DEARBORN TOWNSHIP MEETING MINUTES JANUARY 1943 - DECEMBER 1943 (90) page 97 January 12, 1943 Regular meeting of Dearborn Township Board held in Dearborn Township Hall at 8: P. M. Eastern Standard War Time, Tuesday, January 12, 1943 Meeting called to order by Supervisor Daly. Upon roll call the following members were present. Mokersky, Jones, MacDonald, Patterson, and Daly also Attorney Bollinger. Minutes of previous meeting held on December 8th, 42,. were read by clerk and as there were no corrections, Same stood approved as read. Clerks report of claims and accounts for month of December, 42, were read (see page 99). Motion made by MacDonald, seconded by Jones that same stand approved as read and bills ordered paid. YEAS: Mokersky, Jones, MacDonald, Patterson and Daly. Treasurers receipts and disbursements for month of December 1942, were read. Motion made by Mokersky seconded by Patterson that same stand approved as read. YEAS: MacDonald, Patterson Jones, Mokersky, and Daly. Attorney Bollinger stated that suit of Dearborn Township versus City of Dearborn was dismissed since last Township Board meeting by Judge Callendar, but advised he filed a petition for appeal hearing from circuit court decision to sate Supreme Court. Lester Martin owner of lot 477 Cummings Ford Road Sub'n advised that 1942 tax rolls showed a house valued at $610.00 on said lot whereas no building was on lot, after verification that our records were in error. Motion was made by Mokersky seconded by Patterson that the amount of $12.12 which would be the tax on said house assessed at $610.00 be refunded and a check be issued for $12.12, due to error in Tax Roll. YEAS: Jones, MacDonald, Patterson, Mokersky and Daly. Supt. Fearnley of Water Dept. presented claims and accounts for the month of December, 1942. Motion made by Mokersky seconded by macDonald that claims and accounts as presented be accepted and bills ordered paid. YEAS: Jones, Patterson, MacDonald, Mokersky and Daly. Supt Fearnley, turned over five letters to clerk each sealed letter submitting price quotation on #4500 pounds of 3/4" strong lead service pipe. Motion made by patterson seconded by Mokersky that Supt. Fearnley be instructed to communicate with some other concerns soliciting price quotations on above material before any order is placed for said material. YEAS: Jones, Mokersky, MacDonald, Patterson and Daly. Communication from Seth Fearnley Supt of Water Dept under date of Jan. 12, 1943. was presented and read. Same recommended amendments be made to the Rules and Regulations of the Dearborn Water Systems to wit: Article #18, of Section #4, Service pipes which would set up the qualifications: age, residence. registration, etc., of licensed journeyman plumbers and Master Plumbers and provides that each master plumber must register with the Water Dept Annually, during the month of April and contributed a fee of $1.00 for registration (92) page 98 Also add a Section to Article #3, under debt charges to wit: When a customer wishes to pay his account in full, all unpaid interest shall be canceled and a charge of $5.00 shall be made for servicing the account provided that if the account had run mort than five years, the service charge shall be $5.00 less 1.00 for each year or major fraction thereof which the account may have to run in excess of five years. Moved by Jones seconded by Mokersky, that suggested amendments to the Rules and Regulations of the Dearborn Township Water System be confirmed and incorporated in and become an active part of said Rules and Regulations. A. dated Jan. 11, 1943 was received seeking permission to audit Water Department accounts for year 1943, and submitting a price of $500.00 for said audit which audit reports would be furnished quarterly as heretofore. M. Eastern War Time Tuesday Evening Feb. 9, 1943. Meeting called order by Supervisor Daly. Upon roll call the following members were present: Jones, MacDonald, Patterson and Daly. Mokersky entered later. also present were Attorney Bollinger and the Township Engineer Edwin Orr. (93) page 101 continued Minutes of regular meeting held Jan. 12, 1943, were read by clerk and as there were no corrections, it was unanimously agreed that same stand approved as read. Upon completion of the reading of the minutes of previous meeting Supervisor Daly advised a delegation representing Hone Owners residing in Watsonia Sub'n #3, were in attendance, wishing to learn what recent action was taken by Township Board relative to having sanitary sewers installed on several street in their section of Township. Supervisor Daly advised this matter had been referred to our Township Attorney, also our Township Engineer and as both were present he would call upon them to advise re: latest developments in connection with said contemplated sewer district. It was then pointed out by Township Engineer that plan as originally contemplated, relative to financing this project out of funds remaining in Water Construction account was later found to be impracticable from a legal stand point, due to technicalities and Attorney Bollinger concurred with this statement. Engineer Orr advised he communicated with Bondholders, of Dearborn Township Water System and their representatives in Chicago, Ill. and advised bondholders no doubt will be interested if total issue of $118,000. was taken up at a price of 105. Attorney Bollinger then suggested it might be advisable to get a 90 day option