The Women’s Civic Club of Nepperhan, one
of Yonkers’ oldest community organizations, held
its 85th annual scholarship luncheon April 20 at
the Ukrainian Youth Center on Palisades Avenue.
In 1928, a meeting of civic-minded women
in the Nepperhan Community, now known as Runyon Heights, was organized and convened by the
late Mrs. Cora A. Ross. After years of working
together for the betterment of their community,
the women decided to make their union official
and The Women’s Civic Club of Nepperhan was
incorporated in 1935.
Since that time, the club has modified its role
with the Yonkers community, which has always
been its primary focus. Over the last 70 years,

The City of Yonkers honored its Gold
Star Mothers, whose sons died in combat protecting our country, with an April 21 luncheon
at Westchester Manor.
Gold Star Mothers Yonkers Chapter
President Hope Hollingsworth-Coaxum welcomed those in attendance and thanked them
for supporting this group of special women.
Hollingsworth-Coaxum also introduced hon-
oree Jessica Bryan, founder of Step Into Their
Boots, an organization dedicated to helping
America’s youth understand and appreciate
what a fallen hero has done for us and our
country, and to help promote volunteerism,
patriotism, camaraderie and community service.
Jack Lotz of the Central Committee of
War Veterans was the master of ceremonies.

Saga Ends… Finally

Former City Councilman Liam McLaughlin
threw his hat into the ring and announced last week
that he is a candidate for City Council president.
McLaughlin kicked off his campaign at the Sprain
Lake Golf Club to a large crowd of family, friends
and supporters.
“People who know me know that I’m not one
to sit on the sidelines when there’s a job to be done
– and the job of making Yonkers a better city is
not done yet,” he said. “We face tremendous challenges: putting people back to work, continuing to
grow our economy, funding our schools, and improving our quality of life. I’m running for City
Council president to tackle these challenges headon and help lead Yonkers to a better future.”
McLaughlin, a Republican who served on the
City Council from 1999 to 2009, will likely receive
the nomination of the Yonkers GOP next month,

Affordable Housing Law Options

City Councilman Christopher Johnson
recently held an informational meeting to
discuss options under review for a new Affordable Housing Ordinance for Yonkers. The
meeting was held in his First District at the
Charter School for Educational Excellence on
Warburton Avenue.
Johnson provided the 50 or so in attendance with a detailed handout, which compared the three options under review: a plan
drafted by the City Council, a plan drafted by
Mayor Mike Spano, and Johnson’s preference
for a new affordable housing law.
The most important number in any new
affordable housing law is the percentage of
units that a developer who is building more
than 10 units of housing must put aside as affordable units. Both the City Council versions
and the mayor’s version have 10 percent set
aside; Johnson would like to see 20 percent.
“If a developer builds 100 units, 20 of
those units should be affordable housing,”
he said. “The people in this district, and all
around the city, need affordable housing and
I’m here to represent you.”
Other key differences in each of the three
proposed affordable housing laws outlined by
Johnson include:
• Income Distribution: Applicants for affordable housing units are based on the average income for a Westchester County resident, which is $97,200 for a family of three;
the average income in Yonkers is $56,816 for
a family of four. The City Council version
of the law would have new affordable units
include Yonkers residents making 50 to 80
percent of the county’s area median income,
and the mayor’s version of the law has those

A sad and surreal event occurred outside

Mayor Phil Amicone read a letter apologizing to
Westchester Guardian Publisher Sam Zherka for

moves on or retires. The reason the Enrico
Fermi Scholarship Foundation in Yonkers is
celebrating its 50th anniversary this year is
due, in part, to past scholarship recipients who
have returned and are volunteering their time
and resources to make sure that students will
continue to get help and support, like they did.

‘The Grapevine?’ Yeah, that was the newspaper
for all of Yonkers’ public schools discussing their
incredible news about how every school was successful with academics, clubs, sports or special
events. You might be wondering why it hasn’t been
published in quite some time now. The newspaper
was shut down because there was no advertising to
keep it going.
“Nowadays, not only in Yonkers but in Westchester, news has focused on negative stories and
doesn’t really pay close attention to the wonderful
things that are happening, as well. ‘The Grapevine’
newspaper highlighted the positive things about
Yonkers and its schools. It showed the joy and happiness each school achieved and how proud they
were for it.
“This newspaper was there when I was in
middle school in Yonkers, and when you are in
middle school, you should be thinking of the high
school you want to attend the following year. At
first I had problems choosing the right school for
me to attend, but reading the ‘Grapevine’ helped
me have a better understanding of what each
school had to offer and what I could be interested
in doing in that school.
“Newspapers should print this good news in
print and also online so that more people can read
it. This could also be good for parents who want to
enroll their child in a Yonkers school and are looking for excellent details on that school to help their
child learn the right way and grow.”

“The news is reported to the ‘little people,’
but who are those people? We walk around oblivious to the smaller tragedies but read and agonize
over the bigger ones. The Lincoln High School
newspaper has been going on for some time now,
and no one has even noticed.
“The main teacher, Mr. Minard, has poured
his heart out on the details no one cares about. This
newspaper is meant to support the ‘little people’
to empower them and report on stories that may
have never been heard of. Some students and administration find the newspaper a burden and just
another after-school club. There is no greater pain
than holding an untold story inside of you.
“At the newspaper, we try to get those stories
out because no matter how small, they do matter.
We write to taste life twice, to experience a feeling
all over again; to hear stories from the past, realities of the present and predictions of the future. As
writers, we strive to be heard, wanting support and
recognition for the work we have done. Our newspaper may not be published next year, but this year
it will matter.
“The local news is mostly negative, and unheard. You are lucky if you own a small business in
Yonkers and you get to be a part of the news, as it is
very rare. We walk past the streets never realizing
the struggle that these business owners are going
through. Then one day we walk past and there is
no business, just an empty space with lost hopes
and dreams.
“The people of Yonkers also deserve some
recognition: most hold stories within them and die
with them the same way, never given the chance to
be heard. But isn’t that our job as reporters?
“Yonkers holds the true treasures of Westchester, but the media has continuously shown that

