for multinational clients in this ever-expanding global economy.
Where do you begin? Where do you end? What is the division
of labor between in-house and outside counsel?
This session will review the critical tasks of trademark
portfolio management, including creating a brand
development strategy, trademark clearance and prosecution,
ownership structure for the portfolio, enforcement of
trademark rights and licensing marks—all with the

contrasting views from both sides of the lectern. The

Madrid System Users’ Meeting (MSUM) Organized by
World Intellectual Property Organization (WIPO)

The MSUM will open with an update from WIPO on
the developments of the Madrid System, followed by
presentations from officials of elected Contracting Parties of
the Madrid System. The invited officials will address specific
issues regarding the designation of their countries in an
international registration, including how to handle and avoid
notifications of provisional refusal.

CM02 Plain Packaging: Who Will It Affect Next?

Currently, plain packaging legislation applies only to
tobacco products, so why should other industries care or
object? Is this really a slippery slope issue? Speakers will
explore how the current law affects packaging and what
could happen in the future.
Discussion will include the broader implications of current
worldwide developments, such as what has happened in
the course of the year since the Australian government
implemented the most sweeping legislation to date on
plain packaging. Experienced panelists will also analyze
pending cases at the World Trade Organization and bring
you up to date on the latest EU developments concerning
revisions to the Tobacco Products Directive and the
possibility of expanded health warnings, all of which could
have a significant impact on the use of trademarks and
standardized packaging.

In eBay Inc. v. MercExchange, LLC, 547 U.S. 388 (2006),
the U.S. Supreme Court undercut the presumption of
irreparable harm in cases seeking injunctive relief. Since
then, a varying degree of tests and factors have been
applied by U.S. courts when ruling on injunctions, with
some stating there no longer is any presumption of
irreparable harm at all, others stating such a presumption
remains in trademark cases, and still others stating that
depending on the facts, there might or might not be such
a presumption.
This panel discussion will examine:
• Which jurisdictions still apply the presumption.
• How jurisdictions that have fully embraced eBay are
dealing with proof of irreparable harm.
• New strategies trademark owners have had to develop in
light of the opinion in order to obtain injunctive relief.

trademarks around the world. Recently, many U.S.-based
brand owners have been surprised to discover that the U.S.
government is increasingly issuing orders that change the
rules for trademark applications and renewals in embargoed
countries, with potentially significant consequences.
Speakers will provide an overview of these issues, including
the ethical obligations of trademark owners and an
interpretation of the orders by the Office of Foreign Assets
Control (OFAC). Embargo and boycott jurisdictions will be
discussed as well as and how the Foreign Corrupt Practices

commitment is required from each participant. Admittance
is on a first-come, first-served basis. Once capacity at the

Whether the acquisition is technology-driven or the purchase
is all about the brand, trademark counsel must work with
corporate merger and acquisition teams and outside counsel
to make sure that the acquired marks are properly vetted
and valued, that appropriate licenses are in place, and that
the proper clearance and due diligence to support current

world’s various indigenous people, have often provided
inspiration for trademarks and brands. Such adoption and
adaption is increasingly viewed not as an honor but as a
misappropriation. Product recalls, public apologies and
corporate embarrassment are but a few of the potential
consequences of such practices.
The session will provide an update on the progress of
international efforts through the World Intellectual Property
Organization (WIPO) to protect the intellectual property of
indigenous groups and will examine both new and existing
national initiatives to preserve traditional cultural expressions

area. Beverages are available throughout the day. On

A guest ticket will give access only to the event(s) purchased
and includes event transportation when applicable. For the