from Bondholders. Dearborn Township Officials made it clear that other sections of Dearborn Township wee much in need of sewers and water improvements and indeed were seeking same from Township Board. and in view of this fact, it would seem the better policy to pursue, account to serve only son small district, that a bond issue for a much large amount should be considered by Engineer to serve a greater portion of the Township which issue should prove more attractive to bond buyers and as per-attorneys suggestion it was deemed advisable that they get in touch with Michigan Advisory Board to learn what prospect there wold be to sell such an issue. Motion was made by Patterson seconded by jones, That engineer Orr be authorized to make a factual survey of districts in the Township which in his opinion should be served at the present time by sewers also water mains or which in the near future should have such improvements and when survey has been completed to advise the Township Board. Baker dated 1/29/43 was red by clerk, same advised them was a balance of $502.00 due their company for contract work done on Dearborn Township Water Mains. Motion made by Jones, seconded by MacDonald that clerk be instructed to write the WAyne County Road Commission, asking them to advise if Ray D. Patterson Clerk page 106 B l a n k page 107 February 24, 1943 Special meeting of Dearborn Township Board, held in Dearborn Township Hall as per written notice given to nembers of Township Board at 2: P. M. Eastern War Time February 24, 1943. Meeting called to order by Supervisor Daly, Upon roll call the following memebers answered present: MacDonald, Jones, Patterson and Daly, Mokersky entered later. Also present Attorney Bollinger and Engineer Orr. Supervisor Daly, advised meetign was called to ascertain latest developmetns from the township Eningger relative to his factual survey in connection with contemplated Sewer Installation in Watsonia Sub'n #3, and other sections of Township as ordered at regular township board meeting February 9th, 1943. (97) page 107 continued and after hearing from Engineer Orr and Township Legal adviser Bollinger to take whatever action deemed proper to carry out this sewer improvement at the earliest possible date. Engineer Orr then advised he had contemplated making a trip to Chicago, Ill about thursday to take up direct with attorneys representing the Bond Holders of the $118,000.00 Water District as he thought fuller information could be obtained by so doing and a much quicker and more satisfactory arrangement made Attorney Bollinger then quoted from letter from same Chicago fire of attorneys who represent Bondholders, also advised he talked with same attorney this A. M. and he was given assurance that an option at price quoted in their letter namely 105 could be secured, He was of the opinion that without a detailed plan being worked out for presentation that contemplated trip to Chicago, Ill, would not be advisable at the present time. Engineer Orr then advised he had made a survey and had plans drawn showing district to be served, number of houses in district, approximate distance between houses and had figured approximated cost and he estimated the new Bond issue hold be #200.00 which wold be $82.00 plus the present $118,000. Water District issue. This new district wold consist of parts of Golden Acres Sub'n Cummings Ford Road Sub'n Comfords, Sweets and Watsonia Park #3. Engineer advised before asking for option that Township Board should satisfy themselves as to the sufficiency of contemplated District to be served. At this point Attorney Bollinger suggested, that as it had now been shown that definite plans and figures had been worked out by Engineer the planned trip to Chicago Ill looked more feasible and if same would expedite matters at present time or some date in the near future, the trip should be given favorable consideration. Engineer Orr at this point advised he was interested only in anything that would hasten this project, and as to necessity for trip to Chicago. same could await future. developments. Board agreed as to sufficiency of District and authorized Engineer and Attorney to work out details. Attorney Bollinger presented an agreement by and between the Township Board of the Township of Redford Wayne County, Michigan, party of the first part and the Township Board of the Township of Dearborn party of the second part reading: RESOLVED: that Edwin W. Daly, supervisor be and he is hereby authorized and directed to sign the following agreement for and on behalf of the Township of Dearborn, and, BE IT FURTHER RESOLVED: that the form of said agreement is hereby approved and whenever the same is signed by both parties thereto and filed with the Clerk of the party of the seconded part that is shall continued in effect indefinitely but may be revoked by either party upon notice to be served upon with the Township Board of the Township of Redford, Wayne County, Michigan or upon the Clerk of the Township of Dearborn. (98) page 107 continued Motion made by Jones seconded by MacDonald that the above agreement between the Township Board of the Township of Redford, Wayne County, Michigan. and the Township Board of the Township of Dearborn be approved and be it resolved that Edwin W. Patterson clerk being duly sworn says that the above resolution was passed by the Township Board, of the Township of Dearborn authorizing Edwin W. Daly, Supervisor