Our Organisation
FWBC’s primary responsibility is to regulate workplace relations laws in the building and
construction industry through education, advice and compliance activities.
FWBC achieves this by:

educating and advising industry participants about their rights and responsibilities under
workplace laws

investigating suspected contraventions of the law, the Building Code, federal
agreements and awards

instituting and intervening in proceedings when workplace laws are broken

FWBC staff are employed under the provisions of the Public Service Act 1999, which means
that it is part of the Australian Public Service (APS). As an APS employee, staff are employed

The FWBC provides a national service, with offices in Melbourne, Sydney, Canberra, Brisbane,
Perth, Adelaide, Hobart and Darwin.

Overview
Fair Work Building & Construction (FWBC) regulates workplace laws in the building and
construction industry, through education and enforcement. The agency is focused on ensuring
compliance with laws and the Building Code in areas including unlawful industrial action,
coercion, right of entry, freedom of association and discrimination together with administration
of the Building Code 2013.
Investigators are primarily responsible for undertaking assessments, investigations and audits
into breaches of Commonwealth workplace laws including the Fair Work (Building Industry) Act
2012 (FWBI Act), the Fair Work Act 2009 (FW Act), the Building Code 2013 and other laws
relating to the building and construction industry.
APS 4 Investigators will have some experience conducting investigations and/or audits, an ability
to interpret and apply the law, well-developed communication and interpersonal skills, a capacity to
work well individually and as a team member, and be able to deal with conflict in a professional
manner.
APS 5 Investigators will have experience in conducting investigations and/or audits,
demonstrated ability to interpret and apply the law, well-developed communication and
interpersonal skills, a capacity to work well individually and as a team member and be able to
deal with conflict in a professional manner.
Investigators must be prepared to travel regionally and interstate for a number of weeks at a
time for operational training or to assist in other FWBC offices. They must also hold a current
driver’s licence.
The successful applicant will be appointed as an Inspector under the FWBI Act.
Duties
APS 4
Under supervision and guidance, the typical duties of a FWBC Investigator include, but are not
limited to:


Conduct compliance activities and investigate breaches of Commonwealth workplace laws and
the Building Code.
Conduct site visits and undertake all aspects of code audits and inspections.




Participate in education sessions that FWBC provides to industry participants and undertake
liaison with relevant organisations and Government agencies.
Prepare reports, correspondence and briefs of evidence.
Provide advice and assistance to industry participants via the FWBC 1800 Hotline service.
Update the FWBC case management system and use information technology generally to
enhance investigation work.
APS 5
Under guidance, the typical duties of a FWBC Investigator include, but are not limited to:







Conduct compliance activities and investigate breaches of Commonwealth workplace laws and
the Building Code.
Conduct site visits and undertake all aspects of code audits and inspections.
Participate in education sessions that FWBC provides to industry participants and undertake
liaison with relevant organisations and Government agencies.
Prepare audit and inspection reports; correspondence on results of compliance activities; and
briefs of evidence to legal officers for the conduct of legal proceedings.
Provide advice and assistance to industry participants via the FWBC 1800 Hotline service.
Collate statistics and data relating to the building and construction industry.
Update the FWBC case management system and use information technology generally to
enhance investigation work.
Selection Criteria
When considering applications, selection advisory panels will seek evidence of performance
against each of the criteria.
Selection panels may use a range of methods to identify work outcomes, capabilities and
behaviours that demonstrate performance. It is therefore in the interests of candidates to
present their application in a way that demonstrates significant outcomes associated with each

APS 4
1. An ability to plan and conduct investigations and/or audits. Able to acquire knowledge of the
relevant laws and identify breaches.
2. Sound written and oral communication, liaison and representational skills.
3. Sound conflict resolution and interpersonal skills.
4. Ability to assess priorities and manage competing deadlines both independently and as a
member of a team.
5. Sound computer skills and ability to use case management systems.
APS 5
1. Well-developed investigative skills including a demonstrated ability to plan, conduct and
lead investigations and/or audits.
2. Demonstrated ability to interpret and apply legislation, and a working knowledge of
preparing briefs of evidence.
3 Well-developed written and oral communication, liaison and representation skills.
4. Well-developed conflict resolution skills and interpersonal skills.
5. Ability to assess priorities and manage competing deadlines both independently and as a
member of a team including mentoring of junior staff.
6. Well-developed computer skills and demonstrated experience using case management
systems.

Employment Conditions and Eligibility
Employment Conditions
Your conditions of employment will be those contained in the Office of the Australian Building
and Construction Commissioner Employee Enterprise Agreement 2011-2014.
The remuneration package comprises base salary and superannuation at 15.4%. The salary
range for the APS 4 Investigator position is $66,144 - $71,779. The salary range for the APS 5
Investigator position is $73,738 - $78,148. This will be negotiated with the successful applicant
depending on relevant skills and experience.
The successful applicant will also be eligible for the Remote Localities Allowance, which is
$6,000 pa without dependants and $10,000 pa with dependants. A relocation package may be
available to the successful applicant depending on individual circumstances.
