BILL AS INTRODUCED 2000 1 2 H.720 Page 1 H.720 Introduced by Representatives Doyle of Richmond, Ginevan of Middlebury 3 and Miller of Shaftsbury 4 Referred to Committee on 5 Date: 6 Subject: Education; alternative learning environments; educator preparation 7 and professional development; exchange of student information; 8 appropriation 9 Statement of purpose: This bill proposes to strengthen statutory policies 10 regarding provision of educational services to underscore the focus on 11 providing services within the classroom whenever possible; fund a study on 12 alternative programs; strengthen educator preparation for handling a variety of 13 needs and behaviors in the classroom; and direct educators and various 14 administration branch administrators to develop a system for timely exchange 15 of information about students. 16 17 18 19 20 AN ACT RELATING TO EDUCATOR PREPARATION FOR HANDLING A VARIETY OF NEEDS AND BEHAVIORS IN THE CLASSROOM, ALTERNATIVE LEARNING PROGRAMS AND EXCHANGE OF INFORMATION ABOUT STUDENTS It is hereby enacted by the General Assembly of the State of Vermont: 21 VT LEG 119528.1 BILL AS INTRODUCED 2000 1 2 H.720 Page 2 Sec. 1. 16 V.S.A. § 2901(a) is amended to read: (a) It is the policy of the state that each local school district develop and 3 maintain, in consultation with parents, a comprehensive system of education 4 that will result, to the extent appropriate, in all students succeeding in the 5 general education environment. This chapter does not require that a child 6 remain in the regular classroom if the child A comprehensive system of 7 education includes an array of services which are needed by students in the 8 district. These services could include a separate alternative program if the 9 district finds that some of its students could be better served in an environment 10 outside the classroom, or if the district finds that separate placement is the best 11 way to provide services to a student who is disrupting the class and thereby 12 impairing the ability of the classroom teacher to provide quality services to 13 other pupils. This chapter does not replace or expand entitlements created by 14 federal law, nor is it the intent of this chapter to create a higher standard for 15 maintaining a student in the general classroom than the standard created in the 16 following federal laws: 20 U.S.C. § 1401 et seq., Individuals with Disabilities 17 Act; 29 U.S.C. § 794, Section 504 of the Rehabilitation Act; and 42 U.S.C. 18 § 12101 et seq., Americans with Disabilities Act. 19 Sec. 2. 16 V.S.A. § 2902(b) is amended to read: 20 (b) The educational support system shall: 21 *** VT LEG 119528.1 BILL AS INTRODUCED 2000 1 H.720 Page 3 (4) Provide clear procedures and methods for handling a student who 2 disrupts a class and shall include provision of educational options, support 3 services and consultation or training for staff where appropriate. Procedures 4 may include provision for removal of the student from the classroom for as 5 long as appropriate, consistent with state and federal law and after reasonable 6 effort has been made to support the student in the regular classroom 7 environment. 8 *** 9 Sec. 3. ALTERNATIVE PROGRAMS; STUDY; APPROPRIATION 10 (a) The amount of $50,000.00 is appropriated to the State Board of 11 Education to: 12 (1) Review the national research on alternative learning environments. 13 (2) Describe the nature of Vermont alternative programs. This should 14 include information about the process that went into designing each program, 15 and describe alternatives that were considered or tried and rejected. 16 (3) Determine whether existing alternatives do and can successfully 17 operate within the current laws and regulations governing public and 18 independent schools. 19 20 (4) Describe the cost, funding and finance structures of Vermont’s alternative programs. VT LEG 119528.1 BILL AS INTRODUCED 2000 1 2 H.720 Page 4 (b) Based on this research, the commissioner shall develop recommendations on the following: 3 (1) Whether differential standards for alternative programs are necessary 4 and, if so, the content of the standards, and a clear statutory definition of an 5 alternative program required to meet the standards. 6 (2) Changes that may be needed to the education finance structure. 7 (3) A system which would enable the department of education to: 8 9 10 11 12 (A) annually gather information about alternative learning programs, and use the results of the survey to identify unmet needs and best practices; and (B) monitor, evaluate the effectiveness of, and approve alternative programs to ensure that they are providing a quality education. 13 (c) On or before January 15, 2001, the State Board of Education shall 14 report to the Senate and House Committees on Education the information 15 gathered, recommendations, and recommended legislation and appropriations 16 to implement the recommendations. 17 Sec. 4. EDUCATOR PREPARATION AND PROFESSIONAL 18 DEVELOPMENT; STANDARDS BOARD FOR PROFESSIONAL 19 EDUCATORS; STATE BOARD OF EDUCATION 20 21 (a) The State Board of Education and Standards Board for Professional Educators shall clarify and strengthen requirements for teacher and VT LEG 119528.1 BILL AS INTRODUCED 2000 H.720 Page 5 1 administrator training in basic classroom management, understanding of 2 disabilities and special needs, instructional and curricular adaptations and 3 accommodations, dealing with people of diverse cultural backgrounds, 4 prevention of behavior problems, and handling of students who exhibit 5 challenging behaviors. 6 (b) The Commissioner of Education, in the next guidebook for local 7 Standards Board for Professional Educators shall recommend that each board 8 encourage teachers to consider the need for further training in classroom 9 management, understanding of disabilities and special needs, adaptations and 10 accommodations, dealing with people of diverse cultural backgrounds, 11 prevention of behavior problems, and handling of students who exhibit 12 challenging behaviors in their professional development plans. 13 (c) The Commissioner of Education shall encourage school administrators 14 to ensure that experienced teachers are available to help newer teachers learn 15 effective classroom management skills, and that experienced teachers avail 16 themselves of ongoing professional development opportunities in this area. 17 (d) The Commissioner of Education shall meet with representatives of 18 superintendents, the court system, the departments of public safety, of social 19 and rehabilitation services, and of developmental and mental health services, 20 and two representatives of education consumer groups to develop policies, 21 possible recommendations for legislative change, and internal procedures and VT LEG 119528.1 BILL AS INTRODUCED 2000 H.720 Page 6 1 training that should be put into place to ensure timely exchange of appropriate 2 information about a student’s behavior which may be needed to ensure the 3 safety of other students or in order to be able to provide timely intervention or 4 alternative educational or other services. 5 (e) The Commissioner of Education and the chair of the State Board of 6 Education shall report the results of work carried out under this section to the 7 Senate and House Committees on Education by April 15, 2000.
