Approve the Registration and Reporting Procedure of Flight Regularity of the Civil Aviation of Ukraine (hereinafter - the Procedure), which is attached. 2. General Provisions 1.1. Registration and Reporting Procedure of Aircraft Flights Regularity of the Civil Aviation of Ukraine (hereafter – the Procedure) was developed in obedience to the requirements of the Air Code of Ukraine to bring the regulatory and legal framework, which governs the activity of the Civil Aviation of Ukraine, in accordance with the European Union (EU) standards and the standards of recommended practices of the International Civil Aviation Organization (ICAO) and International Air Transport Association (IATA). 1.2. The Procedure applies to: personnel of the Civil Aviation involved in the preparation, provision and flights operations, control after flights operations of the civil aviation aircraft; companies and organizations involved in training and support missions. 1.3. Procedure sets requirements for account, estimation and report of air ship flights regularity of the civil aviation aircraft and may be used by operators, air transport enterprises, and the Derzhaviasluzhba (State Aviation Service) to implement the accounting and assessment of flights regularity. 2. Normative references For development of this Procedure such regulatory legal acts were used: Air Code of Ukraine; Decree of President of Ukraine d/d July, 15, 2004 N 803 " On Government Aviation Security Service of Ukraine "; Decree of the President of Ukraine d/d August 16, 2004 N 912 "On Amending Certain Decrees of the President of Ukraine; The Air Traffic Service Procedures – the Aviation Rules of Ukraine, part 85 (hereafter – the Air Traffic Service Procedures), approved by the order of the Ministry of Transport of Ukraine d/d March, 25, 2002 N 199, registered in the Ministry of Justice of Ukraine on April, 10, 2002 by N 354/6642 (as amended); Regulation of time intervals of arrivals and departures at the international airports of Ukraine, approved by the order of the Ministry of Transport of Ukraine d/d July, 16, 2004 N 645, registered in the Ministry of Justices of Ukraine on Augusts, 3, 2004 by N 969/9568; Airport Handling Manual, IATA; Air Traffic Flow Management User Manual, CFMU Handbook, Eurocontrol; Standard Schedule Information Manual (SSIM); Worldwide Scheduling Guidelines, IATA. 3. Terms Terms used in this procedure have the following meanings: Airport - the enterprise that provides services in the handling of passengers, baggage, cargo and mail, providing flights operations and aircraft maintenance, and keeps and uses for its needs airfield, air terminal and other ground facilities, appropriate equipment and trained personnel; international airport - the airport intended for receiving and sending aircraft carrying international flights, and which undergoes customs, border, sanitary-quarantine, security and other statutory controls; aviation domestic airport - the state-appointed airport, which is intended to serve the aircraft, which operate flights only within this country territory; departure airport - the airport, from which under the agreement on air transportation carriage of passengers, baggage, cargo or mail starts; destination airport - the airport, where under the agreement on air transportation carriage of passengers, baggage, cargo or mail must be completed; intermediate airport - the airport, which according to the flight schedule provides transit aircraft landing; aerodrome - certain area of the earth or water surface (including any buildings, constructions and equipment) intended wholly or partly for aircraft arrival, departure, movement, parking and maintenance. If the term "aerodrome" is mentioned in the provisions relating to the flight plan and communication procedures, it also includes places that can be used by certain types of aircraft such as helicopters or aerostatic balloons; departure of the aircraft (off (off-block time) – the time of aircraft moving-off from a platform, places of stand, while towing or after the engines started for flight; operator’s daily flight plan - flight plan filed by the operator’s structural unit in accordance with the aircraft flight plan, scheduled and non scheduled, including its own aircraft fleet, which carry flights in other countries; allowed deviation from the slot (Slot tolerance) - time from five minutes to the slot and up to ten minutes after the slot, which can be used only by the Air Traffic Service (hereinafter - ATS) on aerodrome maneuvering area; delay departure of the aircraft - aircraft departure from the airport later than the time specified in schedule (flight plan); delay flight - the arrival of aircraft at the airport later than the end time specified in schedule (flight plan); Parking space (place of stand) - highlighted area on the platform with the appropriate equipment intended for aircraft parking; Airport Flight Plan - Airport flight plan prepared by an authorized unit of the airport based on a seasonal schedule of civil aviation aircraft plans and flight plans of the operators who have the appropriate permissions to use the airspace of Ukraine; platform - certain area of the airport to accommodate aircraft, for landing or deplanement of passengers, loading or unloading baggage, mail, cargo, refueling, parking or maintenance; flight plan (FPL) the fixed-form document which is given to the ATS bodies and contains certain formalized information about