RESOLUTION TO AUTHORIZE CONTRACT LEASE AND OPTION WITH
McCRACKEN COUNTY PUBLIC SCHOOLS FINANCE CORPORATION AND TO
ENTER INTO PARTICIPATION AGREEMENT WITH SCHOOL FACILITIES
CONSTRUCTION COMMISSION - 23
Motion made by Michael Hatton and seconded by Jeff Parker to enter into a contract lease
and option with the McCracken County School District Finance Corporation, enter into a
Participation Agreement with the School Facilities Construction Commission and to approve
all other documents in connection with the issuance of bonds in connection with the
refunding of the Finance Corporation’s Series 2004 Energy Conservation bond issue.

MOVING SCHEDULE FOR THE SCHOOL RECONFIGURATION PLAN - 35
Motion made by Jeff Parker and seconded by Michael Hatton to approve the moving
schedule for the school reconfiguration plan, as presented. Motion carried.
ORDERS OF THE TREASURER - 36
Motion made by Jeff Parker and seconded by Don Heine that the Orders of the Treasurer for
payment of bills be approved and payment be authorized. Motion carried.
EXECUTIVE SESSION - 37
Motion made by Michael Hatton and seconded by Don Heine that the Board go into
Executive Session to discuss the following business, for the following reasons and under the
following exceptions to KRS 61.810:
1) To deliberate on the future sale or acquisition of real property pursuant to KRS
61.810(1)(b) because publicity created if the matter is discussed in open session would be
likely to affect the value of the property under consideration;

2) To hear a report from the attorney for the board on pending and proposed litigation
pursuant to KRS 61.810(1) (c) because the discussion in open session would be a waiver of
the attorney/client privilege and have an adverse effect on said litigation.

Motion made by Michael Hatton and seconded by Don Heine that the Board return to regular
session. Motion carried.
Chairman Neil Archer announced that no action was taken in Executive Session.
