Esconde Court stops BIR from imposing fuel tax at Clark, Subic BY DING CERVANTES ANGELES CITY – A regional trial court (RTC) here has issued a writ of preliminary injunction, stopping the Bureau of Internal Revenue (BIR) from enforcing “directly or indirectly” a regulation that was purportedly designed to curb loses worth P40 to P60 billion from smuggling yearly. RTC judge Philip Iturralde issued the order to Finance Sec. Cesar Purisima and Bureau of Internal Revenue (BIR) Commissioner Kim Henares who were ordered to withdraw the implementation of Revenue Regulation No.2-2012. The regulation, already being enforced by the BIR, required fuel importers at Clark and Subic to pay regular taxes, despite Republic Act 7227 as amended by Republic Act 9400 exempting them from such taxes in lieu of five percent tax on gross income earned (GIE). The regulation said, however, that the importers could reimburse what they paid beyond the GIE after showing proof that the fuel they sold had been consumed within Clark or Subic, also as prescribed by law. Iturralde noted that the regulation was intended to curb fuel smuggling from Clark and Subic, from which the government has reportedly been losing from P40 billion to P60 billion per year. But Pampanga 1st District Rep. Carmelo Lazatin, who filed the petition against the regula- tion, noted that the BIR had “no authority to go beyond the provisions of RA 9400 which amended RA 7227.” Iturralde noted that “since there appears to be patent conflict between the questioned regulation and RA 9400, in order to prevent injury to the registered businesses inside the Freeport zones, there is a need to restrain the BIR from implementing Revenue Regulation No. 2-2012 until the main case has been heard.” The judge warned, however, that RA 9400 prescribes penalties to investors who are found smuggling fuel from Clark or Subic. The penalty includes perpetual barring from doing business in any Freeport or economic zone in the country. CITY OF SAN FERNANDO – The city government here is optimistic of the potential of the historic San Fernando Train Station to become a major tourist attraction. Mayor Oscar Rodriguez, together with Mark Lapid, chief operating officer of the Tourism Infrastructure and Enterprise Zone Authority (Tieza), formally opened the train station during the celebration of the 70th anniversary of the Araw ng Kagitingan on April 9. According to accounts, Philippine national hero Dr. Jose P. Rizal once got off a train in this station to visit friends in San Fernando. The train station also saw the agonizing journey of Filipino and American soldiers who were forced by the Japanese to take part in the Death March. Llamas added that in 2006, the original Agusuhin settlers were brought to a 14-hectare lot in the nearby village of Cawag, where Hanjin initially spent P2.7 million for the construction of a public school, church and other public facilities for the relocated families. Two weeks ago, these residents were again displaced from their homes when Pamana Inc. claimed the land, which is apparently being eyed to be developed into a resort. The residents lamented that after they have been relocated to make way for Hanjin, their supposed relocation site now turned out to be owned by another entity. At present, the displaced families have built makeshift houses by the roadside at Barangay Balaybay, a village in Castillejos, Zambales. Reports indicated that the municipal government of Subic have already identified another site for the relocation of the 235 displaced families, and that ground works have already started in preparation for their transfer. ANGELES CITY – As evidence to the city’s commitment in providing quality education to deserving students, a government scholar here recently finished his degree at Angeles University Foundation as Cum Laude. Justin Yves Gozun, a 21-year old Nursing student has been under the Public Employment and Services Office (PESO) scholarship program during the entire duration of his 4- year-college education. According to Gozun, he receives scholarship assistance of P20,000 every semester to supplement the funding for his education. All he needs to do is to maintain a grade point average of 85 every semester. “The PESO scholarship was really a blessing. It has inspired me to continue striving hard with my studies. I see to it that I am studying hard not only to maintain my scholarship but to make the city government proud. There are a lot of people who would want to finish their studies though they are financially incapable,” Gozun said. Panlilio over the ruling of the Commission on Elections (Comelec) declaring Lilia G. Pineda as the duly-elected chief executive of Pampanga in the May 2007 elections. This, consequent to the electoral protest the latter filed against the former. The suspended priest-turned-governor’s petition was rendered moot and academic in the wake of the regular national and local elections in May 2010 and the proclamation of winners. That, the ruling declared, “has left the Court no alternative except to dismiss the petition in accord with jurisprudence to the effect that the expiration of the contested