to enter into the above agreement with the Township Board of the Township of Redford Wayne County, Michigan signed. the 24th, day of February 1943. Attorney Bollinger presented resolution No. 1, reading. WHEREAS: a petition had been filed, signed by the record owners of more than sixty five per cent (65%) of the land in the proposed special assessment district therein described and duly verified both as to signature and ownership of property: and WHEREAS said petition asks for the establishment of a Special Assessment District described as follows: Bounded by West by Telegraph Road, on the North by Colgate Avenue, on the East by Parker Avenue, and on the South by Annapolis Avenue. page 108 and for the construction of as were commencing at a connection with the existing were system is said district at Annapolis and Parker, running thence Northerly to a connection with the were system of the City of Dearborn at Dartmouth and Parker, together with a pumping station to provide an outlet for the sewer system in said district; and WHEREAS: the construction of said sewer appears to be desirable for th public health of the Township. WHEREAS: plans specifications and estimates of cost of the proposed improvement and a map f the district benefited have been prepared by Edwin M. Orr Engineer and filed with the Township Clerk. IT IS HEREBY RESOLVED: that said maps plans specifications and estimates are hereby approved, and that the cost of said improvement is estimated to be $9900.00 and the period of usefulness of the proposed improvement is estimated to be not less than ten years. RESOLVED FURTHER: that the Clerk caused notices of said hearing of objections to be published twice in the Dearborn Press. the first publication to be at least two weeks before said hearing, and by posting for two weeks in three public places in the Township. Motion was made by Mokersky seconded by MacDonald that the reading of the minutes of the regular meeting February 9th'43, and special meeting of Tuesday February 24th'43 be waived. Yeas: present. A. dated March 8th, 1943 was received and read re-auditing the books and records of the Dearborn Township Water Department for year of 1943 quarterly basis and which submitted a price of $75.00 per quarter with provision that after completing the first quarter it is found the volume of work required and adjustment of rate for the succeeding three quarters of 1943, that the Township Board shall be advised in writing to this effect and a new rate established. Attorney Bollinger made a report as to standing of suit against City of Dearborn he advised the appeal was being carried on. but felt that Dearborn Township should also be represented in the suit by "John Spaulding, Attorney as a great amount of work and expense had already been encountered without cost to Township. that the fee Bonus be increased from 20% to 25%. Motion made by MacDonald seconded by Mokersky, that "John Spaulding Attorney" be authorized to enter suit in behalf of Dearborn Township, also that the combined fee bonus would be 25% instead of 20% as previously set up. YEAS: Patterson, Mokersky, MacDonald Daly, and Jones. Attorney Bollinger also advised that a bill has to be passed by Act of Legislature before Water and Sewer District could be combined. Motion made by MacDonald seconded by Mokersky that clerk be authorized to have sufficient ballots printed for the General Election Monday April 5th' 43, and notify persons selected to serve on Election boards also that Township Board go on record as official adopting Eastern Standard War Time. YEAS: Patterson, Mokersky MacDonald, Daly (Jones absent) Clerk asked the Board as to advisability of having one phone line connected direct with water department and it was unanimously agreed that Clerk request The Michigan Bell Telephone Co. to have this improvement effected at the earliest possible date. Meeting called to order by Supervisor Daly. Upon roll call the following members were present. Supervisor Daly advised meeting was called for the purpose of hearing reports from Engineer and Attorney relative to boundary lines - streets included and equipment purposed in Revenue District to be served by Sanitary Sewers. Engineer Orr, reviewed plans as drawn covering Sanitary Sewer, District #1, in Watsonia Park Subdivision #3, advising his both sets of plans called for a pump station, but as no alleys were incorporated in lay out of said subdivision, his plan to construct sewers in rear of lots upon which easements were requested from property owners, would have of necessity to be discarded in favor of his other set of plans which he presented showing the Sanitary Sewer System, to be constructed in the Streets, account of the very limited number of responses to litters mailed to property owners seeking easement. Engineer Orr also, reviewed plans as drawn covering Sanitary Sewer District #2, lying North of Ford Road and West of Telegraph and Gulley Roads. He advised this proposed territory in Sanitary Sewer District #2, would be served by Gravity as no electric pump could be purchased account of same taking a high priority rating and Government priority was not available. Attorney Bollinger was next heard from presenting and reading "Ordinance #9" in it entirety, creating a combined Water and Sewer System. This ordinance set up rates rules and regulations to govern receipts and distribution of all receipts of said combined Water and Sewer