ANIMAL VACCINES

Online tenders are invited by the Commissioner, Animal Husbandry, M.S Pune-1 in prescribed format from manufacturers and their authorised dealers/distributors by TWO-

BID SYSTEM (T-1, Technical Envelope and, Commercial Envelope C-1) for finalizing rate contract for the period 2011-12 from the date of agreement till 31-12-2012 for supply of Animal Vaccines to Institute of Veterinary Biological Products, or any other institutes/offices of the Animal Husbandry Department, Government of Maharashtra.

The online Tender Time Schedule (Key Dates) is displayed on the e-tendering portal of Dept. of Animal Husbandry http://adf.maharashtra.etenders.in. The tender form along with Terms & Conditions can be downloaded from above website w.e.f. 17.01 hrs of 17/10/2011 to 16.00 hrs. Of 9/11/2011 by payment of Rs. 5,000/- (Rupees Five

Thousand only) as the cost of tender form. An Earnest Money Deposit of

Rs.1, 00,000/- (Rs. One lakh only) for the items enlisted in Annexure is to be submitted. The cost of the tender form and the Earnest Money Deposit shall be submitted in the form of Demand Draft drawn on any nationalized bank in favor of "Accounts

Officer to the Commissioner, Animal Husbandry, Maharashtra State, Pune-1" payable at

Pune. Both the Demand drafts should be submitted physically, to the Office of the

Commissioner, Animal Husbandry, Maharashtra State, Pune-1. On or before 16.00 hours of 9/11/2011.

TENDER TERMS & CONDITIONS

1.

ITEMS UNDER TENDER PROCESS FOR PURCHASE

Online tenders are invited by the Commissioner of Animal Husbandry, Maharashtra

State, Pune -1 for finalizing the rate contract for supply of Animal Vaccines, as per the technical specifications listed in Annexure- A (serial nos. 1 to 13 ) to this document, are to be finalized and purchased by the Department of Animal Husbandry for a period from the date of agreement to 31-12-2012. The number of items to be purchased is likely to vary as per the requirement of various institutes of the department.

2.

ELIGIBILITY FOR PARTICIPATION IN TENDER PROCESS a) The Manufacturers with valid manufacturing license/Certificate of

Registration, issued by competent authority for item listed in Annexure- A

OR the Dealers /Distributors authorized by manufacturing company in course of their regular business having valid certificate, are eligible to submit the tenders. b) The manufacturing company must have an in-house quality certificate, issued by the competent authority. c) It must be noted that the tenderer should not have been black-listed by any

Government Agency/Institutions of local self Government/Public Sector in

India under any contractual relation with them or pending legal/penal action for complaints of quality. The undersigned reserves the right for insisting upon submission of Good Performance Certificate issued by any such agency. d) A valid non conviction report form Local FDA authorities is required for the tenderer supplying Veterinary vaccines. e) A valid Good performance certificate form Local FDA authorities is required for the tenderer supplying Veterinary vaccines. f) The registration certificate of manufacturing company must indicate that production of the item shown in Annexure-A is commenced. Only provisional Registration of the item without commencement of production is not sufficient. g) A certification that the poultry flock producing Specific Pathogen Free[ SPF] eggs are free from specific pathogen flocks from Disease Investigation section Pune. / or any competent authority. h) The bidder company should clearly state whether the firm is registered with

NSIC/SSI Unit. i) In case the tenderer is submitting tender as a Dealer/Distributor of any manufacturing company, he must have valid certificate of appointment as

Dealer/ Distributor issued by the manufacturing company. j) Tenderer should have experience of Three years supply to state government, for the tender items of veterinary vaccines and Specific Pathogen eggs

(SPF). g) Non-compliance with the above conditions will render the tender ineligible for further processing and the Commercial bid in such case will not be opened.

3.

