1. Tenders are open to all contractors registered with Ministry of Finance
(Bidang 22 sub- bidang 03 pecahan sub-bidang 01).
2. Registered with Pest Control Association Malaysia (PCAM) or Bumiputra
Integrated Pest Management Association (BIPM).
3. Contractors must own valid licenses both for pest control management and pesticide keeping from the Ministry of Agriculture Malaysia.
4. Site visit is mandatory . Site visit and clarification will only be done once.
All contractors are to assemble at the specified date and time. Contractor who failed to participate in the site visit is considered not interested with the
Tender.
5. The sealed envelope containing the tender Documents (duly completed and signed) is to be hand delivered so as to reach the specified tender box
(Tender box A) not later than the specified time as stated.
6. Any tender delivered after the stipulated time from whatever cause arising will not be considered.
7. A tender shall not be considered if all the Conditions of Tendering are not strictly adhered to.

1. No Variation
The Contractor shall note that a fixed and firm price tender is called for and no variation whether by way of increase or decrease in cost of materials or labour or otherwise which may take effect between the date of tender and the date of delivery shall be permitted or be taken into account in the amount payable to the Contractor.
2. Discrepancy
It will be the sole responsibility of the Contractor to scrutinise all the
Contract Documents supplied to him/her and satisfy him/her that they are exact copies of those included in the tender table documents. In the event or any discrepancy being found between such copies supplied to the
Contractor and those included in the tender table documents it will be the sole responsibility of the Contractor to apply to have such discrepancy rectified before the final date for submission of tenders stipulated in the
Form of tender.
3. Validity
Tender shall remain valid ninety (90) days from the final date for submission of tender and no Contractor may withdraw his/her tender within that period.
4. Tender Deposit (Earnest Money)
Tender Deposit (Earnest Money) of RM 1,000.00 shall be delivered together with the completed tender documents. The Bank will not be responsible for any loss due to the Contractors’ negligence. This earnest money shall be returned to all unsuccessful Tenderer. The successful
Tenderer’s earnest money will be returned on submission of valid performance bond (5% of the annual contract sum)

1. INTRODUCTION
This specification details the termite interception and baiting system requirements of Bank Negara Malaysia (BNM). The areas covered under this contract are as follows: -

Site location stipulated for the above service execution is as per attached layout plan drawing and site visit.
The specification refers to the circumstances that currently prevail at the site. Some alteration may occur from time to time during the period for which the contract is extant. In these cases the Contractor may be required to vary the type of service supplied. Such variations will be cost in accordance with the variation rates quoted in Form of Tender document.
2. SITE VISIT
It is a condition that Contractors wishing to tender must visit the premises to acquaint themselves with all aspect of the site and any restrictions that may affect their ability to perform the work detailed in this specification. Any claims, which may subsequently arise because the contractor has not satisfied this condition, will not be entertained. Whilst every effort has been made to provide accurate information with respect to
Schedule of Work Area , the Bank cannot be held responsible for any errors or omissions. It is therefore the C ontractor’s responsibility to confirm that these areas are correct in order to price the work. Any discrepancies should be brought to the attention of the Bank.

3. PERFOMANCE BOND
The Contractor must warrant a performance bond of 5% from the total sum of the annual contract in the form of Bank guarantee throughout the duration of the contract.
4. MATERIALS AND WORK
The Bank reserves the right to reject any materials and works non compliance to the specification. Replacement of rejected materials and works and any additional charges related are to be borne by the Contractor.
5. STAFF REQUIREMENT AND WORKING HOURS / DAYS
Four (4) workers including One (1) Supervisor shall be provided at every time for execution of the said service, as follows:-
8.30 a.m. to 5.00 p.m. a. Monday to Friday

or prefixed visiting day)

6. TRANSPORTATION AND STORAGE
: 8.30 a.m. to 5.00 p.m.
The Contractor shall provide a van/any car in order to transport their workmen, chemical or equipment. Other than the stipulated area as reported, no chemicals/materials are allowed to be stored onsite.
7.
CONTRACTOR’S EMPLOYEES
The Contractor is solely responsible for their employees.
The Contractor shall provide the Bank with a list of names of all personnel working on site and should keep that list up-to-date by notifying in writing as they occur.
It is the responsibility of the Contractor to ensure that: -
a. All employees should record time in and out at security counter. b. Non- Malaysians have a valid entry visa and work permit. c. The employees have no criminal records. d. The employees agree to be searched if required.

