How you, O Athenians, have been affected by
my accusers, I cannot tell; but I know that
they almost made me forget who I was - so
persuasively did they speak; and yet they
have hardly uttered a word of truth. But of
the many falsehoods told by them, there was
one which quite amazed me; - I mean when
they said that you should be upon your guard
and not allow yourselves to be deceived by
the force of my eloquence. To say this, when
they were certain to be detected as soon as I
opened my lips and proved myself to be
anything but a great speaker, did indeed
appear to me most shameless - unless by the
force of eloquence they mean the force of
truth; for is such is their meaning, I admit that
I am eloquent. But in how different a way
from theirs! Well, as I was saying, they have
scarcely spoken the truth at all; but from me
you shall hear the whole truth: not, however,
delivered after their manner in a set oration
duly ornamented with words and phrases. No,
by heaven! but I shall use the words and
arguments which occur to me at the moment;
for I am confident in the justice of my cause
course.): at my time of life I ought not to be
appearing before you, O men of Athens, in
the character of a juvenile orator - let no one
expect it of me. And I must beg of you to
grant me a favour: - If I defend myself in my
accustomed manner, and you hear me using
the words which I have been in the habit of
using in the agora, at the tables of the money-
changers, or anywhere else, I would ask you
not to be surprised, and not to interrupt me on
this account. For I am more than seventy
years of age, and appearing now for the first
time in a court of law, I am quite a stranger to
the language of the place; and therefore I
would have you regard me as if I were really
a stranger, whom you would excuse if he
spoke in his native tongue, and after the
fashion of his country: - Am I making an
unfair request of you? Never mind the
manner, which may or may not be good; but
think only of the truth of my words, and give
heed to that: let the speaker speak truly and
the judge decide justly.
And first, I have to reply to the older charges
and to my first accusers, and then I will go on
to the later ones. For of old I have had many
accusers, who have accused me falsely to you
during many years; and I am more afraid of
them than of Anytus and his associates, who
are dangerous, too, in their own way. But far
more dangerous are the others, who began
when you were children, and took possession
of your minds with their falsehoods, telling of

X. Term
This License Agreement is made effective as of 28th August 2002 between Stephen Marshall,
Stephen.marshall@vuw.ac.nz (“Licensor”) and the reader of this document (“Licensee”).
This Agreement shall continue in effect in perpetuity- commencing on the Effective Date once any
portion of the document has been read.
Consequent to your receiving this document, the receipt and sufficiency of which is hereby
acknowledged by your reading this license, Licensee agrees as follows:
XI. Warranties
I. Content of Licensed Materials; Grant of License
Licensor warrants that it has the right to license the rights granted under this Agreement and that the
use of copyright material constitutes “fair use”. The use of trademarks is done for informational
purposes and any such remarks remain the property of the owners (you know who you are).
Licensee acknowledges that the copyright and title to the Licensed Materials and any trademarks or
service marks relating thereto remain with Licensor. Licensee shall have no right, title or interest in the
Licensed Materials except as expressly set forth in this Agreement.
Licensor warrants that the physical medium on which the Licensed Materials is provided to Licensee will
be free from defects.
Licensor hereby grants to Licensee non-exclusive use of the Licensed Materials solely for their own
private use in accordance with this Agreement.
Notwithstanding anything else in this Agreement:
The materials that are the subject of this Agreement shall consist of this document – both sides
(hereinafter referred to as the "Licensed Materials").
II. Delivery/Access of Licensed Materials to Licensee
Licensor will provide the Licensed Materials to the Licensee in paper format.
Subject to the Limitations set forth elsewhere in this Agreement:
XII. Limitations on Warranties
Neither party shall be liable for any indirect, special, incidental, punitive or consequential damages,
including but not limited to loss of data, business interruption, or loss of profits, arising out of the use of
or the inability to use the Licensed Materials.
III. Fees
Licensor makes no representation or warranty, and expressly disclaims any liability with respect to the
content of any Licensed Materials, including but not limited to errors or omissions contained therein,
libel, infringement of rights of publicity, privacy, trademark rights, moral rights, or the disclosure of
confidential information.