the intended flight, or part of flight required for processing, indication and operation of flight; repeating flight plan (RPL) - flight plan concerning some often repeated, regularly performed flights with identical basic features and provided by the operator for the ATS bodies to save and reuse; air traffic plan in the airspace of Ukraine – a plan which is daily filed by the Ukraerocentr (Ukrainian Air Center) on the basis of airspace users’ requests (plans) on flights with appropriate permissions from the authorized state bodies, and on the basis of permission on the airspace usage, given by Ukraerocentr (Ukrainian Air Center) and Region Dispatch Center (RDC); aircraft arrival (on-block time) - time of aircraft stop on platform, a parking space, after taxing or towing; late aircraft arrival (hereafter - LAA) is arrival of an aircraft at the air-port after the time, specified in schedule (air-port flights plan); airport capacity - the number of passengers, baggage and cargo and aircraft after types that can be served at the airport in an hour time (a combination of carrying capacity of runway, air terminal and platforms); capacity of air traffic services (Capacity) - the ability of ATS systems or any other operating subsystems to serve aircraft in its normal mode. It is determined in the number of aircraft belonging to a certain part of airspace in the definite period of time; Regulation - a method of bringing the needs of airspace in accordance with the declared capacity of ATS by limiting the number of flights, planning to enter a certain aerodrome or airspace, with the help of slots appointments; air ship flights regularity - includes the notion of aircraft departures regularity (for air-ports and operators) and flights operation regularity (only for operators). Flights regularity characterizes the work of air-ports, operators and the whole industry of delivery of passengers, baggage and cargo in accordance with contracts on transportation; aircraft departures regularity - regularity of departures is determined in percentage, as ratio of the regular aircraft departures toward the total number of aircraft departures specified in schedule (flights plan). If aircraft started from the parking space without delay, departure is considered regular; flights regularity - the regularity of flights is determined in percentage as the ratio of flights made regularly to the total number of flights specified in the schedule (flight plan); flight - a flight of aircraft (scheduled or unscheduled) that runs in one direction from the initial to the destination point of route; on-schedule flight - flight which is a part of the series of flights, associated with the transportation of passengers, cargo and mail, which is accessible for the public payment use and run in obedience to the officially approved schedule of tracking between the same two or more points, regardless of commercial load, and also in accordance with the requirements of Annex C Standard Schedules Information Manual it is given the J, G, F or A service type; unscheduled flight - flight which does not fall under the definition of scheduled flights; general aviation flight - aircraft flight (business-trip, private, training or distillatory flight), except for unscheduled and charter flights, where in accordance with the Annex C Standard Schedules Information Manual it is given the P, T, K, D, E, W or X service type; charter flight- flight, that runs on chartered aircraft under the charter contract (aircraft chartering), under which one party (aircraft owner) for a fee shall provide the other party (the charterer) with all capacity of one or several aircraft at one or more flights for the air shipment of passengers, baggage, cargo or with other purpose, if it does not conflict with the current legislation of Ukraine and that in accordance with Annex C Standard Schedules Information Manual is given C, H or O service type; calculated chocks removal time - - calculated time of the beginning of aircraft moving; scheduled time of arrival - the time of the aircraft's arrival at the airport, which consists of the actual time of takeoff, flight duration and time for taxing after landing; Slot of airport (time interval) – definite date and time (usually in the range of 15 or 30 minutes) of aircraft arrival to the airport or its departure from the airport; slot of air traffic control body - time of aircraft takeoff or landing, designated by the appropriate ATS body for the reasonable use of current capacity in points of flight route or in the destination air-port by establishing the air trafficking procedures with the purpose of the streams regulation efficiency; authorized unit - a unit of the airport or operator, entrusted with monitoring functions, accounting and reporting on the regularity; authorized person - the official of the authorized unit or the airport operator, which has the authority make control, accounting and reports on the regularity, assessing; scheduled take-off time - take-off time, which is calculated as the time of aircraft departure specified in schedule (flight plan), plus time for taxing and safety; taxi time - time from the moment of aircraft departure to takeoff or from time of aircraft landing to arrival to the parking space; operator - the person, organization or company that operates the aircraft, or offering their services in the field of air shipment and works industry. 