E-Statement Agreement for Electronic Delivery of Statements and Disclosures This Agreement describes your rights and obligations as a user of our E-statement service. It also describes the rights and obligations of Layton State Bank. Please read this Agreement carefully. TERMS and AGREEMENT 1. This Agreement applies to your use of our Internet Banking Service, Community Connection and Corporate Connection, which permits you to access your accounts with us via the Internet for services selected by you and agreed upon by us. This Agreement applies to all persons that are parties to the accounts. In this Agreement, the terms “you” and “your” refer to each depositor on an account accessible by this Internet Service, and the terms “LSB,“ us,” “we,” and “our” refer to the Bank. By accepting the “E-Statement Agreement for Electronic Delivery of Statements and Disclosures,” referred to as “Agreement” below, you authorize us to make your deposit account, loan statements and disclosures, which we are required to provide to you under applicable Federal and State statutes and their implementing regulations, available at our website. You agree that Layton State Bank may, as permitted by law, provide all applicable disclosures to you electronically. You are responsible for downloading or printing the disclosures or providing the Bank with a non-electronic address to which the disclosures may be mailed. 3. Definitions: E-Statement is a visual text of your deposit account statement and check images displayed on your personal computer monitor. Electronic Communication means a message transmitted electronically between you and us in a format that allows visual text to be displayed on equipment, for example, a personal computer monitor. Electronic Address is your e-mail address, which is not limited to receiving electronic communications transmitted solely by us. 4. LSB E-Statement You agree to receive your monthly deposit account statements, loan statements, and disclosures electronically. With an LSB deposit account, you will have the ability to retrieve your monthly account statement, check images if applicable, and account disclosures from our website. You will be notified by E-mail when your statements and disclosures are ready to be viewed. You also have the ability to print your statement and images, as well as save them, to your personal computer. You are deemed to have received any electronic communication provided to you when they are made available to you. 5. E-Statement Requirements To receive and retain your LSB E-Statements, you need a personal computer with Internet access and E-mail capability, and you must be enrolled in our Online Banking program. To view your monthly checking account statement and check images, you will need Adobe Acrobat Reader. 6. You agree that Layton State Bank may, as permitted by law, provide all applicable disclosures to you electronically. You are responsible for downloading or printing the disclosures or providing the Bank with a non-electronic address to which the disclosures may be mailed. Your Responsibility You are responsible for selecting all systems, hardware and your Internet Service provider and for any defect, malfunction or interruption in service or security due to hardware failure, your choice of Internet Service provider and systems and computer services. By accessing our website, you confirm that your computer is capable of viewing statements in a Portable Document Format (PDF). You also confirm your computer is equipped with software that enables you to view and retain files in PDF. You agree that if you give your user ID and password to anyone or fail to safeguard its secrecy, you do so at your own risk since anyone with your user ID and password will have access to your accounts. Contact us immediately if you believe someone has obtained your user ID and password without your permission. If your monthly statement contains transactions that you did not make, notify us at once. 8. This is an Agreement to receive your deposit account and loan statements and disclosures online. The disclosures that will be made available online include those that are currently located on the back of your statement. Disclosures not mentioned, such as overdraft notices, account hold notices, etc., will continue to be mailed in paper form. Statement@laytonstatebank.com is the web address from which you will receive notification as to the availability of your E-Statement This address is for our notification purposes only. E-mail correspondence regarding general online banking questions and requests for a printed copy of Rules and Regulations Affecting Your Layton State Bank Accounts disclosure, which you received during the account opening process, can be sent to our personal banker email at personalbanker@laytonstatebank.com. Email is not a secure network so do not include in your email any personal information such as birth date, account numbers, etc 9. E-Statement Notification We will notify you via E-mail that your E-Statements are ready to be viewed. The Email notification will be sent to the electronic address that you have provided. You must provide LSB with a working E-mail address at all times. You are responsible for changing your email and notifying us if the email address is no longer active. 10. E-Statement Notification Returned Undeliverable If your E-Statement notification is returned to us as undeliverable, we will attempt to make contact with you, referencing the phone number or address as shown in our records. If our contact methods prove unsuccessful, we will terminate the EStatement feature on your account and you will receive paper statements via the U.S. Postal Service at the mailing address shown on our records. 11. Electronic Address Changes You agree to provide us with a current electronic address for transmission of your EStatement notification. You must notify us of any changes to your E-mail address. You must change your email address in the Online Banking under “options,” 12. E-Statement Fees and Charges There are no fees or charges to transmit your E-Statement notification to your electronic address. 13. Privacy Disclosure The circumstances under which we may disclose information about your accounts to third parties are summarized in our current privacy notice accompanying this Agreement You should also know that our Privacy Disclosure statement is displayed on our website at www.laytonstatebank.com 14. Third Parties You understand that support and services relating to this Internet Service are provided by third parties other than us, and you authorize us to contract with third parties to provide such support and service. 15. Amendment We may amend this Agreement at any time. Notice will be sent to you at your current address in our files. Amendments will be effective upon the date indicated in the notice. Any use of the Online Banking after we notify you of an amendment will constitute your agreement to such amendment. 16. General This Agreement is intended to supplement and not to replace other agreements between you and us relating to your accounts, including, without limitation, our Deposit Account Rules. In the event of a conflict between this Agreement and any other account rules and agreements that apply to your accounts, this Agreement shall govern and prevail. 17. Termination We may modify, suspend or terminate your privilege of using our Internet Service and may withhold approval of any transaction, at any time, without prior notice to you. In the event we terminate this Internet Service, we will try to notify you in advance but are not required to do so. You will be notified as soon as practicable. Any one person who can use the account accessible with this Internet Service may terminate this Internet Service. Termination shall not affect the rights and obligations of the parties for transaction made with the Internet Service before we have had a reasonable time to respond to your termination request. You agree that you will not use any of the online banking services in any illegal activity as defined by local, state and federal laws. Violation of applicable laws could result in termination of this Agreement. 18. Right to Withdraw Consent You have a right to cancel this Agreement and withdraw your consent to receive your account statements and disclosures online. We must receive notification of your intent to withdraw consent either by email (from the email address we have on file for you) or a signed letter of withdrawal. You may also elect to receive paper statements again by choosing that option within your internet online banking account. 19. Damages and Warranty Disclaimer IN NO EVENT SHALL LSB BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF THESE DAMAGES) CAUSED BY OUR ONLINE BANKING PROGRAM, OR ARISING IN ANY WAY OUT OF THE INSTALLATION, USE, OR MAINTENANCE OF YOUR PERSONAL COMPUTER, SOFTWARE, OR ANY INTERNET ACCESS SERVICES. ONLINE BANKING AND RELATED SERVICES ARE PROVIDED “AS-IS.” LSB DOES NOT MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, CONCERNING THE HARDWARE, THE SOFTWARE, OR ANY PART THEREOF, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 20. This Agreement and the Online Banking shall be governed by and construed in accordance with the laws of the State of Wisconsin, without giving effect to any conflict of law rules which will require the application of the law other than the State of Wisconsin.
