CONTRACT FOR STALLIONS COMING TO HOBGOBLINS STUD
TO COVER MARES / FOR SEMEN COLLECTION
WHEREAS [
] is the owner of a stallion known as [
] and wants to cover a mare / have semen collected (delete as applicable) at Hobgoblins
Stud, Duddleswell, East Sussex TN22 3BH and
Whereas this agreement records the terms on which Hobgoblins Stud accepts the said
stallion from the said owner
NOW WITNESSETH AS FOLLOWS:
(1) No stallion will be admitted onto the premises of Hobgoblins Stud unless:
(a) An in-date certificate of vaccination against Equine Influenza virus has been
presented to the manager or other representative of Hobgoblins Stud.
(b) An in-date certificate proving that the stallion has been swabbed and tested negative
for Contagious Equine Metritis in the current breeding season has been presented to
the manager or other representative of Hobgoblins Stud.
(c) An in-date certificate of vaccination against Equine Viral Arteritis (EVA) including
proof that the stallion was negative for EVA prior to vaccination OR a certificate
from either the VLA or the AHT certifying that the stallion is serologically negative
for EVA on a blood test taken within 28 days of entering Hobgoblins Stud or has
been proven by virus isolation on a semen sample collected after January 1st of the
current year not to be shedding EVA has been presented to the manager or other
representative of Hobgoblins Stud.
(b) may be performed at Hobgoblins Stud at the owner’s/manager’s discretion, but no
semen will be collected for use until the results of all tests are known and certified.
(d) A current valid paid up certificate of insurance covering third party liability up the
value of £1,000,000 and veterinary liability issued with a recognized U.K insurance
company has been presented to the manager or other representative of Hobgoblins Stud.
By signing this contract the stallion owner acknowledges that damage or death to the
stallion may not be covered by Hobgoblins Stud’s insurance, and we strongly recommend
that stallion owners take out their own insurance to cover these eventualities.
(2) It is the stallion owner’s responsibility to make sure that all tack needed by the
stallion arrives with the stallion at Hobgoblins Stud. No tack other than a Chiffney for
covering will be provided by Hobgoblins Stud.
(3) Hobgoblins Stud will assume no responsibility for the safety of the stallion, or of any
persons handling the stallion or mare, during the stallion’s presence on the premises of
Hobgoblins Stud. The stallion owner retains full responsibility for any injury to the
stallion, to any other horse, person, animal or property caused by the stallion whilst on
the premises of Hobgoblins Stud.
(4) The breeding process will be under the direction of the attending Veterinary Surgeon
(if present) or of the Manager of Hobgoblins Stud, and the stallion handler agrees to take
direction from him / her.
(5) The attending Veterinary Surgeon (if present) and the manager of Hobgoblins Stud
retain the right to discontinue the breeding process if, in his or her opinion, it becomes
unacceptably dangerous or for any other proper reason.
(6) Veterinary work relating to and associated with artificial insemination will be
undertaken by the Veterinary Surgeon Madeleine L H Campbell MRCVS as she sees fit
pursuant to the approach previously agreed with the owner of the stallion.
(7) In the event of an emergency or accident requiring veterinary attention, a Veterinary
Surgeon will be called at the discretion of the Stud Manager. Every reasonable
endeavour will be made to consult the owner of the stallion before veterinary work is
done, but in case of an emergency and / or of the owner not being contactable the
Veterinary Surgeon will take such action as is considered necessary and at the owner’s
cost. Routine health care including vaccinations, tooth care and worming for stallions at
livery at Hobgoblins Stud will be undertaken at the owner’s expense when due.
The farrier will be called at regular intervals at the discretion of the Stud Manager whilst
the stallion is at Hobgoblins Stud (save where otherwise specifically directed by the
owner), and any costs incurred will be chargeable to the stallion owner and must be paid
upon receipt of the account.
(8) Keep fees are payable over and above Veterinary fees, fees relating to breeding
and semen collection and any other fees arising hereunder.
For stallions at livery at Hoboblins Stud, the account for keep fees,
veterinary fees and any other fees arising hereunder will be presented to the owner
weekly and unless settled within 7 days of presentation shall attract interest at 0.25% per
week. Further and in any event any balance outstanding must be paid before the
stallion may be removed from Hobgoblins Stud; failure to do so will entitle the owners
of Hobgoblins Stud to retain the stallion, dispose of the same without further notice to the
owner, and account for the proceeds of such disposal to the owner after making all proper
deductions arising herein.
For stallions “walking in” the account will be presented at the time of treatment / service
and must be paid upon presentation of the account, before the stallion can be
removed from Hobgoblins Stud. Failure to do so will entitle the owners of Hobgoblins
Stud to retain the stallion, dispose of the same without further notice to the owner, and
account for the proceeds of such disposal to the owner after making all proper deductions
arising herein.
Payment may be made by cheque, cash or direct bank transfer.

(9)The owner understands and hereby acknowledges that Hobgoblins Stud expressly (to
disclaims the full extent permitted by law) any and all liability for loss and
damage howsoever caused by reason of the owner’s horse and / or its presence at
Hobgoblins Stud (including but not limited to fire, theft, injury to any horse(s), person or
property and any other third party liability).
(10)The owner undertakes and hereby acknowledges that the owner is and remains
responsible for all such loss and damage as set out in the previous paragraph hereof. The
owner further hereby represents and warrants to Hobgoblins Stud that all such loss and
damage is covered by a current fully paid up insurance policy with a recognised United
Kingdom insurer which has been previously taken out by the owner, which said insurance
policy shall remain in force for the duration of the stallion’s stay at Hobgoblins Stud. A
copy of the said insurance policy must be presented with the stallion when he arrives at
Hobgoblins Stud and must be produced upon request.
(11)
Reference to the singular herein shall include the plural and visa versa.
(12) The parties hereby agree that failure to enforce any of the foregoing shall be deemed
not to be a waiver thereof unless expressly waived in writing and signed by the attending
Veterinary Surgeon or the manager of Hobgoblins Stud.
(13) The parties agree that this is the whole agreement between the parties and supersedes
any previous agreements, representations or understandings.