e. Any employee, agent or subcontractor found to be under the influence of alcohol or drugs should be removed from the Bank premises immediately. f. All employees must wear uniforms, nametags and BNM security pass.
8. WORK PRIORITY AND SKILLS OF EMPLOYEES
The Contractor must ensure that all their employees and agents involved in the Services are competent and have all the skills and qualifications necessary to carry out the Services in accordance with the
Contract.
The Bank may at any time by notice in writing to the Contractor require that any person(s) employed by the Contractor are not engaged in carrying out the Services or any part thereof and the contractor shall forthwith replace any such person(s) with an alternative person(s) acceptable to the Bank.
9. WORK SCHEDULE & REPORTING SYSTEM
Upon appointment, the Contractor would be required to schedule for the year all tasks, which are to be performed. The maintenance schedule shall be such that the C ontractor’s work would not interfere with the operation and working of the Bank and its officers. In areas where the
Contractors are required to be accompanied, the work has to be coordinated with the relevant officers.
To facilitate the monitoring of work done in periodic circle, the
Contractor is to prepare a monthly report for each task (e.g. station hits with termite feeding activities) in which the areas, dates of work done, the period
(e.g. twice a week) etc. are clearly tabulated for easy reference.
10.
USER’S ACCEPTANCE
The Bank will regularly monitor the performance of the Contractor in relation to the requirements of the Specification and will from time to time take a random sampling test for this purpose. Such audits will seek to confirm that specified tasks are carried out at the scheduled frequency and in the manner as defined in this Specification. The Bank reserves the right to instruct that the maintenance to be repeated, deduct payment or withhold payment in the case of unsatisfactory performance or incomplete work. The
Bank will also compare the actual allocation of labor and the provision of equipment and materials against those indicated in the Terms and Condition of the tender.

The Contractor will be given an opportunity to accompany the representative of the Bank during inspections.
11. ROLES AND RESPONSIBILITIES
The roles and responsibilities of the parties associated with operation of this Contract are set out in broad terms below:
BNM:
Job monitoring i.e site inspection and auditing;
Payment certification;
Performance measurement.
Contractor:
On job supervision;
Record keeping;
Reporting as required;
Supply equipment and materials;
Maintenance of skill levels;
Safety assurance.
Joint Management Group:
Review and monitor performance and relationships of the parties to the Contract; and
Review and plan improvement initiatives.
12. EQUIPMENT, MATERIALS AND CHEMICALS
The Contractor is responsible in providing all the necessary equipment, materials, transportation, machines and chemicals (including all consumable items such as chemicals, etc.) to meet the Specification. A list of these chemicals must be submitted. However, the contractor must provide equipments and materials as stated in the list prepared by the Bank.
The Contractor will be responsible for any damages caused to the surface of the building, or furniture, fixtures or fittings as a result of misuse of equipment or materials, or by negligence whilst carrying out his/her works.

13. REPORTS ON BREAKDOWN AND DAMAGES
In the event of any damages and breakdown to the Bank premises and properties noted by the Contractor and its employees they should notify the Bank at once for rectification and repairs.
14. OCCUPATIONAL HEALTH AND SAFETY
The Contractor must have in place procedures to ensure the safety and well being of their employees whilst they are engaged on termite baiting work and the Bank staff and the public visiting the Bank. These procedures must also comply with any relevant statue. The Bank will not be responsible in dealing with authorities in case of non-compliance found during the contract period.
15. INSURANCE
The Contractor shall have a valid insurance cover for workmen compensation and public liability. A copy of the insurance policy shall be given to the Bank for reference.
16. PAYMENT AND RECOVERY OF SUM DUE
The Contractor is required to submit an invoice together with service reports of the respective calendar month. Service reports should detail a periodic operations completed, attendance, Site Instruction, Non
Conformance Report, Schedule of Deduction, Work Done
Acknowledgement, Extra Services, etc. during the month.
Payment for periodic tasks and special operations will only be sanctioned for payment upon presentation confirming the Bank’s satisfaction with the work undertaken.
It is a condition of the contract that any sum of money recoverable from or payable by the Contractor may be deducted from any due to the contractor at that time, or which become due to the contractor at some later time.
Deduction of the payment will be based on uncompleted or unsatisfactory works.