District. Said ordinance to be published and upon publication in Dearborn Press, to be effective and entered in Dearborn Township Ordinance Book. Supervisor Daly, advised there were some present at the meeting who would like to interview Township Board, and suggested said hearing would be first order of business. Mr. C. R. Baker of 6600 Kingsbury Ave. first to be heard advised he was seeking a permit to occupy a House Trailer 30 ft. long containing three rooms to be used by himself, wife and 13 year old daughter on lot 663 in Murphy Bros, Martin Park Subdivision #1, until he could complete building a house 24 X 26 ft. of brick veneer construction. Motion made by Mokersky seconded by macDonald that a permit be granted for a period of three months,subject to extension of time if needed, but also with the proviso, that permit be subject to withdraw if complaints were received from adjacent property owners. Mr. Wroblenski and Mr. Upton, advised Board of good work being carried on by their organization, in connection with Civilian Defense, such as drilling with Regular Fireman of Redford Township and learning the art of fire fighting Mr. Upton, as chief spokes,an solicited any help Township could give in the way of providing such equipment as Fire Extinguisher crow bars, foamite bamboo brooms, axes, approximately 500 ft. of 1-1/2" garden hose & reel for hose, He volunteered to donate his Model "A" truck minus a license which he believed would be taken care of by the Township. and he maintained if a great part of this equipment would be forthcoming from the Township numerous grass fires and possibly fires of other origins could be put under control by their organization without restoring to the calling out of the Redford Township Fire Dept, thereby saving a possible charge of $25.00 Supervisor Daly appointed a committee of five, namely Jones, Mokersky, Wroblewski, Upton and Wescott, to make inquires along lines suggested and being their recommendations to attention of Township Board. The solution proposed contemplates the Wayne County Drain commission arraming with the Wayne County Road Commission for permission to enter the Storm Water section of the Jim Daly Road Sewer at a point North of the Sanitary Sewage diversion chamber of in Michigan Ave. and from that point extending a storm sewer Southerly along Jim Daly Road to an adequate depth at a point adjacent to Jim Daly Road and the present location of the Bayham Drain and to further take such steps and proceeding was will accomplish this end. Supervisor advised he received letter which complained that an open basement in which water was standing was unprotected at 3906 Detroit, Street lot 1107, Amended Plat of Dearborn Pointe Subdivision and was not only unsafe but unsanitary and a menace to health. Attorney Bollinger advised this was a Violation ad suggested that ownership be looked up and owner notified to have this hazardous condition remedied at earliest possible date. Supervisor Daly advised meeting was called for the consideration of construction bids presented by several contractors at 10:30 A. M. E. S. W. T. June 22, 1943. (136) page 157 continued Supervisor Daly suggested as both Attorney Bollinger and Engineer Orr were present, it would be appropriated to hear their views before Township Board began consideration. of bids and awarding of contracts. Engineer advised he considered until price as submitted by majority of bidders particularly on Section #2 as unreasonable, being greater in excess of his estimated cost, although he was inclined to believe a more favorable bid, If present figures were not accepted and project was re-advertised at present time and under present working conditions was most unlikely, therefore, readvertising, for new bids lacking assurance of less cost would in the final analysis possibly add to the cost of the project as well as delay construction and retard completing and putting Sanitary Sewer Section #1 and #2 into operation. Attorney advised that while bids submitted were higher than anticipated by Township Engineer, for both Sanitary Sewer District #1 and #2, it would in his opinion be unwise as well as costly to throw out bids and re-advertise thereby delaying completion and without the least assurance as pointed out by Engineer that a lower construction cost would result, He also stressed the point that enough money through the sale of $180,000. of Dearborn Township Water and Sewer System Refunding and Extension Revenue Bonds plus surplus money now on hand, would be available to meet all construction cost and obligations and properly carry on thereby making this Sanitary Sewer District a sound financial undertaking, and also due to the fact that Bonds, had already been sold on June 15th, 1943, he believed Township Board should take no action towards delaying project, therefore he would recommend that Board give this project favorable consideration at this time. After hearing views, as expressed by Engineer and Attorney, as to feasibility and contemplated cost of this project, Supervisor Daly asked for consideration of bids as submitted 10:30 A. M. E. S. W. T. Tuesday June 22nd, 1943, which extension of figures were verified by Engineer as to total cost of each Section. Upon tabulation of bids it was found that Angel DiPonio, was low bidder for Section #1 his bid price being ($25,487.95). Drainage Contractors Inc, was found to be low bidder on Section #2, his bid price