issues B righam Young University is constantly making changes to enhance the college experience for all students. New buildings are constructed, majors are introduced and programs are created to help students succeed. The housing situation is no different as changes are continually being made to help assist students with their living conditions. Julie Franklin, director of Residence Life, answered some frequently asked questions to help students get an idea of what some of the housing policies are, what on-campus housing accommodations will be available to students in the upcoming year and what is in the future for the housing market in Provo. Although many things are still under review, Franklin is taking an active role in improving the housing market for all students. What is contracted housing? Contracted Housing is student housing that is provided by offcampus providers. The landlords or owners sign agreements with the university to provide housing that meets requirements of the university to our students. Why are BYU students required to live within a 2-mile radius of campus? I don’t think it will come as a surprise to anyone that the administration and board of trustees consider the entire university experience to be very important for students, not just the academic experience. One thing that has been identified as being a concern is where students live and what their residential experience is. A feature of that is the separation of genders in the living situation. In most cases landlords cannot discriminate by gender because that is a violation of the federal Fair Housing Act. However any university has the right under Title IX to separate students by gender if they want to. Universities can also extend that right to other housing providers as long as they are bound to each other by a contract or some other agreement. The contracted housing program extends the university’s right to segregate by gender, a principle important to our sponsoring institution, to off-campus housing providers as long as those providers are renting only to students. Without the agreement connecting the property with the university, segregation cannot be assured. Other principles important to the administration have been included in the agreement; some of those are embodied in the Residential Living Standards which is also a feature of contracted housing. When are students allowed to live outside the 2-mile radius? Single undergraduate students who have unique circumstances or particular hardships may apply for a waiver from the requirement to live in contracted housing. Waivers can be filled out on-line by either going to the Off-Campus Housing Web site and into the Off-Campus Housing Portal or when you confirm your residential address. As you input information and proceed through the screens you will receive instructions. It is important to note there is a form that needs to be signed and brought in or taken to the Off-Campus Housing Office before the process is complete. What is happening with the old DT area? Is a new apartment complex going to be built and if so, who would it be available to? No final decisions have been made regarding the future use of the DT site. What are the different requirements for BYU single students versus married students? Single undergraduate students are required to live in contracted housing. There are no requirements for married students, graduate students or students with families. Is the supply of married housing meeting the demand? While I do not have specific information I am aware the general housing market in Utah County is very tight. What on-campus housing options will be available to single students in fall 2009? Housing will be available for single students in Helaman Halls, Heritage Halls and Wyview Park. Will Wyview Park continue to be available for single students only? Single students have been accommodated in Wyview Park for two and a half years now and the feedback we have received from students has been very positive. BYU Photo Julie Franklin currently serves as the director of Residence Life with responsibility for both on-campus and off-campus housing. What advice would you give students who are looking for housing for the first time? I advise students to visit the property when possible before signing contracts. It is helpful to talk with students who have lived at the property, and as always read the contract and any addenda carefully before signing. Are there any new renovations to on-campus housing students should be made aware of? The university has a comprehensive schedule for doing normal updates and replacements. This year will be no different, but there is nothing significant. What things can students do to make finding housing easier? I suggest students start the process early for best selection. 11 Getting to know the Off-Campus Housing Office How does housing become/remain BYU contracted? How The landlord contract explains that the housing unit must meet the minimum specifications and must require all tenants to adhere to the BYU living standards. These specifications can be found on the Off-Campus Housing Office Web site at byu.edu/offcampushousing. How do I get out of my contract? The BYU Off-Campus Housing Office has five primary goals: To promote a living environment that is conducive to moral, spiritual and academic performance. To establish guidelines for the development and maintenance of living conditions for student needs. To establish standards of fairness in studentlandlord rental matters. To advise students and owners on rental problems and responsibilities. To help BYU students find housing. The Off-Campus Housing Office is located in C-141 ASB. You may also contact them at 801 422-1513 or visit their Web site at byu.edu/offcampushousing. 