As part of this, the staff of Nevada County's CalWORKs program work to empower our customers to find and secure employment and become financially self-supporting. We know that when people become self-supporting, they and their children will enjoy higher self-esteem and a better quality of life. CalWORKs staff are with their customers each step of the way. While they participate in work activities, CalWORKs staff are there to provide help with employment coaching, counseling, child care, transportation, and other work-related expenses. And, when someone receives or applies for public assistance, that person will be required, or may volunteer to participate with CalWORKs. That participant and Nevada County enter into an agreement to participate in employment-related activities, usually for 32 hours per week. As long as the terms of that agreement are met, the participant continues to receive public assistance payments (as long as they are otherwise eligible). If needed for employment, CalWORKs staff may assist that individual to earn a GED, obtain basic academic skills, participate in vocational training or attend a Job Search Workshop. Our Job Search Workshop gives intensive instruction and supervision in conducting a successful search for employment. Topics include résumé writing, application completion, interviewing, and how to successfully handle the everyday problems faced by every working parent. A participant may also be offered a non-paid employment assignment with a government or nonprofit agency in order to develop workplace discipline and gain valuable on-the-job training. http://calworks.co.nevada.ca.us/about_calworks.htm (1 of 3) [5/19/2003 3:03:36 PM] About CalWORKs The CalWORKs Welfare-To-Work services program is designed to help those currently receiving or applying for CalWORKs cash assistance who are required to, or desire to obtain employment and work toward self-sufficiency. We also make our employment services available to all segments of Nevada County in order to prevent poverty within our community. CalWORKs also directly helps Nevada County in other ways. As CalWORKs customers become financially independent, they acquire new skills and increased confidence. As public assistance rolls decrease, and as the underemployed and working poor find better jobs, we create a new skilled workforce and an army of productive taxpaying citizens. And, as Nevada County and its business community continue to grow and prosper, this new workforce will be a solid foundation for this growth. Finding a job will help you become selfsupporting, and enjoy a better way of life. After you find employment, you will have more money for your family, serve as a role model for your children, increase your self-confidence, and build a future. Nevada County’s CalWORKs Employment Services staff is here to help you reach your goals and find employment. Employment Services was designed with you in mind. It is not just another government program. It’s much more than that. Ø Your Employment Services’ Counselor is with you every step of the way, providing you with such important supportive services as childcare, transportation, and work and/or trainingrelated expenses. Ø Employment Services can help you find employment so you become self-sufficient. If needed, you will learn skills that will help you find employment in today’s work force and learn skills that will help you find employment in the local labor market. Ø Employment Services are offered at CalWORKs/Workforce Connection—a one-stop career center at 117 New Mohawk, First Floor, Nevada City, the Eric Rood Adminstration Center, 950 Maidu Avenue, Nevada City and the Employment Development Department (EDD) at the Joseph Government Center in Truckee. Through Employment Services, everyone wins. You gain a job and a future and employers gain a skilled workforce. Who Must Participate? Mandatory Participants - If you are a California Work Opportunity and Responsibility to Kids (CalWORKs) recipient, and are not exempt, you must participate in the CalWORKs’ program. You are considered a “mandatory participant.” If you are a mandatory participant, you are required to: Ø Keep appointments made by your Employment Services’ Counselor; Ø Sign a Plan; Ø Meet all Employment Services’ requirements, including the requirements of your Employment Services’ Plan; Ø Do not quit a job or lower your earnings, and Ø Provide proof of satisfactory progress in your assigned activity when required. http://calworks.co.nevada.ca.us/calworks_handbook.htm (2 of 19) [5/19/2003 3:04:13 PM] CalWORKs Handbook We will decide if your must participate in Employment Services when: Ø You apply for aid; Ø Your eligibility is re-determined, or Ø You have a change in your exemption status. Volunteers - Even if you are not required to participate in Employment Services, you can take an active part. You would be considered a “volunteer.” Ask your counselor how you can become involved in Employment Services. Who Is Exempt From Participation? Exemptions You are exempt and do not have to participate in Employment Services if: Ø You are under 16 years of age and not a custodial parent, or are 60 years of age or older; Ø You are 16, 17, or 18 years of age and go to school (not including college) full-time, unless you are in school as part of your Employment Services’ activities or a custodial