being ($44,404,90.) Motion made by MacDonald, supported by Mokersky that bid of Angelo DiPiono, on Section in amount of ($25,487,95.) being low be accepted also bid of Drainage Contractors Inc. on Section #2, in amount of ($44,404.90) being low be accepted. M. E. S. W. T. Tuesday, July 13, 1943. Meeting called to order by Supervisor Daly. Following members being present answered roll call. Odom Jones, Patterson, Daly, (Mokersky absent entered later) also present Attorney Bollinger, Engineer Orr entered later. Clerk read minutes of four previous meeting, namely, Regular Meeting held June 8th, Special Meetings June 15th, 22nd, and 23rd. As there were no correction minutes stood approved as read. Supervisor Daly, at this point advised there were some persons in attendance at meeting who would like to be heard from, before proceeding with other routine business. Mr. Sasa a representative of Houseman Spitzley Corp. selling and renting agents of Detroit, Michigan, was first to interview the Board. He advised his company was searching for office quarters and wished to know if Dearborn Township would consider renting the small frame building used as a voting booth located at Southwest corner of Lehigh and Telegraph Road, for a period of approximately four months and if so what rental would be asked. Motion by Mokersky,seconded by Jones, that Houseman Spitzley Corp. be granted a permit to use voting booth located at Southwest corner of Lehigh and Telegraph Road at a rental rate of $25.00 per month, subject to right of Dearborn Township to enter at any time for purpose of any election or public function, possession to be given up, upon 24 hrs, notice and that they be authorized to carry public liability Insurance to compensate and indemnify Dearborn Township in event of any personal injury to occupants or any one entering building also with proviso that building upon expiration of rental period be turned back in same condition as when rented. YEAS; Odom, Jones, Mokersky Patterson and Daly, Nays: none. A delegation representing Sector #1, Dearborn Township was next heard from. Mr. Anthony Wroblewski, Mr. Ruebelmann and Mr. Upton, being chief a spokesmen regarding Civilian Defense actives. Mr. Ruebelmann Senior Sector Warden, Sector #1, advised he understood Mr. Von Moll of office of Civilian Defense could give no assurance that any fire fighting equipment helmet indian tanks etc, would be forthcoming until this part of Dearborn Township was placed in or designated as a critical area and wished to know if Township Board was in a position to procure or advance funds for the purchase of auxiliary Fire Dept. Equipment. (138) page 159 continued Attorney Bollinger, advised Township Board had no money available or set aside which could be advanced lawfully from any fund at this time and believed the solution which would be in keeping with the statues would be to have all property owners residing not only within the boundaries of Sector #1 but n all of the northern part of the Township circulate petitions, praying for the establishment of a Fire Department and present petitions to Township Board and if petitions when checked were found sufficient and Election could be called to create a Special Assessment District. Mr. Upton, advised he talked with Mr. Logan Chief of Redford Township Fire Department and and of the opinion Dearborn Township Board wold be able to render helpful information from him, along the line of action necessary to be taken to secure some Auxiliary Fire Equipment. Supervisor Daly, advise Engineer Orr made suggestion that Dearborn Township Board write proper official of that Civilian Defense Region - Chicago, Ill. Re Ruebelmann stressed the point that some Civilian Defense Material as essential at present time and Township Board should make some provision to secure and advance funds for purchase of same and stated that an amount of $250.00 had been offered or suggested at Regular Board Meeting in June and at this time he wold like to know if previous offer was still good. After considerable discussion, MOtion was made by Mokersky, and seconded by Patterson that the sum of $250.00 be allotted to sector #1, Dearborn Township for purchase of Civilian Defense Equipment with the understanding, as stated by Mr. Ruebelmann that Sector #1, will contribute a like amount. At this point, objection was raised by Jones, to granting of $250.00 his contention being that all other 7 Sectors without any doubt, ask for similar amounts, which on account of lack of funds set aside in our budget for this purpose this amount could not be made available at this time. page 160 Another objection was voiced by Mr. William Thorne, a resident and tax payer and an Air Raid Warden in Sector #8, Dearborn Township his opinion, being to the effect if this action was taken, same would be unlawful procedure. Before roll call could be taken on motion to allot $250.00 to Sector #1, a new motion was made by Mokersky, withdrawing his original motion with permission of member who seconded his motion. which permission was given and original motion was then declared withdrawn. Motion was made by Mokersky seconded by Patterson that on account of Rabid Dogs condition existing in Dearborn Township ., there be established a Dog Quarantine in all of Dearborn Township outside of Village of Inkster, Michigan limits, for period ending September 15th, 1943. but with proviso that expiration date of Quarantine