Bull Valley Riding Club, Inc. – Guest Release GUEST’S RELEASE, ACCEPTANCE OF RESPONSIBILITY AND ACKNOWLEDGEMENT OF RISKS. WARNING Under the Equine Activity Liability Act, each participant who engages in an equine activity expressly assumes the risks of engaging in and legal responsibility for injury, loss, or damage to person or property resulting from the risk of equine activities. I am 18 years of age or older, or the parent or legal guardian of the person named below, and fully understand that equine activities are hazardous to participants, regardless of all feasible safety measures that can be taken, that riding a horse and participating in horseback riding activities through the Bull Valley Riding Club, Inc. (“Club”) bears risks of personal injury, death and property damage for me, my horse, others . This release shall serve as notice to me, or my parent or guardian signing below, of the risks of engaging in equine activities, including (i) the propensity of an equine to behave in dangerous ways that may result in injury to the participant, (ii) the inability to predict an equine’s reaction to sound, movements, objects, persons, or animals, and (iii) the hazards of surface or subsurface conditions. I also acknowledge that there are many natural and environmental conditions, which by themselves or in combination with riding can cause personal injury, death and property damage. Horseback riding can present unpredictable and dangerous hazards. Knowing that equine activities bear those and related risks, I fully agree that I am totally responsible for the safety of myself and my horse when riding my horse, or anyone else’s horse, on any road, trail or property with the Village of Bull Valley, and elsewhere in McHenry County, and in any other activities with which the Club is associated. I expressly hereby assume the risk and all legal responsibility for injury, loss or damage to myself or my property that results from participating in an equine activity sponsored by the Club. I accept sole individual responsibility for knowing the range of my own ability to manage, care for, and control a particular horse or perform a particular equine activity, and it shall be my duty to act within the limits of my own ability, to maintain reasonable control of the particular horse or horses at all times while participating in an equine activity sponsored by the Club, to heed all trail rules and posted warnings, to stay on designated trails and connecting roadways, and to refrain from acting in a manner that may cause or contribute to the injury of anyone. I also agree while participating in any Club activity or riding on any trail maintained or sponsored by or through the Club, to follow all rules of safety, to ride in a safe manner and only where the property owners approves. I will not smoke on any trail, carry firearms or other hunting weapons, or ride while intoxicated, or carry or consume any alcoholic beverages while riding. Since I am accepting full responsibility and understand and assume the significant risks and unexpected situation that can occur in horseback riding on trails and in related activities, I fully release and discharge, without reservation, the Club, its directors, officers, and members, and the land owners upon whose property I may ride and who make their land available for riding through the Club, from any and all liability under any theory of liability including negligence, whether known or unknown, as a result of any Club and equestrian activities. For myself and my heirs, assigns, and personal representatives, I unconditionally waive, release and discharge in advance, any and all claims for personal injuries, property damage or death which may occur after the date of this Agreement as the result of my participation in Club trail riding and other equestrian activities. THIS IS AN UNCONDITIONAL RELEASE OF LIABILITY.