Johnny C. is about a year-old and 45
pounds. He is already neutered and ready for
a home. Johnny is very affectionate and thinks
he is a lap dog. If you let him, that’s where
this boy will sit! Johnny listens to commands
and is being socialized with other dogs. He
has been cat-tested and did well. Johnny will
do best at this time as an only dog and with a
home with no children under 12. He is appropriate around other dogs and could be walked

Walks Begin in May

On the Move “Discover Your Neighborhood
Walks,” with new opportunities that include a
guided tour.
There are two types of Discover Your
Neighborhood Walks: Holy Yonkers Walks
and Historic Yonkers Walks. Both get the body
and the mind moving!
The first Yonkers Historic Walk is
Wednesday, May 8 from 6:15 to 7:30 p.m.
This interesting walk showcases the locations surrounding the first competitive game
of golf in the United States. Jack Carey and
Carl Gessman will lead participants on a tour
of the remaining building landmarks where
the game took place and enjoy photos of Yonkers golf history. The meet-up site is Gorton
High School, near the Palisade Avenue field
entrance.
Walk highlights will include the site of
the home of golf progenitor John Reid on Lake
Avenue, founding stories and remaining landmarks on North Broadway, and the clubhouse
on Palisade Avenue.
The second Yonkers Historic Walk is

a tour that showcases the extraordinary Untemyer Gardens (Tim Tilghman) and the Lenoir

Go from Movies to Move-ins
The old Kimball Theater.
The Yonkers Industrial Development Agency last week gave initial approval to assisting
construction of a 14-story, 220-unit mixed-use
residential and commercial tower at the site of
the former Kimball Movie Theater on Yonkers
Avenue, just west of the Bronx River Parkway.
The Cottage International Development
Group envisions the Kimball Residences as
market-rate rental apartments, and has already
obtained needed variances from the city’s Zoning Board and approvals from the Planning
Board. It expects to begin construction by year’s
end.
The YIDA will assist with the project by
providing a sales tax exemption worth an estimated $1.5 million on construction materials
to be used for the rental apartment complex, as
well as an $875,000 mortgage tax exemption.
The YIDA also expects to negotiate a Payment
In Lieu of Taxes agreement that will allow a
phased-in property tax schedule.
The 270,000-square-foot project will total
$72 million when the costs of land acquisition
and construction are figured in.
“This project is extremely significant for
Yonkers,” said Mayor Mike Spano, who chairs
the Yonkers IDA. “It will replace an old theater
and adjacent properties that have become an
eyesore, with 220 units of new market-rate housing and commercial space that will anchor this
neighborhood for many years to come … Combined with the residential activity underway at
the downtown waterfront, this east side project
is proof that Yonkers is becoming a hotspot for
new development in Westchester County.”
The developer has assembled several contiguous lots at the intersection of Yonkers Avenue and Bronx River Road, centered on the old
and dilapidated Kimball Theater that has been
empty for many years.
“High quality rental housing, near Metro
North as this project will be, attracts people who
want to be close to New York City but who also
want the advantage of a suburban location,” Spano continued. “This kind of housing keeps Yonkers attractive to retiring baby boomers looking
to downsize, to young professionals starting out,
and people who will start families and hopefully
stay in Yonkers as their families grow.”
The Cottage International Development
Group is based in Yonkers and headed by Thomas Conneally. Kimball Residences will carry a
LEED “green building” certification, making
it the city’s first residential tower to be built in
accordance with the nationally-recognized environmental sustainability standard.
Fifth Annual Artist Showcase
At the Yonkers Library
A group of Yonkers artists will show selections of their work in the fifth annual Yonkers
Artists Showcase from May 3 to July 26 in the
gallery at the Yonkers Riverfront Library. The
exhibit has been organized and curated by Gino
Civale and Luis Perelman under the auspices of
YonkersArts.
An opening reception will be held Friday,
May 3, from 5 to 7 p.m.
Throughout the last 25 years, various local arts organizations, including Art on Main
Street/Yonkers, The Blue Door Artist Association, The Blue Door Art Gallery, The West
Room Gallery and the Yonkers Public Libraries
have made it possible for local artists to display
their works, often for the first time. Currently,
about 200 visual artists live or work in Yonkers,
many of them working in YOHO, the former
Alexander Carpet Mill in Yonkers’ Nepperhan
Valley.
The fifth annual Yonkers Artist Showcase
spotlights the presence of a number of remarkable artists in Yonkers, showing a variety of
creativity comparable to that found in New
York City. The curators have selected 38 artists
who will show pieces ranging from paintings
to works on paper, photographs, sculptures, encaustics and other creative expressions.
The exhibit is open and free to the public.

Fighting Fires in High-Rise Buildings

A new study by the National Institute of Standards and Technology on the capabilities of fire
departments to fight fires in high-rise structures
should have Yonkers officials taking a look at the
city’s capability to fight fires in the ever-growing
number of high-rise buildings constructed and
planned, according to Yonkers Firefighters Union
(IAFF Local 628) President Barry McGoey.
The study from NIST, which can be found at
www.nist.gov, outlines the difficulty of fighting
fires in high-rise structures by quantifying the time
it takes for firefighters to conduct search and rescue operations and to put out the fire.
On average, a crew of six firefighters is able
to rescue trapped victims and extinguish a fire
nearly twice as fast as a three-person crew in highrise buildings, and increasing the size of firefighting crews also has a substantial effect on the ability
of firefighters to protect lives and property in residential fires, according to the report.
Researchers measured 14 “critical tasks” required when potential risks to building occupants
and firefighters are greatest, and found that threemember crews took almost 12 minutes longer than
crews of four, 21 minutes longer than crews of five,
and 23 minutes longer than crews of six to complete all tasks. Four-person crews took 9 minutes
and 11 minutes longer than five- and six-member
crews, respectively.
“Everybody knows a bigger fire is more dangerous,” said McGoey. “This new study shows that
current crew sizes in Yonkers put firefighters at a
disadvantage in a high-rise fire, which will allow