parent; Ø You have a disability that is expected to last at least 30 days and would keep you from working or participating in an Employment Services’ activity, and are either receiving or trying to obtain the medical help you need (this exemption does not apply if you are a teen parent required to participate in the Cal-Learn program); http://calworks.co.nevada.ca.us/calworks_handbook.htm (3 of 19) [5/19/2003 3:04:13 PM] CalWORKs Handbook Ø You are a non-parent caretaker relative of a child who is a dependent or ward of the court, or have a child at risk of placement in foster care and we decide that caring for the child prevents you from working or participating in an Employment Services’ activity on a regular basis; Ø You must stay at home to care for a household member who is unable to care for himself or herself and it prevents you from working or participating in an Employment Services’ activity on a regular basis (this exemption does not apply if you are a teen parent required to participate in the CalLearn program); Ø You are the parent or other caretaker relative of a child six months of age or younger, and are providing care for that child, with the following restrictions: ♦ You may be exempt for this reason only one time during a period of continuous stay on aid under the CalWORKs’ program. ♦ If you received this exemption before and give birth or adopt another child six months of age or under, you may be exempt for 12 weeks. ♦ If you are a teen parent required to participate in the Cal-Learn program, this exemption does not apply. We may ask for verification when you claim any of the above exemptions. Your Employment Services’ Counselor can review your situation at any time. Please call your local CalWORKs’ office. Your path may not include every activity in Employment Services because a lot depends on your education and job history. The activities Employment Services offers are described below. Remember the purpose of Employment Services is to HELP YOU PREPARE FOR WORK AND FIND A JOB so you can support yourself and your family. Appraisal – When you begin participating in Employment Services, you will be given an Appraisal. During the Appraisal, your Employment Services’ Counselor will assess your work history, education, need for supportive services, and other information to help determine what your Employment Services’ activity or activities will be. Job Search – Following the Appraisal, most participants will be assigned up to four (4) weeks of Job Search activities. However, Job Search activities may be longer or shorter if your counselor and you agree that it would be more beneficial to you. Nevada County offers Job Search Workshops for people with little or no work experience. We offer an intensive four-week Job Club/Job Assistance Workshop at the Employment Services’ site located at 117 New Mohawk, First Floor, Nevada City . Employment Services is a one-stop career center where you can obtain all the information needed about job openings and opportunities. The following participants will not be required to participate in Job Search activities after an Appraisal has been done, but may be asked to do so: Ø A person who is working in an unsubsidized job or is participating in an approved Self-Initiated Program (SIP) if the job search schedule would prevent him or her from working or participating in a SIP; or Ø A teen parent required to participate in the Cal-Learn http://calworks.co.nevada.ca.us/calworks_handbook.htm (5 of 19) [5/19/2003 3:04:13 PM] CalWORKs Handbook program or a custodial parent age 19 years of age, without a high school diploma or GED. Assessment - You will be sent for an Assessment if: you do not get an unsubsidized job during your time participating in Job Search, we decide sending you to Job Search as your first activity would not help you or we decide to shorten your time in Job Search because it is not likely to lead you to getting a job, The purpose of an Assessment is for you, the participant, and us, Employment Services, to put together AN EMPLOYMENT SERVICES’ PLAN to help you find employment. To do this, a team of assessors will look at your abilities, interests, work history and education, the need for supportive services, skills, and available jobs in your area. Also considered, will be any physical, medical or emotional problems that may limit your ability to work or participate in Employment Services’ activities. A list of available services will be offered to you so that you may complete the Employment Services’ Plan and find a job. If you are in a Self-Initiated Program, your Employment Services’ Plan may be set up based on your Appraisal. However, you may be sent for Assessment if another activity is needed to ensure that you are participating in Employment Services activities for the number of hours that is required of you. In Reappraisal, we decide if there were special circumstances that kept you from finding employment in your area. If we decide there were no special circumstances, you will be sent to another activity and will be required to participate in one of the following activities: Ø Unsubsidized Employment Ø Work Experience Ø Job Skills Training Directly Related to Employment Ø Mental Health, Substance Abuse, or Domestic Abuse Services Hours of Participation One-Parent Families – If you are the adult in a