CME TARGET AUDIENCE: Psychiatrists and other physicians working at the interface of law and psychiatry. OBJECTIVES: Participants will improve their skills in forensic psychiatry in the following three areas: 1)Service, including treatment of forensic patients, development of service delivery strategies, and enhancement of consultative abilities at the interface of psychiatry and the legal profession; 2)Teaching, including new methods of training of forensic psychiatrists and classification of the tasks and functions of a forensic psychiatrists, and 3)Research, gaining access to scientific data in areas that form the basis for practice of the discipline. THURSDAY, OCTOBER 14, 1999 2:15 PM - 6:15 PM COST - $40.00 C1-COURSE - Insanity Defense Evaluations (Core) Philip Resnick, MD, Cleveland, Ohio The distinctions between the defenses of not guilty by reason of insanity, guilty but mentally ill, and diminished capacity will be explained. Tests for criminal responsibility will be placed in their historical perspective, including the wild beast test, M’Naghten standard, irresistible impulse, Durham rule, Model Penal Code, and the 1984 Federal rule. Participants of the “policeman at the elbow” test will be examined. The faculty will discuss which diseases may qualify for an insanity defense, such as psychoses, mental retardation, paraphilias, PTSD, intermittent explosive disorder, amnesia, pathological gambling, and epilepsy. Malingering, intoxication, and battered woman syndrome will also be covered. Common errors in writing insanity reports will be identified. Participants will practice writing insanity opinions after watching a videotaped case vignette. Handouts will include eleven landmark insanity case summaries, fifty-five suggestions for cross-examiners of psychiatrists, twelve clues to malingered psychoses, principles of writing insanity reports, and two sample reports. Berlin, MD, Baltimore, MD Since the Supreme Court decision in 1996 in Kansas v. Hendricks, there has been a renewed interest in and substantial commitment of resources by several states to the treatment of sex offenders. Additionally, several states have passed “chemical castration” laws which are fraught with problems of informed consent and other ethical considerations. Furthermore there still exists a very substantial opinion in the psychiatric community that sexual offenders cannot be treated. This course will attempt to address some of these problems. The course will begin with an introduction to the problem. A description of the materials and methods used to assess the child molester will be presented, including the role of penile tumescence, visual reaction time, interviews and questionnaires. The role of biological and medical measures will be presented along with pharmacological treatments. A detailed presentation of behavioral treatment outcome and sexual offender recidivism studies will be reviewed. Issues of informed consent will be presented as will considerations involved in treatment and research design and outcome studies. Ample time will be left for questions. This course is a presentation of the AAPL Institutional and Correctional Forensic Psychiatry Committee. It is the second of a two year sequence. This advanced course will include a history of correctional psychiatry, a review of the major cases in this area as well as recent developments in the subjects of confidentiality and informed consent a s they apply to jails and prisons. The course will cover issues related to managed care in corrections, including contract negotiation to establish the scope of services, formulary issues, etc. Psychopharmacology in correctional settings will be discussed. Advanced concepts such as systems approaches and the integration of medical, mental health and addiction services, will be presented. There will be a review and discussion of the Prison Litigation Reform Act. In addition the course will invite audience participation in the discussion of difficult clinical issues including services to special populations such as youth in adult correctional facilities, women, geriatric patients, patients with mental retardation/developmental disabilities and patients with co-occurring disorders. Recent publications on the subject of “Forensic Psychotherapy” will be reviewed as well as the second edition of the APA’s “Guidelines for Psychiatric Services in Jails and Prisons” and the National Commission on Correctional Health Care’s “Guide to the Delivery of Mental Health Services in Correctional Settings.” The faculty for this course includes leading educators, surveyors and practitioners in correctional psychiatry. AAPL 1999 ANNUAL MEETING LUNCHEON SPEAKERS THURSDAY, OCTOBER 14 L1 – Reading the Expert Witness from the Perspective of a Juror COST - $32.00 Jo-Ellen Dimitrius, PhD Dr. Dimitrius received her PhD in 1984 from Claremont Graduate School in California. Her doctoral dissertation was “The Representative Jury: Fact or Fallacy.” Her first appearance in court was in 1984. Since then she has consulted in over 600 trials and picked over 400 juries. She has evaluated over 10,000 jurors, witnesses, lawyers and even judges during trial. She has also done much pretrial focus group and mock trial work. Her astonishing ability to understand and predict the behavior of jurors, witnesses, lawyers and judges led to her being nicknamed “The Seer” by the American Lawyer magazine, and her selection as the jury consultant in many of the most high profile cases of the ‘80’s and ‘90’s including: The Nightstalker, McMartin Preschool, Rodney King, Reginald Denny, John duPont, Frances Ford Coppola and of course, O.J. Simpson. Dr. Dimitrius also advises many Fortune 100 companies about how regular people would respond to their witnesses, claims and defenses. She co-authored a book entitled, “Reading People”, which was released in June of 1998 by Random House. She is currently working on a second book which will be released in January of 2000. She has been featured in magazines such as People, Newsweek, TIME, Parade, USA Today, New York Times, and Los Angeles Times, and has been on numerous television broadcasts. Steadman, PhD Risk Assessment of Community Violence: Taking Stock at the Turn of the Century Dr. Steadman is President of Policy Research Associates, Inc. Previously, Dr. Steadman ran a nationally known research bureau for 17 years for the New York State Office of Mental Health. His work has resulted in six books, over 100 journal articles, 18 chapters, and numerous reports. Dr. Steadman continues to work with the National GAINS Center for Persons with Co-occurring Disorder in the Justice System, the MacArthur Foundation Violence Risk Assessment Study, the National Resource Center on Homelessness and Mental Illness, and the Women and Violence Coordinating Center. He received his BA and MA degree in Sociology from Boston College and his PhD in Sociology at UNC, Chapel Hill. Dr. Steadman is a recipient of the Amicus Award from AAPL in 1987. He received the Philippe Pinel Award from the International Academy of Law and Mental health in 1988, the Saleem A. Shah Award in 1994 from the State Mental Health Forensic Directors, and the 1998 Distinguished Contribution to Forensic Psychology from the American Academy of Forensic Psychology.
