Food Guarantee
Seller guarantees that no articles of food sold by seller to buyer during the period in which this guarantee is effective will be adulterated or
misbranded within the meaning of the Federal Food, Drug and Cosmetic Act of June 25, 1938, as amended, or within the meaning of any state food and
drug law, the adulteration and misbranding provisions of which are identical with or substantially the same as those found in the Federal A ct, and that
such goods will not be produced or shipped in violation of Section 404 or 301(d) of said Federal Act; provided, howeve r, that the seller does not
guarantee against such goods becoming adulterated or misbranded within the meaning of said Act or Acts after shipment by reas on of causes beyond
seller’s control; and provided also that where goods are shipped under buyer’s labels, seller’s responsibility for misbranding shall be limited to that
resulting from the failure of the product to conform to the label furnished by the buyer. Buyer undertakes to save seller h armless from any liability under
said Act or Acts for any other type of misbranding arising out of the use of buyer’s labels, or for any liability under said Act or Acts for misbranding where
buyer insists upon the use of any label after seller has questioned in writing the use of such label.
This guarantee shall become effective when it has been signed by both parties and shall continue to be effective until it is revoked by
either party by the giving of ten (10) days’ written notice to the other party.

Product Description:
Green Beans, Mixed Short Cut is a canned food prepared from a blend of tender, young, round-type green bean pods that are cut
into pieces of less than ¾” in length and pieces of the whole beans less than 1-1/2” in length with lightly salted liquor as the packing
medium. No sulfites added.

Standard
Practically uniform, bright color typical of young tender green beans properly processed.
Reasonably tender, small-seeded and full-fleshed beans. Practically free from fiber or tough strings and are
not materially affected in appearance by sloughing.
Normal, free from any objectionable flavor and odor.
Practically clear with a slight yellow-green to green tint and a trace of suspended material and sediment.
Blend of 2,3,4 and 5 sieve beans cut into pieces of less than 3/4” in length and pieces of the whole beans
less than 1-1/2” in length.

Fairly free from blemishes, stems, leaves, and other extraneous materials and any other defects.
Microbiological Specifications:
Commercially sterile. Product shall conform to good manufacturing practices and to applicable industry standards.
Packaging Information:
The product is canned in conventional 603x700 (#10) cans which are then packed in corrugated boxes, six cans to a case. 56 cases
per pallet standard. Each container to be conspicuously marked with contents, net weight, manufacturer’s name and address, and
identifying date code.