4. Symbols and Abbreviations AAMS - automated airport maintenance system; Derzhaviasluzhba - State Security Aviation Service; ADS (OCC) – Airline’s Dispatching Service (Operations Control Center); ACDAC - AC deputy of the airport chief; W - runway; PC – parking space; ATS - air traffic services; AFP - airport flights plan; AC - aircraft; Slot (STOT) - Scheduled Take-off Time; CDSA - central dispatch service of airport; ARO - air traffic information gathering office (“after receipt order”); SSIM - Standard Schedule Information Manual, IATA; UTC - coordinated world time; VIP - very important persons (very important person). 5. General requirements 5.1. Flights regularity is one of the most important quality characteristics of passenger service. During air transportations operator, airport and business entities must follow the rules of air transportation of passengers, baggage, cargo and mail, set by current legislation of Ukraine. When scheduling flights operator must take into account the airports’ specific characteristics particular for calculation of taxi time after moving-off and time from landing to arrival. 5.2. On the basis of this Procedure the airports structures and operators should be provided with prepared instructions governing company’s account and report issues, concerning flights regularity and assigned duties of officials, and those who are responsible for provision of aircraft flights regularity in those issues. 5.3. The activities of operator are assessed by the level of departures regularity and the level of carried flights. Airport activities are assessed only with the level of aircraft departures from the airport. 5.4. The control over the flights regularity procedures is fulfilled by: operator - ADS (OCC) – Airline’s Dispatching Service, the authorized person of operator in the airport; airport - Central Dispatch Service (CDS) of the airport or authorized unit control the activity on the platform. 5.5. To identify and report about the reasons for the delay departures and violations of flights regularity, two-digit or alphabetic codes listed in Delay Classifier (Appendix 1) are used. 5.6. The Resolution of the authorized unit and the authorized person to ensure the aircraft departures regulatory, if it does not contradict the flights security, is obligatory for subordinate services involved in preparing aircraft departure. Departures regularity and flights are calculated and classified by airports and operators in accordance with paragraphs 6, 7 of this Procedure. 5.7. Slot for scheduled or unscheduled flights is mandatory for crew, operator’s representatives, staff of the corresponding airport services and companies involved in the planning of aircraft flights. The operator must agree with the airport coordinator the necessary alterations of departure time, which are more than 15 minutes than calculated time, taking into account current (within 72 hours) permits to use the airspace of Ukraine and the airport capacity, or directly with Eurocontrol new slot (STOT) and to notify about changes through the Air Traffic Information Gathering Office (ARO) as required in Air Traffic Service Procedures. 5.8. If the operator’s authorized person applied to the airport person authorized with information on cancellation of flight, SLOT for this flight is canceled. 5.9. According to its tasks, Derzhaviasluzhba posed for the operators and airports of Ukraine conditions of daily flight planning, accounting system, and analysis of statistical reporting and aircraft flights regularity of civil aviation. 6. Assessment of the aircraft operations regularity 6.1. Aircraft flights regularity includes the notion of departures regularity and the regularity of flights. 6.2. aircraft flights regularity assessed: for the industry as a whole - under regularity of departures from the airports of Ukraine and the flight operations in Ukraine; by operator - under regularity of departures and flights operations on its fleet; by airport – under scheduled departures regularity and non scheduled traffic (flight plan), regardless of their origin. 6.3. The level of flights operations regularity is included in the redistribution and the appointing of airlines for the operators on the competitive basis. 7. Aircraft departures regularity 7.1. Departure is regular if: the operation start time from PS correspond to the time determined by the AFP, and takeoff is performed according to Slot - windows; aircraft takeoff is performed later than the calculated takeoff time, but aircraft arrived at the destination point in time set in schedule (flight plan), allowing the deviations noted in subparagraph "6" of paragraph 8.1 of this Procedure. 7.2. Departure delay associated with flight or transportation of passengers and luggage from one airport to another is identified in the departures regularity report as the reason of arrival not the destination airport. 7.3. To provide the full covering of the vacant seats, identified after the registration of tickets and baggage clearance, the operator’s authorized person can make decision on the flight delay and shall agree with the authorized airport unit upon a new departure time, as stated in Item 5.7 of the Procedure. 7.4. The local departure time is indicated in schedule, but all airport services are coordinated by the World Time (UTC). 