HOW TO GET A TENDER FORM:

Tender Form along with Terms & Conditions can be downloaded from e-

Tendering Portal http://adf.maharashtra.etenders.in of the Department of Animal

Husbandry w.e.f. 17/10/2011 at 17.01 hrs to 9/11/2011 at 13.00 hrs by payment of Rs. 5,000/- (Rs. Five thousand only) as the cost of tender form in the form of

Demand Draft drawn on any Nationalized Bank. The demand draft shall be drawn in favor of "Accounts Officer to the Commissioner, Animal Husbandry,

Maharashtra State, Pune-1” and shall be payable at Pune. This amount is non refundable. The tender document can be downloaded from above mentioned website after entering the details of said demand draft. The demand draft must be submitted physically to the office of Commissioner, Animal Husbandry,

Maharashtra State, Pune-1 before 9-11-2011 up to 17.00 hours. The scanned copy of demand draft should be uploaded during online tender submission.

4.

EARNEST MONEY DEPOSIT (EMD)

1.

An Earnest Money Deposit of for items enlisted in Annexure-A, Rs.92150/-

(Rs. One lakh only) should be paid in the form of Demand Draft drawn on any nationalized bank. Cheque or cash will not be accepted. The Demand Draft for

EMD shall be physically submitted to the Commissioner, Animal Husbandry,

Maharashtra State, Pune-1 before 9-11-2011 up to 17.00 hours. Scanned copy of Demand Draft should be uploaded for online tender submission.

2.

The following categories of suppliers are exempted from payment of earnest money deposit- i.

The firms located in Maharashtra & Registered with Director

General of Supplies & Disposals, New Delhi. ii.

Small Scale Industrial Units registered with Director of

Industries, Maharashtra, only for items manufactured by them. iii.

The SSI units registered with National Small Industries

Corporation and Small Industries Service Institute of Govt. of

India for their manufacturing items. iv.

Government and Semi-Government Institutions of Maharashtra and undertakings of any State Government /Government of

India. v.

Suppliers registered with the Central Stores Purchasing Officer of the Directorate of Industries, Maharashtra, who has satisfactorily supplied the material for last five years.

In case of claim for exemption, the bidder must submit necessary documents / exemption certificate from appropriate authorities. The EMD is liable to be forfeited, in case the rates quoted by the tenderer are approved but the party refuses to enter into the agreement for supply.

6. MANNER OF SUBMISSION OF ONLINE TENDER FORMS

Tenderers should prepare & submit tenders online on department’s e tendering portal http://adf.maharashtra.etenders.in in two bid systems. Accordingly the rates for the items in ANNEXURE – A should be quoted & submitted online in the prescribed form-commercial envelope C1 duly encrypted with tenderer’s digital signature certificate. The required documents as mentioned below need to be uploaded in technical envelope T1 given in online e-Tender. While completing e-

Tender Bid Preparation, tenderers have to generate HASH VALUE of the Technical and Commercial envelopes. It may be noted that while online opening of the eTender, Technical Envelope T1 will be opened in the first stage. Commercial

Envelopes C1 of only such tenderers will be opened online, who have fulfilled all requisites terms and conditions. Approved by the designated authority. The tender not fulfilling any of the requisite terms and conditions, will be rejected and no further claim will be entertained.

a.

Technical Envelope T1 (Technical Bid):-

The technical information in the form of following documents is mandatory. i.

Manufacturing license for the manufacturer/Certificate of appointment as authorised

Dealer/Distributor, issued by manufacturing company for the dealer/distributor. ii.

Attach scan copy of Demand Draft of Rs 5000/- for purchase of tender form. iii.

Attach scan copy of Demand Draft for Earnest Money Deposit.

Certificate of exemption for Earnest Money Deposit from the concerned authorities. iv.

Declaration duly signed by the tenderer (Annexure-B). v.

Sales Tax Registration Certificate of the manufacturing /dealer / distributor Unit, with registration number /TIN, valid on the date of filing the tender. In case the application for allotment of registration/TIN is being pending with the concerned department, the attested Xerox copy of the application accepted by the department has to be attached. A valid certificate for exemption of Sales Tax must be enclosed wherever applicable. vi.

A Certificate of In house quality control that the vaccines are manufactured as per IP

2010 mentioning the expiry date of vaccines. vii.

Information brochure of the quoted tender items. viii.

Details regarding experience of supply of such type of items in the past, if any. ix.