term of office renders the petition moot and academic.” Pineda buried Panlilio in an avalanche of over 400,000 votes in the 2010 gubernatorial contest. In the contested 2007 polls, the Comelec proclaimed Panlilio the winner with 219,706 votes, as against Pineda’s 218,559 votes. Pineda’s protest resulted to the Comelec’s Second Division proclaiming her the winner with 190,729 votes over Panlilio’s 188,718 votes. Despite the Comelec order for Panlilio to vacate the Capitol, he continuously performed the duties of a governor while his petition remained pending before the Supreme Court, which lasted until his term ended. Pineda did not sit even for just a second as duly-elected governor in the 2007-2010 term. “It’s simply a moral victory.” Pineda now calls the decision of the High Court. A non-issue, really. The Kapampangans knowing and keeping in their hearts their true governor since 2007. And happily served by her for as long as they can remember. That was Among Ven Samson the last time I saw him – at the recognition rites for the Most Outstanding Kapampangan Awards capping the Pampanga Day celebrations on December 11 last year. We embraced each other not so much as fellow MOKA awardees as still-a-penitent son to an ever-forgiving father. Yes, Among Ven and just-out-of-the-seminary me had some issues back when he was my parish priest in Sto. Tomas in the early ‘70s. So much water has not only gone under the bridge but even flooded my town since then, and we have reconciled. But still, some pangs of guilt and remorse are just too deep to finallyb heal. And I am now in mourning. Anyways, Among Ven, barely audibly exulted, “ikwa ke mu rin” holding the MOKA trophy. You long deserved it, Among. I told him as we posed with his beloved Atching Claring for photographs. Among Ven stands out among the MOKA for culture recipients. No mean feat is his translation of the Bible in the Kapampangan language, and as great an opus is the Kapampangan Dictionary. These, aside from his translations of novenas and other liturgical rites. It would have been to the eternal shame of the Kapampangans had he been bypassed anew in the last MOKA. It was Easter Monday when I got the text message from Ronnie Tiotuico, president of our Mater Boni Consilii Seminary Alumni Association that Among Ven had his own Passover – to the kingdom of the Father. And soon our website filled up with sharings of experiences with Among Ven. From our elder brother Rey Deang, president of our alumni group in the US and Sta. Ana townmate of Among Ven: “He loved the priesthood to the end. He ceased his ministry because he respected the priesthood so much, even when he was offered a post in Iraq as a Catholic Priest, he took it on but later quit, because of his state of life at that time. He enjoyed his work there, and the opportunity to be with Armenian Christians.” Another US-based elder brother, Verne Quiazon, summed up our collective feelings for our mentor thus: “Fr. Ven was a man of talent, dedication and integrity. The Church in Pampanga would have been the poorer but for the voluminous work of translations that Fr. Ven has done and in the process he also advanced Kapampangan culture and literature. A cynic might say that others would have taken up the work Fr. Ven has done anyway but it would be difficult to match his scholarship and dedication. Fr. Ven’s dedication is deeply rooted in is faith: he was faithful to his priesthood, to his Church and his family. He was a priest to the very end and he will always be Among Ven to me. He loved the Church dearly and kept on doing her work even after he has left active ministry. And his love for his family is a strong testament to married love in a world where the family is constantly being barraged and damaged by an hedonistic and materialistic environment. Fr. Ven’s integrity is a challenge to the Church. He could have stayed on an active priest with a family on the side - a number of priests actually do. But he chose to do it by the rules dura lex, sed lex. Celibacy is not a divine imposition, it is not even biblical - most of the apostles were married and were family men. In the past, priestly celibacy was a witnessing to a life totally dedicated to the ministry. Now, that the family as an institution is under constant threat and barrage, married priests would be strong witnesses to the sanctity of married life and the family. Apu Ceto is a pastor very much after Christ’s image and heart. He is not one to condemn sinners but would break bread with them. It is so very Apu Ceto to have been the last person to spend time with Among Ven during his last minutes of his earthly existence. Even from afar, I can feel Apu Ceto’s great love for his priests and he makes no distinction between the good ones and the bad ones. He loves them all - like God loves us all. I pray for both Among Ven and Apu Ceto and thank God for having blessed my life with these two saintly persons. May Among Ven rest in peace. May Apu Ceto’s tribe increase. Aye, Verne, we, the sons of our Mother of Good Counsel, all say “Amen.” TODAY IN HISTORY First man in space ON APRIL 12, 1961, aboard the spacecraft Vostok 