12 Your contract is a legal and binding document. The StudentLandlord Rental Agreement allows a student to terminate their agreement for graduation and for internships required for graduation. These special provisions are possible with a 120-day written notice given to the landlord. Who Who runs the BYU Off-Campus Housing Office? There are four full-time staff members working with over 1500 landlords under BYU contract. Who should I talk to when I have a problem with my apartment? First, talk to your landlord. The Off-Campus Housing Office often get complaints and discovers the landlord isn’t aware of the problem or what the problem is. When should I find housing? When You need to make a choice early enough to see what your options are. Most students begin looking as early as February or March for fall semester housing. When should I go to the housing office about a problem? When the landlord is not being responsive and communicating with you. Where should I live? e r e h W Be aware of what your needs are. It comes down to what you’re looking for and what you’re used to. What do you want? Look at the pros and cons for each option and decide what is important to you. Talk to other people who have lived there; find out the good and the bad. Talk to the management and see if you’re going to be able to communicate with them. What is the advantage of having BYU contracted housing? A student’s living environment is a major part of college life. Living conditions can greatly influence a student’s growth and performance. Because the university relies upon the community to provide accommodations for most of its students, BYU has established the Off-Campus Housing Office and a contracted housing program to cultivate that desired environment off-campus. Using the Off-Campus Housing Web site resources An abundance of information concerning housing at BYU is available on the Internet at byu.edu/offcampushousing. You may find helpful information concerning the purpose of the BYU OffCampus Program and the Residential Living Standards. Vacancy listings, average rental costs, comparative rental data, maps of the local community and campus, the dispute resolution program for BYU student tenants and landlords and a guide to renting are also available through the Web site, making it much easier to find the type of apartment you want. The guide to renting will help you understand many rights and responsibilities of tenants and landlords, and a complete copy of the BYU Off-Campus Housing Handbook is accessible online. It contains the university’s policies, procedures and requirements pertaining to the BYU Off-Campus Housing Programs. You may also contact the Off-Campus Housing Office by e-mail through the Web site. Vacancy Listing To help landlords and students sell leases and find rentals available for renting, the Off-Campus Housing Office provides vacancy listings on the Internet and on printed sheets available at C-141 ASB. These vacancy listings are updated daily. Available rentals in university-contracted housing for singles and other housing for graduate students and families are listed. The vacancy listings are updated each business day and placed on the Web site byu.edu/offcampushousing. Click “Vacancy Listings.” Landlords may place vacancies on these lists and students may list rental contracts for sale by clicking “Place a Listing” on the main page of the Web site. Listings may also be placed by calling the Off-Campus Housing Office at (801) 422-7666 between 1 p.m. and 5 p.m., Monday through Friday. A rental listing will remain on the rental list for two weeks unless the landlord calls the office to continue the listing or remove it. “Vacancy Listings” also has links to a “Comparative Data” chart of apartments and condominiums of all sizes. This includes making sure the university has a current residential address. BYU requires every single undergraduate student to live in contracted housing. “The administration and board of trustees wants off-campus housing to be an extension of on-campus housing with a great academic and social environment where the students can be successful,” said Garry Briggs, manager of off-campus housing. This is why updating personal information is taken so seriously by BYU and should receive prompt attention. Here are some frequently asked questions and concerns about updating information and living in BYU contracted housing: I live in contracted housing, but have not yet updated my personal information. Every time a student logs on to Route Y a personal notice will appear reminding them to update their personal information. Students are encouraged to do this right away. Simply click “Personal Information” listed on the homepage of Route Y. Open each section and change or verify your information. Then save each section and close the window. The last step is probably the most important. Click the box: “I have reviewed my contact information and affirm that it is correct.” It is important to make sure the residential address is correct. Every semester landlords are required to verify with BYU who is living in their contracted housing. If a student claims to live there when in actuality they do not, they may be fined up to $150 as well as be reviewed by the Honor Code Committee. If a student is unsure about their address, a list of all contracted housing can be found on the Off-Campus Housing Web site byu.edu/offcampushousing. Simply click on “Contracted Housing Search” and search different categories. I live in contracted housing and have updated my personal information but I’m still receiving personal notices concerning my contact information. Go over the steps above; perhaps something was missed or not saved. If the problem continues contact the Off-Campus Housing Office at (801) 422-1513. I am married but have not yet notified BYU. Go to the Records Office, located in B-150 ASB, as soon as