Mayor Orders Change to
Current Zoning Code
Mayor Mike Spano announced last week
that the Department of Planning and Development will spearhead modification of the city’s
current zoning code, and will hold two public
forums to receive feedback from the general
public. The forums will be held Wednesday,
April 24 from 7 to 9 p.m. at Yonkers Riverfront Library, and Thursday, May 23 from 7 to
9 p.m. at Will Library.
“I have asked our planning professionals
to tune up what is acknowledged to be a good
zoning ordinance, just one that needs to catch
up with the times,” said Spano. “The only way
to test a complicated law like a zoning ordinance is to put it into use, catch the errors and
fix them. We welcome those who are working
with the ordinance on a frequent basis to attend the public forums so we can potentially
incorporate the public’s recommendations.”
The Yonkers Zoning Ordinance, last
amended in 2000, is the primary land use control document for any development or use of
property in the city. Over the 12 years of its
use, new land uses have come into prominence
and aspects of the ordinance are perceived to
be outdated, inconsistent or overtly inhibitive
to business. By amending the zoning ordinance, the city can alleviate the concerns of
small businesses, homeowners and developers.
“We are looking to firm up the text of the
zoning code and hope that anyone who has information will tell us their issues with the ordinance,” Wilson Kimball, acting commissioner
of planning and development. “The work that
we are doing is about the text of the ordinance
– the zoning map will be dealt with at a later
time.”
The city’s Zoning Ordinance Review
Committee has been reviewing the ordinance
since earlier this year and now is looking to
the public to provide insight. The committee
consists of the Department of Planning and
Development commissioner, the Department
of Housing and Building commissioner, the
Planning Bureau director, Planning Board
chairman, Zoning Board chairman, and a representative from the Engineering Department,
Corporation Counsel and the Mayor’s Office.
The committee expects the revised Yonkers Zoning Ordinance to be completed in
2013.

Re-Opening Sprain Ridge Pool: One
Water Park is Enough, Two is Too Many
Does anyone remember the beautiful 8-footdeep family swimming pool in Tibbetts Brook
Park?
Probably not, because it was reconstructed
and made into a water park with 4 feet deep swimming areas.
Now, according to a lengthy article Friday,
April 12 in Yonkers Rising, the only local newspaper that really gives Yonkers a good “heads up,”
the Westchester County Board of Legislators can’t
wait to begin construction (after two years of dillydallying) on, get this, another water park in Yonkers – just what the City of Yonkers does not need.
If you’re depending on elected officials to
do the right thing, consideration must be given to
reconstructing the only 8-foot-deep family swimming pool that is available to the City of Yonkers
residents.
If in 2011 the Board of Legislators unanimously added $8.8 million to the capital budget in
order to reconstruct the Sprain Brook Park facility,
did it ever stop to think that the only other near-
by 8-foot-deep family swimming pool is Saxon
Woods – granted a beautiful pool and facility, however, not located in Yonkers but in Mamaroneck,
and not easily accessible by bus for most residents
in Yonkers.
The Board of Legislators should stop dragging its feet and accept the fact that it is off base in
contemplating giving Yonkers another water park.
Maybe this is a reason the Astorino Administration
officials are not going along with the water park
fiasco.
Perhaps another meeting should be called to
acknowledge that reconstructing what we already
have would be better than what was proposed; admit a mistake was made and move along. Moneywise, finances would be saved by pursuing this
endorsement strategy.

Johnson has proposed reaching a broader range of Yonkers
residents with the law, with 35 percent going to those making between 30 to 55 percent of the AMI, 40 percent of the units going
to those with incomes between 55 and 75 percent of the county
AMI, and 25 percent of the units going to those with incomes at
75 to 100 percent of the AMI.
• Monthly Expenses: All three versions of the law would
have the total rent expense of new affordable units consume no
more than 30 percent of a family’s gross income.
• Home Ownership: If developers chose to build condominiums or private homes, a similar portion of those units must be
set aside for affordable housing home ownership. Homes would
be given to those earning 60 to 120 percent of the county AMI,
and their total monthly expense cannot be more than 33 percent
of their total gross income.
• Opt Out: This is another important component of any affordable housing law. Developers could be allowed to opt out of
the law by paying into a fund to be overseen by the Yonkers Affordable Housing Task Force. The cost would be per unit of hosing, with the City Council version providing no opt out; Spano’s
version having developers pay $75,000 per studio, $150,000
per one-bedroom, $200,000 per two-bedroom, and $240,000
per three-bedroom; and Johnson proposed $150,000 per studio,
$185,000 per one-bedroom, $190,000 per two-bedroom and
$195,000 per three-bedroom unit.
• Bedroom Distribution: Both the City Council version and
the mayor’s version have the breakdown of what affordable
units are studios, one-, two- and three-bedrooms to be the same
bedroom distribution as the total number of units built. Johnson
proposed the no more than 10 percent of the affordable units be
studios, one-bedroom up to 20 percent, two-bedroom at least 50
percent and three-bedroom at least 20 percent of the total number of affordable housing units.
• Affordable Housing Fund: Both the mayor’s plan and
Johnson’s plan have the affordable housing fund controlled by
the Yonkers Affordable Housing Task Force.
• Councilman Johnson also proposed giving preference for
affordable housing units to city residents and city employees.
His plan would also give incentives to developers including relaxing requirements for height, density and parking.
There is currently no affordable housing law in Yonkers.
The City Council passed an affordable housing ordinance in
2009, which was vetoed by former Mayor Phil Amicone.
Councilman Johnson explained that a compromise of all
three plans must be agreed to by a majority on the Council and
Mayor Spano.