IV. Authorized Use of Licensed Materials
Licensee may read the materials silently.
The Licensed Materials are provided on an "as is" basis, and Licensor disclaims any and all other
warranties, conditions, or representations (express, implied, oral or written), relating to the Licensed
Materials or any part thereof, including, without limitation, any and all implied warranties of quality,
performance, merchantability or fitness for a particular purpose. Licensor makes no warranties
respecting any harm that may be caused by paper cuts, ink smears, the transmission of a computer
virus, worm, time bomb, logic bomb or other such computer program. Licensor further expressly
disclaims any warranty or representation to Authorized Users, or to any third party.
Licensee may destroy the materials completely in such a way as to render the contents unreadable.
XIII. Indemnities
Licensee shall make no payment to Licensor for use of the Licensed Materials (gifts accepted in cash
form).
Authorized Users. "Authorized Users" are:
Persons who receive an original copy of this document from the Licensor who read and therefore are
bound by the terms of this license.
Authorized Uses. The Licensed Materials may be used solely as follows:

VI. Specific Restrictions on Use of Licensed Materials
Licensee shall indemnify and hold the Licensor harmless for any losses, claims, damages, awards,
penalties, or injuries incurred by any third party, including reasonable attorney's fees.
XIV. Assignment and Transfer
Licensee shall not knowingly permit anyone other than Authorized Users to use the Licensed Materials
in any way whatsoever.
Licensee may not assign, directly or indirectly, all or part of its rights or obligations under this Agreement
without the prior written consent of the Licensor, which consent will be unreasonably withheld and/or
delayed.
Modification of Licensed Materials. Licensee shall not modify or create a derivative work of the
Licensed Materials without the prior written permission of Licensor. This includes paper airplanes.
XV. Governing Law
Removal of Copyright Notice. Licensee may not remove, bend, fold, mutilate, spindle, obscure, make
sarcastic remarks about, criticize or modify any copyright or other notices included in the Licensed
Materials.
Commercial Purposes. Other than as specifically permitted in this Agreement, Licensee may not use
the Licensed Materials for commercial purposes, including but not limited to the sale of the Licensed
Materials or bulk reproduction or distribution of the Licensed Materials in any form.
Display. Licensee and Authorized Users shall not have the right to electronically display the Licensed
Materials.
Digitally Copy. Licensee and Authorized Users may not download and digitally copy any portion of the
Licensed Materials.
Print Copy. Licensee and Authorized Users may not print any portion of the Licensed Materials.
Archival/Backup Copy. Licensee may not create copies of Licensed Materials to be maintained as a
backup or archival copy during the term of this Agreement or as required to exercise Licensee's rights
under Section XIII, "Perpetual License", of this Agreement.
Caching. Licensee and Authorized Users may not make such local digital copies of the Licensed
Materials as are necessary to ensure use by Authorized Users by browser or other software.
Scholarly Sharing. Authorized Users may not transmit to any third party in any format whatsoever any
portion of the Licensed Materials for personal use or scholarly, educational, or scientific research or
professional use and particularly not for re-sale. In addition, Authorized Users do not have the right to
use, figures, tables and brief excerpts from the Licensed Materials in the Authorized User's own
scientific, scholarly and educational works.
VII. Licensor Performance Obligations
Availability of Licensed Materials. Licensor shall make the Licensed Materials available to Licensee
and Authorized Users once, in paper format subject to availability – no rainchecks.
Support. Licensor will offer no activation or installation support, including assisting with the
implementation of any Licensor software. Licensor will not offer reasonable levels of continuing support
to assist Licensee and Authorized Users in use of the Licensed Materials, if you can’t read then you
can’t execute this license and should destroy this document.
If the Licensed Materials fail to operate in conformance with the terms of this Agreement, Licensee shall
immediately notify Licensor, and Licensor shall promptly use reasonable efforts to restore access to the
Licensed Materials as soon as possible or when they get around to it. In the event that Licensor fails to
repair the nonconformity in a reasonable time, Licensor shall reimburse Licensee in an amount that the
nonconformity is proportional to the total Fees owed by Licensee under this Agreement.