possible and fill out the appropriate paper work to change your marital status. If the university record shows your status as single, you can be fined for living in non-contracted housing even though you are married. I have decided not to attend school at BYU this semester. Go to Route Y and click on “Personal Information.” Then click the box: “I will not be taking classes at BYU during Winter Semester 2009. I understand if I decide to update Winter Semester 2009, I must update my contact information.” Then click on the “Submit” button. This is in addition to the deferment form that must be completed at the Registration Office in A-153 ASB. I am living at home. Complete the “Declaration of Living at Home Form” available on the Off-Campus Housing Web site or on your Route Y Contact Information page. Complete the form onlines, print it out and turn it into the Off-Campus Housing Office in C-141 ASB. I am attending classes away from Provo Campus or have special circumstances or hardships. Planning dates, budgeting and details like wedding cakes can become overwhelming. On top of all that a couple continuing in school must figure out housing accommodations and find a place that will become their happy home for the start of their beautiful new life together. When searching for off-campus housing there are few things a couple should know. There’s not a specific process to go through to find married housing because graduate and married students can live wherever they want. Garry Briggs, from the BYU Off-Campus Housing Office, said it is important for newlymarried couples to remember they need to go to the Record’s Office at B-150 ASB and change their marital status. This simple step will ensure that the university understands you’re no longer a single student required to abide by university requirements to live in contracted housing. If undergraduate students fail to change their marital status they will receive non-compliance fees. Off-campus family housing can be difficult to find in the Provo and Orem area, but Briggs said that during peak times of transition, either when Winter Semester ends or August contracts end, students may have a better chance of catching recent openings. Students may have to look in neighboring cities for housing because of the high demand in the area. If they expand their search to Lindon, American Fork or Springville they may find better rates and get a nicer deal. Of course, transportation is necessary for this kind of commute. The Off-Campus Housing Office has a listing service especially for family and graduate students that provides an updated list of openings around the valley. Briggs said students need to realize that with some contracted housing those owners have a contract with the university and are required to do certain things. In off-campus non-contracted housing the university has no contract and therefore no requirements so “buyer beware.” A couple should have a clear understanding of the contract requirements and know exactly what they are signing because it may be different from the standards they have grown accustomed to in contracted single housing. Couples who are getting married in the middle of the semester may go online or into the Off-Campus Housing Office to request a waiver from contracted housing while they are single. As an engaged couple, each person may request the waiver, and continue looking for housing. One can live in the apartment they’ve chosen, while the other finds another place until they get married. This helps the couple avoid locking into a yearlong contract for single students and gives them the opportunity to find and secure their future home early. Students who have already gone through the process suggest couples start looking for housing early. “I know you can’t really plan for those things, but if you’re talking about getting married, or if there is a good chance that you’re going to need it, just go look,” said Sarah Horne, a student who got married this past summer. She said due to an internship over the summer it was difficult to really look at housing before coming back right before school started. It’s also important to prioritize what you want in housing because you won’t always find everything for the price you can afford. “Know that married housing is more expensive, so don’t be surprised,” said Janelle Payne, a student just married in August. She said rate your priorities so you can focus your search according to the number of bedrooms, the location or the size of the kitchen. Figure out what is important to you as a couple and then use listings to narrow down your search. 27 Emergencies can happen to students tooo You can be prepared for more than just classes and finals From the American Red Cross (www.redcross.org) T here are six basics you should stock for your home in the case of an emergency: water, food, first aid supplies, clothing and bedding, tools and emergency supplies and special items for medical conditions. Keep the items that you would most likely need during an evacuation in a container you can easily carry. Below is a list of what should be included in your kit. Possible containers include a large, covered trash container, a backpack or a duffle bag. Water Store water in plastic containers such as soft drink bottles. Avoid using containers that will decompose or break, such as milk cartons or glass bottles. A normally active person needs to drink at least two quarts of water each day. Hot environments and intense physical activity can double that amount. Children, nursing mothers and ill people will need more. • Store one gallon of water per person per day • Keep at least a three-day supply of water per person (two quarts for drinking, two quarts for each person in your household for food preparation/sanitation). Food Store at least a three-day supply of