Westchester Foreclosure
Update: Filings on the
Rise in 1st Quarter
The number of foreclosure filings in the first quarter of 2013
jumped 80 percent from the first quarter of 2012, reported Westchester County Clerk Timothy Idoni, who serves as clerk of the Westchester County Supreme Court where foreclosure actions are heard.
“These first quarter filing numbers are the largest we’ve seen
since historic highs in 2008,” he said.
Idoni’s office reported 683 foreclosure actions having started between Jan. 1 and March 31 of this year, as compared to 379 during the
same period last year. A total of 422 foreclosures were reported during
the first quarter of 2011, 663 were reported during the same quarter in
2010, 488 in 2009, 759 in 2008, 530 in 2007 and 378 in 2006.

Editor’s Note: One reason for the increase in foreclosure filings
is the efforts by banks to catch up with their backlog of foreclosures
accumulated over the past three years. Banks stopped actively foreclosing on properties after Bank of America was found in 2010 to
have filed incomplete documents related to their foreclosures and
stopped all of their foreclosures in all 50 states. While the number
of foreclosures in Westchester is high this quarter, it may actually be
a good thing for the Westchester real estate market. Only after foreclosed properties are sold can the market completely bottom out and
sales rise.
Legislators Request
Extension From HUD
to Save 2011 Funds
Westchester County Board of Legislators Chairman Ken Jenkins
has requested a month-long extension from the U. S. Department of
Housing and Urban Development for the county to respond to issues
regarding non-compliance of the fair and affordable housing settlement
in order to prevent the reallocation of 2011 Community Development
Block Grant funds.
The request asks HUD to modify the response date for the county
to complete an analysis of exclusionary zoning and also promote Source
of Income legislation from April 25 to May 25.
In his letter, Jenkins points out that the court-appointed monitor
of the housing settlement, James Johnson, noted during his appearance
at the BOL’s Committee of the Whole meeting April 8 that he and his
staff were completing their own analysis of exclusionary zoning, and
that some errors they made have caused additional follow up with municipalities around the county. Since the monitor’s analysis will not be
completed until mid-May of this year, Jenkins said an extension of time
from HUD would allow the county to craft a plan to overcome exclusionary zoning practices based on the monitor’s findings, should any
such practices be found.
The BOL continues to wait for County Executive Astorino to send
the members new SOI legislation for its consideration, Jenkins notes in
his letter. He reminds HUD, as well, that the BOL passed a resolution in
September for Astorino to undertake this action within 60 days. A recent
Appellate Court decision reiterated that the county executive failed to
promote SOI legislation as required under the Consent Decree.
“This short extension of time being requested gives the county executive and administration ample opportunity to craft and submit Source
of Income legislation to the Board of Legislators, which will rectify a
major point of contention between the county and HUD,” said Jenkins.
“The recent legislation ratifying the Local Development Corporation
serves as a fine example of the administration promoting legislation and
working with the board to enact a law. I think a similar effort can be
made here.”
The urgency and rationale for asking HUD for the extension rests
simply on trying to prevent the loss of the 2011 CDBG funds, which
HUD has indicated will be reallocated unless the county can provide
substantive assurances that it has a plan to address zoning and SOI legislation, said Jenkins.
“We are all trying to work together on this issue to ensure that these
important grants are saved,” said BOL Majority Leader Pete Harckham.
“Otherwise, the municipalities and not-for-profit organizations that are
meant to receive these funds will be adversely affected, which, in turn,
will hurt taxpayers and residents being served by important programs
supported by these grants.”
Remarked Legislator Catherine Borgia, chair of the BOL Government Operations Committee: “We have to work collaboratively with
HUD to quickly resolve the outstanding issues of the housing settlement
in order to protect Westchester taxpayers from further economic penalties. This extension will give the Board of Legislators and the county
executive time to work together to craft positive solutions with the Federal government.”

The Students for Students Scholarship Fund will hold “Mayfair 2013,” a community outreach carnival for children ages five to
10, for the families of Sarah Lawrence College and the surrounding