17. ASSIGNMENT/ VARIATION/ TERMINATION OF CONTRACT
The Bank reserves the right to vary the contract should the need arise. This may result in a change in the contract price.
The Bank may terminate the contract at any time and without stated reason upon giving one-month notice in writing.
If the contractor fails to meet the requirements of the specification he will be advised of the failure in writing and be allowed a fixed time in which to remedy it. Failure to do so in the allotted time may result in termination of the contract upon seven days notice in writing.
The Bank reserves the right to terminate the contract at once in the event of any serious breach of contract or misdemeanor on the part of the
Contractor.
18. CALL-BACK SERVICES
Should there be re-infestations of controlled pests during the contract, the Contractor will render additional services without charges .
The services include removal and disposal of any waste of dead pests surrounding the termite baiting stations and any other related complaints from the Bank. These services will be rendered immediately upon receipt of notification.
19. LICENSE
The successful Contractor will be req uired to provide a valid “Pest
Control License” with an expiration date beyond that of this contract or proof of renewal ability. Should this license expire and be renewed within the term of this contract, the contractor shall promptly provide the Bank with a copy of the renewed license.

A. GENERAL REQUIREMENTS
1. LOCATION / SITE VISIT
The Contractor must visit the site and justify the correct scope of works involves for the Bank will not pay any additional charges for any reason on site condition.
2. SOCIAL WORKER SAFETY ACT 1969
The Contractor must abide to the terms and condition as ruled in the Social
Worke r’s safety Act 1969 .
3. TRAFFIC CONTROL AND SIGNAGE
The Contractor must ensure appropriate signage are used while carrying out his work to ensure safety of the public.
4. SERVICES
The Contractor shall carry out the termite interception and baiting system for
Bank Negara Malaysia Lanai Kijang, Resort at Port Dickson and Security
Quarters at Shah Alam as detailed in the Scope of works below and in this
General Requirements incorporating the specifications for the service, for a period of 36 calendar months of possession of site or within such extended time as shall be determined by the Bank.
B. GENERAL TERMS
1. The work provided shall be the Termite interception and baiting system. The
Contractor shall ensure that the Bank Negara Malaysia Lanai Kijang, Resort at Port Dickson and Security Quarters at Shah Alam are free from all termite colony.
2. The Contractor shall be fully responsible on the method of treatment and the frequency required. Methods of treatment and chemicals used shall be approved by the relevant authorities.
3. The specification, scope of works and schedules for the termite interception and baiting system shall form part of and to be read in conjunction with this
General Requirements.

C. RESPONSE TIME
1. Response time shall immediately after receiving complaints by the
Contractor via telephone calls, complain forms, fax or emails. The response time shall be not more than twenty-four (24) hours after receiving the complaints.
2. The Bank has the right to appoint other persons to undertake any portion of the works without any notice if the Contractor failed to follow the stated response time. All cost of work undertaken by the third party shall be fully recoverable form the Contractor. Fair rate shall be used to determine the cost of works involved.
3. The Bank has the right to deduct any payment due to schedule maintenance not done according to schedule as stated in the specification.
D. VERIFICATION OF COMPLETED WORK
All Completed works shall be verified as follows: a. Dated color photos taken before, during and after works b. Signoff form by the Bank’s Supervising Officer (S.O)
Daily/Monthly list of completed works / closed work orders shall be submitted to the S.O’s office in soft and hard copies for clarification and monthly payment process.
E. RULES, REGULATIONS AND STANDARDS
1. All works performed including personnel performing the work, material and equipment shall comply with the requirements, rules and regulations of the following: a. Suruhanjaya Tenaga b. Tenaga Nasional Berhad (TNB) / Supply Licensee c. Jabatan Keselamatan Pekerjaan dan Kesihatan (DOSH) d. Jabatan Bomba dan Penyelamat (BOMBA) e. Jabatan Alam Sekitar (DOE) f. Jabatan Kerja Raya (JKR) g. Syarikat Bekalan Air Selangor (SYABAS) h. Other Government Departments, utility authorities /local authorities,
Licensees and Companies having jurisdiction over the Services and facilities.