1, Soviet cosmonaut Yuri Alekseyevich Gagarin becomes the first human being to travel into space. During the flight, the 27-year-old test pilot and industrial technician also became the first man to orbit the planet, a feat accomplished by his space capsule in 89 minutes. Vostok 1 orbited Earth at a maximum altitude of 187 miles and was guided entirely by an automatic control system. The only statement attributed to Gagarin during his one hour and 48 minutes in space was, "Flight is proceeding normally; I am well." After his historic feat was announced, the attractive and unassuming Gagarin became an instant worldwide celebrity. He was awarded the Order of Lenin and given the title of Hero of the Soviet Union. Monuments were raised to him across the Soviet Union and streets renamed in his honor. The triumph of the Soviet space program in putting the first man into space was a great blow to the United States, which had scheduled its first space flight for May 1961. Moreover, Gagarin had orbited Earth, a feat that eluded the U.S. space program until February 1962, when astronaut John Glenn made three orbits in Friendship 7. By that time, the Soviet Union had already made another leap ahead in the "space race" with the August 1961 flight of cosmonaut Gherman Titov in Vostok 2. Titov made 17 orbits and spent more than 25 hours in space. To Soviet propagandists, the Soviet conquest of space was evidence of the supremacy of communism over capitalism. However, to those who worked on the Vostok program and earlier on Sputnik (which launched the first satellite into space in 1957), the successes were attributable chiefly to the brilliance of one man: Sergei Pavlovich Korolev. Because of his controversial past, Chief Designer Korolev was unknown in the West and to all but insiders in the USSR until his death in 1966. Born in the Ukraine in 1906, Korolev was part of a scientific team that launched the first Soviet liquid-fueled rocket in 1933. In 1938, his military sponsor fell prey to Soviet leader Joseph Stalin's purges, and Korolev and his colleagues were also put on trial. Convicted of treason and sabotage, Korolev was sentenced to 10 years in a labor camp. The Soviet authorities came to fear German rocket advances, however, and after only a year Korolev was put in charge of a prison design bureau and ordered to continue his rocketry work. In 1945, Korolev was sent to Germany to learn about the V-2 rocket, which had been used to devastating effect by the Nazis against the British. Ikatlo, ano pa bang mas sasarap pa sa pakiramdam kaysa sa maghanapbuhay hindi lamang para sa pamahalaan kundi para sa Bayan? Iba ang naidudulot na karangalan ng paglilingkod sa kapwa at sa ating minamahal na bansa. Muli, nananawagan ako na kayong mga magsisipagtapos sa kolehiyo ay isiping magtrabaho sa pamahalaan. At mas matibay ko itong inirerekomenda sa mga mag-aaral na nanggaling sa State Universities and Colleges dahil ang matrikula ninyo ay may subsidyo mula sa buwis na ibinabayad ng bawat mamamayan. Hindi ko sinasabing gawin ninyo ito dahil lamang sa utang na loob, kundi gawin ninyo ito dahil sa pagmamahal ninyo sa Bayan, pagmamahal din para sa bawat mamamayang Pilipino at dalisay na hangaring maglingkod ng tapat at buo ang loob. Sa pagtatanong natin ng kung ano nga ba ang kinabukasan, ang simpleng sagot diyan ay: KAYO—kayong mga kabataang nagpursiging magtapos ng kolehiyo at may mga kakayahang magagamit ninyo sa paglilingkod sa loob ng pamahalaan para sa Bayan. Ikagagalak kong makakita ng mga bagong mukha na mas nakababata rito sa Kongreso at sa iba pang sangay ng pamahalaan. Nakakapagbigay ito sa aming mas nakatatanda ng karangalang magtrabaho sa loob ng gobyerno na may kaakibat na bagong kaalaman na patuloy pa rin at mas naipapaigting pa ang kagustuhang magbigay serbisyo para sa sambayanan. By employing this technology and his own considerable engineering talents, by 1954 Korolev had built a rocket that could carry a five-ton nuclear warhead and in 1957 launched the first intercontinental ballistic missile. That year, Korolev's plan to launch a satellite into space was approved, and on October 4, 1957, Sputnik 1 was fired into Earth's orbit. It was the first Soviet victory of the space race, and Korolev, still technically a prisoner, was officially rehabilitated. The Soviet space program under Korolev would go on to numerous space firsts in the late 1950s and early '60s: first animal in orbit, first large scientific satellite, first man, first woman, first three men, first space walk, first spacecraft to impact the moon, first to orbit the moon, first to impact Venus, and first craft to soft-land on the moon. Francis Maslog, officer-in-charge of the Provincial Manpower Training Center (PMTC), said that of the total 96 graduates, 15 successfully finished the three-month courses on consumer electronics, 19 on computer literacy, 34 on shielded metal arc welding and 28 on computer hardware servicing. Maslog said they offered these courses free of charge. “This is in line with the thrust of Governor Lilia “Nanay Baby” Pineda’s administration of pro- viding ample livelihood and employment opportunities to target needy