Terms and Conditions Cancellation By PB i. In all cases, PB reserves the right to cancel your holiday for the dates You have reserved. This is extremely unlikely, but should this event occur You would be fully refunded and compensated as set out in clause 4a. j. Booking Your Holiday Preliminary Reservations -Please telephone our UK office on +44 (0) 1344 849 135 to discuss your holiday requirements and to check the chalet’s availability for your preferred dates. You may make a preliminary reservation giving you first option on the chalet for a period of three days. At this time you will be sent a personal quotation detailing the reservation. If you do not confirm the booking within the required time, your reservation will lapse and the chalet will be offered to other parties. However, this period can be extended by arrangement if there is no other interest in your chosen date. Confirming Your Booking - Having read and agreed with our booking conditions, please sign your quotation and post or fax it to us with the required 25% deposit (30% for Chalets Philippe). Alternatively the deposit may be paid by credit card or debit card over the phone. Final payment is required ten weeks before departure. Full payment is required if booking within this time. A confirmation invoice will be issued on receipt of the signed quotation form and payment. Please note that until we have received the signed quotation form and deposit your reservation will be treated as an option only, subject to expiry as above. Payment - Payment before your holiday is accepted in most currencies by cheque, bank transfer, traveller’s cheque, debit card or credit card. We accept Visa, MasterCard, Delta, Switch and American Express. Please make cheques payable to Pollen-Brooks. A 2.0% surcharge is payable for credit card and debit card transactions (4% for American Express) and 1.5% for French debit card transactions which we will automatically add to your payment. For bank transfers, non-UK cheques and payment in currencies other than Euros, please contact our UK office for details. Payment in the resort for additional services taken is accepted in Euros. This can be in cash, traveller’s cheque, Visa, MasterCard, Delta and American Express. Travel Insurance - In order for us to accept your booking and for your own protection, you must have adequate travel and cancellation insurance for all party members. It is your responsibility to ensure that the insurance cover you purchase is adequate for your parties needs. We do not check policies. Booking Through An Agent - Please send your signed quotation and all payments to your agent through whom all correspondence will be sent. Please do not hesitate to contact Pollen-Brooks directly for any information. Security Deposit – If booking a self-catered (‘Freedom to Choose’) holiday with PB a security deposit of 25% of the value of the holiday must be paid before the holiday date. This sum will be returned (less any damage caused by the party) within 30-days of leaving the property. Travelling Your Flight Arrangements - Please do not book your flights until your chosen holiday dates have been confirmed. Please note the suggested arrival and departure times from the chalet (see below) when making your flight reservation. Geneva Airport Transfers (Winter) - You are met by our chauffeur driven vehicles which take you directly to and from the resort. The transfer time by road from Geneva airport to Chamonix is approximately 60 minutes. Child seats are available. Transfers to and from other airports are possible but may incur a surcharge, please contact our UK office for details. Arrival and Departure Times - We would be grateful if you could arrive at the chalet after 4pm so that it can be fully prepared for you. We request that you vacate the chalet by 10.30am on the day of departure. Road Directions -Please let us know if you require directions to the chalet by road. In The Resort - Chauffeured vehicles are available from 8am to 11pm to drive you anywhere within the Chamonix Valley. Day trips to other ski areas such as Courmayeur in Italy can be arranged if a big enough group wishes to go. Health, Passports & Visas EU Nationals - EU Nationals are recommended to hold a full passport valid for the duration of the holiday and for at least six months after the journey home. Neither visas nor vaccinations are currently required to enter either France or Switzerland. Non-EU Nationals - For information on France, contact the French visa service in London (Telephone +44(0) 906 554 0700), your local French Consulate or the French Embassy web site: www.ambafrance-uk.org For information on Switzerland (Geneva flights), contact your local Swiss Consulate, the Swiss visa service in London (Telephone +44(0) 906 550 3545) or the Swiss Embassy web site: www.swissembassy.org.uk Booking Conditions Booking A Holiday A holiday booking is made between Pollen-Brooks (‘PB’) and the signatory of your quotation who must be over 18 years of age (‘You’). All correspondence to PB is to be addressed to: Pollen-Brooks, St.Anthony, Portnall Drive, Wentworth, Surrey GU25 4NN, England. The booking procedure is as laid out in this web site. The contract between You and PB is in all circumstances to be governed by these booking conditions. a. A contract will come into force only when PB has acknowledged receipt of your first payment in writing. Amendments By You b. Amendments must be confirmed in writing, signed by You or any authorised member of your group. They will come into effect on the day they are received by PB. In any event You hereby agree to indemnify PB for any reasonable expenses incurred in making an amendment whether or not PB succeeds in confirming your request. c. Subject to availability, any change of dates within the same season more than 56 days prior to departure will be accepted by PB without charge. A change of dates to a future season or within 56 days of departure will be deemed a full cancellation. Please see clause 3 below. Cancellation By You d. In the case of cancellation by You the deposit payment and any final payment already collected will be refunded only if the property is re-sold, the refunded amount will be 90 % of the amount paid to PB. PB recommends that You take an insurance policy to cover for cancellation of stay. Any cancellation will come into effect the day written notice is received by PB. Recorded delivery is strongly recommended. e. You will be liable for any charges incurred by PB in cancelling any special requests already booked for you. Amendments By PB f. We reserve the right to advise You of a change to your holiday both before and after You make a reservation. An amendment made prior to departure which is deemed to be significant by PB (for example a change of dates or a change in accommodation standards) gives You the right to cancel the holiday if You choose. Should You cancel in such circumstances You will receive a full refund. In all significant cases we will pay You compensation