shall be extended if deemed necessary for protection of life and property. Question arose as to advisability of re-organization of Dearborn Township Zoning Board, Attorney Bollinger was delegated to contact Hon. Thomas Murphy, Judge of Probate, relative to appointment of two new members to zoning board to fill expired terms of two members who served an zoning board as originally set up. Supervisor Daly, advised the matter of Sewer Inspection should be gi en immediate consideration, account of great number of new homes being constructed in the township, which sewage in majority of instances is being disposed of through City of Dearborn, Sewers, Mains and he advised Dept of Public Works of City of Dearborn are looking to Township to have Plumbing and Sewer Inspection made for the good of the service. Supt. Fearnley, of Water Dept. asked about rates to be charged for plumbing and Sewer Inspection and Mr. Michael Boyle of Dept of Public Works, City of Dearborn advised as to rate he would charge, if he was delegated to make these inspections for Dearborn Township. Fred Sweet Chief of Auxiliary Police Dept, if Dearborn Township appeared before the Board, seeking advice relative to enforcement of plenary powers granted to Defense Council and such persons as may be necessary to carry out the functions of th council in accordance with Dearborn Township Ordinance #7, He expressed the opinion that said Ordinance #7, lacked adequate provision for prosecution of violators of rules set up governing blackouts. (147) page 171 continued Mokersky suggested that Attorney Bollinger, review Ordinance #7, was well as State Laws recently enacted dealing with violators of provisions set up for enforcement of Blackouts, and rendered legal opinion at next meeting. This suggestion hade the unanimous approval of full board membership. Mike Chernick was next to interview the Board. he advised his company the Detroit Construction Co. had five houses built on South side of Pennie Road West of alley in rear of business lots facing Jim Daly road in Watsonia Park Subdivision #3, which lack sewage disposal facilities and which previous to building said houses it was his understanding this section of Pennie Road was to be included in set up covering Sanitary Sewer District #1. As it developed this was not the case, account this section of Pennie Rad not being included by Dearborn Township Engineer in Sanitary Sewer District #1, and therefore he deemed it proper to seek relief from Dearborn Township as Wayne County Health Board, would not permit the installation of septic tanks, thereby leaving his five houses with out occupancy and with no means of sewer disposal, consequently he believed he should not be called upon to install a sewer line on Pennie Road at his own expense, feeling this cost of approximately $2500.00 should be borne wholly by Dearborn Township, After Considerable discussion motion was made by Mokersky seconded by Patterson that the above request of Mike Chernick be tabled. Before calling for yeas and nays on this motion, Mr. Chernick was granted further hearing in which he contended his request should not be tabled but should be acted on at present meeting so further delay would be eliminated, Mr. Jones concurring Mokersky then asked permission of seconded to withdraw his motion which was granted by seconder Patterson. Jones at this pint asked mr. Mike Chernick if he would contribute an amount big enough to take the speculation or rick out of building this additional sewage line on Pennie Road providing Dearborn Township would undertake to provide up to $1800.00 of the contemplated cost of $2500.00 for the building of this line, Mr. Chernick promised to take care of any cost over and above the $1800.00 and also would live up to plans and specifications as provide for by Engineer Orr in the remainder of Sanitary Sewer District #1. Jones made motion seconded by Mokersky, that Dearborn Township authorize the expenditure of the sum of $1800.00 from Water and Sewer construction fund with the proviso that Mike Chernick pay all monies over and above said sum sufficient to complete said sewage line on Pennie Road. A. dated August 31st, 1943, which informed the Supt of the Water Dept. that the books and records of his department would require revamping account of the fact that a new bond issued had been sold which refunded the original water revenue bonds in the amount of $118,000.00 and added extensions to the Water Department to cost of which is covered in the sale of $118,000.00 of combination of Sewer and Water Revenue Bonds also general ledger accounts under the bond issue do not apply also profits earned under the old system require special treatment on the books and in addition a new chart of accounts and the open of new accounts under the bonds issue are required. Proper accounting should be made in the handling of Water and Sewer Transactions to meet the requirements of the new ordinance, but old accounts should be closed as of July 1st, 1943 before the new accounts are set up and letter also estimated the cost of this work at $150.00. Motion by Mokersky, seconded by Patterson, that Walter A. Markin, be engaged as C. P. A and instructed to closed all old accounts of Water Department and set up new accounts at the cost of $150.00 as stipulated in his letter for this service. Mr. Henry Jacobs and Mr. Francis Knapp representatives from Wayne County Treasurers Office were next