Freedom of Information Request Reference No: I note you seek access to the following information: How many offenders who received a police caution in 2012-13 (including all types of cautions - ie. simple cautions and conditional cautions) had previously received a caution, and how many previous cautions in total had they received? Please provide the data for the financial year 2012-13 if possible. Alternatively, periods by calendar year or another 12 month period are acceptable. Please break down those who have accepted multiple cautions into the following categories, if possible: 1 - 5 previous cautions, 6 - 10 previous cautions, 11 - 20 cautions, 20+ cautions, 50+ cautions and 100+ cautions. In addition, please provide a figure for the greatest number of cautions accepted by a single offender in your force area. Decision I have today decided to disclose the located information to you in full. Please find attached information pursuant to your request above. Please be aware that under the Ministry of Justice Guidance on Adult Simple Cautions, a second caution can be issued for a similar offence if a period of two years has elapsed since the first was delivered and exceptional circumstances exist. Equally, by asking for all caution types individuals may have received a caution and a conditional caution. For youth the system of youth cautions was changed in April 2013 from an escalatory process whereby a youth could receive one reprimand and then a Final Warning, to a system of Youth Cautions and Youth Conditional Cautions which are decided on a case by case basis. Therefore young people, under the Legal Aid, Sentencing and Punishment of Offenders (LASPO) Act 2012 are entitled to receive more then one youth caution or youth conditional caution. Equally, an individual may have received a caution or conditional caution when under 18, and again received a caution or conditional caution as an adult. The MPS can only provide statistics for cautions issued within their own force area and therefore cannot state whether an individual has previously received a caution in another force area.