as detailed below: Days Before Departure Compensation Per Chalet Booking More than 56 days 150€ 15-56 days 300€ 0-14 days 550€ If you fail to pay the balance of the booking price or other costs before the due dates, we reserve the right to cancel your reservation with no refund to You. PB's Responsibilities k. PB accepts responsibility for ensuring that the holiday, which You book with PB, is supplied as described on this website. PB accepts liability for any loss You may suffer if your holiday is not as described and PB will pay You appropriate compensation if this has affected the enjoyment of your holiday. l. m. PB accepts responsibility for any loss, death, injury or illness caused by the negligent acts and/or omissions of PB’s employees, agents, suppliers, subcontractors, servants and/or agents of the same whilst acting within the scope of their employment in the provision of your holiday, except where the failure to perform or the improper performance was due to: i. Your own acts or omissions ii. Acts or omissions of a third party not involved with the provision of your holiday iii. Circumstances which were unforeseeable or unavoidable even when exercising all due care PB’s liabilities shall in all cases be limited in accordance with international conventions concerning transportation and accommodation. Your Responsibilities n. As part of this contract You hereby agree to guarantee payment for any chargeable services requested by any member of your group both before and during your holiday. The Chalet Manager will take a credit card guarantee on Your arrival at the chalet. o. You undertake to behave with propriety and in such a manner as in no way to cause distress, damage, danger or injury to other clients, property, our employees and/or any third party. The contract of any client in breach of this clause shall be terminated forthwith and we shall have no further contractual obligations. We shall be entitled to recover the cost of any damages or loss caused by You or any member of your party; this must be paid direct at the time to the chalet manager. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination. In addition, a 2000 Euros security deposit will be taken with the final instalment payment of your holiday. This is to cover any damages caused by You but discovered after your departure. This money will be returned (less damage costs) 72 hours after your departure. Price Guarantees p. The price of Your holiday becomes fixed once the booking has been confirmed. PB reserves the right to amend prices at anytime due to factors such as currency fluctuation. q. We reserve the right to decrease prices of unsold holidays and to correct errors at anytime. Health, Passports And Visas r. Please see the section headed ‘Health, Passports and Visas’. It is your responsibility to ensure that documents are in proper order before travel. PB accepts no liability for any loss or inconvenience caused as a result of your failure to take reasonable care in this respect. Medical Conditions And Disabilities s. If You or any member of your party have any medical problem or disability, which may affect your holiday, please, tell us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements. In any event, You must give us full details in writing at the time of the booking. If we reasonably feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline the booking or, if full details are not given at the time of booking, cancel where we become aware of details. Please note, in deciding whether we can properly accommodate the persons needs, we are entitled to consider the reasonable needs and requirements of our other clients and practical operational difficulties. Transport t. It is your responsibility to make your group’s travel arrangements, either to the chalet or to an airport from where PB can make the resort transfer for You (Winter). Where possible You must inform PB of your own flight arrangements at least four weeks prior to departure, requesting any transfers if applicable. u. PB cannot accept responsibility for guests missing flights for any reason or mislaying or destroying travel documents, and no credit or refund will be given if You fail to take up a component of your holiday as a result. v. PB is not responsible for any flight delays but will still endeavour to transfer You to the chalet from the airport. Travel Insurance w. Please see the section headed ‘Travel Insurance’ under the section ‘Booking Your Holiday’. Special Requests x. Please let us know any special requests You may have at the time of booking. Although we cannot guarantee it, we will do our best to meet your request but failing to do so will not constitute a breach of contract on our part. Any special dietary requests (e.g. Halal or Kosher food) that incur additional costs will be charged to the client. Any Problems y. If You are unhappy with any aspect of your holiday, You must address your complaint immediately to both the chalet manager and the local service provider. In the unlikely event that your problem cannot be resolved locally, You must inform PB in writing of your complaint within 30 days of your return so that any rights to compensation can be examined. z. In the event that your dispute cannot be settled amicably, it may (if You wish) be referred to arbitration under an inexpensive procedure devised and administered by the Chartered Institute of Arbitrators. We take the issue of chalet security very seriously, however, owing to the nature of chalet holidays the buildings may not be locked at all times. bb. Any valuables left at the property are left at your own risk, PB are not responsible for their loss. Skiing With PB cc. It is the responsibility of You and your group to judge the suitability of each area in which You ski. If You or any member of your group ski in a location on the recommendation of or accompanied by any representative of PB, PB will not be liable for any injuries howsoever caused. Smoking Policy dd. To ensure the safety and comfort of all our guests, we ask that You refrain from smoking in the chalet. General ee. Headings within these booking conditions are for reference purposes only and all images are intended to give a general impression only. These booking conditions and any matters arising from them are subject to and governed by English law. To the best of our knowledge all details in this website were accurate at the time of being published. g. Once your holiday has started, PB will pay You a pro rata refund for any part of your holiday which, due to amendment made by PB, cannot be taken. h. Please note that PB shall not be liable for any refund should PB be forced to cancel or change your holiday due to circumstances amounting to Force Majeure. Such circumstances shall include, but are not limited to, war or threat of war, riot, civil strife, terrorism, industrial disruption, natural disasters, fire, technical problems, adverse weather, governmental action and similar events beyond our control.