one-parent CalWORKs’ case, and not exempt, you are required to participate in your assigned Employment Services’ activity/ activities for a total of 32 hours per week. Two-Parent Families – If you are an adult in a two-parent CalWORKs’ case, and not exempt, you and/or the other parent in your assistance unit are required to participate in your assigned Employment Services’ activity for a minimum total of 35 hours per week. Both parents may participate to meet the 35-hour requirement, but one of you must participate for at least 20 hours per week. In addition, to receive CalWORKs’ childcare (paid by federal money), you and the other parent in your assistance unit are required to participate for a minimum of 55 hours per week, unless at least one parent is disabled or has to care for a severely http://calworks.co.nevada.ca.us/calworks_handbook.htm (8 of 19) [5/19/2003 3:04:13 PM] CalWORKs Handbook disabled child. Note: The requirements for hours of participation do not apply if you are participating in the Cal-Learn program. Participation in More than One Activity At A Time We may require participation in more than one activity at a time if you can manage, it is consistent with your Employment Services’ Plan, and the activities can be scheduled together. Remember, you must participate in the minimum number of Employment Services’ activity hours described above. Satisfactory Participation Attendance – When you sign your Employment Services’ Plan, you agree to attend your activity and complete it. You are expected to arrive on time for each scheduled activity and attend all scheduled hours of activities. If you are unable to attend Job Search activities because of illness or other compelling reasons, you are required to call your Employment Services’ Counselor before 10:00 A.M. on the day of the scheduled activity to explain the reason you are absent. Your Employment Services’ Counselor will determine whether you have good cause for missing the assigned activity. Satisfactory Progress – All Employment Services’ participants are required to make satisfactory progress towards completing their assigned activities. Satisfactory progress means: being on time for scheduled activities, clean and appropriately dressed for work or job seeking, actively participating by completing assignments, taking part in discussions, being attentive and making an effort to learn and gain from the experience. Participants in educational or training programs must meet the provider’s standards for satisfactory progress. Completion of Assignment – A work activity is considered completed when the participant attends the scheduled number of hours in the activity and maintains satisfactory participation and/or meets the educational or training provider’s standards for completion. Remember, assigned activities are preparing you for employment. You are expected to follow the same standards as an employer expects when you find employment and begin to work. Supportive Services We understand you may need more than training and job counseling to take a successful part in Employment Services. That is why we help pay for childcare, transportation and work or training-related expenses. If other funding sources are unavailable for your supportive services’ expenses, we will pay for the supportive services as described below. Advance Payments - If you qualify for supportive services’ payments and need a payment before your activity has begun, an advance payment will be given so you will not be short on money - even for a small amount of time. Note: As of July 1, 1998 , advance childcare payments will go directly to the provider and will not be paid to you, the participant. Supportive Service Payments Include: Ø Childcare Costs - If the childcare is a necessary requirement for your participation in Employment Services’ activities, you may receive childcare for each child in your CalWORKs’ assistance unit, who is 10 years of age or http://calworks.co.nevada.ca.us/calworks_handbook.htm (10 of 19) [5/19/2003 3:04:13 PM] CalWORKs Handbook younger. For special circumstances, your 11 or 12-year old child may receive childcare if money is available. In addition, you may receive childcare for a child who lives with you, but is not in your CalWORKs’ assistance unit and not having childcare would prevent you from participating or finding employment. You may choose the type of childcare needed such as: a childcare center, relative, friend, or neighbor. We cannot pay childcare if you choose someone in your CalWORKs’ assistance unit, a child’s legal guardian, parent, or anyone under 18 years of age as the caregiver. Payments can be made to licensed childcare providers and, in some instances, to providers who do not require licensing. If your provider is not licensed, he/she must apply for Trustline registration (unless your provider is your child’s aunt, uncle, or grandparent). The most that can be paid is a rate based on what is normally charged for childcare in the area in which you live. Ø Transportation costs (up to a certain amount) traveled to and from your Employment Services’ activity for you and your children and travel to and from childcare. Ø Work or training-related costs for books, tools, and special clothing needed as part of a work activity. Ø If personal counseling is needed to help with your participation in Employment