the city and its taxpayers, now ends the disastrous slew of events and
lawsuits between Amicone and Zherka that will eventually cost the
taxpayers of Yonkers close to $1 million.
Amicone read his mea culpa, which states: “I want to make this
public apology to Mr. Sam Zherka, his wife and eight children and
to the Westchester Guardian for statements made as mayor which
falsely charged Mr. Zherka with criminality and wrongdoing. I also
want to take a moment to apologize for confiscating the Westchester
Guardian’s news racks. I sincerely and deeply apologize on my behalf
and on behalf of my administration for causing so much hurt to Mr.
Zherka and his family.
“I admit that any false and defamatory statements made by my
administration were wrong and brought about shame, misfortune and
scorn to Mr. Zherka and his family,” he continued. “I will never know
the full extent of the damage the false allegations made by my administration may have caused his family, his business, and the Westchester Guardian. I am hopeful that this apology will go a long way
in healing some of the wounds inflicted by these false statements and
charges and somehow compensate on a personal level.
“It is with these sincere feelings and a humble heart that I stand
to give a public apology to Mr. Sam Zherka and his family, and ask
that they forgive me and those of my administration,” Amicone concluded.
A prior statement leaked to the press stated that Amicone had
“’unlawfully’ confiscated the newspaper racks,” but the word “unlawfully” was removed prior to the City Council adopting the settlement
Tuesday. The removal of the word points to the letter not being written by Amicone, but by Zherka’s attorneys, who also required that
the mayor stand outside City Hall and embarrass himself and ask for
forgiveness before Zherka.
The mayor does apologize for confiscating the newspaper boxes
for the Guardian, although the public never fully found out who ordered the removal of the Guardian’s boxes, at a time when Zherka and
the Guardian were printing front page stories about the mayor, including allegations about his personal life and a headline with Amicone
and Mayor Ernie Davis on the front page titled “Dumb and Dumber.”
Throughout the letter, Amicone apologizes for the actions of “his
administration” but in the apology regarding the confiscation of the
newspaper boxes, he does not use those words. It appears that he takes
full responsibility for this action, which led to a sorry and costly pair
of lawsuits filed by Zherka.
It is important to review what happened because of the total cost
to the people of Yonkers: $1 million dollars pays for a few teachers,
and firefighters, and police officers. Any city – especially Yonkers –
cannot afford this loss.
Zherka and his employees of the Guardian sued Amicone and the
city for the unlawful removal of the newspaper boxes. Zherka won
an $8 million verdict, which was settled for $393,000, (including a
$170,000 personal liability for Amicone), with the city paying for the
actions of Amicone and/or his administration, in their role as city employees.
Zherka then filed a second lawsuit against Amicone for defamation of character regarding statements made at a Republican ward
meeting, calling Zherka a “mobster,” a “convicted drug dealer” and
a “thug.”
The $30 million defamation case never made it to court because
of the $100,000 settlement and Amicone’s public apology.
“Rather than hold the city liable for millions of dollars in damages, all we want is an apology,” said Zherka. “This is yet another
victory for free speech and press. This apology is long overdue but
I’m happy to see that Mayor Amicone is apologizing personally, and
on behalf of his entire administration.”
Again, Zherka refers to Amicone and “his entire administration.”
We wonder, and the people of Yonkers deserve to know, who it was in
Amicone’s administration that recommended or influenced Amicone
to make this foolish decision? Zherka’s newspaper racks lawsuit did
not tell us that answer, with some testifying that it was the mayor who
ordered the removal, but other pointing the finger at others in City
Hall.
Many point the finger at Zherka for filing these lawsuits and hurting the people of Yonkers. But in these cases, and in other cases where
Zherka has won First Amendment cases against other local governments in Westchester for removing the same newspaper boxes from
their Village Halls, we believe it is the stupidity of elected officials we
voted for who should be blamed, and not Zherka.
They fell for his bait, and now the taxpayers have to pay.
The City Council, quietly and without debate, approved the
$100,000 settlement by a vote of 4-3, with Democratic Councilman
Wilson Terrero (majority leader), Christopher Johnson and Michael
Sabatino voting no, and Republican Councilman John Larkin (minority leader), Mike Breen and Dennis Shepherd voting yes, with Council President Chuck Lesnick.
Lesnick was the swing vote in the settlement approval; he voted
against the prior Zherka settlement of $393,000.
“It’s unfortunate that the taxpayers have another burden but I am
hopeful that Sam Zherka will donate the money to a Yonkers-based
charity,” Lesnick stated. “This vote is different from the previous settlement which I opposed because it is not a First Amendment case and
the former mayor has now apologized. Yonkers now needs to move
forward and put this issue to rest. And I hope tonight’s vote concludes
the matter for good.”
Majority Leader Wilson Terrero also suggested that Zherka donate the $100,000 to a Yonkers charity. Zherka, however, has stated
that the money will go into a trust fund for his children.
Former Councilwoman Joan Gronowski sent a letter to the Council urging them not to approve the settlement. Calling the ZherkaAmicone battle “the Phil and Sam saga,” she urged the council “not
to settle the case simply for fear of continued litigation. The only true
deterrent will be to hit elected officials in their own wallets. I implore you to take a chance on our constitution, “said Gronowski who
believed that Amicone should pay his own legal fees and settlement
costs because he admitted to making the defamatory comments.
Gronowski’s reference to continued litigation is based on Zherka’s personal wealth, and his ability and predisposition to file numerous lawsuits without concern for legal fees, in the hopes that those he
sues will settle because it is cheaper than remaining in the courts with
Sam for years.
Yonkers resident Terry Joshi also spoke out against the settlement, saying: “The city is in dire financial straits. We have paid plenty
so far in this tiff and I can’t understand how we could spend another
$100,000.”
We will seek comments from the City Council for the reasons for
their votes, for and against this settlement, for next week’s Yonkers
Rising.
We are sorry that Mayor Amicone had to make this embarrassing show, but more sorry that he made the decisions that cost the city
$1 million. It is a large black mark on his administration, which was
scandal-free for eight years and did a lot of good for the people of
Yonkers.

without opposition. A cross-section of Yonkers Republicans, Democrats
and Independents were at his announcement, and he spoke about the
need to get voters from all parties to vote for him, and the need for all
elected officials to work together.
“Throughout my public life, I have worked with Republicans and
Democrats to do the right thing for Yonkers. It’s not about claiming personal credit or victory, but about accomplishing results for our taxpayers
and residents,” he said. “When I’m council president, I will work with
the mayor and my colleagues on the City Council to get things done for
Yonkers.”
As a lifelong resident, McLauglin said he has fought for some of
Yonkers’ great accomplishments, including ending the federal desegregation case, reclaiming the waterfront, opening new developments like
Ridge Hill, and making the city one of the safest in America.
“But I know that, as far as we’ve come, without the right leadership
at City Hall and without the experience and wisdom to make the right
decisions, things could get worse, not better,” he said. “We must always
keep moving forward, believing in better jobs, better schools, better
neighborhoods, and a better quality of life. That’s what my candidacy
stands for: A better Yonkers, in every way, for all of us.”
McLaughlin, who lives in southeast Yonkers with his wife, Debbie,
and son, Ryan Patrick, presented a positive vision and future for the city.
“I’m invested in Yonkers; this is where Debbie and I have chosen
to raise our family. We were raised here. We went to school here. We
bought a house here, and we pay taxes here. We care about the future
of this city,” he said. “We must keep fighting for tax relief on behalf of
our home- and business owners. We need to grow our local economy so
that more people can enjoy good paying jobs here. And we will always
protect the quality of life that makes Yonkers so special: keeping our
schools, streets, parks and neighborhoods clean and safe for the families
who live here and love the city of Yonkers.”
McLaughlin is a practicing financial attorney at the McLaughlin &
Zerafa firm in Yonkers. He is also a certified public accountant, formerly
a senior auditor at Ernst & Young. On the City Council, he served as
chairman of the Budget Committee and as both council majority and
minority leader.
McLaughlin’s announcement came after former Councilman Dennis Robertson, a Democrat, dropped out of the race for council president.
The two are friends and former colleagues on the council and would not
have run against each other.
It is unclear who will challenge McLaughlin on the Democrat
line to see who will replace Council President Chuck Lesnick, who is
term-limited from running again. It is widely believed that Ken Jenkins,
chairman of the Westchester County Board of Legislators, will challenge McLaughlin if Jenkins does not get the Democratic nomination
for county executive.
County Democrats are meeting this week to make their endorsements.
If Jenkins wins the nomination for county executive, there is currently no established Democratic candidate who has expressed a desire
to run for council president. Two Democrats, Mike Rotanelli and Frank
Spotorno, have announced, but neither is expected to get the endorsement at the Yonkers Democratic convention, which will take place next
week. Both can collect the 1,000 signatures and run in a Democratic
primary for council president in September.
Nepperhan Community Center Director Jim Bostic has also been
named as a possible Democratic council president candidate, and community activist Terry Joshi told Yonkers Rising that she is seriously considering a run.
Lesnick – and Democrats – have won the last two elections for
council president, with Lesnick narrowly defeating Republicans Richard
Martinelli and Jim Castro Blanco. Combined with Democratic Mayor
Mike Spano winning in 2011, the question now becomes: Can a Republican still win a citywide election in Yonkers?
Liam McLaughlin thinks so, and has the head-start in a race that
will evolve over the summer and fall and will likely have more candidates stepping forward over the next month.