7.5. Aircraft departures regularity is defined in percentage as the ratio of regular aircraft departures to the total number of flights included in the AFP. 8. Flights Operations Regularity 8.1. The flight is performed regularly, if aircraft arrived at a destination airport: a) not later than the time specified in schedule (flight plan); b) on arrival time later than that set in schedule (flight plan): not more than 10 minutes - for flights of up to 3 operation hours; not more than 15 minutes - for flights lasting from 3 to 6 hours; not more than 20 minutes - for flights lasting more than 6 hours. 8.2. Taxing and air traffic security require the time depending on the features of the airport, but not less than: departure - to 15 minutes; on arrival of aircraft with a maximum certification take-off mass 136 tons - more than 15 minutes, for aircraft with a maximum certification take-off mass less than 136 tons - 10 minutes. 8.3. Aircraft arriving not a destination port but to another airport in the same city in time set in schedule (flight plan) is considered regular. 8.4. Flights operation regularity is determined in percentage as the ratio of the of flights carried out regularly to the total number of flights planned in the schedule of flights (airport flight plan). 9. The accounting procedure of flights regularity 9.1. Aircraft departures regularity is calculated under all transportation flights performed on schedule and unscheduled with passengers according to the airport flight plan. Accounting of departures and implementation of cargo and business flights are conducted separately. 9.2. In the case of aircraft landing at airports which were not planned in the schedule (flight plan), the regularity of their departures from these airports are not counted. 9.3. The responsible for the aircraft departures delay is the airport where there was a delay for the following reasons: a) limitation or abandoning of aircraft receiving (cleaning or unscheduled repair of the runway, the malfunction of radio and light support, evacuation of the aircraft flight from flying field, except for weather conditions). The reason for the delay is the message about limitation or abandoning of aircraft receiving; b) failure: Customs, immigration, aviation security services; subordinate services involved in commercial aircraft maintenance; companies (companies) involved in the preparation of aircraft departure. б) Working malfunction of: customs bodies, immigration services, aviation safety service; subordinated services participating in commercial servicing of aircrafts; companies (enterprises) participating in preparation of aircraft departure. 9.4. Departure delays made of the fault of the flight personnel cabin crew, are relied on operators with the subordination of the crew members. 9.5. Flights are excluded from the number planned for the calculation of flights regularity in the case of there cancellation, regardless of cause. 9.6. In case of change of the aircraft type a new slot of departure is assigned, regarding type of this aircraft, peculiarities of the technological schedule of aircraft ground maintenance and capacity of the airport. The flight operation regularity and return departure from the fly back airport are taken into account based on the time specified in the previous flight plan. 9.7. If necessary, it is possible to replace the aircraft with two or more aircrafts with smaller passenger capacity. Departure of the first aircraft is executed in accordance with the schedule, the following – in accordance with the preceding flight plans (after slot coordination with the airport) with a total flight time interval between the first and the last aircraft not more than 5 minutes of sync. If the minimum noted time is not observed departure is considered irregular. 9.8. If necessary, it is possible to replace two or more aircrafts with aircraft of greater passenger capacity. Departure regularity is carried in accordance with the scheduled departure of the first aircraft, second departure is excluded from the plan due to lack of loading. In the same order departure from the reverse flight airport is calculated. 9.9. In case of transfer of the flight to the next day, regularity of this departure is calculated relatively to AFP on that day when there is the priority of aircraft departure in AFP. 9.9.1. Duration of aircraft delay is calculated from the time specified in the AFP, till the appointed date of departure next day. 9.10. Regularity of flight operation, which starts on one calendar day and ends - on the next (being specified in AFP), is carried on the day, when the end of the flight is planned. 9.11. Priority of ground maintenance is granted to the aircrafts, which arrived without a violation of assigned slot. 10. The procedure of reporting about regularity violation 10.1. Each violation of the regularity of scheduled and unscheduled flights with passenger transportation must be fixed in the report about regularity violation (Appendix 2). 10.2. Head of operational shift of the company or ACDAC organizes and conducts an investigation of the reason for aircraft departure delay, determine the final cause and service, which allowed the delay. Conclusion about objectivity of determining of departure delays is made up by CDSA head, where there is no CDSA - the airport chief. 10.3. Report about delayed departure is made by the representative of CDSA and agrees it with operator’s representative. A copy of the airport report shall be sent to the operator, which aircrafts are handled at the airport, and it is the basis for making the report about fulfilling the flight in the airline. In case of disputable conclusions of the CDSA and ADS (OCC) an additional investigation into the causes of flight delays is conducted and summery report about violation of regularity is issued. 