Services, a referral will be made. Please see your counselor for more information and/or referral. Note: If Employment Services pays for more childcare, transportation, work and/or training-related expenses than needed for participation, you are required to pay it back. However, you may not be required to pay it back while you are in Employment Services’ activities if doing so would prevent you from participating. http://calworks.co.nevada.ca.us/calworks_handbook.htm (11 of 19) [5/19/2003 3:04:13 PM] CalWORKs Handbook Supportive Services after You Get A Job We provide Job Retention and/or Supportive Services up to 12 months after you have begun employment. We pay only if needed to keep your job and you are unable to obtain the services from somewhere else. Once you find employment, it is important to keep it; we will provide whatever assistance necessary to ensure your success and retain your employment. Alternative Payment Program Once your situation improves or you leave aid, we transfer your childcare reimbursement to the local Alternative Payment Program (Sierra Nevada Children’s Services). Your childcare provider does not have to change once you find employment or transition off of aid. If you still need help with childcare costs and have been off aid for two years, you may be eligible (depending on the amount of your income) to continue to receive assistance from the Alternative Payment Program. CalWORKs or the Alternative Payment Program will pay your caregiver directly. Your CalWORKs Employment Services’ Plan Your Employment Services’ Plan is important. The plan ensures that you receive the agreed upon services and/or training as long as you are taking part in Employment Services and receiving cash aid. The plan tells what you must do and what we must do to make your CalWORKs’ plan a success. Your Employment Services’ Counselor will help you review each of the following parts of your Welfare-to-Work Plan: The Employment Services’ Plan / Rights & Responsibilities tells you about CalWORKs, our responsibilities, and your rights & responsibilities. This agreement applies as long as you are in Employment Services. The CalWORKs’ Employment Services Handbook The Employment Services’ Plan – Activity Assignment explains the work activity in which you are participating. You will sign an activity assignment each time you begin a new work activity. Read each part of your Employment Services’ Plan carefully. If you have questions, be sure to ask your CalWORKs’ Counselor. Both you and your Employment Services Counselor will sign each assignment. You must continue to participate in Employment Services and move from one activity to another until you find employment and become self-supporting. We support your goal to find employment and will provide whatever assistance we can to help you become successful and continue to advance in your job and career. Reasons for Not Participating We recognize you may have good reason for not signing your http://calworks.co.nevada.ca.us/calworks_handbook.htm (13 of 19) [5/19/2003 3:04:13 PM] CalWORKs Handbook Employment Services’ Plan, not taking part in one of the work activities agreed upon in your activity assignment, not accepting a job offer/referral, quitting a job, or reducing your earnings. Some reasons may be personal or related to the assignment. Reasons Related To You: Ø Transportation or work and/or training-related expenses paid in order for you to participate and they have not been provided. Ø A victim of domestic abuse and participating would be harmful to you or dangerous to your family. Ø Licensed or exempt childcare is not reasonably available during your training, employment or travel time for: - A child 10 years of age or younger; or A child in foster care or SSI recipient, but who is not included in the assistance unit. Reasons Related To Activity Assignment or Job: Ø Discrimination at the job or training because of age, sex, race, color, religion, national or ethnic origin, physical or mental disability, political affiliation or marital status. Ø Travel to work or training from your home is more than two hours round trip by car, bus, other transportation, or more than two miles round trip to walk because other transportation is not available. The limit on travel and mileage does not include transportation time or mileage to take family members to and from school or to and from other care providers. NOTE: If you do not take a job or participate in an assigned activity because of this reason, you are required to participate in Community Service closer to your home. http://calworks.co.nevada.ca.us/calworks_handbook.htm (14 of 19) [5/19/2003 3:04:13 PM] CalWORKs Handbook Ø The job requires more daily or weekly hours than is normal or customary. Ø Conditions at the job and/or training site violate health and safety standards or could cause serious injury or death. Ø The job or work activity does not provide Workers’ Compensation Insurance. Ø Accepting a job or work activity would interrupt or interfere with an approved education or training assignment, except Work Experience or Community Service. Ø Accepting a job or work activity would cause violation of the terms of your union membership. What Happens If You Do Not Participate As you know, participation in Employment Services is mandatory for all able-bodied CalWORKs’ applicants and