The course incorporates a rigorous examination of constitutional law, analysis, and interpretation, relating these to governing. The course requires voluminous, careful, and critical comprehensive reading by all students. The course is oriented towards students wishing to go to law school or graduate school. Therefore, it is intense. Attendance in class is mandatory. Failure to attend class is not acceptable and will result in a lower grade—i.e. for each unexcused absence over two, you receive a deduction of two points from your class average. This policy attempts to save students from getting poor grades. You cannot learn adequately unless you attend, participate, and learn through interaction in class. The course provides the opportunity for students to hone analytical, critical-reading, and communication skills. Doing well in this course demands high motivation, consistent concentration, sustained dedication, and active participation. Students must be prepared to present and discuss the analysis of caselaw in each class. Lack of preparation is unacceptable. In this course, students must have not only a thorough understanding of the cases, law, and judicial rationale, but also analyze the law, reflect on legal and empirical implications of the holdings, appreciate concurrences and dissents, explore contingencies, You should question what you read and hear. You should view precedence both retrospectively, in terms of consistency with past precedence, and prospectively, in terms of the consequences of the holdings and rationales related to possible future fact patterns. The professor will call on students whether or not they volunteer to answer. Other students should benefit from your comments and questions in class. This is a collective enterprise, so contribute—otherwise you are not pulling your load. You are given a grade for class participation. The course has an electronic syllabus, designed to facilitate student access to information. You have access to an incredible amount of material through this syllabus. The professor will use different modes of teaching ranging from lecture to discussion, to Socratic method, to facilitating student interaction, to reactive challenge, etc. Each student should pay attention to what is said each day in class, both to and from students. Strive to do better each class period that you speak or write. In this course, students examine the U.S. Constitution through detailed analyses of constitutional caselaw, the history and politics of litigation, and the policy impact of judicial decisions. We examine federal and state statutory law as they pertain to selected cases. We focus on several U.S. Supreme Court Justices, their decisions and opinions, judicial and political philosophies, and behavior, also. The objectives of this course include having students: (a) gain a sophisticated understanding of the modes of constitutional interpretation in the U.S. system of government; (b) learn the constitutional powers and limitations associated with the three branches of government; (c) understand the respective powers of the states and the national government; (d) assess the nature, extent, and importance of the rights possessed by individuals which governments are not to abridge; (e) study the important political and social context of judicial decision-making and the impact of court decisions in the ongoing policy processes of the U.S.; and (f) analyze arguments, criticize arguments, create arguments, draw reasoned conclusions, and communicate diverse positions effectively. This is not too much to ask of students that actually desire an education. Students are to conduct themselves professionally at all times. The successful teaching of this class requires extensive classroom interaction. Students are to treat others respectfully at all times, especially when criticizing others’ viewpoints. Students must adhere to the highest standards of honor in all matters related to scholarship. The professor condemns and prohibits any form of plagiarism, cheating, or other unfair, unethical conduct and will prosecute occurrences according to UTSA rules (see Information bulletin): “Scholastic dishonesty” includes, but is not limited to, cheating, plagiarism, collusion, falsifying academic records, and any act designed to give unfair advantage to the student (such as, but not limited to, submission of essentially the same written assignment for two courses without the prior permission of the instructor, providing false or misleading information in an effort to receive a postponement or an extension on a test, quiz, or other assignment), or the attempt to commit such an act.” UTSA Information Bulletin, p 128, Sec. 203. Students are to contact the professor at richard.gambitta@utsa.edu instead of the WebCT email. 1 Students should prepare to discuss all cases listed on the syllabus, but the focus in class and emphasis on exams will be on those cases with one or two asterisks (i.e., * or **). Generally, the professor will conduct extensive Socratic interactions on cases with two asterisks (**), discuss cases with one asterisk (*), and may refer many times to cases without asterisks. Students are responsible for every case with one or two asterisks and every case discussed or mentioned in class. The professor has given students multiple citations to cases in the electronic syllabus. Students will find abridgements of the cases in the casebook. Cases have citations to the U.S. Reports or equivalents and to findlaw.com or www.oyez.org/oyez/frontpage. The professor will make numerous assignments from websites as the course progresses. The professor will bring oral arguments to class and assign "thinking assignments." Cases from the 2006-7 and 2008-9 terms may be included without notice throughout the course, though the syllabus contains some of them already. Read your emails everyday and check for new messages on WebCT every two days. Students who do not enjoy speaking in class may comment on WebCT, providing insights or questions for everyone to share. Quizzes will be given when the professor believes participation lags. Plagiarism will not be tolerated, will be discovered, and will be prosecuted. Students are on the highest honor system. We pursue a morality of aspiration and reach new heights in achievement. The professor may cut cases where time demands it, entirely for the benefit of student sanity. He will add cases when he finds them relevant or necessary to illumination of concepts, methods, or substance. The order of case discussions is not set in concrete, but, in general, students should be prepared ahead of the instructor by five cases with asterisks. Professor may shift the order of cases or sections for pedagogical purposes, also, but will give due notice to students. We start slow, but build speed and momentum.
