TERMS OF SALE
1 - PURPOSE
These terms are intended to define the relationships
contracted between Skoubee Sàrl, hereafter Skoubee, and The Purchaser
of the Skoubee Technology, hereafter The Client.
These conditions govern the sale of the interactive medal with which the client
has access to an on-line space located at the website www.skoubee.com. Personal
information, including the pet’s profile, will be
recorded on this space for the Client.
These conditions are applicable when the Skoubee Medal is purchased on the website
(www.skoubee.com) whether the Client is a professional or a consumer.
The purchase of the Skoubee Medal through this site implies acceptance
by the Client of these terms of sale.
These terms and conditions shall prevail over all other conditions,
general or specific, which are not specifically approved by Skoubee.
Skoubee reserves the right to change its terms and conditions at any
time. In this case, the conditions will be those in force on the Skoubee internet site on the
date of registration and purchase of the medal by
the Client.
Before purchasing and using the Skoubee technology, the Client will have read and accepted
these terms of sale.
2 -SKOUBEE TECHNOLOGY DESCRIPTION:
Skoubee reserves the right to make any changes and improvements to its website which are
deemed necessary and appropriate and will not be held
responsible for damages of any kind that may arise from these changes.
Skoubee is primarily intended for people (Clients) want to voluntarily share personal
information about their pets with any other person who might find their lost pet.
The Skoubee medal shall be fastened by the Client on the pet’s collar.
The unique identification number on the medal worn by the pet will fit the public profile report
of this pet on the Skoubee site.
It is strongly recommended that the Client always use the same medal for each designated
pet and not remove it from the pet in order to avoid confusing
information related to that pet with the information of another pet.
If a medal is lost, for example, due to unfastening the pet’s collar, the
Client will notify Skoubee in order to deactivate the medal. Another medal may then be
purchased with a different identification number and the information related to the lost medal
will then be redirected to the number of the
new medal.
The Skoubee technology connects to a database server using
a unique identifier for each medal via a web browser in order to
read personal data related to their pets.
The Client can then make all or part of the pet’s information publicly accessible on the pet’s
identity card on the Skoubee site.
This data will be immediately available to third parties by means of a
smartphone, or any other equivalent technology provided with a camera, a
web browser and an internet connection (tablet PC) which can read the profile on the
Skoubee site, as accessed through the pet’s medal.
For this, it suffices to read the NFC chip on the Skoubee medal by
means of a smartphone or other technology which employs NFC technology, or by flashing
the QR code on the
Skoubee medal, or also by manually entering the medal’s 8-digit code on the Skoubee
website.
3 - LIABILITY AND CUSTOMER'S OBLIGATIONS:
The Client is responsible under its national laws, and has the full legal and
personal responsibility for the information and data that the Client has chosen to include in
the Skoubee profile for the Client’s pet.
The Client agrees to update the information related to the profile of the pet and is solely
responsible for the accuracy of such information.
Skoubee draws the customer's attention to the confidential nature of certain
data accessible to third parties during the reading of the Skoubee medal, such as
name, home address or phone number of the owner
the pet.
If the customer makes a deliberate choice to make this information viewable on
www.skoubee.com, he personally takes full responsibility.
Skoubee reminds the Client that every medal has a unique identifier and the
medal must be securely attached to the pet’s collar.
The client should avoid removing the pet’s medal to avoid risk of error
confusing information between different pets.
In any case the Client or his heirs cannot hold Skoubee responsible if the information entered
by the Client is false or erroneous.
4 - PRICES:
The selling price of the Skoubee technology mentioned on this site is valid at time of order.
The prices are quoted and invoiced in Swiss francs and include Swiss taxes.
Any other currency is calculated from the official rate of the Swiss franc, Skoubee currency
reference.
5 - SECURE PAYMENTS:
Payments will be made online by credit card and will be made through the secure PayPal
system using SSL (Secure Socket Layer) protocol
so that the transmitted information is encrypted by software and
no third party can become access this information during the payment transaction
on the network.
This secure payment system ensures total privacy and the
bank simply informs Skoubee of the acceptance or rejection of
payment.
No witness type "cookie" is used.
6 - WARRANTIES:
Services sold by Skoubee benefit from the legal guarantee provided by the
Swiss law. Requests for claims or refunds must be made
by post to the address of the headquarters or the Skoubee site within thirty days of full
registration or activation on the Skoubee site.
Each medal has a 24 month warranty from the date of purchase.
During this period, the medal can be replaced if it does not function properly under normal
operating conditions as described in the description of the Skoubee technology.