ment maintains a crew size of four members, irrespective of the type
of apparatus they are assigned to. During interior operations at highrise buildings, the department’s crew size is effectively reduced to three
members, since the drivers/operators of the first-arriving fire apparatus
remain outside the buildings making water connections from the hydrants to the building’s standpipe system, raising ground and aerial ladders, or performing other essential tasks.
“Mayor Spano and the members of the Yonkers City Council need
to read this report and consider it before making budgetary decisions
that affect public safety,” said McGoey. “This research makes clear that
having too few firefighters on each piece of apparatus can have devastating consequences. Firefighters have always known this anecdotally, but
now this report puts the facts in the hands of policy makers, and it can’t
be ignored.”
He said it is no longer acceptable for a fire department to say that if
it needs more firefighters to fight a fire, it will just send more units.
“NIST has proven that this ‘just send more trucks’ strategy increases the amount of time it takes to conduct search and rescue operations
and to get water on a fire, and that means bigger fires and more lives
lost,” McGoey continued. “Another problem with this ‘just send more
trucks’ strategy is that doing so will strip the rest of the city of any fire
protection until mutual aid can be called in from neighboring towns or
additional firefighters can be called in from home. Either option can take
anywhere from 30 minutes to several hours to accomplish, an unacceptable and dangerous plan.”
When a crew of three or four firefighters responds on a ladder truck
to a high-rise fire, one crew member must remain in the lobby area to
“control” the elevators and to ensure that the stairwells remain a safe
exit for evacuating occupants while the other firefighters ascend to the
fire area to begin search and rescue activity. With only two or three on a
search crew, only one search pattern can be initiated because firefighters
must remain in groups of at least two when they enter a burning structure. However, if five or six firefighters arrive on that first truck – even
when one remains in the lobby to attend to the stairwells – two search
teams can be formed from the remaining crew ascending to the fire area
and both can engage separate but simultaneous searches to find trapped
occupants.
The National Fire Protection Association defines high-rises as
buildings that are seven stories or taller, the height that exceeds most
types of fire service ladders. These include office and apartment buildings, as well as hospitals, senior living facilities and hotels, where occupants are generally physically unable or too unfamiliar with the building
to exit quickly in an emergency.
The City of Yonkers currently has dozens of high-rise buildings and
even more planned for developments in downtown Yonkers, the Hudson
River waterfront and the Alexander Street corridor.
Like most U.S. communities, new high-rise buildings in the City
of Yonkers are required to have automated sprinkler systems, which are
designed to control the spread of fires – not to fully extinguish them. It
is also important to remember that irrespective of whether a high-rise
building has functioning sprinklers, it is the smoke from the fire that
kills. Even a small fire in a high-rise building will emit a considerable
amount of toxic and deadly smoke before the sprinkler system is activated.

