DETERMINING POSITIONS ELIGIBLE FOR THE DEFINED CONTRIBUTION
RETIREMENT PROGRAM
BE IT RESOLVED that the above ordinance, being Ordinance 30-2008 as
introduced, does now pass on first reading and that said Ordinance shall be
considered for final passage at a meeting to be held on January 6, 2009 at 7:00
p.m. or as soon thereafter as the matter can be reached at the regular meeting
place of the City Council and at such time and place all persons interested be
given an opportunity to be heard concerning said Ordinance and that the City

WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local
unit to have made an annual audit of its books, accounts and financial
transactions; and
WHEREAS, the Annual Report of Audit for the year 2007 has been filed
by a Registered Municipal Accountant with the City Clerk of the City of
Hackensack as per the requirements of N.J.S.A. 40A:5-6, and a copy has been
received by each member of the governing body; and
WHEREAS, the Local Finance Board of the State of New Jersey is
authorized to prescribe reports pertaining to the local fiscal affairs, as per R.S.
52:27BB-34; and
WHEREAS, the Local Finance Board has promulgated a resolution
requiring that the governing body or each municipality shall by resolution certify
to the Local Finance Board of the State of New Jersey that all members of the
governing body have reviewed, at a minimum, the sections of the annual audit
entitled:
General Comments
Recommendations;
WHEREAS, the members of the governing body have personally reviewed
as a minimum the Annual Report of Audit, and specifically the sections of the
Annual Audit entitled:
General Comments
Recommendations
as evidenced by the group affidavit form of the governing body; and
WHEREAS, such resolution of certificate shall be adopted by the
governing body no later than forty-five (45) days after the receipt of the annual
audit, as per the regulations of the Local Finance Board; and
WHEREAS, failure to comply with the promulgations of the Local Finance
Board of the State of New Jersey may subject the members of the local
governing body to the penalty provisions of R.S. 52:27BB-52 – to wit:
R.S. 52:27b – “a local officer or member of a local governing body who,
after a date fixed for compliance fails or refuses to obey an order of the director
(Divison of Local Government Services), under the provisions of this Article, shall
be guilty of a misdemeanor and, upon conviction, may be fined not more than
one thousand dollars ($1,000.00) or imprisoned for not more than one year, or
both, in addition, shall forfeit his office.”
NOW, THEREFORE, BE IT RESOLVED, by the governing body of the
City of Hackensack that it hereby states that it has complied with the
promulgation of the Local Finance Board of the State of New Jersey dated July
30, 1968 and does hereby submit a certified copy of this resolution and the
required affidavit to said Board to show evidence of said compliance.

WHEREAS, Bergen County Community Development Grants have been
proposed by the following organizations located in the municipality of
Hackensack, New Jersey; and
WHEREAS, pursuant to the State Inter-local Services Act, Community
Development funds may not be spent in a municipality without authorization by
the Mayor and City Council; and
WHEREAS, this resolution does not obligate the financial resources of the
municipality and is intended solely to expedite expenditure of the aforesaid
Community Development Funds.

WHEREAS, the New Jersey Board of Public Utilities, Office of
Clean Energy administers the Local Government Energy Audit Program
(Program), an incentive program to assist local government agencies to conduct
energy audits and to encourage implementation of energy conservation
measures; and,
WHEREAS, the Governing Body of the City of Hackensack has
decided to apply to participate in the Local Government Energy Audit Program;
and,
WHEREAS, the facilities to be audited are in New Jersey, are
owned by the City of Hackensack, are served by a New Jersey regulated public
utility, and that the City of Hackensack has not already reserved $100,000 in the
Program this year as of this application; and,
WHEREAS, it is acknowledged that acceptance into the Program is
dependent on the Scope of Work and cost proposal, and that Program rules will
have to be met in order to receive incentive funds; and,
WHEREAS, upon acceptance into the Program, the City of
Hackensack will prepare Facility Data Forms and Scopes of Work for each facility
to be audited, solicit quotations from the authorized contractors, and submit the
Part B application; and,
WHEREAS, the City of Hackensack understands that energy audit
work cannot proceed until a Application Approval Notice is received from the
Program; and,
NOW, THEREFORE, BE IT RESOLVED that the Governing Body
of the City of Hackensack, approves the submission of an Application for
participation in the Local Government Energy Audit Program of the New Jersey
Board of Public Utilities.

WHEREAS, the governing body of the City of Hackensack has been
advised that an emergency affecting the safety and welfare of the citizens of the
City of Hackensack and the general public did occur when a sewer line collapsed
on Frederick and Washington Streets; and
WHEREAS, the Project Manager notified the City Manager setting forth
the circumstances regarding the emergency; and
WHEREAS, the governing body is satisfied that an emergency did exist
and that immediate action was necessary to restore the aforementioned lines to
full operation; and
WHEREAS, the cost of the repairs totaled $10,847.13, which was a fair
and reasonable quotation; and
WHEREAS, the Chief Financial Officer has certified that funds are
available in account #8-01-201-25-311-311-204 of the Current Budget, Purchase
Order #164041;
NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council of
the City of Hackensack that pursuant to N.J.S.A. 40A:16 which authorizes the
governing body to award contracts without benefit of public bidding in emergency
situations and the vendor, J. Fletcher Creamer and Son, 101 East Broadway,
Hackensack, New Jersey 07601, be paid therefore.

been engaged in negotiations for a new collective bargaining agreement between

WHEREAS, various Year 2008 bills have been presented for payment this
year, which bills were not covered by Year 2008 Budget Appropriations; and
WHEREAS, N.J.S. 40A:4-58 provides that amounts in excess of
appropriations over and above the amounts deemed to be necessary to fulfill the
purpose of such appropriations may be transferred to appropriations deemed to
be insufficient during the last two months of the year.
NOW THEREFORE BE IT RESOLVED by the Mayor and City Council of
the City of Hackensack that the transfers in the amount of $1,317.00 be made

WHEREAS, pursuant to N.J.A.C. 5:23-4.5A, the City of Hackensack
advertised for, and, received proposals for daytime ambulance services for the
City of Hackensack for the hours of 6:00 am to 6:00 pm, Monday through Friday,
in accordance with N.J.S.A. 40A:11-4.5. Competitive contracting proposals;
solicitation process; and
WHEREAS, three Emergency Medical Services proposals were received
from Hackensack University Medical Center, Holy Name Hospital and FUCHS
E.M.S; and
WHEREAS, the Mayor and City Council, upon recommendation of a
committee consisting of the City Manager, the City Attorney and the Purchasing
Agent, are desirous of awarding the contract to Hackensack University Medical
Center,
NOW, THEREFORE, BE IT RESOLVED that Hackensack University
Medical Center be awarded the contract to supply daytime ambulance services
to the City of Hackensack; and
BE IT FURTHER RESOLVED that the Mayor and City Council authorize
the City Manager to execute a contract with Hackensack University Medical

Center, to perform the afore-described services in accordance with the proposal
submitted; and
BE IT FURTHER RESOLVED that the City Clerk publish a Notice of this
action once in The Record, and upon execution, retain a copy of the contract for
public inspection.
