TERMS OF USE “ANSWER THE PHONE AND TELL SOMEONE HOW LIFE IS IN BRUSSELS TODAY” 1. Conditions of Participation Visit.brussels organizes the present communication campaign (hereafter the “Campaign”) from the 7th Janurary 2016 until the 31st January 2016. During this period, participants from abroad may use the website www.call.brussels (hereafter the “Website”) in order to call randomly people in three different public places in Brussels (Flagey, Mont des Arts and Molenbeek, hereafter the “Places”) to share their experience and feelings about life in Brussels today. For this purpose, the Website integrates a tool allowing to call one of the publicly accessible phones installed in the Places by visit.brussels (hereafter the “Phones”). Any person present around the concerned Place at the moment of the call may answer the Phone. The conversations which the participants have through the Phones and the live video streaming will be recorded in order to promote the Campaign. Users using the call feature in any way express their consent to all the provisions of the present Terms of Use as well as their consent to the uses specified above of all attributes of their personality (such as their voice), of their personal data and of their phone conversations made by means of the Website. Participants answering the Phones in the Places and passing by the Phones, are duly informed, by means of public display, of the Campaign. By answering the call or staying near the Phones, the Participants give their consent to the uses specified above of all attributes of their personality (such as their image and their voice), of their personal data and of the phone conversations they have had by means of one of the Phones). 2. Obligations of the Participants Participants agree to abide by all applicable laws, regulations and codes of conduct, and particularly to refrain from: - - providing content or messages that are false or misleading, obscene, racist, xenophobic, abusive, illegal, deceitful, intrusive of one’s privacy, offensive, damaging, violent, menacing, tormenting, defamatory, violating intellectual property or other rights or that incentivizes any of the foregoing; requesting personal information from other participants; providing content concerning third parties without their prior consent; providing content which violates third party’s rights or damages them in any way; providing content which refers to illegal activities or contains inappropriate content; using the Campaign for direct marketing purposes, including prospection, soliciting, advertising or the sale of goods and services; every action that may result in interference with the good functioning of the Campaign; - attempts to gain unauthorized access to any part of the Website or to the equipment used for the exploitation of the Website or the Campaign; and using the Website for other purposes than those specified in the present Terms of Use. Visit.brussels cannot and may not be held liable for any disrespect of these Terms of Use or of the applicable laws and regulations by any participant. The participants guarantee and hold visit.brussels harmless against any action or complaint by third parties (including public authorities) in connection with the Campaign. Moreover, any participant who violates the present Terms of Use may be excluded from any further participation to the Campaign. The participants are obliged to duly and immediately inform visit.brussels in writing from the moment they acquire knowledge of any inappropriate behavior in connection with the Website or Campaign, or the spread of any illegal, incorrect, shocking or indecent content or any violation of one of the their or third parties’ rights. Availability and functioning of the Website Visit.brussels ensures, to the extent possible, that the Website remains accessible for a normal number of Users. Visit.brussels cannot guarantee the normal functioning of the Website at all times without any interruption or error, nor that any flaws are immediately solved, nor that the Website and the server hosting it are completely free from viruses or other malicious elements. Visit.brussels reserves the right to suspend or stop all or part of the Website or of the Campaign at all times and at its sole discretion without any prior notice. Visit.brussels cannot and may not be held responsible for any loss and/or damage of any kind resulting from the suspension, interruption, (technical) interference, delay, difficult access and/or blocked access to whole or part of the Website, or any virus or other malicious elements present on the Website. 3.2. Use of the Campaign The participants use the Website at their own risk. The Website, its components and all information, software, installations and services pertaining to the Campaign are delivered as such, as available without any guarantees (not explicit, nor implied) and within the boundaries set by the law. Visit.brussels declines all responsibility in the event of loss or damage (direct, indirect, tangible or intangible) resulting from the use or impossibility to use the Website and its components or from the use of information provided by other participants. With respect to the content of the phone conversations between participants, visit.brussels only acts as a technical intermediary and does not operate any prior verification or moderation whatsoever. 4. Protection of personal data In the framework of the Campaign, some personal data of the participants may be processed (such as their image and their voice) for the purpose of the good functioning of the Campaign. In such cases, the data controller is visit.brussels. According to the Law of 8 December 1992 relating to the protection of personal data, data subjects have a right to access, modify, rectify and delete any personal information.