7 - LIABILITY SKOUBEE:
Skoubee in the process of selling online is only bound by an obligation of means. Skoubee
cannot be held liable for damages resulting from using the Internet such as data loss,
hacking, viruses, out of
service, or other unintended problems.
Skoubee cannot be blamed for malicious
use of the Client’s personal information, error on the pet, or
for incomplete or incorrect information on the profile of the pet.
7-1 Accessibility and Networks
Skoubee cannot be held responsible in case of poor
functioning of the Internet (WIFI, 3G, 4G, etc..).
Skoubee points out that the reading of information on the pet’s profile is only possible when
the Internet is functioning normally.
Skoubee declines all liability in the event that the data download is
impossible or of poor quality.
The Skoubee site is normally accessible 24 hours a day, 7 days a week,
throughout the year.
Skoubee nevertheless reserves the right, without notice or compensation, to close access
temporarily or permanently and will not be responsible for damages
of any kind that may arise from this.
The client acknowledges being aware of the constraints and limitations of the Internet
and mobile Internet.
Under these conditions, the customer must, as is true of any user or owner of a
smartphone, protect its technical equipment against any particular
form of contamination by viruses and / or attempted intrusion or
access or use by third parties, including parents, relatives or the Client. Skoubee will not be
held responsible for any such intrusion, contamination or use.
7-2 - Fraudulent use of the support:
Skoubee cannot be held responsible for the misuse of
Client’s information by a third party.
The Client is personally responsible for the data that is entered into the
profile of the pet on the Skoubee site as well as the potential for fraudulent use of this
information by others.
The Client must be aware of the ease with which his or her information can be
accessed by a third party.
Only the Client is able to modify the information related to the profile of its pet which is
recorded on the Skoubee website.
7-3 Degradation of the media:
The customer acknowledges that the custodian in the legal sense of the medal.
It must particularly ensure its integrity so that it does not suffer any deterioration likely to
affect the reading.
Skoubee advises the customer to change the medal every 3 years to ensure its
always optimal playback.
A new medal with another code will replace the old one.
Information related to the animal will be redirected to the new medal.
7-4 Using the collar as support for the medal:
The choice of collar for attaching the medal is the sole responsibility
the Client. The Client is solely responsible for attaching the medal to the pet’s collar.
Skoubee cannot be held responsible in the event that the pet’s collar opens and the medal is
lost.
7-5 Technical Incidents related to code readers for the medal:
Skoubee is not responsible for the operation of the readers for reading
the medal’s codes.
The customer must take note of the operating instructions of the medal and its
functions as well as the information it generates (historical data sharing,
social networks, etc..).
Skoubee cannot be held responsible for the use of this data by
others.
7-6 Reproduction:
Skoubee disclaims any liability for fraudulent reproduction of the
medal.
The customer must check the readability of the medal’s codes.

The customer is responsible for duplicate QR code medal he reproduced
in any medium whatsoever.
skoubee cannot be held responsible for poor quality
reproduction of a QR code used in the conditions described herein
terms and conditions.
The customer shall be responsible to the size, material, quality
Printing and other procedure of reproducing a QR code or
unique code that will implement and incurs risks when reading
others.
Skoubee cannot be held responsible for the malfunction of the QR
codes and codes thus reproduced.
8 - INTELLECTUAL PROPERTY:
All elements of the Skoubee website are and remain the
intellectual and proprietary property of Skoubee.
No one is allowed to reproduce, use, repost or use for any purpose
whatsoever or in any form whatsoever, even partially, the elements of the
site whether they be software, visual or audio. Any single link or hyperlink is
strictly prohibited without prior written agreement from Skoubee.

9 - PERSONAL DATA:
According to the law relating to data, information of a personal nature
about the Client cannot be processed automatically.
The Client has a right of access and rectification of permanent change and
deletion of data. This right can be exercised by writing to
Skoubee headquarters or by email.
This deletion renders immediately unusable the Skoubee medal, and data
cannot be recovered.
Skoubee reserves the right to prematurely terminate the account linked to the Client if the
Client uses the technology in an illegal manner or if the published information is racial,
pornographic or deemed unethical
by Skoubee.
10 - PERSONAL INFORMATION:
Skoubee may be required to inform the Client by email of the availability of software updates
or new services.
11 - SETTLEMENT OF DISPUTES:
These conditions of online sales are governed by Swiss law and only the
French version of these conditions shall prevail. In case of dispute, exclusive jurisdiction is
given to
competent courts of the Canton of Fribourg, despite multiple defendants or
call warranty.