10.4. Flight Delay Report is made up by ADS (OCC) under the copy act of aircraft’s maintaining airport, information from operator’s agent abroad, and the information from the commander of the flight crew. 10.5. There is no reporting about flight delays due to weather conditions and late arrival of aircraft. 10.6. Flight delay report must be made before departure by the authoritative member of the running shift and submitted for signing to ACDAC no later than one hour after departure. The report is fully processed after its signing by ACDAC (for operator - the head of the OCC. 10.7. If a representative of the operator does not agree with the code of delay, in the "representative of the operator" space the phrases "signature refused" or "watch special opinion” are admitted and a brief written explanation must be attached. 10.8. Reasons for delays and services, which made the delay possible, are determined according to the Classifier of Delay in accordance with Annex 1. But in addition all causes of delays must be attributed to particular individuals, departments or organizations that should prevent the violation of regularity. It means that all delayed flights are to be distributed: the fault of the operator AC; because of the airport "AP"; the fault of the "ATS" bodies; by weather conditions, "WC"; late arrival of aircraft under the scheduled flight, "LAA". 10.9. If the delay of aircraft departure occurred for several reasons for violations of technological departure preparation schedule, it is the reason that was decisive. If the flight delay occurred for several reasons, it is one of the reasons, which was first. But all the causes relating to a violation of a technological departures preparation schedule are subject to investigation. The departure delay report should display all the reason for the flight delay. 10.10. Departure delays due to aircraft’s evacuation are assigned to the service which was responsible for the occupied airfield, besides if the time of evacuation was exaggerated - the service that is responsible for terms of evacuation. Violations of flights regularity due to evacuation of governmental aircrafts are relied on the authorities of the departments managing these very aircrafts (under commission’s resolution). 10.11. Accounting of departure delays flight operations are conducted in the airport flights plan (AAMS) using two- digit or two-letter codes according to Annex 1 of this Procedure. 10.12. Accounting of departure delays and flight operations are formulated in daily flight plan and flight operation summary of the airline (for airport). Form of the operation summary is presented in Appendix 3. While processing the flight plan, indicate: operator’s name in accordance with document of ICAO, Doc 8585 "Symbols of flight-operating agencies, aviation authorities and services”; Type of aircraft in accordance with the document of ICAO, Doc 8643 "Symbols of aircraft types”; airport in AFTN codes in accordance with the requirements of the document of ICAO, Doc 7910 "Localization (index) indicators”. 11. Reporting 11.1. Reporting on regularity of scheduled and unscheduled (flight plan) aircraft departures, regardless of their presence at the airports of civil aviation, relies on CDSA (authorized unit). 11.1.1.Report on the regularity of aircraft departures from the airport in accordance with the form, which is given in Annex 4, the airport (airline), regardless of ownership, must be sent not later than the 5-th day after the reporting period, to the Air Shipment Regulations Department and the Department of Licensing State Aviation Service. 11.1.2. The report shall include the information about all performed departures, regardless of their origin, carried out by domestic and international flights. 11.2. Operator independently conducts monthly and annual accounting and analysis (free style form) of the regularity of his/her own fleet flights, which include the following statistical information about the number of: on schedule flights; completed flights; regular flights: delayed flights, including those due to weather conditions or other reasons. Report on the regularity of departures of own fleet (annex 5) must be sent not later than the 5-th day after the reporting period, to the Air Shipment Regulations Department and the Department of Licensing State Aviation Service. 11.3. Summary report on the regularity of departures flights from airports of Ukraine is composed in Derzhaviasluzhba (State Aviation Service) based on reports received from the airports, following the form of Annex 4. 11.4. Summary Report on the regularity of flights operations carried by operators of Ukraine is composed on the basis of reports received from operators, following the form of Annex 5. Description of the code can consist of several provisions. In case of doubting the correctness of presentation an international system of units is used for clarification. It is important that the codes are used for messages, reflecting actual fact, and in any case – for messages about the clearing up of relationships. 1. Standard codes 1.1. Domestic airline codes 00 - 05 These codes are left for the airlines, so each of them can meet the individual requirements of the airline 1.2.