2. In addition, the following regulations / standards shall be complied with: a. The Electricity Supply Act 1990 b. The Electricity Regulations 1994 c. MS.IEC 364:1996 or BS 7671:1992 (IEE Wiring Regulations) d. Occupational Safety and Health Act 514:1994 e. The latest Malaysian Standards and /or IEC Standards f. JKR Standard Specifications g. Be in accordance with and be subject to the approval for the Supervising
Officer (S.O).
3. The Contractor shall be responsible for the submission of all the necessary applications to the relevant utility authorities/ local authorities, other relevant authorities and licensees in connection with the execution of the works in this Specification, Summary of Tender and Form of Tender.
F. SCOPE OF WORK FOR TERMITE INTERCEPTION AND BAITING
SYSTEM
1. METHOD a. A thorough inspection to all of BNM building structure shall be carried out to confirm the locations of termite infestations and cause factors. The contractor must use the appropriate termite detection equipment i.e
TERMATRAC-radar detector, thermal imaging camera or moisture meter. b. Upon detection of active termite colonies, the Above Ground (AG) station must be installed. c. This station must be checked and additional supplement must be added every two (2) weeks until termite activities ceased. d. When feeding has not been observed for two consecutive monitoring periods, the Above Ground (AG) Station will be removed. e. In Ground stations must be installed at least 4 meters centre to centre at every linear meter close to the building. This station must be equipped with six (6) interceptors. f. In Ground stations must be checked once (1) a month. The Contractor must prepare a detailed inspection schedule and su bmit it to the Bank’s S.O. g. If active feeding is detected in the In Ground stations, baits supplement station should be added by stacking it on top of existing interceptors
’ station.
This station shall be inspected every two (2) weeks and additional supplement must be added until termite activities ceased.

h. Spoilt / rotten interceptor must be replaced with new ones. i. All stations must be coded to provide easy tracking. Bank Negara Malaysia must be notified a minimum of one (1) week in advanced of inspection scheduled. j. In accordance to items no. c and g, if any “hits” are detected during an inspection, the Contractor must check every-two-weeks until no more feeding activities are detected for the next two (2) consecutive months. k. Upon completion of services provided during the inspection, the Contractor shall complete and present the service report to the contract administrator.
As part of the report, the Contractor must include a diagram showing the bait stations, indicating the service performed on each station, infestation present and corrective action taken. The diagram must be coded accordingly. l. The Contractor shall perform all services in a safe manner and in accordance with the most modern and professional pest control procedures.
All workmanship shall conform to National Standards and meet all local, state and federal codes (item E) that govern.
2. REPRESENTATIONS OF CONTRACTOR
The Contractor represents and warrants: a. that he/she will provide all necessary labour, materials and equipment to accomplish the hereafter described work in a professional manner. b. that he/she is financially solvent and that he/she is experienced in and competent to perform the type of work. c. that such temporary and permanent work required by the contract documents as is to be done by him/her can be satisfactorily constructed and used for the purpose of which it is intended and that such construction will not injure any person, or damage any property. d. that he/she has carefully examined the specifications and the site of work and that from his/her own investigations, has satisfied themselves as to the nature and location of the work, character, quality, quantity of materials likely to be encountered and character of equipment and other facilities needed for the performance of the work, the general and local conditions all other materials which may in any way affect the work or its performance. e. the Contractor is responsible to present with product liability for free. This is to cover the likelihood of BNM property been damaged by termite attack after the installation of the Termite Interception and Baiting System.

3. CHEMICAL AND APPLICATION a. Approved chemical bait containing termite food with insect growth regulator and does not contain any repellent ingredient. b. All chemicals used must be approved by Pesticide Board of Malaysia. The
Contractor is required to submit a copy of approval note before commencing the work on site. c. Use only recommended dosage by the manufacturer to achieve optimum results. d. All monitoring station must be filled with attractant to intercept the termite.
4. PRECAUTIONARY MEASURES a. The Contractor shall be responsible for any deficiencies and shall correct it at no cost to Bank Negara Malaysia. b. The Contractor shall at times keep the premises free from accumulations of waste materials or rubbish caused by his work or employees. c. Upon completion of the project, the Contractor shall be responsible for the removal of all unused materials, equipment, scraps and debris resulting from the work.