heard from explaining percentage division of proceed from the sale of tax delinquent properties due to be divided between the State of Michigan, County of Wayne, and municipalities as quoted in Wayne County Treasurer's letter of September 14th, 1943. Figures were presented by them showing Wayne County Treasurer had estimated cash on hand for Dearborn Township in the amount of $141,154.14 and a formula based on actual disbursement of State Land Sales, monies was presented to Township Board for consideration. As formula set up and presented to Township Board seemed a fair and equitable method for distribution of funds. (156) page 181 continued Supervisor Daly, advised several residents from Van Born Little Farms Subdivision was in attendance to ascertain what had been accomplisher towards securing water, and believed regular producer should be waived, and hearing be granted them at this time. before proceeding with regular business. Supervisor Daly then called upon Engineer Orr, to outline work done and progress made towards solution. Engineer Orr, then advised in his opinion the War Production Board would turn down any application for priority if presented to them. showing an average of two and one half tons of cast iron per housed, he estimated approximately 63 toms of cast iron would be required to furnish water to a total of 25 houses, in this subdivision and this would be double the amount set up for each house by War Production Board. He also believed even if project was approved by War Production Board the cost od installing a water system in this subdivision where 25 housed were far apart account of subdivision being laid out in large lots, would not be warranted as he felt cost would be excessive as project if undertaken would be excessive, as project if undertaken would cost approximately $10,500.00, or at the least $400.00 per house. which would be far in excess of cost of any water lines previously laid in the Township and would be financially unsound and not in keeping with rates as set up in Ordinance. Mr Roney spokesman for the delegation appeared satisfied, the estimated cost of $400.00 per house was too high to be borne direct by Township but felt each house owner would be willing as outlined at last meeting to advance a considerable portion of the money to pay cost of installation, and thereby reduce cost to Township. After further study and figuring by Engineer Orr and consultation , Supervisor Daly, asked Mr. Roney if he thought each of the approximated 25 home owners, could raise $250.00 each to help defray the cost providing the War Production Board approved the application, he was sure each could and would be willing to raise the $250.00 and said he would call a meeting right away of the interested home owners in the subdivision and let Township Board know result. Jones, Odom,m Patterson, Mokersky and Daly, also present Attorney Bollinger and Engineer Orr. supervisor Daly advised meeting was called account complaints being received from Wayne County Drain Commissioner and Warren Construction Co. on November 18, 1943, relative to flooded basements, alleged to be caused by Dearborn Township connection on sewer system serving Lukasewicz Dearborn Subdivision, and also to hear from Engineer Orr, who had been asked to investigate and make a report to the Township Board. Engineer Orr, then explained that he met with Wayne County Drain commissioner and Mr. Moore their Engineer after his attention had been drawn to complaint, and after consultation, and inspection he agreed complaints was justified and in his opinion Dearborn Township was obligated to remedy and he would recommend that a new and separate 15" sewer line be constructed and tied in with our present system in the Watsonia Park Subdivision #3, to correct existing condition. Motion made by Mokersky seconded by Odom that Engineer Orr be authorized to contact several contractors requesting them to submit bids to Dearborn Township Board for construction of a 15" sewer main, on Jim Daly Road. Wilkinson, Dealer in Municipal and Corporation Bonds, 1228 Buhl Building, Detroit, Michigan Dated November 11, 1943, which offered $5000. Dearborn Township , Wayne County, Michigan 21/2% - 4-1/2% refunding Bonds dated March 1, 1942, due October 1st, 1968 at par and interest upon which he had an option on specific action relative to picking up these Bonds was taken. Supervisor Daly read a letter received from John J. Kozaren, Wayne County Treasurer dated November 15th, 1943 which showed considerable cash on hand which represents proceeds from sale of tax delinquent properties located in the Village o Inkster, Township of Dearborn, by th eState Land Office Board and which advise d these funds and Township in the Following percentage. State County .181% .0683% Township Village School .845% .6643% .1646% 100% Total Should Dearborn Township Board agree to accept settlement under this plan, Following action was taken by Dearborn Township Board and original of this resolution was forwarded to Wayne County Treasurer namely, Motion by Mokersky supported by Jones, RESOLVED THAT WHEREAS: the Township of dearborn has been requested by the County Treasurer, to agree to the distribution of proceeds from the sale of State Lands on a percentage basis as set forth in his letter of November 15th, 1943 and WHEREAS: the Treasurer of Wayne beginning with the 1940 Auction Sale conducted by the State Land Office Board, has