recipients. Exemptions are listed in the section titled, “Who Is Exempt From Participation?” If, for any reason, you do not do what Employment Services requires, the following steps will be taken: Cause Determination – If you do not meet Employment Services’ requirements, you have the right to explain why. The County will decide if it is a good reason for not participating. See the section titled, “Reasons for Not Participating.” If you have good reason for not doing what Employment Services requires, your Employment Services’ Counselor will help you so you can meet Employment Services’ requirements. http://calworks.co.nevada.ca.us/calworks_handbook.htm (15 of 19) [5/19/2003 3:04:13 PM] CalWORKs Handbook If changes cannot be made so you are able to meet the Employment Services’ requirements, you will not be required to participate in Employment Services. You will be referred to the CalWORKs’ Clinical Team for follow-up services. Compliance – If you do not meet Employment Services’ requirements, a notice will be sent to you. You have 20 calendar days after the date of the notice to call or meet with your Employment Services’ Counselor and show good cause for not doing what is required or agree to sign a compliance plan and meet the requirements, if you do not have good cause. If you meet the plan requirements, no penalties will be applied. Financial Sanctions – If you are a mandatory participant (see the section titled, “Who Must Participate?”), your family’s cash aid will be lowered if you fail or refuse to meet Employment Services’ requirements without good cause and fail to resolve the problem by signing and completing a compliance plan. Your family’s cash aid will be lowered if anyone who is required to participate does not meet Employment Services’ requirements. This financial sanction will happen only if the person does not have good reason, or fail to sign or complete a compliance plan. The person in financial sanction will not receive cash aid for a period of time. If your family is a two-parent family getting cash aid because of unemployment, there are special rules for financial sanctions. If a parent who must participate in Employment Services causes a financial sanction, both parents will lose their cash aid. However, the parent who did not cause the sanction can keep his or her cash aid if he or she participated in Employment Services, is exempt, or has good cause for not participating. The first time you are sanctioned, your family’s aid will be lowered until Employment Services‘ requirements are met. http://calworks.co.nevada.ca.us/calworks_handbook.htm (16 of 19) [5/19/2003 3:04:13 PM] CalWORKs Handbook The second time your family’s aid is lowered for a minimum of three (3) months. After three months, the sanction will stop if Employment Services’ requirements are met. The third or additional time your family’s aid will be lowered for a minimum of six (6) months. After six months, the sanction will stop if Employment Services’ requirements are met. Penalties for Volunteers – Individuals who are exempt from participation (see the section titled, “Who Is Exempt From Participation?”) may choose voluntary participation in Employment Services. If you volunteer for the Employment Services’ program and fail to meet Employment Services’ requirements without good reason, you may not be allowed to participate in Employment Services for a period of time. See your CalWORKs’ Employment Services Counselor if you have any questions regarding these requirements. Your Child’s School Attendance If your child(ren) must attend school and Employment Services decides he/she does not do so on a regular basis, (unless he/she is eligible to participate in the Cal-Learn Program) your family’s cash aid will be lowered. If we ask for it, you must show proof your child(ren) is attending school regularly. State Hearing – If you disagree with any County decision regarding an Employment Services’ penalty (see the section titled, “Good Reasons for Not Participating”), your status in Employment Services, your Employment Services activity or your Employment Services’ supportive services, you may ask for a State Hearing. For Employment Services’ financial sanctions, you may use the same process you use when you disagree with the action taken on your cash aid. Your Employment Services’ Counselor will help you file for a State Hearing if you wish. You may request a Re-hearing after the State Hearing decision is reached. Ø If you file for a State Hearing before the penalties start, penalties will not be applied while the hearing is being decided. Ø If you file for a State Hearing for any other County action, different rules apply. The Employment Services’ hearing rights form explains these rules. You can ask for copies of the form at any time. 2. Independent Assessment - If you do not agree with the results of your Assessment or Employment Services’ Plan, someone who is not a County Counselor will review the Assessment and complete another one if necessary. The results of this independent Assessment will be used to set up your Employment Services’ Plan. Ø If you have an independent Assessment finished, penalties will not be applied while you await the results of the review. 3. Formal Grievance Set by the County Board of Supervisors -This is a process adopted by the Nevada County Board of Supervisors.