Annual Report of last year. x.

Indemnity bond after the above period will be required to be given by the tenderer agreeing and assuring that in case of any complaint of losses of animals due to vaccination the same will be paid by the tenderer to the Commissioner, Animal

Husbandry, Maharashtra State, Pune xi.

A valid non conviction report form Local FDA authorities. xii.

A valid Good performance certificate form Local FDA authorities. xiii.

A certificate that the SPF eggs are free from specific pathogens from Disease

Investigation section Pune./From any competent authority. xiv.

Audited Financial Statement of last year xv.

Details of experience of supply of vaccines in past, if any xvi.

Check list duly signed (Annexure-E).

All the above documents should be uploaded in Technical Envelope T1.

These documents must be duly certified/attested by a gazetted Officer or a Notary and the originals should be kept ready for submission on demand. Failure to enclose the certified /attested copies will make the tender form liable for rejection. b. Commercial Envelope C1 (Commercial Bid):-

The rates should be quoted only in the online price tender. The rates not quoted in prescribed online tender form or quoted on separate paper will not be considered and the tender form will be rejected. The rates should be quoted as described in the tender document. The Commissioner, Animal Husbandry, Maharashtra State, Pune reserves the right to call for break up of rates quoted, if necessary.

c. Commercial Envelope C1, and Technical Envelope T1 should be submitted online as per the stipulated procedure. The HASH VALUE of both envelopes must be generated online. No tenders will be accepted after stipulated date & time. Also no request for extension of time will be entertained. d. Tenders sent by Registered Post or by Speed Post / Courier will not be accepted. e. The firm making any undue effort to bring pressure from outside/departmental authority will be liable for outright rejection.

7. CHECK LIST

The documents in the check list must be compulsorily uploaded online with e-Tender form. Any omission in this regard, will make the tender liable for its rejection. Before preparation of the online tender, the tenderer is advised to check each item and score at the appropriate place as Yes or No in the checklist and mention the page number accordingly.

8. HOW TO QUOTE RATES a.

Rates for supply of consumables, glassware’s, and animal vaccines and chemicals items, as per Annexure A, Sr.no.1 to Sr.No.13) should be quoted in the prescribed online tender form for F.O.R. (Destination) at any place in the Maharashtra State.

The rates should be quoted inclusive of all taxes applicable. Tax structure as per

VAT / CST as applicable, must be followed. The Institute will provide octroi exemption certificate if asked for. b.

Rates must be submitted only in Online Prescribed Tender form. c.

Tenderer should mention make of the item. The tenderer should also specify whether the They are required to give guarantee for exact fitness, satisfactory performance and premature ware of the parts, offered other than the genuine parts. d.

Validity of Rates – The rates quoted would be valid from the date of agreement up to 31.12.2012. Repeat order for the tendered items can be given by the purchaser within this period. The tenderer is bound to supply the items with the accepted rates. e.

In case the decision of acceptance of rates remains pending beyond the ‘period of validity of rates’ and the tenderer proposes the change in the rates quoted , subsequently the case will be inspected on merit.

9. PRICE VARIATION/ESCALATION a) Increase in rate on any account such as increase in input cost etc. will not be admissible in any case. b) The tenderer will not quote or offer less price than the approved price in relation with this tender and agreement to any agency/institute concerned with

Government of Maharashtra or Government of India or supply the same item to any of its distributor/dealers/whole- sellers at a lower rate, (after applying all relevant discount structures) during the contract period including extension if granted, failing which “the tenderer” will have to accept the lesser price for all the orders concerned during the contract period.

10. ACCEPTANCE OF TENDERS a.

The Commissioner, Animal Husbandry, M.S. Pune-1 reserves the right of accepting whole or any part of the tender or to refuse all tenders without assigning any reason. b.

The Commissioner, Animal Husbandry, also reserves the right to call for break-up of the quoted rates if required. c.

The Commissioner, Animal Husbandry does not pledge himself to accept the lowest tender and reserves the right of accepting the whole or any part of the tender or portion of the rate offered against any item and the tenderer shall supply the same at the rates quoted.