nonperishable food. Select foods that require no refrigeration, preparation or cooking and little or no water. If you must heat food, pack a can of sterno. Select food items that are compact and lightweight. However, there are some circumstances that prevent students from residing in housing that has been contracted by BYU. Some of these circumstances include living at home, completing an out-of-state internship or having unusual hardships. It is possible to waive the university requirement to live in contracted housing by submitting the proper waiver form. There is no guarantee a student will be granted permission. Because of this it is essential that students submit their waiver before moving in to a new location. If a student plans to live with family while attending BYU, the student must turn in the “Declaration of Living with Family” form to the Off-Campus Housing Office, C-141 ASB. The form can be found on the Off-Campus Housing Web site byu.edu/offcampushousing. The form must be signed by a parent or eligible family member before submission. At the light proceed straight ahead onto South State Street until you see Monaco Court on the left. 31 Resolving problems with Conflict Resolution Center for Conflict Resolution helps students deal with issues E ach year hundreds of BYU students seek the help of the BYU Center for Conflict Resolution. The center assists in resolving everything from a landlord disagreement and roommate problems to a dispute with off-campus businesses. The center will address any conflict that involves a BYU student. They encourage and assist students in communicating with the offender before proceeding to the legally binding steps of arbitration or court. Sara Pedersen, who has graduated from BYU, contacted the BYU Center for Conflict Resolution with a problem. “The management company had violated my roommate’s contract and moved her into our apartment, which led to contention between all of us in the apartment,” Pedersen said. “We contacted the BYU Center for Conflict resolution and they were able to help us confront the management company as well as settle things in our apartment. When we first tried to talk to the management, we were walked over. But with BYU’s help, they spoke with us and resolved our problem.” Pedersen said she was impressed with the timeliness and respect she and her roommate were given by the center and the ability it gave them to not be victims. In keeping with the mission of BYU, the center encourages everyone involved to dispute conflicts in a peaceful manner. To assist with this, the center first offers scriptural guidance to assist in dealing with conflict resolution, which is available at their office in 4412 WSC and on their Web site, http://ccr.byu.edu. Here they give principles from the scriptures and then encourage communication between the parties. If informal communication produces no resolution, the parties can proceed to the mediation process where negotiations take place through the assistance of a neutral third party. This process allows the parties to reach their own solution to a problem and determine what is an acceptable settlement. John Pace, manager of BYU Center for Conflict Resolution, said many conflicts can be resolved through mediation without involving the legal system. Of the 20-30 cases his office receives each month, 80 percent are resolved before they reach arbitration. When mediation does not work, the parties proceed to arbitration, a private judicial process. Part of the agreement made between tenants and landlords through the housing contract is that they settle disputes through the arbitration process when mediation does not work. BYU is able to act as a private court without the meetings and papers required by formal courts and allowing students to participate in arbitration. The parties may represent themselves or have a legal representation. They present 20 minute testimonies to a panel of three people: one law faculty, one student and one landlord. When these cases go to arbitration, the parties give jurisdiction and control of their dispute to the arbitration board. The decision made by the board is final and legally binding. These decisions can be petitioned for modification or reviewed by a state court if a mistake was made. The grounds for such rarely exist. If there are any issues between roommates that involve a violation of the BYU Honor Code the Honor Code Office will deal with these issues. The Center for Conflict Resolution was formed in January 2003 to remove the case­ load from the Off-Campus Housing Office that was handling only housing conflicts. Prior to the center’s formation, there was no source of assistance for students who had conflicts with businesses and needed legal advisement. Wilson said this is one of the advantages of living in Foreign Language Student Residence because students get “instant feedback” on their language skills or questions. One requirement of living in the Foreign Language Student Residence is meeting for dinner every Sunday through Thursday, usually between 5 and 7 p.m. Dr. Kelling described these dinners as “social gatherings” where students can talk, eat and listen. Here students’ language skills improve through casual conversation while they also learn the cultural aspects of mealtime. Dr. Kelling said the major benefit of Foreign Language Student Residence is the confidence students gain. Wilson agreed and said living there has not only affected her language abilities, but has helped her get over her fear of talking to people in a different language. “Living here has definitely helped me get away from the book answers,” she said. Students can apply online or through their language classes. After the application is completed, qualified students will have an interview with a faculty coordinator from their requested language.