sectors in the province.” He said the governor has been very supportive to the various training activities of the PMTC, ensuring that the facility is equipped with the needed training tools and equipment such as compressors and grinders including safety gears like hard hats and gloves. During the graduation rites held at the Benigno Aquino Memorial Hall, Maslog urged the graduates to further hone their newly-acquired skills, use it in gaining employment, and if possible, put up their own business. Benny de Guzman, a technical sergeant of the PAF Weather Group based at Clark Air Base who was among the graduates, said he will buy a welding machine and start his own business as he plans to retire from government service a year from now. Technical Education and Skills Development Authority (TESDA) Provincial Director Ben-hur Baniqued congratulated the graduates for successfully completing their respective short courses. Baniqued also urged them to strive and work hard not only in gaining employment but to become entrepreneurs. For his part, Maslog said that the graduates will further undergo 300 hours of on-the-job training with local companies such as Honda Cars in the City of San Fernando, Enigma Computer Shop in Angeles City, St. Catherine Realty and other supportive business establishments. He noted that one of the center’s graduates last year, Joseph Estrada, a namesake of the former president, bested other graduates of a prestigious national-based institution. What is your name?)” Datu said he was surprised by Tambungan’s question, claiming they knew each other. He said he nevertheless introduced himself again politely to the police chief who, he claimed, angrily demanded explanation for his presence in the compound. Based on 2007 census, Barangay 630 has a total of 33 residents, but it grew to 48 based on the 2010 census. In Mindanao, Barangay Bucana in Davao City holds the record of most populated village with 78,352, up from 74,113 in 2007. The least populated village in Mindanao is Barangay 39 in Cagayan De Oro City with 46 residents. It rose from 34 in 2007 census. David pinned his hopes on Pineda, saying “the governor has been helping his people a lot and the farmers have high hopes on her.” He said he is ready to help Pineda on her projects designed to help farmers get a better yield and improve their lives. David said he was alarmed by his own study and survey that the average age of farmers in Pampanga is 54. He asked the ages of at least 1,000 farmers. He said the project of Pineda should encourage younger people to engage in the noble but rewarding profession of farming. “As I have said, farming is where the money is. David developed the green-colored fruits at his greenhouse donated through the DA High Value Crop Development program initiated by former President and now Pampanga 2 nd District Rep. Gloria Macapagal-Arroyo. Several farmers who received greenhouses are encouraged by David’s success in growing honeydew lemons under greenhouse condition using organic fertilizers. They also want to learn David’s methodology. FAIR MARKET But David’s success story on growing honeydew lemons had been cut short by the so-called “greed and unfair market practice of some middlemen.” David disclosed that a prominent and well-known firm had purchased his honeydew lemons for P20 per kilo. Then a few days later he found out that the private firm had sold his fruits much higher, commanding a P120 per kilo price at a mall in Pampanga. David urged Gov. Pineda to help farmers get a fair share of the marketing and monetary benefits of their fruits and vegetables. “We do all the work and invest on our crops with our hard-earned money. But it’s the middlemen who benefit a lot when they have nothing to lose but everything to gain,” said David in the dialect. TRADING POST He asked the firstterm governor to create a trading post similar to what Agriculture Sec. Proceso Alcala had fully supported in Sariaya, Quezon. It benefited Quezon farmers, most of whom from the province’s second district where Alcala was a former congressman. Imperial said the governor had asked him earlier to make a study on the trading post or center along the Olongapo-Gapan road. “Gov. Pineda was inspired by the success of the trading post pushed by Secretary Alcala in Quezon. But he asked me to make a thorough study of the trading center to make sure it will be beneficial, especially to farmers,” said Imperial. Butil Farmers Partylist Rep. Agapito Guanlao of Pampanga also pushed for the creation of a trading center in the province. David said the national government should help farmers sell their produce in a set-up where they will earn more instead of the middlemen. He said the money and time spent by the government on subsidizing the farmers should be used in helping them market and sell properly their fruits and vegetables. “The farmers can buy their fertilizers and other needs. The real problem is that they don’t get much profit from their products due to unfair practices,” said David. He said that the farmers bring directly their products at the trading post, selling higher compared to what the middlemen offer them.