11. SIGNING OF AGREEMENT a.

Successful tenderer/authorised representative as detailed under condition 13-c, shall enter into the Contract Agreement with the Competent authority i.e. The

Commissioner, Animal Husbandry, M.S., Pune-1, preferably within 10 days of acceptance of tender or when called for by the commissioner in this regard. b.

The successful tenderer will be required to execute an agreement on judicial stamp paper. c.

Only the person authorised by due resolution in this contest is allowed to sign the agreement on behalf of the successful tenderer. Any other person will not be eligible to sign the agreement on behalf of the successful tenderer. d.

The Earnest Money Deposit will be forfeited in case the tenderer fails to sign the agreement after acceptance of his tender. The tenderer is liable to be blacklisted in such case.

12. SECURITY DEPOSIT :-

a. The successful tenderer will have to give a Security Deposit of 3% of total value of the order given by the indenting officer. The security deposit should be given in the form of Bank Guarantee for 36 months or Term/Fixed Deposit

Receipt pledged to the Commissioner A.H. It should be drawn on any nationalized bank valid for at least 36 months.

b. The Government and Semi-Government Institutions of Maharashtra and undertakings of any State Government /Government of India will be exempted from paying the security deposit. The security deposit will be returned after 6 months of successful completion of the tender period and proper functioning of the supplied material. Indemnity bond after the above period will be required to be given by the party agreeing and assuring that in case of any complaint of losses the same will be paid by the contractor to the Commissioner, Animal

Husbandry, Maharashtra State, Pune. d.

Security Deposit will stand forfeited, in case of any breach of terms and/or conditions of the tender and/or contract.

13 . INDENTING PARTIES

Joint Commissioner of A.H, Institute of veterinary Biological of the

Department of Animal Husbandry Govt. of Maharashtra will be the indenting officer for the items under the rate contract.

14. DEMAND AND SUPPLY SCHEDULE a.

Successful tenderer will have to supply the goods as per order placed within

60 (sixty) days or the period given by the indenting officer after receipt of supply order. For failure within the above stipulated period, the tenderer is liable for a penalty of 0.5 % (Half percent) of the total price of the goods, per week or part thereof for late delivery of such goods till the date of its final supply/receipt. b.

A repeat order within the validity period of the rate contract may be given, if required. c.

The number of items to be purchased may change as per the discretion of the indenting department.

d.

The Contractor will have to necessarily supply the item of the same quality and make, as have been specified in his bid.

15. BILL RAISING, PAYMENT AND PROCEDURE THEREOF a.

The supply should be made F.O.R. destination at various institutes /places in

Maharashtra State..The vaccines supplied by the tenderer should have a long expiry of at lease one year from the date of supply. It should be supplied in cold chain facility as per recommendation of IP 2010.to all the district places of the Maharashtra state at his own cost at the places mentioned in the supply order b.

The payment shall be released by the Indenting officer only after the receipt of the delivery vouchers duly certified by the institute head to which it is supplied. c.

Payment shall be made by the indenting officer on production of bills raised by the Contracting Company. All payment shall be made in the name of contracting company only. d.

As the payments are made from Government Treasury, the undersigned shall not be responsible for any delay in receipt of grants from Government or procedural delay due to treasury operations, which is beyond control of undersigned or the indenting officer.

16. TAX DEDUCTIONS FROM BILLS

Income tax at appropriate rate will be deducted at source for the supply made.

17.

QUALITY CONTROL a) If the undersigned desires to inspect the material, manufacturing facility and stores, they should be offered for inspection to him or to his agent at the cost of supplier. b) All the vaccines and diluents Sr.No. 1 to 13 supplied shall be tested if found necessary by the indenting officer from any institute approved by the undersigned and the cost of such inspections will be borne by the successful tenderer.

18.

PENALTY CLAUSE

In case, contracting party fails to deliver consignment thereof within the contract period of delivery or in case the goods are found not in accordance with the prescribed specifications and/or as per approved samples, the Commissioner

Animal Husbandry, Maharashtra State, Pune or indenting officer on his behalf, shall exercise his discretionary powers to take one or more of the following actions. Any loss, penalty imposed on supplier shall be deducted from the bills payable to him to the extent of bill amount and any other amount due to contractor under the same or any other contract with the undersigned or any of the indenting agencies. a.

