copies of all relevant membership and qualification certificates for all operatives, where there are any changes from last year's submission * a copy of your public liability insurance certificate & schedule EXEMPT PREMISES APPLICATIONS The exemption application is for members of accepted Professional Bodies that want to administer special treatments in the London Borough of Hackney. Exemptions will only be granted for authorised treatments to bona fide members of the bodies listed at Appendix 1 in the guidance notes. 15. You must provide the completed application form and the following: * copies of all relevant membership and qualification certificates for all operatives. FEES 16. Fees details are appended to the back of these notes. PROCESSING YOUR APPLICATION 17. The following people are consulted about your application: Licensing Enforcement staff Building Control Development Control (Planning) Commercial Standards Service MSTPREMISES/GUIDANCE/new/renewal/variation/exemptions/revised28122011 5 Police LFEPA (Fire Brigade) Pollution Service Licensing Enforcement, Commercial Standards and Building Control will need to carry out a site visit to your premises. They will contact you to arrange a mutually convenient appointment. 18. If no objections are received on your application, it can be dealt with under authority delegated to the Licensing Team Manager. A licence can be issued subject to the Council's standard conditions applied to all Massage & Special Treatment premises and any other specific conditions that may be recommended by any of the professional organisations that have been consulted. If you disagree with any of the conditions, the matter can be reported to Sub-Committee, where you will have the opportunity to put your case. 19. If any objections are received, the application will be referred to the Licensing SubCommittee for decision. If that is the case, you will be notified and provided with details, including a copy of the report. Please see paragraphs 22 and 23 below. 20. Once a licence is granted, it usually remains in force until 31 March each year. You will be invited to apply for renewal. REFUNDS & NON-COMPLETED APPLICATIONS 21. The following scale of refunds applies: Where applications have not been completed Between the date of application and notification of receipt of objections Between final date for objections and completion of technical surveys Between completion of technical survey and determination by the Council Amount of Fee Returned 70% 70% 50% NIL OBJECTIONS TO LICENCE APPLICATIONS 22. Anyone wishing to object to an application must write within the time specified to the Team Manager Licensing at the Licensing Service, Hackney Service Centre, 1 Hillman Street, London E8 1DY, giving detailed grounds of objections. Objectors must be prepared to attend the Licensing Sub-Committee to support their objection. ATTENDANCE AT SUB-COMMITTEE 23. The Licensing Sub-Committee is open to any member of the public to attend as an observer. The applicant and objector(s) may be represented by a barrister, solicitor or any other person they choose. Applicants and objector(s) may bring any person to support their case, however hearsay evidence is not normally allowed. Those giving evidence should therefore only speak of matters within their own knowledge. They should not, for example, refer to oral complaints made by other people. 24. Each party will be given the opportunity to question anything said by the other side. The decision of the Sub-Committee will normally be announced at the end of the hearing and, MSTPREMISES/GUIDANCE/new/renewal/variation/exemptions/revised28122011 6 in addition, all parties will be notified in writing. The Council has no power to award costs to either side. NOTE: A copy of the hearing procedure is available on request. It is automatically provided to applicants and objectors in advance of the Committee APPEALS 25. A person whose application is refused or who is aggrieved by any term, condition or restriction attached to the licence can appeal to Magistrates' Court. The Council is the party who defends the decision made by the Licensing Committee but the Court re-hears all the evidence for and against the grant of the application or the imposition of the term, condition or restriction, as the case may be. 26. A person aggrieved by the order of a Magistrates' Court on any such appeal has a right to appeal to the Crown Court. 27. An objector aggrieved by the Council's decision does not have these rights of appeal but is entitled to object again when the licence comes up for renewal. REVOCATION 28. The Licensing Service takes a serious view of infringements / contraventions of licence conditions etc. Officers will take appropriate action which could result in a prosecution and, where relevant, recommendation will be made to Sub-Committee to refuse or revoke licences. UNLICENSED TRADING 29. Until such time as any Licence has been officially granted, and you have the valid licence certificate on display at your premises, you remain unlicensed. It is an offence to trade as a premises offering massage & special treatments whilst the application is being processed and, in such cases, the Licensing Enforcement Team will seek to prosecute, without further warning. 30.