Notification of Modifications of Licensed Materials. Licensee understands that from time to time the
Licensed Materials may be added to, modified, or deleted from by Licensor and/or that portions of the
Licensed Materials may migrate to other pieces of paper. Licensor may give prompt notice of any such
changes to Licensee. Failure by Licensor to provide such reasonable notice shall be considered bad
luck on your part. If any modifications render the Licensed Materials less useful to the Licensee or its
Authorized Users, the Licensee should consider themselves fortunate that the Licensor left anything
behind.
This Agreement shall be interpreted and construed according to, and governed by, the laws of New
Zealand, excluding any such laws that might direct the application of the laws of another jurisdiction.
The courts located in Wellington, New Zealand shall have jurisdiction to hear any dispute under this
Agreement.
XVI. Dispute Resolution
In the event any dispute or controversy arising out of or relating to this Agreement the Licensee agrees
that the Licensor was right and apologies unreservedly.
All documents, materials, and information in the possession of Licensor shall be made available to the
other party for review and copying until the Licensee apologises.
XVII. Force Majeure
Neither party shall be liable in damages or have the right to terminate this Agreement for any delay or
default in performing hereunder if such delay or default is caused by conditions beyond its control
including, but not limited to Acts of God, Government restrictions (including the denial or cancellation of
any export or other necessary license), wars, insurrections, because the Licensor felt like it, and/or any
other cause beyond the reasonable control of the party whose performance is affected.
XVIII. Entire Agreement
This Agreement constitutes the entire agreement of the parties and supersedes all prior
communications, understandings and agreements relating to the subject matter hereof, whether oral or
written. If the Licensee prefers, they can replace the entire agreement with the terms and conditions of
the GNU Free Documentation License (http://www.gnu.org/licenses/licenses.html) – have a nice day.
XIX. Amendment
No modification or claimed waiver of any provision of this Agreement shall be valid except by written
amendment signed by authorized representatives of Licensor and the Licensee’s great grandparents,
unless initiated by the Licensor.
XX. Severability
If any provision or provisions of this Agreement shall be held to be invalid, illegal, unenforceable or in
conflict with the law of nature or any jurisdiction, the validity, legality and enforceability of the remaining
provisions shall not in any way be affected or impaired thereby.
XXI. Laws of Physics
Any use of the information contained in the Licensed Materials, in any manner whatsoever, will increase
the amount of disorder in the Universe. Although no liability is implied herein, the Licensee is warned
that this process will ultimately lead to the heat death of the universe.
XXII. Waiver of Contractual Right
Waiver of any provision herein shall not be deemed a waiver of any other provision herein, nor shall
waiver of any breach of this Agreement be construed as a continuing waiver of other breaches of the
same or other provisions of this Agreement.
XXIII. Notices
All notices given pursuant to this Agreement shall be provided by the Licensor if they feel like it and may
or may not be communicated to Licensee depending on the whim of the Licensor.
Notice of "Click-Through" License Terms and Means of Passive Assent. Licensor requires
Authorized Users to agree to the terms of this license relating to the use of the Licensed Materials
before permitting Authorized Users to gain access to the Licensed Materials through mere use or
viewing of the Authorized Materials or this license,
Withdrawal or Replacement of Licensed Materials. Licensor reserves the right to withdraw from or
replace within the Licensed Materials any item or part of an item.
VIII. Licensee Performance Obligations
Protection from Unauthorized Use. Licensee shall use reasonable and unreasonable efforts to ensure
that no one else obtains access to the Licensed Materials other than directly from the Licensor
IX. Mutual Performance Obligations
Confidentiality of User Data. Licensee agrees to maintain the confidentiality of any data relating to the
Licensed Materials. Such data may be used solely for purposes directly related to the Licensed
Materials and may not be provided to any third party. Licensor agrees to maintain the confidentiality of
Licensee information unless they really feel like breaking it.