To recover from the contractor as liquidated damages, a penalty of 0.5 %

(Half percent) of the goods price, which the contractor/supplier has failed to

deliver as aforesaid for each week or part of a week during which the delivery of such goods may be in arrears, and/or b.

To purchase such goods from any other sources and at such price as the purchasing officer in his sole discretion feels fit and to recover the differences of cost if any from the tenderer. The additional amount of expenditure incurred over and above approved rates will be liable for recovery from the approved tenderer. The defaulting contractor will be penalised to the extent of differences in the rate of 100% of the value of the order. If the defaulting contractor fails to pay penalty, he will be permanently delisted from the list of approved contractors of departments of Maharashtra Government/Central

Government and security deposits of the contractor will be forfeited. c.

To forfeit the entire amount of security deposit of the contractor. d.

To cancel the contract or part thereof with the supplier. e.

To blacklist the supplier permanently from the list of departmental suppliers.

19.

WARRANTY CLAUSE AND ITS OPERATION

The Tenderer/Contractor/Supplier/Successful Bidder should declare that the goods/stores/ articles sold to the buyer under this contract, shall be of best quality and workmanship and shall be strictly in accordance with the specifications and particulars contained/mentioned in ANNEXURE-A. The vaccines supplied by the tenderer should have a long expiry of at least of one year from the date of supply. It should be supplied in cold chain facility as per recommendation of IP

2010.

to the entire district places of the Maharashtra state.

20. FORCE MAJEURE

If, at any time during the continuance of this contract, the performance in whole or in part by either party of any obligation under this contract shall be prevented or delayed by reason of any war, hostility, acts of the public enemy, civil commotion, sabotage, fires, floods, explosions, epidemics, quarantine restrictions, strikes, lock outs or acts of Good (hereinafter referred to as events), provided notice of happening of any such eventuality is given by either party to the other within 21 days from the date of occurrence thereof, neither party shall by reason of such event, be entitled to terminate this contract nor shall either party have any claim for damages against the other, in respect of such non performance or delay in performance; and deliveries under the contact shall be resumed as soon as practicable, after such event has come to an end or ceased to exist, and the decision of the purchasing officer as to whether the deliveries have been so resumed or not shall be final and conclusive, provided further that if the performance in whole or part of any obligation under this contract is prevented or delayed by reason of any such event for a period exceeding 60 days, either party may at its option terminate the contract, provided also that if the contract is terminated under this clause, the purchaser shall be at liberty to take over from the contractor at a price to be fixed by the purchasing officer, which shall be final and all the unused, undamaged and acceptable materials, bought out components and stores in course of manufacture in the possession of the contractor at the time of such termination or such portion thereof, as the purchaser may deem fit accepting such material, bought out components and stores as the contractor may with the concurrence of the purchaser elect to retain.

21. PERIOD OF VALIDITY OF CONTRACT

The contract shall be valid for from the date of agreement up to 31.12.2012.

23. SETTLEMENT OF DISPUTES a.

It will be the responsibility of the tenderer to prove beyond doubt his liability for any exemption from paying the Earnest Money Deposit and/or Security

Deposit wherever applicable. The tenderer should produce relevant document/certificate from the competent authority in such case. b.

All the disputes between indenting agencies and the supplier shall be settled by the undersigned. However, the disputes between the contractor and the undersigned or the appeal against the decision of undersigned in disputes referred to him, shall lie with the Secretary/Principal Secretary of the

Department of Animal Husbandry, Government of Maharashtra. c.

Judicial proceedings if any will be under the jurisdiction of Pune Court.

24. REMOVAL OF DIFFICULTY . a). The undersigned shall take such decision to remove difficulties due to ambiguity of provisions in the tender documents or due to provisions which are inconsistent with the objective of this tender. b). The dates quoted in the tender form are subject to change for any reason or in the event of any holiday, abruptly declared by Government.
