COMMISSION FOR OTHER BACKWARD CLASSES GOVERNMENT OF NATIONAL CAPITAL TERRITORY OF DELHI VIKAS MINAR,5th FLOOR, I.P. ESTATE: NEW DELHI ABOUT US This Commission known as ‘The Commission for Other Backward Classes of the National Capital Territory of Delhi’, was constituted by the Lt. Governor of the National Capital Territory of Delhi vide Notification no. F.28(93)/91-92/SC/ST/P&S/109 dated 20.04.1993 as a permanent body in compliance with the directions of the Hon’ble Supreme Court of India contained in its Judgement dated the 16th November, 1992 in the W.P. (Civil) no.930 of 1990 (Indira Sawhney and Ors. Vs. Union of India and Ors.) for the purpose of entertaining, examining and recommending upon requests for inclusion and complaints of over-inclusion and under-inclusion in the lists of Other Backward Classes of Citizens. The Commission consists of five persons as under: a) A Chairperson, who is or has been a Judge of a High Court or the Supreme Court. b) Chairperson, Delhi Social Welfare Advisory Board (Member-Ex-Officio). c) Two non-official Members, who have special knowledge in matters relating to backward classes, to be nominated by the Government. d) Member-Secretary of the Commission. FUNCTIONS a) The Commission shall examine requests for inclusion of any class of citizens as a backward class in the lists and hear complaints of over inclusion or underinclusion of any backward class in such lists and tender such advice to the Government as it deems appropriate. The advice of the Commission shall ordinarily be final and binding upon the Government. b) POWERS OF THE COMMISSION The Commission shall, while performing its functions have all the powers of a Civil Court trying a suit and in particular, in respect of the following matters namely: a) b) c) Summoning and enforcing the attendance of any person from any part of India and examining him/her on oath; Requiring the discovery and production of any documents; Receiving evidence on affidavit(s); d) e) f) Requisitioning any public record or copy thereof from any Court or office. Issuing commissions for examination of witnesses and documents; and Any other matter, which may be prescribed. HOW TO OBTAIN CERTIFICATE OF OBC For the purpose of obtaining OBCs certificate, citizen belonging to the OBCs category may approach their SDMs of the District concerned. APPROACH US For being included in OBC’s list of Delhi, citizen may approach the Commission giving proof/documentary evidence to substantiate their claim. The Commission would then issue invitation to the claimants ; inviting evidence to reach a conclusion whether the claimants is to be included/excluded. ACHIEVEMENTS MADE This Commission has so far issued two reports. In its first report, the Commission identified the following 53 castes for inclusion in the OBCs list of GNCT of Delhi and a notification to this effect was issued vide no. F.8/11/99-2000/DSCST/SCP/OBC/2855 dated 31.05.2000. Two more reports viz. IIIrd report dated 13.09.2000 and the IV th report dated 18.04.2001 of this Commission, recommending some more castes for inclusion in the OBCs list of GNCT of Delhi, are under submission. In its 3rd report. This commission has recommended the following castes for inclusion in the list of OBC’s of the GNCT of Delhi. 1. Od 2. Charan Gadavi 3. Bhar/Rajbhar 4. Rauniyar And besides above the commission has also recommended the following to be added in the nomenclature of the OBC’s list. 1. Vaishnav,Swami alongwith Bairagi 2.