who are actively involved in the Enrico Fermi Scholarship
Foundation, which has given out more than 300 scholarships
to Yonkers residents who are of Italian-American descent
over 50 years.
“I graduated from the Hackley School in 2005 and our
counselor encouraged me to apply,” said Andrew Sabatino,
a 2005 scholarship recipient. “The scholarship breakfast was
an exciting and memorable day for me. I didn’t expect the
number of people to be there. When I walked into the Polish
Center there were hundreds of people and I learned that this
was a big deal … I also didn’t know how much my scholarship would be until the breakfast. When I received the one
$10,000 scholarship given out that year I was shocked.”
Andrew attended Columbia University’s School of Engineering and Applied Science for his undergraduate degree
and most recently his master’s degree.
He first got re-involved with Fermi by proving music at
the breakfast with his brother. He accepted a larger role in
joining the breakfast committee in 2010.
The Sabatino family’s role in Fermi is strong, with Andrew’s mother, Mary Jane, also getting involved in the annual breakfast committee. Andrew joined the board in 2011.
“We are pretty new to the organization, considering
those who have been involved for decades,” said Andrew,
who explained that this year’s breakfast on May 5 at Westchester Manor should have up to 300 attendees. “This gives
us a nice mix on the board, and it makes a lot of sense to get
involved when you have an organization that awards scholarships every year. And we are making an effort to reach out
to past recipients, and trying to get them involved. We are
asking them to give a little back and are getting a good response.”
Richard Poccia is a 1975 scholarship recipient.
“I grew up in the Crestwood section of Yonkers and
went to Cardinal Spellman High School and found about the
Fermi Scholarship and applied,” he said. “As I walked into
the breakfast with 400 people, it was very impressive for a
young kid.”
Richard went to Manhattan College and graduated in
1970 with an accounting degree. He is a certified public accountant and is currently a partner at PricewaterhouseCoopers.
“In 2005 I realized that it was the 30th year of the Fermi
Scholarship and since I received the award I reached out to
them and gave a contribution, and gave back the amount
of money I received in the scholarship, but without interest,” said Richard, who serves as vice president of the Fermi
board. “I felt it was appropriate to find the organization and
contact them and thank them for what they did for me. I
joined the board and was a keynote speaker at the breakfast.
I chaired and emceed the breakfast in other years, and have
helped to determine what we need to do to continue. It’s hard
to sustain an organization that has been around for 50 years
without new people and new ideas.
“I think giving back is a very important thing, which my
firm also believes in – giving students a chance to earn your
future and helping students get financial literacy and education in high school and college,” he continued. “The Fermi
Scholarships have helped a lot of people. The first Sunday
in May is always the breakfast. And we can’t forget that the
day is really about the scholarships and giving the recipients
advice about college and your future … It’s unfortunate that
others don’t come back, but I encourage them to give back
to those who gave to you, and invest the time and energy to
impact the lives of many.”
Antoinette DiLello is a 1976 scholarship recipient.
“Winning the scholarship was an honor and a proud moment in my life, for me and my family to celebrate my Italian
heritage. I went to Manhattan College and received a BA and
my master’s degree. I went right from Manhattan to St. Paul
the Apostle School, and I’ve been there ever since. I love
what I do and love St. Paul’s and working in Yonkers,” said
DiLello, who is the current vice principal and a fifth-grade
teacher with 32 years at St. Paul’s. “I won the Fermi Scholarship in 1976 and I’ve been involved since the day I won. For
the past 37 years I have served on the Advisory Board, the
Breakfast Committee, the Scholarship Committee and the
Board of Trustees.
“In 1987 I co-chaired the breakfast and I’ve spoken at
past breakfasts as a former recipient and for many years I
chaired the scholarship reception committee, which welcomes new recipients and prepares them for the morning
breakfast activities,” he continued. “The goal of the Fermi
Scholarship Committee is to promote education, which is
what I am all about. I’ve always wanted to be a teacher, and
this organization is all about going to college, and that’s important to continue.”
This year’s breakfast will be held May 5 at Westchester

Scholarship Available
The Yonkers African American Heritage Committee has scholarships available to Yonkers African-American high school seniors who
will be graduating in June 2013 from the Yonkers Public Schools, or an
alternative program, who are pursuing a college education.

“Every day that passes, we are so used to our same old routines
that the ‘big picture’ gets blurred out. When you turn on your television,
all you hear is constant negativity about Yonkers. How can the people
of Yonkers keep the positive alive if negativity is surrounding us everywhere we look?
“When things turn upside down for me, I like to focus on celebrities
that started from the bottom and worked their way up. In that case, who’s
more of a great example than Lady Gaga? She made it big, so why can’t
you? Gaga learned to play the piano by the age of 4 and kept practicing
ever since. That’s the difference between some people. The ones who
keep fighting and the ones who eventually back down.
“Of course she experienced people with negative things to say
about her but if she didn’t look past it, she wouldn’t be the international
pop star she is today. In this generation most people gossip, with constant name-calling and endless bullying. Back in Lady Gaga’s childhood, she talks about how she remembers some girls from her class who
were hanging out with some boys. Those boys picked her up and threw
her in the trashcan on the street. All the other girls from her school were
leaving and could see Gaga in the trash can. Everybody was laughing –
heck even Gaga was laughing.
“Gaga remembers holding back her tears with her lip quivering.
‘Are you about to cry? You’re pathetic,’ they said. That’s what Gaga
felt like at the time – pathetic. The reason why I’m bringing this up is
to show that even Lady Gaga, one of the most famous international pop
stars, just like most of us, had her struggles, but she rose above. So can
you.”

shadowing, which is a great program run by LHS Academy of Finance

The City of Yonkers lit up the sky April
16 in remembrance of the victims of the Boston Marathon bombings. Honoring the official
color of the Boston Marathon, the Yonkers City
Hall clock tower glimmered in purple as the city
joined in solidarity for those killed or injured in
the tragic events of April 15.
“What occurred was a senseless act of
violence and an attack on the American way of
life,” said Mayor Mike Spano. “Our thoughts
and prayers are with the citizens of Boston, especially the victims of the explosions and their
families, as well as those emergency responders
who heroically came to their aid … Lighting our
city clock tower purple is a simple yet poignant
gesture, remembering that despite this tragedy,
we as Americans unify, proving good always
outweighs the acts of evil.”
Additionally, upon the direction of President Barack Obama, the American flag at Yonkers City Hall was flown at half-staff until sunset on Saturday, April 20, in honor of the Boston
Marathon victims.