made settlements to this Township of monies received from said Board for the sale of State Lands on the basis of proportionate amounts to all taxing units concerned, and WHEREAS: it has been necessary for the County Treasurer due to highly detailed and technical work in connection with the distribution of funds on this basis, to make a charge of 4% on such settlements and WHEREAS: the office of the County Treasurer has devised a formula of making the settlements on a percentage basis, there by reducing the amount of work involved, accelerating the payment of monies to the governmental units involved, and entirely eliminating the 4% operational charge. Clerk read a communication form Liquor Control Commission Lansing, Michigan dated November 22nd, 1943, which advised a request had been received from (Jennings J. Wise) 5901 N. Telegraph Road, Dearborn Township for a dance permit. After due consideration motion was made by Mokersky seconded by Odom the Clerk write Liquor Control Commission, advising Dearborn Township Bard has no objection to the granting of a dance permit and therefore recommends that same be granted to (Jennings J. Clerk read a communication from Liquor Control Commission, Lansing, Michigan Dated on August 20th, 1943, but which had just been received reading a request has been received from (Ann Dean) 24720 Ford Road, Dearborn Township, for a license to operate as a class "C" and which requested Dearborn Township Board to advise as to the advisability of licensing this establishment which is a request for transfer of class "C" license from Bill Montgomery to above applicant. Motion by Mokersky seconded Odom, that clerk be authorized to notify Michigan Liquor Control Commission that Dearborn Township has no objection to this transfer of class "C" license from (Bill Montgomery) to (Ann Dean) 24720 Ford Road, (163) page 188 continued and therefore recommends that transfer request be granted. Minutes of regular meeting of November 9th, 1943 and special meeting of December 1st, 1943, were read by clerk. Motion made by Mokersky seconded by Odom that minutes as read by clerk stand approved. Before proceeding further with regular business Supervisor Daly advised that Attorney Chenoske, representing several property owners of Van Born Little Farms Subdivision was in attendance and would be heard from at this time. Attorney Charnoske, then explained he was as stated appearing before the Board, in behalf of a number of property owners, to stress the great need of water in their subdivisions, he advised he gathered from the reading by the Clerk of minutes of previous (165) page 191 continued meetings as well as from other sources, that the opinion prevailed that cost of furnishing water to said district would be rather excessive and that Dearborn Township Board did not feel they were in a position to provide all money needed from the Water & Sewer Fund necessary to complete project, however, he felt regardless of cost some method of financing could be worked out, which would be acceptable to both Dearborn Township Board and residents seeking improvement and he solicited Engineers and Attorneys opinions as to approximate cost as well as proper procedure to be followed to secure necessary improvement, relative to cost, Engineer ORr, at this point advised Attorney Charnosek he estimated the Water System cost would approximate $1050.00 to serve the twenty five houses owned by the petitioners residing in Van Born Little Farms Subdivision. Township Attorney Bollinger then explained that residents, petitioning for Water were preciously advised at to approximate cost was well as procedures to follow, However he also stated it was the understanding at a precious meeting if each of the twenty five property owners would contribute 250.00 each or a total of $6,250.00, toward the cost of this project, Dearborn Township Board would finance balance of cost from Water & Sewer Fund, This arrangement seemed reassuring at this time, however it was later found nothing definite re-financing materialized. He also informed Attorney Charnosek, the Township Board was at all times anxious to furnish water tot he part of this subdivision petitioning for same, but deemed it quite in order to have some assurance that a portion of contemplated cost would be borne by the District benefited before undertaking project he believed the proper way to secure said improvement would be as stated several times previously to create a Special Assessment District and asked Attorney Charnoske, to endeavor providing he found out project would be honored by War Production Board, to work out a plan for the raising of a portion of contemplated cost, by the sale of $6,250.00, Special Assessment Bonds and providing sale was successful the Dearborn Township Board would arrange to provide balance of funds necessary to complete project, thereby giving relief as prayed for in their petition. Attorney Charnoske seemed agreeable to work along lines as suggested by Engineer Orr and Attorney Bollinger. Communication from Glenn T. Phillips, Landscape Architect and City Planner, dated Detroit Michigan December 10th. 1943, was read by clerk, wherein he outlined as per request of Attorney Bollinger, procedure for consideration of Township Board regarding preparation of a zoning ordinance and building code for the Township and also which outlined scope of service to be rendered for a stipulated monthly retaining fee.