the women of the civic club have granted annual
scholarship awards to graduating high school students and have volunteered invaluable services to
many associations, organizations and institutions
throughout the city, county, state and nation.
This year’s scholarship recipients include:
Brianna Bartley, who attended PEARLS
Hawthorne school and Roosevelt High School, is
active in her school, community and church. She
has participated in Relay for Life, student government, Pre-School Camp at School 39, track and
field, the Westchester Community College Summer Entergy Program, Praise Dance, youth programs and more. Bartley has also participated in
the National Young Leaders Conference in Washington, D.C., which brings together the future
leaders of America, mentoring and enriching the
most promising high school students in a handson, experiential atmosphere while preparing them
for a lifetime of leadership.
“My strength has come from both my faith
in God and my mother,” said Bartley, who plans
on attending college and law school. “Although
she has raised my sister and me as a single parent,
my mother never gave up. When things came into
our lives that attempted to destroy us, my mother
always found her way through it all. Watching
how determined she was helped me achieve and
continuously aspire for greatness.
“I have confidence in myself to achieve all
of my goals and with my faith in God and my
mother’s encouraging words, I am sure to make
it,” she continued. “Through my work I plan to
also be able to help other young people from similar backgrounds achieve their dreams.”
Kyla Williams was born and raised in Yonkers and currently attends Lincoln High School,
where she will graduate this June.
Throughout her high school career, Williams
interned at Nutrition of House located on Tuckahoe Road in Yonkers, and held the position of
secretary for the Do Something Club, an organization designed to give back to those in need and
to spread awareness. She is also a former member
of Young Women in Progress, which is the junior
association of the Negro Women Council.
Over the years, Williams received various
awards from school and community organizations
for her commitment to community service. Above
all, she is dedicated to helping others and pursuing a career in health services.
This year’s Community Service Awards
went to Jack Toone and Dwanita Crosby.
Toone has dedicated his life to making sure
foster care children have positive influences in
their lives and make it to college. He was recently
bestowed the 2012 CUNY Lehman Community
Partner of the Year Award for successfully matching more than 100 youth with Lehman College
students, providing them much needed exposure
as they start to formulate ideas about a career.
As the program coordinator of the Abbott
House Mentoring Program for the past 10 years,
Toone believes that every youth has a gift and it is
mentors’ job to help kids recognize that gift, and
put them in places where they can use it. He is a
firm believer that mentoring is an evidence-based
strategy that can positively impact kids’ lives.
Toone has seen the transformative power in
mentoring and has advocated for all institutions
that deal with youth to incorporate mentoring in
their program.
The Abbott House mentoring program
gained fame in the past five years by matching
more than 300 kids in Westchester County and
New York City with mentors. It is this type of
dedication that has earned Toone the 2011 Rising
Stars Award from the Business Council of Westchester and the honor of keynote speaker at the
Big Brothers Big Sisters of America graduation.
He has recently been appointed to the position of director of juvenile justice research
for One Accord, a non-profit agency that goes
into the community and provides workshops to
schools, parents, community centers and stakeholders. These workshops provide research and
data regarding young minority children in education, juvenile justice, mental health and child welfare. The workshops are so powerful that they are
booked solid for the next six months.
Dwanita Crosby was raised in Yonkers where
she was a longtime member of Messiah Baptist Church, becoming a part of various church
choirs and the Praise and Worship Team and often helped with church banquets. She attended
the Nepperhan Community Center After-School
Program and volunteered in the community with
organizations such as the National Council of Negro Women-Hudson Valley Section, Wesley and
Friends, Habitat for Humanity and the YWCA of
Yonkers.
Due to her volunteerism, the YWCA of Yonkers offered Crosby a summer position each year
as an assistant in day care and worked one summer with Executive Director Patricia Sadler. In
2000, she graduated from Lincoln High School
where she was a member of the gospel choir,
under the leadership of Cecilia Myers, and performed at various local community events. She
placed third in the annual McDonald’s Gospel
Fest and performed as a one of the backup singers
at Madison Square Garden with Latin performer
Marc Anthony.
Crosby received a degree in psychology
from Morgan State University and has been active
with the National Council of Negro Women-Hudson Valley Section (a member since the age of
10) serving as the corresponding secretary for the
Mentor Committee and later developed the youth
initiatives program “Young Ladies in Progress,”
as the youth advisor for 20 young ladies between
the ages of 11 and 16.
In 2009, Crosby worked for the YWCA of
Yonkers as the assistant program coordinator/
counselor of the PEARL Leadership Program.
After one year of employment, she was promoted
to program coordinator and helped coordinate
college tours, the community youth forum, open
mics, leadership workshops, etiquette workshops,
the annual Children’s Holiday Fest for more than
400 families in the City of Yonkers, talent shows,
the intergenerational program, the Girls Empowerment Conference and summer internships for
program participants.
Crosby is currently pursuing her master’s
degree in public administration at John Jay College with dual specialization in human resource
management and operations management. In
addition, she continues to work as the executive
assistant (since 2006) to Yonkers City Council
President Chuck Lesnick, program coordinator
of the YWCA PEARL Program, vice president
of Operations for Living Proof Records, LLC.,
(since 2010) and serves as vice president of Hope,
Healing and Growth, Inc., and a member of the
YWCA Green Team.
The Woman of the Year Award went to Florence Lucas, who graduated from Jamaica High
School in 1951 and in 1952, after the loss of her
foster parents, relocated to Yonkers.
In 1954 she embarked on a career in nursing
and was employed as a nurse’s aide at Yonkers
Professional Hospital until 1959. She graduated
from Rochambeau School of Nursing in White
Plains and in 1968 began employment at Yonkers
General Hospital as a licensed practical nurse, retiring in February 1995. Lucas counts her many
years of employment there as being among her
most memorable years of service to others.
In 1980 she joined Community Baptist
Church, under the leadership of Pastor Clarence
Bolling. She was a member of the Senior Choir,
Parents’ Council, and is a newly-appointed member of the Floral Club.
In 1981, Lucas was accepted into the Terrace
City Chapter No. 26 Order of the Eastern Star,
where she remains a member and a supporter.
From 1997 to 1999, she volunteered her services
as a community aide to the City of Yonkers’ Office for the Aging at the Congregation Sons of Israel Senior Center.
In January 2008, she joined the Women’s
Civic Club of Nepperhan, Inc. Among her most
cherished activities has been serving on the Shirley E. Williams’ Scholarship Committee; Lucas
has also served three successive terms as chaplain
of the organization.
Continuing her tradition of service to others,
since 2010, she, along with her good friend the
late Marcia Brown, has volunteered regularly at
the Sans Souci Rehabilitation and Nursing Center.
Congratulations to the honorees and to the
members of the Women’s Club of Nepperhan for
their continued service to the community.

Many elected officials, veterans and family members of those lost attended the luncheon to pay tribute. A prayer was read, which
read, in part: “Our sons and daughters, pride
of our nation, have served, fought and died, so

the price they paid for our freedom. Blessed
are those who fought, and died for they shall
